Public Comments
The first resident to speak was Louis DiCocco. Mr. DiCocco wanted to know the present
cost of operating the Recycle Center. Supervisor Gutzler answered that the cost is over
$250,000. Mr. DiCocco asked how the proposed Recycle Center permit fee was determined.
Councilman Bettina answered. Discussion about the permit fee followed.
The next resident to speak was 011ie Simpson. She first asked if residents could only
permit one vehicle. Councilman Bettina replied that residents could get two permits for the
annual fee. Councilwoman Czarniecki noted that the Board would be limiting the number of
visits that residents could make to the Recycle Center. Ms. Simpson then asked if residents that
do not have a permit would be able to gain access to the site by borrowing another vehicle that
has a permit. Councilman Bettina replied that the Recycle Center would be run on the honor
system. Graham Foster, Highway Superintendent, clarified that the Recycle Center staff would
be checking the vehicle, not the driver. Ms. Simpson then asked if there would be large start-up
costs when the new policy is put in place and if these additional costs were considered when the
permit fee was determined. Supervisor Gutzler discussed the cost to implement the program.
Ms. Simpson asked if there could be an express lane at the Recycle Center for those residents
that already have a permit, so that they don't have to wait in line as others buy the permit. Al
Roberts, Attorney to the Town, explained that all permits are to be purchased at the Town Clerk's
Office. Ms. Simpson then noted that the Town Clerk's Office isn't open on Saturdays. She
added that she would not know about the Town Board Meeting schedule and the changes to the
Recycle Center if not for the Poughkeepsie Journal. She would like the Town to mail letters and
postcards to the Town residents when changes are made. Councilman Bettina noted that changes

would be posted to the website and the Town signboard. Supervisor Gutzler added that flyers
were handed out at the Recycle Center. Ms. Simpson replied that not everyone has a computer
and internet access. She then asked how someone would get a new sticker each time they buy a
car. Councilman Bettina would like the old sticker to be turned in before a new sticker is issued.
Ms. Simpson then asked if she would be refunded the permit fee when she moves out of the
Town. The Board replied that there would be no refunds. Ms. Simpson then recommended that
the residents be issued a card that would be used to gain access to the Recycle Center.
Discussion about the recommendation followed.
The next resident to speak was Claudia Bruno. She noted that she tried to get the new
permit but was told that nothing was ready yet. Since the original proposed start -date was
approaching, she asked if she would be charged a fee if she showed up to the Recycle Center
without a permit. Mr. Roberts explained that the permits will be purchased at the Town Clerk's
office. Ms. Bruno replied that she would have to make special arrangements with her job to be
able to come in. Supervisor Gutzler explained that the program will be phased in and the start
date will be pushed back. Ms. Bruno then responded to Councilwoman Czarniecki's comment
that usage to the site will be limited. Ms. Bruno noted that she occasionally makes 5 trips in one
day. She doesn't think that the Town Board should be restricting the residents. Councilwoman
Czarniecki replied that the Town will take a running average of usage. The point of the limit is
to prevent abuse. Supervisor Gutzler noted that she visited the Recycle Center on the previous
Saturday and witnessed cases of abuse. Discussion followed.
The next resident to speak was Tom Schiesel. He is concerned about the abuse occurring
at the Recycle Center. He thinks that the cost items, such as refrigerators, computer monitors
and so on, should be paid for by the people dumping those items. Mr. Foster explained that the
proposed Resolution will address that concern. Residents will be able to dump as many of those
items as they want, but they will be paying to dispose of them. Mr. Schiesel asked if the permits
could be applied for through the mail. Supervisor Gutzler answered that the Board is looking
into that option.
The next resident to speak was Oscar Scherer. Mr. Scherer asked for an explanation of
the stickers to be used. Mr. Foster answered that different stickers would be needed for different
purposes, but the Board would have to decide on what stickers to use.
Mr. DiCocco asked to speak again. He recommended that the Town post a sign at the
Recycle Center that informs the residents that they can use the site in the normal fashion until the
permits are put into play. Mr. DiCocco also applauded the Town's openness throughout the
Recycle Center deliberations.
Ms. Simpson asked to speak again. She asked if a permit would be needed to drop off
brush and leaves. Mr. Foster answered that a permit would be required. Ms. Simpson then
asked what information she would need to furnish in order to get a permit. Councilman Bettina
answered that residents would need to provide something that proves that they are a resident.
Mr. Foster recommended that a Driver's License be required. Councilman Bettina noted that
some residents don't drive. Mr. Foster pointed out that residents that don't drive won't be driving
to the Recycle Center. The Town Clerk, Chris Masterson, explained how the Town could use a
points system to prove residency. Discussion followed.
The next resident to speak was Ron Scozzafava. He noted that the stickers sometimes
come off. He asked if there would be a charge for a replacement. Supervisor Gutzler replied
that there would be no charge for replacements. Mr. Scozzafava asked if he could let his
children use his car to dump for him. Councilman Bettina again noted that the site would be run
on the honor system.
The next resident to speak was Mary Schmalz. She asked if residents would have to pay
to dump leaves and brush. Mr. Foster replied that senior citizens would have to pay the $30
annual permit fee. Ms. Schmalz claims that Wappinger is the only town or village that doesn't
offer free leaf pick-up. The Board explained that there are many other towns and villages that do
not offer free leaf pick-up.
Mr. Scozzafava asked if residents could still use the previously purchased refuse tickets.
The Board answered that the refuse tickets could still be used.
Ms. Bruno asked if the Town is discontinuing bulk pick-up. Supervisor Gutzler replied
that she is not sure if the Town will be able to do it this year. Mr. Foster added that the Town is
facing a 2% tax cap from New York State. Councilwoman Czarniecki noted that she is not in
favor of continuing bulk pick-up. She has observed that non-residents dump garbage along town
streets when bulk pick-up is announced. Ms. Bruno noted that there are some people that are not
physically able to transport items to the Recycle Center. Discussion followed.
The next resident to speak was June Weyant. Ms. Weyant recommended that people be
limited to the number of similar items that they can dump. She used office chairs as an example.
Mr. Foster claimed that the majority of the people that use the Recycle Center are honest.
Discussion followed.
Mr. Scozzafava noted that the staff at the Recycle Center is very helpful.

