We had previously requested this waiver in our letter of April 7, 1980 stating the reasons and rational: despite what we felt was an overwhelming substantiate and persuasive argument, your Board has chosen to deny our request. We would once again like to renew our request in light of the fact that at the July 7, 1980 meeting of the Town of Wappingers Planning Board on a motion made by Dr. Miller and seconded by Mr. Brannen there was a favorable action on behalf of the New York State Depart- ment of Transportation to waive the downstream drainage fees and subdivision fees on the basis ofth~ allege historical purposes. We know of no basis or guidlines within the ordinance to permit the granting of a waiver to the State while denying ours. We feel that this represents unequal treatment under the law and is extremely prejudice to our interest despite the fact that the State of New York can well afford to pay the fees far better than we can.
