Brown At their September 20th, 1976 meeting, Mr. Steinhaus moved the following resolution for consideration: BE IT RESOLVED THAT the Town of Wappinger Planning Board hereby amends their site plan approval of July l~th, 1976 granted to Dr. Richard C. Brown for a medical clinic to be located on New Hackensack Road, in the Town of Wappinger. Condition number one is hereby amended to read as follows: 'I': Approval of the Dutchess County Department of Public Works shall be obtained prior to the issuance of a building permit and/or Certificate of Occupancy and applicant must meet the reqtiirementsofthe Dutchess County Department of Public Works' as stated in their letter dated 9/17/76. Mr. Porter seconded. ROLL CALL VOTE: Dr. Miller - aye Mrs. Keeler - aye Mr. Brannen - aye Mr. Keller - aye Mr. Porter - aye Mr. Steinhaus - aye Following a discussion, a motion was made by Mr. Steinhaus to write to the Zoning Administrator asking that the Special Use Permit be withheld and that the October 4th, 1976 meeting be a regular public meeting and that a public hearing be held on the application of Dr. Richard Brown. The motion was seconded by Mrs. Keeler. Re: Healing Arts Clinic Dear Dr. Brown: Meeting was held in this office on September 15, 1976 wi'th Ken Russ from your Engineer Richard Barger's office in reference to the proposed access to the above captioned property. We were informed that the subject property is zoned residential and that a special use permi t issued to the applicant would insure against any future changes to the proposed usage. Based on these consid- erations, the stop line sight distance requiremen~of 275 feet for access to non-commercial premises are the determining criteria rather than the 300 feet distances for commercial usage, as previously assumed. This Department will not Object to an access for intended usage at a location opposite Dorothy Heights Road and a work permit for construction of said access will be qonsidered, SUbject to the ,following pondi tions. 1. Si te plan approval must be obtained from the Town of Wappinger Planning Board for the revised loca tion of the access dri ve. 2. Unobstructed stop line sight distances of 275 feet to both approaches on CR 104 must be provided and maintained. 3. The area L",tween CR 104 and your property line must , be lowered and graded to a slope of 1/2 inch per foot downward from the road pavement edge for the entire frontage of your property. .
