Dear Mr. Capolino:
This letter will confirm our conversation on April 18, 1985, and acknowledge
my receipt of your letter dated April 24, 1985.
During our conversation on April 18, 1985, you were asked to submit to this
office a schedule for the purported "move-out" operation being conducted on
your property. You responded, in writing, that this activity will "probably
continue intermittently for several months."
This response is too indefinite and I must ask you to please submit a detailed
and exact statement, including dates of planned activity.

Pursuant to your request, Mr. Capolino was contacted and a site inspection
subsequently took place on his Route 9D & Old Hopewell Road property.
Supervisor Frank Versace accompanied me on the April 18, 1985 visit.
Site inspection revealed the presence of piles of debris, logs, construction
and/or building material, concrete rubble and metal tanks. What appeared to
be heating system equipment was stored in one of the two barns on the property.
Both of the barns were locked so inspection was limited to window views.
Mr. Capolino stated that no work was conducted on the site "except my brother comes
in and tinkers with stuff". Capolino claimed that recent activity was related to
a clean-up campaign. No construction activity was evident during our visit.
With the advice of Town Attorney, Bernard Kessler, I am presently preparing
information forms for outstanding violations.

Pursuant to your request, the following is a summary of our recent meeting:

The meeting commenced with introductions and a walking, visual tour of the
subject property.
Although there were indications of some more recent activity, it was obvious
and discussed that there had been materials stored there for ten years :t or
more. Mr. Versace stated that just because it pre-existed for ten years
doesn1t justify it now. Everyone agreed.
Discussion then developed rega.rding the steel "Tanks". They are scheduled
to be removed this week, weather and D.O.T. permitting.
Discussion developed regarding a "Fill Operation". It was discussed that
there was an existing Barn and Silo that were destroyed by fire, some time
ago. It was the Town that requested the remains of the Barn/Silo be razed
and graded. There are piles of foreign demolition which will be reasonably
removed and areas dressed up.
The issue of drainage was .inspected and discussed. It was obvious that the
Capolino property is several feet higher in elevation than that of the LeRoy
property. We do not consider this an issue.
It was stated by Capolino, that there was not any active trade or business
being conducted from that site. The machines, trucks and apparent activity
at the site is the material "move-out" procedure, which will probably
continue intermittently for several months.
The meeting then concluded with salutations and a unanimous agreement to
work together in harmony and in a non-adversarial relationship toward a
good neighbor policy and to the best interest of the Town of Wappingers.
