Corbally, Gartland and Rappleyea 35 Market Street Poughkeepsie, New York 12601 Re: Chelsea Ridge Mall Town of Wappinger Dear Jon: This is in confirmation of the discussions held at the special meet- ing of the Town Board/Town of Wappinger on August 25, 1980 regarding the above referenced matter. My clients will proceed as follows: 1. All work on the Chelsea Ridge Mall shall cease immediately (8/25/80) with the exception of work on the fire walls which may continue through August 31; all work on the project shall cease by September 1, 1980. 2. All plans and documents prerequisite to the receipt of a building permit which have previously been outlined by the Building Inspector will be submitted by close of business Friday, August 29, 1980. 3. Upon receipt and review of such plans the Building Inspector will provide us with a calculation of fees due whereupon said fees shall be tendered to the Town; any downstream drainage fees required will be paid subject to the reservation of a right for a further determination of the applicability of such fees. 4. The documents and plans submitted will be expeditiously reviewed by the Building Inspector upon his receipt of same. 5. Any reviewing or approval of such plans by the Building Inspector or other agencies of the Town will be without prejudice as regards compli- ance with local and state building codes and regulations. 6. The forebearance of a court action in this matter, along with the submission and review procedure outlined above, shall not be deemed as a ~ " ~ ..... Jon Holden Adams, Esq. Page 2 August 27, 1980 Re: Chelsea Ridge Mall Town of Wappinger recognition by the Town of any vested rights which the applicant has or may subsequently claim. It is my understanding that as we proceed in this manner in good faith the Town will forebear taking any legal action so long as we pro- ceed in an open/cooperative and timely manner. Likewise, it is our reason- able hope and expectation that the agencies and officers of the Town will act in good faith in their review and processing of the various documenta- tion associated with this project. I would again like to take the opportunity to thank the Town Board, the Building Inspector and yourself for the time you took to help us formulate an approach to resolving this difficult and complex matter.
