NEW YORK 12rs80 Tn.. 287-8257 August 29th, 1984 Mr. Peter Luckel Luvluk, Inc. 94 Jessen Place Beacon, NY 12508 RE: Cedar Creek Estates - Final Approval Dear Mr. Luckel: At the August 27th, 1984 meeting of the Planning Board, a motion was made by Mr. Fanuele, seconded by Mr. Keller, to adopt the following resolution fo final approval: WHEREAS, an application for final approval of a subdivision plat entitled "Subdivision Plat for Cedar Creek Estates, Town of Wappinger, Dutchess County, New York" was received by the Town of Wappinger Planning Board on May 14th, 1984, and WHEREAS, a final public hearing was held on said subdivision application and plat at the Town Hall, Mill street, Wappinger Falls, New York, on Monday, August 27th, 1984, and WHEREAS, the requirements of the Subdivision Regulations of the Town of wappinger have been met by said subdivision plat and application, except as noted below, and WHEREAS, the conditions of the preliminary approval of said subdivision plat, granted by the Town of Wappinger Planning Board on April 3rd, 1984, have been met, except as noted below. NOW, THEREFORE, BE IT RESOLVED THAT the application of Peter Luckel - Luvluk, Inc. for approval of said subdivision plat, prepared by Richard G. Barger, P.E. & L.S., and dated May 14, 1984, be approved subject to the following conditions, and that the Chairman be authorized to endorse approval on said subdivision plat upon compliance with said conditions by the applicant, which conditional approval shall expire six months from the date of this resolution if the applicant has not complied with the conditions set forth. Upon completion of all requirements set forth in the action approving the subdivision Plat, the plat shall be properly signed by the appropriate officers of the Planning Board, and shall be filed by the applicant in the Office of the County Clerk in accordance with the requirements of section 278 of the Town Law. Curb cut permits shall be obtained from the Town of Wappinger Highway Superintendent and the Dutchess County Department of Public Works prior to the issuance of building permits. 3. Approval of the road plan and profile and drainage plan and profiles shall be obtained from the Engineer to the Town prior to the signing of the plat. The Conservation Advisory Council shall be given an opportunity to review these plans prior to the approval of the Engineer to the Town. 4. Drainage flow patterns shall be indicated on the individual plot plans. For any surface waters that enter upon properties of other persons, the applicant shall obtain letters from the same per- mitting such discharge. 5. The follwoing improvements shall be required. A. All storm water shall be conveyed by pipe to natural drainage courses. B. Standard street signs will be required at each intersection and temporary signs shall be installed during construction. c. Street specifications shall be those presently in effect at the time of start of construction. D. No open stream will be allowed unless permission in writing is obtained from the Town of Wappinger Highway Superintendent. 6. be paid plat. Downstream drainage fee of $200.00 per lot on the final plat shall be paid prior to the signing of the plat. 9. Lowest opening of all houses {windows, doors, garage doors, crawl space, etc.)shall be at least two feet above the finished road grade unless waived by the Town of Wappinger Highwas Superin- tendent and/or Engineer to the Town. All footing drains and roof leaders shall be piped into the storm drainage system if specified by the Town of Wappinger Building Inspector. 1.1. Prior to the issuance of any building permits, a bond of sufficient amount for the road, drainage and street trees and in a form approved by the Attorney to the Town shall be approved and accepted by the Town. Amount of s,id bond is to be determined by the Highway Superintendent and the Engineer to the Town and shall be approved by the Town Board. 12. In subdivisions with underground utilities, the developer shall contact Central Hudson, the New York Telephone, the Town franchised cable tv company and rhe Town Board to negotiate an agreement whereby cable tv facilities will be installed with underground utilities. Should these negotiations be unsuccessful, the developer or applicant shall provide a statement indicating why an agreement to provide cable tv service could not be reached prior to the signing of the plat. 13. The developer will required to keep the roads of the subdivision clear from snow and ice and make the r03ds passable until such time as the roads have been accepted by the Town. Upon Failure to do so, the Town may authorize, after determining that an emergency exists, a private contractor to clear the roads or make them passable, and the expense of such work will be assumed by the developer. 14. Street trees shall be provided in accordance with the requirements of the Town of Wappinger Subdivision Regulations or as determined by the Town of Wappinger Planning Board. 15. For each lot an application shall be made for a grading permit which shall meet the soil Erosion and Sediment Control ordinance requirements, including submission of a plan showing design and materials and at least a month by month schedule. 16. Five copies of the filed map shall be required for Planning Board distribution. Said copies shall be obtained from the County Clerk's Office. A berm shall be constructed along the property line between lot 4 and the neighboring property (now or formerly lands of John Hughes) prior to the issuance of any building permits. 18.
