Please refer to your correspondence of October 7,2003 regarding the above. More than
half of the propeny own~rs within Cedar Knolls have requested that the Town explore the
possibility of improving the [vad and having the costs charged back to them.
Regrettably, not al i of the homemvI'.ers :nay cooperate. However, Supervisor Ruggiero
has requested that a Resolution he prepared on the Town Board's motion pursuant to
Town Law S200(1) and (6). Jay Paggi "",ill provide the initial estimated maximum cost.
The cost should include sufficient sums necessary to acquire any interest retained by non-
consenting property owners. The Resolution should be made availahle for the November
24, 2003 Board Meeting.
While the original Subdivision shO\ved c. 50 foot proposed road, the pavement that was
constmcted is not located within the center of the proposed Right-of-V/ay resulting in
seve~'al homes. A copy oftile map will he forwarded to you at a later date.

Another question that has arisen is the term of any bond used fInance the cost. Since this
is strictly a road improvement, it would appear that we would be limited to 10 or 15 years
under the local Finance Law. However, Joe Ruggiero is of the belief that if this bond was
combined with other bond issues that we might be able to stretch the overall term to 20
years. Please confirm.
