VI. Discussions
A. Flooding, Joan and Paulette Lanes - Gutzler
Supervisor Gutzler opened the discussion at 7:34 PM. June Visconti, a resident of Joan
Lane, was present to address the Board on the flooding issue. Ms. Visconti gave a brief history
of the topic. She has recently had four significant floods. She noted that there is land behind her
subdivision that has preliminary approval through the Planning Board. Part of that land, which is
in the flood zone, is to be dedicated to the Town. She hopes that the Town Board will be able to
look into the current status of the dedication of the land.
Councilman Bettina asked if the land is in the flood plain. Ms. Visconti confirmed that
certain houses in her development are in the flood plain. She described some of the precautions
that were required by the Planning Board when the new houses in that area were built.
Councilman Bettina asked if the recent floods were 100 -year floods. Bob Gray, Engineer to the
Town, confirmed that the floods were designated close to that. Discussion about a berm
followed.
The next resident to speak was Brian Allen. He noted that his grandfather built the berm.
You can now hear water flow over the berm. He described the course of the water.
Councilman Paoloni asked what the Town can do. Al Roberts, Attorney to the Town,
replied that he did not know what the Town can do legally. He does not have enough
information. He asked if the berm or swale is on property owned by Wappinger Farms or if it is
on the individual parcels. Ms. Visconti has an old map that she would like to show to Graham
Foster, Highway Superintendent. Mr. Allen has volunteered to walk the property with Graham.
Discussion followed.
The next resident to speak was Bill Dengler. He noted that he has the same type of
problem. There is an easement in the back of his property that is flooding back onto his
property. He called Mr. Foster to ask what could be done. Mr. Foster told him that the whole
Town is flooding and that there is nothing he could do. Mr. Dengler noted that the only thing
that needs to be done is to clear the easement. He also has pictures of the conditions on his
property. He stated that the Town wanted the property for an easement, but now doesn't want to
clean the easement. He is hearing MS4 requirements being used as excuses. When he talked to
DEC, he was told that the easement could be cleared as long as Mr. Foster went in with the
Brush Hog. He noted that he pays taxes too, but he doesn't get any action over where he lives.
Discussion followed.
Councilman Beale asked Ms. Visconti if the water was coming from Town of Wappinger
property. Ms. Visconti replied that the area that Councilman Beale is referring to was dedicated
15 years ago and is called Scout's Creek Lake. It was supposed to be made into something
similar to Lake Oniad. The water is coming from Red Hook. Discussion followed.
The next resident to speak was Lenny Abbatantuono. He noted that the flooding has
happened six times in the past eight years. It is not happening only when there are hurricanes.
When the spring thaw comes and the Sprout Creek rises, they all get flooding. He feels that the
main solution is to clear the Creek so that the water can flow. Councilman Paoloni asked how
the Creek could be cleared. Mr. Gray answered that it would be a major undertaking and would
require a permit from DEC. Mr. Foster added that Robinson Lane would need to be shut down.
Councilman Beale asked what powers that Town has to make sure this doesn't happen. He
pointed out that the problem could be caused by an increase in volume of water or from
impassable obstructions downstream. Supervisor Gutzler summarized the actions that the Board
should take. Councilman Bettina would like to include East Fishkill in the discussions.
The next resident to speak was Gary Lindstrom. He noted that this issue isn't anything
new.
The next resident to speak was Michael Clark. He pointed out that the Little League
complex had lost about 5-7 fields. Those fields are still under water. Discussion followed.
Ms. Visconti noted that there have not been many houses built between Noxon Road and
her house. Since 1978, the berm had prevented the water from reaching her house. She feels
that the flooding has something to do with the berm. Councilman Paoloni feels that the problem
is downstream. He thinks that something is blocking the water from getting out quickly enough.
The next resident to speak asked when they would be hearing back from the Board of the
decided course of action. Supervisor Gutzler asked the Town professionals if a time -frame could
be established. Mr. Gray estimated that a preliminary report could be ready in 30 days.
Discussion followed.
Supervisor Gutzler closed the discussion at 7:58 PM.
B. Wildwood Manor Building Use - Czarniecki
Supervisor Gutzler opened the discussion at 7:59 PM. Councilwoman Czarniecki noted
that Wildwood Manor has requested the use of the Town Hall and has provided all necessary
documents and payments. The Town Clerk, Chris Masterson, asked if this request is approved.

