Approval subject to the Engineer to the Town's approval of the driveway access. Vote: Mr. Parsons - aye Mr. Mills - aye Mr. Howell - aye Mr. Fanuele - aye Mr. Keller - aye The motion was carried. Route 376 - RD #3 Wappinger Falls, NY 12590 RE: Bre-Del Enterprises - 2 lots - Resolution of Approval Dear Gentlemen: At the May 13th. 1985 meeting of the Town of Wappinger Planning Board. a motion was made by Mr. Mills to grant preliminary and final approval and to waive the final public hearing. The resolutions of approval are as follows: TENTATIVE APPROVAL IS HEREBY GRANTED to Bre-Del Enterprises, for subdivision as shown on map entitled, "Subdivision of the Lands of Bre-Del Enterprises, Inc., Town of Wappinger, Dutchess County. New York", prepared by John E. Railing. P.E., L.S., and dated January 2nd. 1985, and revised May 1st. 1985 subject to the following conditions: Within twelve months of this tentative approval. the applicant is authorized to submit an application for approval of a subdivision plat in accordance with Article II, ~ 22, Article III, ~ 30, and Article IV of the Subdivision Regulations. In addition, the application must meet the requirements of the Town of Wappinger Zoning Ordinance. In addition, the following improvements, reservations, changes and requirements are pre-requisite to the approval of the plat. 1. Permission to file from the Dutchess County Department of Health shall be obtained on water supply and sewage disposal prior to final approval. 2. Curb cuts shall be obtained from the Town of Wappinger Highway Superintendent to the issuance of building permits. prior I 3. Drainage flow patterns shall be indicated on the individual plot plans. All storm water shall be conveyed by pipe to natural drainage courses. B. No open stream will be allowed unless permission in writing is obtained from the Town of Wappinger Highway Superintendent. 5. The Fire Prevention Bureau shall review the plan and submit any recommendations that they may have prior to final approval. The Fire Prevention Bureau shall also review the proposed street names to prevent similarities. 6. Lowest opening of all houses (windows, doors, garage doors, crawl space, etc.) shall be at least two feet above the finished road grade unless waived by the Town of Wappinger Highway Superintendent and/or the Engineer to the Town. R. All footing drains and roof leaders shall be piped into the storm drainage system if specified by the Town of Wappinger Building Inspector. 9. For each lot an application shall be made for a grading permit which shall meet the Soil Erosion & Sediment Control Ordinance requirements, including submission of a plan showing design and materials and at least a month by month schedule. 10. Five copies of the filed map shall be required for Planning Board distribution. Said copies shall be required from the County Clerk's Office. 11. Road takings as per indicated on the map. 12. The developers engineer/surveyor shall place concrete monuments at the four angle points located along the County Route No. 104, Lot #3 properly line. WHEREAS, an application for final approval of a subdivision plat entitled, "Subdivision of the Lands of Bre-Del Enterprises, Town of Wappinger, Dutchess County, New York" was received by the Town of Wappinger Planning Board on May 13th, 1985. WHEREAS, the requirements of the Subdivision Regulations of the Town of Wappinger have been met by said subdivision plat and application except as noted below, and WHEREAS, the conditions of the preliminary approval of said subdivision plat, granted by the Town of Wappinger Planning Board on May 13th, 1985 have been met, except as noted below, NOW, THEREFORE BE IT RESOLVED THAT the application of Bre-Del Enterprises, Inc. for approval of said subdivision plat, prepared by John E. Railing, P.E., L.S., and dated January 2nd, 1985 and revised May 1st, 1985 be approved subject to the follwoing conditions, and that the Chairman be authorized to endorse approval of said conditions by the applicant, with conditional approval shall expire six months from the date of this resolution if the applicant has not complied with the conditions set forth. Upon completion of all requirements set forth in the action approving the Subdivision plat, the plat shall be properly signed by the appropriate officers of the Planning Board, and shall be filed by the applicant in the Office of the County Clerk in accordance with the requirements of Section 278 of the Town Law. Any Subdivision Plat not so filed within sixty days of the date of Planning Board signature shall become null and void. Conditions of the final approval are the same as those stated in the resolution of preliminary approval. The vote was seconded by Mr. Parsons. # . ...
