Public Comment
The first resident to speak was Mr. Tomasic. He asked for a copy of the minutes. He stated his
voice was deleted from the recording and would like to have a copy. Supervisor Gutzler stated he
could have a copy of the minutes at the end of the meeting. Councilman Paoloni noted that he
didn't think the town has the ability to change the minutes. Councilman Beale pointed out that
there is a digital version of the minutes that is available on demand. There is no room for
disputing the public comments during that meeting it's there forever. Supervisor Gutzler replied
she listened to the minutes early in the day, and to her everything seemed fine. Discussion
continued.

A. Feasibility Study for the Route 9 Corridor Extension: United Wappinger Water

Councilman Bettina asked Mr. Gray to explain the feasibility study for the United Wappinger
Water district. Bob Gray, Engineer to the Town, give a presentation to explain his study. He then
fielded questions from the Board.

RESOLUTION: 2011-323
Resolution Authorizing the Submission of the Fiscal Year 2012 Dutchess County
Community Development Block Grant Program Application
WHEREAS, the Town of Wappinger is participating in the Dutchess County
Community Development Block Grant; and
WHEREAS, input from citizens and groups has been received and considered; and
WHEREAS, an application (a copy of which is attached hereto and made part hereof as
Exhibit "1") has been prepared for a Community Development Block Grant which addresses the
Town of Wappinger's interest and reasons for developing the Challenger Field Improvements.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Dutchess County Community Development Consortium Fiscal Year 2012
application for the Town of Wappinger, including the certifications included
therein, be, and hereby is, approved.
3. The Supervisor is hereby authorized and directed to execute the application by
and on behalf of the Town of Wappinger and forward same to the Dutchess
County Department of Planning and Development within five (5) days hereof.

RESOLUTION: 2011-317
Resolution Establishing a War Memorial Committee
WHEREAS, Councilman Vincent Bettina has proposed a combined Town of
WappingerNillage of Wappingers Falls Veterans War Memorial Committee to help honor and
remember the sacrifices of all of the brave men and women from our Community who have
given their lives in defense of our nation; and
WHEREAS, the Town of Wappinger Schlathaus Park already features an impressive,
centrally located and highly visible World War 11 monument; and
WHEREAS, the base of the existing World War 11 monument at Schlathaus Park could
be architecturally designed and aesthetically modified to serve as an appropriate structure on
which to inscribe the names of our local community's war dead and MIA's, or a separate
structure to honor the same.
NOW, THERFORE, BE IT RESOLVED, that Councilman Bettina, with the assistance
from County Legislator Incoronato, who represents Wappinger and also serves on the Dutchess
County Veterans Affairs Committee, chair and form a Committee to provide the
recommendations to the Town board for such memorial.

RESOLUTION: 2011-318
Resolution Authorizing Replacement of Air Conditioner Compressor Servicing the NY
State Troopers Facility by Crystal Clear, Inc.
WHEREAS, the New York State Troopers lease space from the Town of Wappinger in
the Emergency Services Building, located on Middlebush Road, Wappingers Falls, New York;
and
WHEREAS, the lease between the Town of Wappinger and the New York State
Troopers requires the Town to maintain the air conditioning system and keep same in good
working order; and
WHEREAS, the compressor to the air conditioning system serving the New York State
Police facility has failed; and
WHEREAS, Steve Frazier, Supervisor of Buildings and Grounds has solicited two (2)
verbal quotes for the replacement which resulted in the following:
Sam Schaffer; Crystal Clear Inc. -$2110.00
Dick Smith; C.B. Strain Inc. - $2625.00; and
WHEREAS, in accordance with the Town's Procurement Policy, Steve Frazier
recommends that Crystal Clear, Inc., be awarded the compressor replacement job in the sum of
$2,110.00.

NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town of Wappinger hereby awards the bid for the replacement of the air
conditioner compressor serving the NY State Troopers' office space located in the
Emergency Services Building on Middlebush Road, Wappingers Falls, New
York, to Crystal Clear, Inc., in the sum of Two Thousand, One Hundred Ten
Dollars ($2,110.00), in accordance with the recommendation submitted by Steve
Frazier, Supervisor of Buildings and Grounds.
3. The Town Board hereby authorizes the Town Supervisor, Barbara A. Gutzler, to
award the bid and to execute any repair orders or vouchers necessaryto
implement the repairs above stated.

