Subject:
Application of Dr. Richard C. Brown for site plan
approval and a Special Use Permit to establish a
medical clinic on property located on New Hackensack Road,
in the Town of Wappinger.

At their July 19th, 1976 meeting, the Town of Wappin~e~
Planning Board adopted the following resolution:
WHEREAS, the Town of Wappinger Planning Board has received an
application from Dr. Richard C. Brown for a Special Use Permit to
establish a medical clinic on property located on New Hackensack Road,
in the Town of Wappinger, and '
WHEREAS, a public hearing was h~!d on~said application at the
Town'Ball,"Mill Street, Wappingers Falls, New York, on Monday,
July 19th, 1976, and
WHEREAS, the Town of Wappinger Planning Board reviewed said
application and referred it to the Dutchess County Department of
Planning for recommendation in accordance with Section 239-1 and 239-m
of General Municipal Law and a recommendation was received from them
dated June 1st, 1976.
NOW, THEREFORE, BE IT RESOLVED THAT the Town of Wappinger
Planning Board approves the site plan entitled "Healing Arts Clinic,
Town of Wappinger, Dutchess County, New York", prepared by
Richard G. Barger, P.Eo & L.So, and dated 5/7/76.
IT IS, THEREFORE, RECOMMENDED THAT a Special Uta Permit be
issued subject to the following conditions:

1. Approval of the Dutchess County Department of Public Works
shall be obtained prior to the issuance of a building permit and/or
Certificate-of Occupancy. Site easements shall be obtained where
necessary-to provide site distance of 300 feet in the northerly
direction and 300 feet in the southerly direction and the site plan
shall be revised to indicate required site distance.

2. Downstream drainage fee of $200.00 shall be paid prior
to the issuance of a bui1ding~permit-<Uld/().t'Certificate of
Occupancy.
3. prior to the issuance of a Certificate of Occupancy an amended
landscaping plan shall be reviewed by the Town of Wappinger Planning

4. Revised drainage plan shall be submitted and sha\l be

Gentlemen:
Please be advised the undersigned is attorney to
Dr. Richard C. Brown. I submit herewith proposed site plans
upon an application by Dr. Brown for a Healing Arts Clinic
to' be located on the Ganser property ~i tuate at New Hacken-
"sack RO'ad in this Town.'-Theproposed'plans call for three
office units in the existing structure, as altered. The
uses will be restricted solely to the healing arts in the form
of a medical clinic; it is intended that Dr. Brown's chiro-
practic offices will be maintained in one of.the offices on
the premises, with the other offices to be occupied by similar
professionals, chiropractic, medical, dental, optometric,
etc.
The proposal is made pursuant to Section 421 of
the present Zoning Ordinance of the Town of Wappinger. The
subject property is currently located in a residential dis-
trict, as the Zoning Ordinance presently exists. The Zoning
Ordinance, Section 421.15, allows a medical clinic as a per-
mitted principal use in said district. The subject property
is currently designated R40 under the present Ordinance, and
under the proposed new Zoning Ordinance of the Town, the sub-
ject property is to be zoned multi-family RMF-5. Under the
proposed--new Ordinance, as in the present Ordinance, a medical
clinic is a permitted principal use subject to Special Use
Permit. In any event, under the current Ordinance or under

the proposed new Ordinance, the uses of the property, as pro~
posed in the enclosed site plans, are permitted on the subject
property.
In general, the use of the offices would be from
Q:OO A.M. to 9:00 P.M., Monday through Saturday, except in
cases of emergency. However, it must be understood that as a
practical matter, each office would be utilized on an average
of 4 112 working days per week with the particular office
hours prescribed by the appropriate professional.
