RE: Brookvale Average Density Subdivision - Spook Hill Road
Dear Mr. Spells:
At the April 9thQ 1984 meeting of the Planning Board, a
motion was made by Mr. Parsons, seconded by Mr. Rubenstein,
to grant preliminary approval. The resolution of preliminary
approval is as follows:
TENTATIVE APPROVAL IS HEREBY GRANTED to Norazamt Inc.,
for subdivision as shown on map entitled "Average Density
Subdivision "Brookvale", Town of Wappinger, Dutchess County,
New York", prepared by Richard G. Barger, PoE. & L.S., and
dated 5/12/83, revised 5/21/83,12/16/83, 3/26/84 and 4/9/84,
subject to the following requirements:
Within six months of this tentative approval, the applicant
is authorized to submit an application for approval of a subdivision
plat in accordance with the Town of Wappinger Subdivision Regulations.
In addition, the application must meet the requirements of the Town
of Wappinger Zoning Ordinance. In addition, the following improvements,
reservations, changes, and requirements are pre-requisite to the
approval of the plat.
1. Approval of the Dutchess County Department of Health on
water supply and sewage disposal shall be obtained prior to
final approval.

2. Approval of the road plan and profile and plan and
profile of the drainage system shall be obtained from the
Engineer to the Town and the Highway Superintendent prior
to final approval. The Conservation Advisory Council
shall be given an opportunity to review the plans prior
to final approval.
30 Drainage flow patterns shall be indicated on the
individual plot plans. For any surface waters that enter
upon properties of other persons, the applicant shall obtain
a letter from the same permitting such discharge.
40 The following improvements shall be required:
A. All storm water shall be conveyed by pipe to natural
drainage courses.
Bo Standard street signs will be required at each intersection
and temporary signs will be installed during constructiono
C. Street specifications shall be those presently in effect
at the time of construction.
Do No open streams will be allowed unless permission in
writing is obtained from the Highway Superintendento
5. Inspection fees for water lines, sewer lines and storm
drainage lines shall be paid prior to the signing of the plat.
Certified check will be required.
60 Downstream drainage fee of $200.00 per lot on the final
plat shall be paid prior to the signing of the plato Certified
check will be required.
70 Recreation fee of $500.00 per lot on the final plat shall
be paid prior to the signing of the plat or a land donation
shall be made that is acceptable to the Recreation Commission
and the Planning Board. Determination on this shall be made
prior to final approval. If a monetary contribution is accepted,
certified check will be required.

80 No structure is to be built where the lowest openings
(windows, door~, garage doors, crawl space, etc.) are lower than
two feet above the road surface unless approved by the Highway
Superintendent and/or the Engineer to the Town.
90 All footing drains and roof leaders, if specified by the
Building Inspector, shall be piped into the storm drainage
systemo
10. In subdivision with underground utilities, the developer
shall contact Central Hudson, New York Telephone, the Town-
franchised cable tv company and the Town Board to negotiate
an agreement whereby cable tv facilities will be installed
with underground utilies. Should these negotiations be
unsuccessful, the developer shall provide a statement indicating
why an agreement to provide cable tv service could not be reached.
110 Prior to the issuance of any building permitsq a bond of
sufficient amount for the road, drainage and street trees and in
a form approved by the Attorney to the Town shall be approved
and accepted by the Town. Amount of said bond is to be determined
by the Engineer to the Town and the Highway Superintendent.
12. The developer shall be required to keep the roads in the
subdivision clear from snow and ice and make the roads otherwise
passable until such time as the roads have been accepted by
the Towno Upon failure to do so, the Town may authorize,
after determination than an emergency exists, a private contractor,
to clear the roads or make the roads passable and the expense
of such work will be assumed by the developer.
130 Prior to final approval, the Fire Prevention Bureau shall
be provided with a copy of the plat indicating the proposed
street names to prevent similarity to named current streets in
the Town of Wappinger.

14. An erosion control plan shall be submitted to the
Conservation Advisory Council for their review and then shall
be approved by the Engineer to the Town prior to final approval.
15. A long Environmental Assessment Form shall be filled out
and submitted in order that a determination be made if an
Environmental Impact Statement will be required. Said form
shall be completed and submitted to the Planning Board prior
to seeking final subdivision approval.
16. Compliance with the requirements of the Engineer to the
Town, which will be forthcoming, shall be met prior to final
subdivision approval.
17. A downstream drainage plan shall be submitted and approved
by the Engineer to the Town and the Planning Board prior to
final approval.
18. A fee for a road improvement fund up to an amount of
$500.00 per lot shall be required to be paid prior to the
signing of the plat. Certified check will be required.
19. Six copies of the filed map shall be required for
Planning Board distribution. Said copies shall be obtained
from the County Clerk1s office.
20. The proposed future road bed shall be deeded to the
Town and shall be roughed in and filled where necessary.
