RE: BUCCIERO SUBDMSION -
RESOLUTION OF FINAL SUBDIVISION PLAT APPROVAL
At a regular meeting of the Planning Board of the Town of Wappinger, Dutchess
County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York
on the 20th day of July 1998, at 7:30 P.M.
The meeting was called to order by Chairman Philip J. DiNonno and upon roll being
called, the following were:

WHEREAS, the Town of Wappinger Planning Board received an application for
Final Subdivision Plat approval from JeffBucciero (the "Applicant" and "Property Owner")
for the subdivision of one 12.8 acre parcel of land into two lots, 3.0 acres (Lot 1) and 9.8
acres (Lot 2) in size (the "Project" or "Subdivision"); and

WHEREAS, the subject property is located on the north side of Smithtown Road
approximately 1,400 feet east of the intersection formed by Smithtown Road and Cooper
Road; and
WHEREAS, the subject property is currently undeveloped and is known as Tax Lot
6257-03-050050 on the Town of Wappinger Tax Map (the "Property"); and
WHEREAS, the Planning Board granted conditional Preliminary Subdivision Plat
Approval for the project by resolution dated April 20, 1998, and the conditions of
preliminary approval have been met with the exceptions noted below; and

RESOLUTION OF FINAL FLAT AFFROV AL
WHEREAS, the Planning Board, pursuant to local and State Environmental Quality
Review regulations, adopted a Negative Declaration for the subdivision at its April 20, 1998
meeting; and
WHEREAS, the Applicant has submitted the following two (2) plans, prepared by
Day, Oswald and Gillespie, Hopewell Junction, New York:
1. Sheet 1 of2, "Two (2) Lot Subdivision to be Known as Bucciero Subdivision", dated
1/16/98, last revised 6/30/98;
2. Sheet 2 of 2, "Two (2) Lot Residential Subdivision to be Known as Bucciero
Subdivision", dated 6/20/98; and
WHEREAS, the subject property contains a watercourse as identified on the plan;
and
WHEREAS, the Planning Board found that the proposed 2-10t subdivision would
result in the creation of two (2) building lots; and
WHEREAS, the Planning Board is familiar with the site and all aspects of the
proposed action and has been satisfied that the proposed subdivision will conform to the
requirements of the Town Zoning Law; and
WHEREAS, the Planning Board determined that the Project is an Unlisted action in
accordance with the Local and State Environmental Quality Review Laws; and
WHEREAS, the Planning Board has determined to accept the application for Final
Subdivision Plat Approval and has determined that the final plat is substantively unchanged
from the approved preliminary plat and therefore a Public Hearing for the final plat
approval is not warranted;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The Planning Board hereby adopts and incorporates the recitations and statements
set forth above as if fully set forth and resolved herein.
2. The Planning Board hereby finds that, pursuant to Section 5.514 of the Town's Land
Subdivision Regulations, a proper case does not exist for requiring additional
parklands be suitably located for playground and other recreational purposes within

the Town of Wappinger since less than six building lots would be created, and that
neither the dedication of land nor a fee in lieu of land will be required.
3. The Planning Board hereby grants Final Subdivision Plat Approval subject to the
following conditions and modifications which shall be fulfilled prior to the signing
of the final plat by the Chairman of the Planning Board:
/ a. The Owner shall endorse a copy of this resolution and submit it to the
Planning Board for its files.
b. The Applicant shall prepare a Final Subdivision Plat in accordance with
Section A-5 of the Town of Wappinger Land Subdivision Regulations.
c. The Applicant shall submit the revised final plat to the Dutchess County
Department of Health for its review, approval, and signature for the sanitary
sewage disposal system and the water supply system.
--v' d. The Applicant shall submit the revised plat to the Town of Wappinger
Highway Superintendent for review of both proposed curb cuts. Written
approval for the driveway curb cuts from the Highway Superintendent must
be submitted to the Town Zoning Administrator. The entire length of both
driveways shall be paved. A note to this effect shall be placed on the plat.
/ e. The plat shall be revised to include a note stating that all finished slopes must
be less than 1 vertical and 3 horizontal.
/ f. The Applicant shall submit a statement signed by the Town's Tax Collector
that all taxes due on the subject parcel have been paid.
v' g. The Applicant shall revise, to the satisfaction of the Town Engineer, the
Sedimentation and Erosion Control Plan, including, but not limited to, a
detailed description of erosion control measures, construction sequence, and
long term slope stabilization.
./ h. The final plat shall be revised to include appropriate details and notes for the
sedimentation basin on the west side of the proposed driveway, to the
satisfaction of the Town Engineer.
v 1. The final plat shall be revised to clearly state that no driveway side slope
shall exceed one (1) on three (3).

The final plat shall show the approximate amount of fill needed to construct
the proposed driveway.
The final plat shall include a note stating that because of the rugged
topography of Lot 1, it is very likely that the garage elevation may actually
have to be constructed as shown on the plat.

Conditional approval of the final plat shall expire one hundred eighty (180) days
from the date of this resolution unless all requirements have been certified as
completed or unless a written request for an extension of Final Subdivision Plat
Approval (not to exceed two (2) ninety (90) day periods) is granted.
4. No Certificate of Occupancy will be issued until the lot bounds are staked out and a
possession survey of premises is filed with the Building Inspector containing a note
that stakes have been set as shown thereon.
5. In accordance with the Town's Schedule of Fees, the Applicants shall be responsible
for the payment of any application review fees incurred by the Planning Board in
review of this Project which are in excess of the application review fees paid by the
Applicants to-date. Such fees shall be paid within thirty (30) days of the notification
to the Applicants that such fees are due. If such fees are not paid within this thirty
(30) day period and an extension therefore has not been granted by the Planning
Board, this resolution shall be rendered null and void. Refunds of any remaining
funds within the escrow account for the applications will not be made until six (6)
months after the signing of this resolution.

The question of adoption of the foregoing resolution was duly put to a vote on roll call,
which resulted as follows:
