Luckel: At the March 26th, 1984 meeting of the Planning Board of the Town of Wappinger, a motion was made by Mr. Mills, to adopt the following resolution: TENTATIVE APPROVAL IS HEREBY GRANTED to Peter Luckel, Luvluck Inc.,for subdivision as shown on map entitled, "Proposed Subdivision for Cedar Creek Estates, Town of Wappinger, Dutchess County, New York", prepared by Richard G. Barger,P.E. & LoS., and dated November 30, 1983 and revised February 8, 1984, subject to the following conditions: Within six months of this tentative approval, the applicant is authorized to submit an application for approval of a subdivision plat in accordance with Article II, Section 22~ Article III, Section 30~ and Article IV of the Subdivision Regulations. In addition, the application must meet the requirements of the Town of Wappinger Zoning Ordinance. In addition, the following improve- ments, reservations, changes, and requirements are pre-requisite to the approval of the plat. 1. Approval of the Dutchess County Department of Health shall be obtained on water supply and sewage disposal prior to final approval. 2. Approval of the road plan and profile, and plan and pro- file of the drainage system shall be obtained from the Engineer to the Town, the Highway Superintendent and the Dutchess County Department of Public Works prior to final approval. The Conservation Advisory Council shall be given the opportunity to review the plans prior to final approval. 3. Drainage flow patterns shall be indicated on the indiv- idual plot plans. The following improvements shall be required: Ao All storm water shall be conveyed by pipe to natural drainage courses. B. Standard street signs will be required at each inter- section and temporary signs will be installed during construction. c. Street specifications shall be those presently in effect at the time of construction. D. No open streams will be allowed unless permission in writing is obtained from the Highway Superintendent. 5. Inspection fees for water lines, sewer lines and storm drainage lines shall be paid prior to the signing of the plat. 6. Downstream Drainage fee of $200.00 per lot on the final plat shall be paid prior to the signing of the plat. 7. Recreation fee of $500.00 per lot on the final plat or land donation shall be paid prior to the signing of the final plat. 8. No structure is to be built where the lowest opening (windows, doors, garage doors, crawl spaces, etc.) are lower than two feet above the road surface unless approved by the Highway Superintendent and/or Engineer to the Town. 90 All footing drains and roof leaders, if specified by the Building Inspector, shall be piped into the storm drainage system. 10. In subdivisions with underground utilities, the developer shall contact Central Hudson, New York Telephone, the Town- franchised cable TV company and the Town Board to negotiate an agreement whereby cable TV facilities will be installed with underground utilities. Should these negotations be unsucess- ful, the developer shall provide a statement indicating why an agreement to provide cable TV service could not be reached. ~: ' . t. .' ~. r: , ;r;. Prior to the issuance of any building permits, a bond of sufficient amount for the road, drainage and street trees and in a form approved by the Attorney to the Town shall be approved and accepted by the Town. Amount of said bond is to be determined by the Engineer to the Town and the Highway Superintendent. 12. The developer shall be required to keep the roads in the subdivision clear from snow and ice and make the roads otherwise passable until such time as the roads have been accepted by the Town. Upon failure to do so, the Town may authorize, after determination that an emergency exists, a private contractor, to clear the roads or make the roads passable, and the expense of such work will be assumed by the Developer. 13. The Fire Prevention Bureau shall review the plan and submit any recommendations that they may have prior to final approval. 14. An erosion control plan shall be submitted to the Conservation Advisory Council for their review and then approved by the Engineer to the Town prior to final approval. 15. A long Enviromental Assessment Form, Part III, shall be submitted, and the Planning Board shall decide if an Enviromental Impact Statement must be submitted prior to final approval. 16. Compliance with the comments of the Engineer to the Town, stated in his letter dated February 27, 1984, shall be met prior to final approval. 17. A downstream drainage plan shall be submitted and approved by the Engineer to the Town prior to final approval. 18. A berm shall be constructed along the property line between lot 4 and the neighboring property (now or formerly lands of John Hughes) prior to the issuance of any building permits. '':'7[.!J..'