Resolution Authorizing Use of Schlathaus Park for Schlathaus Memorial Race
WHEREAS, the Mid -Hudson Road Runners Club will be sponsoring the Schlathaus
Memorial Race to be held on Saturday, October 1, 2011, which race will be coordinated with the
Town of Wappinger Recreation Department and the Town of Wappinger Highway
Superintendent with respect to road closures, if necessary; and
WHEREAS, The Mid -Hudson Road Runners Club, and the Town of Wappinger
Recreation Department request the use of Schlathaus Park for use by the runners during the time
of the race; and
WHEREAS, The Town of Wappinger Recreation Department is authorized to expend
funds not to exceed the sum of Three Hundred Fifty Dollars ($350.00) for trophies and
pumpkins; said funds are to be paid out of Budget Line Item A7140.401; and
WHEREAS, The Mid -Hudson Road Runners Club must provide proof of General
Liability Insurance in the sum of One Millions Dollars ($1,000,000.00) naming the Town of
Wappinger as an additional insured or certificate holder under said policy.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board endorses Mid -Hudson Road Runners Club's sponsorship of the
Schlathaus Memorial Race on Saturday, October 1, 2011.
3. The Town Board hereby authorizes the use of Schlathaus Park for the Schlathaus
Memorial Race, sponsored by the Mid -Hudson Road Runners Club and
coordinated through the Town of Wappinger Recreation Department and with the
Town of Wappinger Highway Superintendent with respect to road closures, if
necessary.
4. This Resolution is adopted on the condition that the Mid -Hudson Road Runners
Club provides proof of General Liability Insurance in the amount of One Million
Dollars ($1,000,000.00), per occurrence, naming and insuring the Town of
Wappinger as an Additional Insured or Certificate Holder, insuring the Town of
Wappinger from and against any and all suits, actions or causes of action of every
kind, nature and description brought against the Town of Wappinger for, or on
account of, any injuries or damages for personal injury or property damage
received or sustained by any party or parties participating in the Schlathaus
Memorial Race, or caused by or from the negligence of any of the participants in
the race or any of the officers, members, employees or invitee(s) of the Mid -
Hudson Road Runners Club.

WHEREAS, the Town of Wappinger Recreation Department will be sponsoring and
coordinating the Town of Wappinger Halloween Parade to be held on Sunday, October 23, 2011;
and
WHEREAS, The Town of Wappinger Recreation Department requests the use of
Schlathaus Park for the Town of Wappinger Halloween Parade and to expend required funds
therefore.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby authorizes the use of Schlathaus Park on Sunday,
October 23, 2011, for The Town of Wappinger Halloween Parade, which will be conducted
under the direction and management of the Town of Wappinger Recreation Department.
3. The Town of Wappinger Recreation Department is authorized to expend funds
not to exceed the sum of Eight Hundred Dollars ($800.00) for refreshments. Said funds are to be
paid out of Budget Line Item A7550.400. The event budget is to be independent of necessary
payroll for staff working the event.

Resolution Introducing Local Law No. —of 2011, Amending Chapter 230, Vehicles and
Traffic, of the Town Code, Prohibiting the Overnight Parking of Heavy Commercial
Vehicles on Town Roads in Residential Zoning Districts

WHEREAS, the Town Board of the Town of Wappinger has determmed at ap
Vehicles and Traffic, of the Town Code should be amended so as to prohibit the overnight parking
of heavy commercial vehicles on Town roads in residential zoning districts (the "Proposed
Action"); and
WHEREAS, the Town Board has determined that the Proposed Action is a Type II action
pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known
as "SEQRA") and pursuant to Chapterhestablishes locally yl designatedwn The ype I actions) bencause the
Quality Review (WEQR) Law
Proposed Action is the enactment of a traffic regulation; and
WHEREAS, Type II actions do not require any further environmental processing in
accordance with the provisions of SEQRA and WEQR
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The Town Board of the Town of Wappinger hereby introduces for consideration of
its adoption proposed Local Law No. _ of 2011 in the form annexed hereto;
except as specifically modified by the amendments contained therein, the Town
Code as originally adopted and amended from time to time thereafter is to remain in
full force and effect and is otherwise ratified, readopted and confirmed.
2. The Town Board hereby schedules a Public Hearing regarding the adoption of the
annexed proposed Local Law No. _ of 2011 for 7:30 PM on the 24th day of
October 2011, and the Town Clerk is hereby directed to publish notice thereof in the
Town's official newspapers not less than ten (10) days prior to said public hearing
date.
3. The Town Board hereby directs the Town Clerk to act as follows with respect to the
proposed Zoning Law:
a. To serve a copy of this resolution, the annexed proposed Local Law, and the
public hearing notice to the municipal clerk of each abutting municipality not
less than ten (10) days prior to said public hearing;
b. To serve a copy of this resolution, the annexed proposed Local Law, and the
public hearing notice to the Dutchess County Department of Planning and
Development for advisory review in accordance with Section 239 of the
General Municipal Law; and
C. To distribute a copy of this resolution, the annexed proposed Local Law, and
the public hearing notice to the Town of Wappinger Planning Board for its
review and recommendation pursuant to Section 240-112 of the Zoning Law
prior to said public hearing.

