Straub: This is in response to your letter of February 10, 1981. expressing your firm's concern for the traffic conditions at the Route 9D/Popula Boulevard intersection. The Department's records on the development of the apartment complex and tt~ commercial center are quite extensive, as we have been actively involved since the planning stages. In 1968, the Department dictated that the developer acquire additional land along Route 9D due to sight obstructions along the frontage of its proposed facility. The additional land allowed the driveway to be located at the crest of the vertical curve of Route 9D and Popula Boulevard was constructed at its present location in accordance with the Department's policies and standards of that time. In 1977, the owners and the Department discussed the future growth of the Chelsea Ridge property including additional residential units and the commercial facility. As a result of our site plan review, we recol'l.lrnended that the driveway be upgraded to present day standards and that ". . . consid- eration be given to the construction of an auxilary lane on the east sIde of Haute 9D." Although the majority of the intersectional improvements \.,rere subsequently provided, we are attaching a copy of Hr. Rosenberg's letter of May 5, 1977, which expressed his objections to an auxilary lane. Since future or anticipated traffic volumes are difficult to accurately project, we reached a mutual understanding with the developer that if problems result, \-le ,-muld prohibit northbound left turns into Popula Boulevard. We are attaching a copy of Hr. Rosenberg's letter attesting to the latter agreement. With specific reference to your letter, we are not in favor of providing a "skirt", which 'Vle assume \V'ould be increasing the blacktop shoulder width. The State's Vehicle and Traffic Law explicitly prohibits the use of the shoulder to by-pass vehicles. Ilowever, we would still be in favor and ,,,ould encourage a proposal to widen Route 9D to provide a left turn storage lane for northbound vehicles. Since the lane is necessary as the direct result of the increased traffic being generated by Popula Boulevard, it would be the direct responsibility of the developer (owner) to construct the necessary improvements under a Highway Work Permit issued by the Department. If the owner(s) refused to cooperate, we would still have the option to prohibit the left turn movement, as previously agreed upon. Hr. Frank G. Re: Chelsea Ridge Hall Shopping Center, Town of Wappingers, Dutchess County Dear Hr. Dickson: It is our intent to become a tenant at the New Chelsea Ridge Hall sometime in Harch or April. We feel that this is an excellent business location which should generate a good business traffic flow. However, based on our own observations it is felt that the traffic pattern on Route 9D at the entrance of the shopping center is a problem area. Several weeks ago at the time I visited this location, an accident had just occurred. As I came to a stop, the car behind me was traveling too fast, resulting in the driver making a complete 3600 turn in the road and came within inches of hitting my car. Both commuters and the business people that are presently in the shopping center have advised us about their anxiety going into and out of Chelsea Ridge. Obviously there is a need to either widen Route 9D at this particular location or at least provide skirts on the road. .- (' . It would be greatly appreciated if you could review this matter and hopefully provide some proper input to correct this hazardous situation.
