RE: 3 Lot Subdivision - Booth Blvd.
Dear Mr. & Mrs. Brownell:
At the June 24th, 1985 meeting of the Town of Wappinger Planning Board, a
motion was made by Mr. Mills to grant preliminary and final approval and to
waive the final public hearing. The resolutions of approval are as follows:
TENTATIVE APPROVAL IS HEREBY GRANTED to Richard & Margaret Brownell, for
subdivision entitled, "Subdivision Map, Lands of Richard & Margaret Brownell,
Booth Blvd., Town of Wappinger & Fishkill, Dutchess County, New York".. prepared
by Anthony T. Rowan, L.S., and dated March 8th, 1985 and revised on 5/6/85,
subject to the following conditions:
Within six months of this tentative approval, the applicant is authorized to submit
an application for approval of a subdivision plat in accordance with Article II, ~ 22,
Article III, ~ 30, and Article IV of the Subdivision Regulations. In addition, the
application must meet the requirements of the Town of Wappinger Zoning Ordinance. In
addition, the following improvements, reservations, changes and requirements are
pre-requisite to the approval of the plat.
1. Approval of the Dutchess County Department of Health shall be obtained on water supply
and sewage disposal prior to final approval.
2. Curb cuts shall be obtained from the Town of Wappinger Highway Superintendent prior
to the issuance of building permits.

3. Drainage flow patterns shall be indicated on the individual plot plans. For any
surface waters that enter upon properties of other persons, the appli<<ant shall obtain
letters from the same permitting such discharge.
4. The following improvements shall be required:
A. All storm water shall be conveyed by pipe to natural drainage c~ses.
B. No open stream will be allowed unless permission in writing is o~ained from the
Town of Wappinger Highway Superintendent.
5. The Fire Prevention Bureau shall review the plan and submit any re!ommendations that
they may have prior to final approval. The Fire Prevention Bureau shall also review
the proposed street names to prevent similarities.
6. Downstream drainage fee of $200.00 per lot on the final plat shall be paid
prior to the signing of the plat.

7. Lowest opening of all houses (windows, doors, garage doors, crawl space, etc.) shall
be at least two feet above the finished road grade unless waived by the Town of Wappinger
Highway Superintendent and/or the Engineer to the Town.
8. All footing drains and roof leaders shall be piped into the storm drainage system
if specified by the Town of Wappinger Building Inspector.
9. For each lot an application shall be made for a grading permit which shall meet the
Soil Erosion & Sediment Control Ordinance requirements, including submission of a plan
showing design and materials and at least a month by month schedule.
10. Five copies of the filed map shall be required for Planning Board distribution. Said
copies shall be required from the County Clerk's Office.
WHEREAS, an application for final approval of a subdivision plat entitled,
"Subdivision Map, Lands of Richard & Maragret Brownell, Booth Blvd., Town of
Wappinger & Fishkill, Dutchess County, New York", was received by the Town of
Wappinger Planning Board on June 24th, 1985, and
WHEREAS, a final public hearing is waived by the Town of Wappinger Planning
Board, and
WHEREAS, the requirements of the Subdivision Regulations of the Town of
Wappinger have been met by said subdivision plat and application except as noted
below, and
WHEREAS, the conditions of preliminary approval of said subdivision plat, granted
by the Town of Wappinger Planning Board on June 24th, 1985, have been met, except
as noted below.
NOW, THEREFORE, BE IT RESOLVED THAT the applicatio~ of Richard & Margaret
Brownell for approval of said subdivision plat, prepared by Anthony T. Rowan, L.S.,
and dated March 8th, 1985 and revised 5/6/85, be approved subject to the following
conditions, and that the Chairman be authorized to endorse approval of said
subdivision plat upon compliance with said conditions by the applicant, with
conditional approval shall expire six months from the date of this resolution if
the applicant has not complied with the conditions set forth.
Upon completion of all requirements set forth in the action approving the Subdivision
plat, the plat shall be properly signed by the appropriate officers of the Planning
Board, and shall be filed by the applicant in the Office of the County Clerk in accordance
with the requirements of Section 278 of the Town Law. Any Subdivision Plat not so filed
within sixty days of the date of Planning Board signature shall become null and void.
Conditions of the final approval are the same as those stated in the resolution
of preliminary approval.