Supervisor Gutzler confirmed. Supervisor Gutzler closed the discussion at 8:00 PM.
C. Recycle Center Oversight - Beale
Supervisor Gutzler opened the discussion at 8:00 PM. Councilman Beale noted that he
had previously recommended establishing a Recycle Center Oversight Committee. He
volunteered to serve on this committee and recommends having a mixture of elected officials and
residents on it as well. Councilwoman Czarniecki also volunteered for this committee.
Discussion followed.
The first resident to speak on this topic was Joe Torres. He suggests putting a notice on
the website and allowing residents to volunteer to serve on this committee.
The next resident to speak was John Foster. He noted that he normally uses an SUV to
visit the Recycle Center. A few times a year, he might bring a lawn mower trailer to transport
trash. He asked if anything has been put in place to address his situation. Councilwoman
Czarniecki answered that residents could purchase a one -day pass if they only come in once in a
while. Discussion followed.
Supervisor Gutzler closed the discussion at 8:06 PM.

Public Comments
The first resident to speak was Peter Tomasic. He first compared Wappinger to
communist Russia. He went on to claim that the Town Clerk does not show up to work at Town
Hall. Councilman Beale asked what this statement had to do with the Agenda. Supervisor
Gutzler recommended that Mr. Tomasic stay after the Meeting and enter his comments into the
record.
Peter Tomasic then stated that the previous administration hired friends, at the salary of
$56,000 per year, to count snowflakes. Graham Foster, Highway Superintendent, would then
have to come in and clean the leaves and snowflakes for these employees.
Councilman Beale pointed out that this resident is making unsubstantiated claims. Mr.
Tomasic objected to the fact that Mr. Beale does not own a house. He also noted that
Councilman Beale is "his employee". Mr. Tomasic continued indecipherably.
Councilman Beale noted that this is an ongoing issue where someone feeds Mr. Tomasic
information that is false. Mr. Tomasic then stated that the volunteer firefighters in Wappinger
"go from bar to bar." Mr. Tomasic continued yelling at Councilman Beale as he left. Most of
the comments were indecipherable. The Board took a recess.
When the Board returned from recess, there were no further comments from the public.

VIII. Resolutions
RESOLUTION: 2011-310
Resolution Authorizing Improvements and Enhancements to War Memorial at Schlathaus
Park
WHEREAS, Joseph Geraci is an Eagle Scout and a resident of the Town of Wappinger;
and
WHEREAS, a World War II memorial is located on the Town -owned Schlathaus Park at
the intersection of All Angels Hill Road and Myers Corners Road, which War Memorial consists

