On April 7, 1980, we requested of the Planning Board that they waive
the downstream drainage fee for our Chelsea Ridge Mall in accordance
with the reasons stated in my letter to them of April 7, 1980 (copy
enclosed) . At that time, the Planning Board requested an opinion
of the Town Engineer, Rudy LaPar responded on April 11, 1980 (copy
enclosed) indicating that the issues we raised in our letter to the
Planning Board had merit. However, the Planning Board at a subsequent
meeting on April 21, 1980, which we were not present, denied our
request, considering we were not present and the information that the
Town Engineer requested was not furnished to them, we again requested
an opportunity to have the Planning Board reconsider our request.

Dear Lou:
Prior to that request bein9 considered, the Planning Board referred
the matter to the Town Board which resulted a visit to the site by
Nick Johnson and Bernice Mills. I indicated to Councilman Johnson
and Mrs. Mills that we would again bring this matter to the Planning
Board for their consideration.
In our initial letter to the Planning Board, we raised the point that
the Cranberry Hills project was granted a 50% deduction in downstream
drainage fee because of the proposed construction of holding ponds
which would significantly reduce the consequences of any effect on the
downstream drainage.
Accordingly, we feel that, not only will our ponds reduce the con-
sequences of the downstream drainage, we can conceivably totally
eliminate the downstream drainage resulting from the Chelsea Ridge Mall.
In turning down our request, the Planning Board indicated that the
ability to negotiate the downstream drainage fee was properly a
matter to be undertaken by the Town Board. We would like to officially
request that the Town Board entertain our request to waive the down-
stream drainage fee for all of the reasons contained in my letter
of April 7, 1980 to the Planning Board.
It is our feeling we should be afforded at minimum the same considera-
,tion as was extended to the Cranberry Hills project on the basis of
our construction of suitable holding ponds.
