In reference to the above,on June 1,1995 I observed that
Chelsea Ridge was doing extensive grading and 1illin9 in
the area where the old tennis courts were located.
Contrary to what Mr. Rosenberg states in his reply, I
could only find one site plan dated 1965 which showed no
tennis courts, In speaking to Herb prior to his leaving he
stated that there were no tennis courts approved. In
finding the PB resolution dated 8/25/78,it states tennis
courts to be completed by 9/1/79(attached).
Giving Mr. Rosenberg the benefit of the doubt,that he did
receive planning board appl"oval for the tennis cCturts, he
is replacing them and inspection by myself and Dcm Keller'
shows that the fill added has raised the ground a good 8
to 9 feet from where it was.
The sign he has posted state 2 new r'egulation tennis
courts coming in addition to basketball, which on the OTR
was stated as baseball, which was a mistake on my part.
Since the last part of Mr. Rosenberg's let,ter threatens
legal action against the Town, which is usual 10r' this
person to do, please advise on how I should J:t:l"oceed wi t,b
this matter.

Dear Mr. Liebermann:
We are in receipt of your communication under the date of June 1, 1995, containing a 1) Stop work order.
2) order to remedy violation, sent to US by Certified Mail # T/W 124.
Please be advised that we have a valid site plan issued by the Town ofWappingers Planning Board,
-authorizing us to construct tennis courts at the specific location in question. Had you taken either the-----u--~---'--
minimal initiative required to check your files, or in the alternative had the decency to call us before
embarking on this improper and poorly thought adventure you would have learned exactly what the facts
are.
With respect to "Baseball Cages" we don't know what you are talking about. Do you?
Interestingly it was the Planning Board who required the construction of the tennis facilities as a pre
approval condition on a long prior application before them.
What I find incredulous is that on the stop work order you were obviously aware that in fact tennis
facilities did exist ("replacing Tennis Courts...") and given the equally embarrassing course of conduct by
your office regarding the false and baseless accusations that the storage structure and the swimming pool
at my personal residence lacked appropriate and proper permits, one would seriously question the veracity
and accuracy of any "individual who brings you infonnation about any improper alleged violations
committed by myself.
I'm sure that residents of our 834 apartment units share my bewilderment as to exactly how the public
good is being furthered by your improper arbitrary and capricious perception-ofexactly what your-job
entails. ' . . -
Unless this unwarranted and ill advised interference into the normal business activities of our firm is
immediately withdrawn, please be further that we will be filing a notice of claim as provided by the
G.M.L. against the Town ofWappingers, seeking full compensation for this fiasco. '

Application of Chelsea Ridge, Inc. for Site Plan Approval
of 168 one-bedroom units to be known as "Chelsea Ridge,
Section 5" and located off Route 9D & Chelsea Road.
At the June 20th, 1977 meeting, the Planning Board of the
Town of Wappinger adopted the following reso'lution:
BE IT RESOLVED THAT FINAL SITE PLAN APPROVAL IS HEREBY GRANTED
to Chelsea Ridge, Inc. for site plan entitled "cheisea Ridge Apartments,
Section 5, Town of Wappinger, Dutchess County, New York", consisting
of the following:

Sheet # 2 - Grading & Drainage, dated 3/21/77, latest revision

Said plans were prepared by Richard G. Barger, P.E. & L.S.
Said approval is subject to the following conditions:
l~ Approval of the Dutchess County Department of Health
on capacity of the existing sewage disposal system and
water supply shall be obtained prior to the issuance of
building permits.
2. Approval of the storm drainage plans must be obtained
from the Town of Wappinger Engineer to the Town.

3. The applicant shall supply the Chelsea Fire Company with
a set of building plans for their review and recommendations
prior to obtaining any building permits. ,
4. Before fifty percent of the,Certificates of Occupancy are
issued the recreation facilities must be completed.
5. Approval of the Dutchess County Department of Public Works
shall be obtained prior to the issuance of any building permits.
All items as stipulated in their June 17th, 1977 must be
complied with before building permits are issued.
6. Approval of the New York state Department "of Transportation
shall be obtained prior to the issuance of any building permits.
7. Downstream drainage fee of $26,479.50 shall be paid prior
to the issuance of any building permits.
8. prior to the issuance of Certificates of Occupancy for
each building, the parking, sidewalks, and landscaping for
each building area shall be in their finished state.
9. Determination from the Attorney to the Town on the
applicability of the Town of Wappinger Local Law # 2 of 1977
shall be obtained prior to the issuance of any building permits.
If a statement is required, the applicant must provide one
and submit it to the Planning Board.

Dear Mr. Rosenberg:
We are in receipt of your letter dated June 9, 1977
and revised copy o! plans for above-referenced project.
Following comments refer to three items you have stated
in your letter.
1. Revised site plan which shows the elimination of
circular drive satisfies our concern in regards to vehicles
entering and exiting at County Road 92.
2. We are also in agreement with the concept that would
allow culvert pipe under CR 92 near John Costa's property to
discharge into proposed ponding area.' (Spillway elevation of
existing dam indica tes there will not be any wa ter backup to this
culvert.)
3. As I indicated in my letter of April 20, 1977,
existing 24" RCP culvert under CR 92 in the vicinity of the
main entrance of Chelsea Ridge Apartments will be affected by
increased storm water runoff. Therefore, an additional adequate
drainage discharge opening must be provided at this crossing.
This can be accomplished either by replacing this culvert with
a larg~diameter pipe or installing a second culvert near the
existing one. We agree and accept your willingness for improve-
ment of this culvert along the above-mentioned concept and recommend
that TOwn of Wappinger Planning Board consider your offer and
suggestion as indicated in your letter to handle this drainage
matter.
