NEW YORK 12590 00 TEL. 297.6257 April 15th, 1986 Richard & Margaret Brownell Booth Blvd. Wappinger Falls, NY 12590 RE: Brownell Subdivision - 3 lots - Booth Blvd. Dear Mr. & Mrs. Brownell; At the April 14th, 1986 meeting of the Town of Wappinger Planning Board, a motion was made by Mr. Fanuele to grant preliminary and final.approval and to waive the final public hearing. The resolutions of approval are as follows: FINAL APPROVAL IS HEREBY GRANTED to Richard & Margaret Brownell, for a subdivision entitled, "Lands of RichardJ. Brownell, Booth Boulevard, Towns of Wappinger & Fishkill, Dutchess County, "New York", prepared by Anthony T. Rowan, L.S., and dated March 8th, 1985, and revised 5/7/85, 7/23/85, 1/8/86, and 2/14/86 subject to the following conditions: Within twelve months of this tentative approval, the applicant is authorized to submit an application for approval of a subdivision plat in accordance with Article II, ~ 22, Article III, ~ 30, and Article IV of the Subdivision Regulations. In addition, the application must meet the requirements of the Town of Wappinger Zoning Ordinance. In addition, the following improvements, reservations, changes and requirements are pre-requisite to the approval of the plat. 1. Approval of the Dutchess County Department of Health shall be obtained on water supply and sewage disposal prior to final approval. 2. Curb cuts shall be obtained from the Town of Wappinger Highway Superintendent prior to the issuance of building permits. 3. Approval of the road plan and profile and drainage plan and profiles shall be obtained from the Engineer to the Town prior to the signing of the plat. The Conservation Advisory Council shall be given the opportunity to review these plans prior to the approval of the Engineer to the Town. 4. Drainage flow patterns shall be indicated on the individual plot plans. For any surface waters that enter upon properties of other persons, the applicant shall obtain letters from the same permitting such discharge. 5. The following improvements shall be required: A. All storm water shall be conveyed by pipe to natural drainage courses. B. No open stream will be allowed unless permission in writing is obtained from the Town of Wappinger Highway Superintendent. .. The Fire Prevention Bureau shall review the plan and submit any recommendations that they may have prior to final approval. The Fire Prevention Bureau shall also review the proposed street names to prevent similarities. 7. Downstream drainage fee of $200.00 per lot on the final plat shall be paid prior to the signing of the plat. ($600.00 paid on 6/27/85) 8. Lowest opening of all houses (windows, doors, garage doors, crawl space, etc.) shall be at least two feet above the finished road grade unless waived by the Town of Wappinger Highway Superintendent and/or the Engineer to the Town. 9. All footing drains and roof leaders shall be piped into the storm drainage system if specified by the Town of Wappinger Building Inspector. 10. For each lot an application shall be made for a grading permit which shall meet the Soil Erosion & Sediment Control Ordinance requirements, including submission of a plan showing design and materials and at least a month by. month schedule. 11. Five copies of the filed map shall be required for Planning Board distribution. Said copies shall be required from the County Clerk's Office. 12. All lot lines and dimensions 'shall conform with the zone that the Subdivision is in. .I WHEREAS, an application for final approval of a subdivision plat entitled, "Lands of Richard J. Brownell, Booth Boulevard, Towns of Wappinger & Fishkill,. Dutchess County, New York", was received by the Town of Wappinger Planning Board on April 14th, 1986, WHEREAS, a final public hearing is waived by the Town of Wappinger Planning Board, and WHEREAS, the requirements of the Subdivision Regulations of the Town of Wappinger have been met by said Subdivision plat and application except as noted below, and WHEREAS, the conditions of preliminary approval of said subdivision plat, granted by the Town of Wappinger Planning Board on April 14th, 1986, have been met, except as noted below. NOW, THEREFORE, BE IT RESOLVED THAT the application of Richard & Margaret Brownell for approval of said subdivision plat, prepared by Anthony T. Rowan, L.S., and dated March 8th, 1985 and revised 5/7/85, 7/23/85, 1/8/86, and 2/14/86, be approved subject to the following conditions, and that the Chairman, be authorized to endorse approval of said subdivision plat upon compliance with said conditions by the applicant, with conditional approval shall expire six months from the date of this resolution it the applicant has not complied with the conditions set forth. t #, .. NEW YORK 12590 TEL. 297.6257 Page -3- April 15th, 1986 Upon completion of all requirements set forth in the action approving the Subdivision plat, the plat shall be properly signed by the appropriate officers of the Planning Board, and shall be filed by the applicant in the Office of the County Clerk in accordance with the requirements of Section 278 of the Town Law. Any Subdivision Plat not so filed within sixty days of the date of Planning Board signature shall become null and void. Conditions of the final approval are the smae as those stated in the resolution of preliminary approval. The motion was seconded by Mr. Howell.