of a kneeling soldier on a raised pedestal base; and
WHEREAS, Joseph Geraci, as part of an Eagle Scout project, plans to make certain
improvements and enhancements to the War Memorial, as detailed in his written presentation to
the Town, attached hereto as Exhibit "A", hereafter referred to as the "Proposed Action"; and
WHEREAS, the Town Board has determined that the proposed improvements and
enhancements are deemed to be maintenance and/or repairs involving no substantial changes to
the existing structure; and
WHEREAS, the Town Board determines that the aforementioned maintenance and/or
repairs are a Type II action as defined in 6 NYCRR 617.5 and Chapter 117 of the Code of the
Town of Wappinger and, accordingly, the Town Board hereby expressly determines that this
action is not an action that requires review pursuant to the provisions of the New York State
Environmental Quality Review Act ("SEQRA") or pursuant to Chapter 117 of the Code of the
Town of Wappinger.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby authorizes Joseph Geraci to undertake the improvements
and enhancements to the War Memorial at Schlathaus Park, as detailed in Exhibit
"A", attached hereto and made part hereof, on the express understanding that all
of said improvements and enhancements will be undertaken at no cost to the
Town of Wappinger, and subject to review and comment by the Town of
Wappinger Planning Board and the Engineer to the Town of Wappinger.
3. The Town Board hereby determines that the proposed action, that is the
undertaking of the improvements and enhancements to the War Memorial as
presented by Joseph Geraci, is a Type II action as defined in 6 NYCRR
§617.5(c)(20) and, accordingly, the Town Board hereby expressly determines that
this action is not an action that requires review pursuant to the provisions of New
York State Environmental Quality Review Act ("SEQRA") or, pursuant to 6
NYCRR Part 617 or, pursuant to Chapter 117 of the Code of the Town of
Wappinger.

RESOLUTION: 2011-311
Resolution Authorizing Community Day Events for Calendar Year 2011
WHEREAS, the Town of Wappinger has annually held Community Day, which includes
amusement rides, fireworks, local vendors, a community parade and other presentations to build
community awareness; and
WHEREAS, the Town of Wappinger Recreation Committee oversees the scheduling of events
on Community Day and has proposed holding Community Day celebrations for two (2) days, Saturday,
September 17, 2011, commencing at noon and ending at 10:00 p.m., and Sunday, September 18, 2011,
starting at noon and ending at 6:00 PM; and
WHEREAS, the Recreation Committee has scheduled various events as hereinafter provided.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. The Town Board hereby authorizes the Community Day celebrations to be held at
Schlathaus Park for a two (2) day period, starting Saturday, September 17, 2011,
commencing at noon and ending at 10:00 pm, and on Sunday, September 18, 2011,
starting at noon and ending at 6:00 p.m.
3. The Town Board hereby authorizes a fireworks display to occur on Saturday, September
17, 2011, at approximately dusk.
4. The Town Board hereby authorizes the Town Parade to occur on Sunday, September 18,
2011, at 2:00 p.m., along Myers Corners Road, starting at the property of Mycor

Holdings and ending at Schlathaus Park.
5. The Town Board Hereby authorizes the payroll expense of approximately 60 hours for
three maintenance personnel and approximately 30 hours for two recreation department

6. The Town Board hereby authorizes utilization of the D.0 Sheriff's Department for
security and traffic control for Community Day.
7. The Town Board hereby confirms its delegation of authority to supervise and manage the
Community Day activities to the Town of Wappinger Recreation Committee and the
Town of Wappinger Recreation Director.

IX. New Business
Councilman Beale New Business
Councilman Beale thanked the residents of Wappinger for coming out for the 9/11
ceremony and the dedication of the Mark Palmateer Memorial Park. His connection to this event
is the reason why he responds emotionally when residents like Peter Tomasic show up to Town
Board Meetings to attack Town of Wappinger volunteer firefighters. Councilman Beale
apologized if he offended anyone with his response to Mr. Tomasic, but he stated that he would
not sit by silent as Mr. Tomasic verbally assaults firefighters. Discussion followed.
Councilwoman Czarniecki New Business
Councilwoman Czarniecki noted that the 9/11 service was touching. She was pleased
that she was invited to attend.
Supervisor Gutzler New Business
Supervisor Gutzler noted that, in that last two weeks, five residents, all senior citizens,
have come into her office with ambulance bills. The residents want to know why they are being
billed despite the fact that the Town has an agreement with TransCare. She will be meeting with
TransCare to resolve this issue. Discussion followed. Councilman Beale noted that Wappinger
has the best EMS responders in Dutchess County.
Supervisor Gutzler then noted that the contract for the Cider Mill Water Tank
replacement project has been signed. She does not expect any problems during the 120 -day
duration of the project.