The next resident to speak was Frank Greggo. He asked what problem was being
addressed with these changes. The Board replied that the changes will address the cost to run the
Recycle Center. Mr. Greggo objected to residents being able to use double -axle trailers to dump
at the Recycle Center. The Board noted that some residents do not want to, or are not able to,
transport garbage in their personal vehicles. Discussion followed. Mr. Greggo then asked if the
$50 fee would be charged for each vehicle. Supervisor Gutzler replied that the $50 fee would
cover up to two vehicles.
With no further comments or questions, Councilwoman Czarniecki made a motion to
close the floor. The motion was seconded by Councilman Bettina and passed unanimously.

RESOLUTION: 2011-308
Resolution Adopting Fee Schedule and the Authorizing the Purchase of Supplies for
Recycle Center
WHEREAS, the Recycle Center is funded through the A Fund portion of the Town of
Wappinger budget; and
WHEREAS, the 2011 Budget anticipated that the Town would charge certain fees for
the use of the Recycle Center; and
WHEREAS, the cost to operate the Recycle Center for calendar year 2011 is estimated
to be $250,000.00; and
WHEREAS, Federal and/or State agencies have imposed regulations and requirements
with respect to the disposal of certain materials that have resulted in additional expense to the
Town of Wappinger; and
WHEREAS, the Town Board has agreed upon a Fee Schedule for the use of the Recycle
Center, effective September 17 2011; and
WHEREAS, the Town Board has determined that effective September 17, 2011, use of
the Recycle Center shall be limited to Town residents (including Village of Wappingers Falls
residents living within the jurisdiction of the Town) upon terms hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby determines that the use of the Recycle Center shall be
limited to Town residents who purchase an annual permit, evidenced by a bar-
coded emblem affixed to the resident's vehicle or who purchases a single day
permit. Town residents shall include those Village of Wappingers Falls residents
who live within the jurisdiction of the Town.
3. The Town Board hereby adopts the Recycle Center Fee Schedule, a copy of
which is attached to this Resolution as Schedule "1".
4. The Town Board hereby directs the Town Clerk to purchase bar-coded computer
interfaced emblems, residential garbage tickets, Freon purge stickers, computer
monitor stickers and such other tickets, stickers or computer software needed to
implement the Fee Schedule established in Schedule "1".
5. The Town Clerk shall offer for sale the bar-coded annual Permitted Emblems,
residential garbage tickets, Freon purge stickers, computer monitor stickers, and

suc other tickets and stickers needed to implement the Fee Schedule establish in
Schedule "I".
6. This Resolution supersedes Resolution No. 2011-221 adopted by the Town Board
on August 22, 2011.

VI. New Business
Supervisor Gutzler Statement
Supervisor Gutzler noted that she had to declare a State of Emergency in response to
Hurricane Irene. She thanked the Town Board, Councilman Beale, Councilman Bettina,
Councilwoman Czarniecki, Councilman Paoloni, Fire Inspector Mark Liebermann, Town Clerk
Chris Masterson, John Sullivan and Graham Foster for their help and support throughout the
event. Supervisor Gutzler also noted that several Town Hall employees volunteered to come in
to help if needed.