WHEREAS, the Town Supervisor, as Budget Officer, pursuant to § 106 of the Town
Law, has presented the Tentative Budget to the Town Board for review, examination and
possible revision; and
WHEREAS, said Tentative Budget has been submitted to the Town Clerk on September
30, 2011, as required by law; and
WHEREAS, the Town Clerk, on October 3, 2011, has delivered the Tentative Budget to
the Town Board on accordance with Town Law § 106; and
WHEREAS, New York State Town Law § 108 requires that the Town Board must hold a
public hearing on the Preliminary Budget on or before the Thursday immediately following the
general election in November; and
WHEREAS, Town Law requires the adoption of a Final Budget on or before November

WHEREAS, in order to accomplish the Budget Adoption Schedule set forth in Article 8
of the Town Law, the Town Board hereby establishes the following tentative schedule of Town
Board Meetings set forth below, reserving unto itself the right to change the scheduled meetings
if circumstances require.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. Be it resolved that the Town Board hereby schedules the following meetings of

Resolution Authorizing the Execution of a Contract with Enviro Clean Services, LLC, for
Compliance with Petroleum Bulk Storage
(PBS)
) Regulations nath Farms for Removal of
Underground Storage
WHEREAS, the proposed contract is exempt from the competitive bidding requirements
of § 103 of General Municipal Law, as well as the Town of Wappinger Procurement Policy,
pursuant to Town Code §§46-3(A), because this is a professional service contract subject to state
licensing and/or testing requirements that requires substantial formal training; and
WHEREAS, the Town Board has determined that the authorization of this work and the
execution of the proposed contract is a Type II action thant to 6 e New York S a e Environmental 20) and is
otherwise exempt from environmental review pursuant to
Quality Review Act (SEQRA).
NOW, THEREFORE, BE IT RESOLVED, as follows:
1 _ The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby determines that it is essential that the underground
storage tanks previously located or presently located at Carnwath Farms be
brought into regulatory compliance with applicable Federal and State regulations.
3. The Town Board hereby authorizes Supervisor Barbara A. Gutzler to enter into
the proposed contract submitted by Enviro Clean, a copy of which is affixed as
Exhibit "2", subject to any modifications recommended by the Attorney to the
Town.

IX. New Business
A. Councilman Beale
Councilman Beale received an email from Dutchess County Requesting the use of Main
Meeting room and the fee of hundred dollars be waived. He asked the board if they could act on
it or do they need to go through a more formal approach. Supervisor Gutzler requested that
Councilman Beale read the email for the Board. After Councilman Beale read the email he asked
the board for unanimous consent so it could be added. He then yielded the floor to Councilman
Bettina.

B. Councilman Bettina
Councilman Bettina asked Graham Foster, Highway Superintendent, if no parking signs
could be placed on Old Post Road near Adams. The road is narrow. Mr. Foster replied that Old
Post road will be made wider to Twenty-six feet and the no parking signs would be a board
decision. Councilman Bettina next item was the consideration of using Carnwath for agriculture
purposes such as a community garden. Councilman Paoloni questioned how the water would be
supplied and how the cars would get in and out to their plots. Discussion continued.
C. Councilman Paoloni
Councilman Paoloni asked the board to consider letting Mr. IIker use his sons car for the
recycle center. He has purchased the Thirty dollar permit and this is a special circumstance. Mr.
Ilker explained he uses his son's truck for large items that do not fit in his truck. He would like a
permit for his son's truck. Highway Superintendent Graham Foster explained that in the past the
car with the permit would be followed by the other vehicle that has the larger items in it.
Discussion continued. Councilman Beale added that this is a topic for the Recycle Center
committee and to come up with a solution. Supervisor Gutzler suggested to Mr. Ilker to get in
touch with Councilman Paoloni when he needed to use the other vehicle and they would discuss
the solution.
Councilman Paoloni had a letter from a resident living near the Rail Trail stating there are
ATV's on the Rail Trail and they are having trouble getting it patrolled. Supervisor Gutzler
suggested getting a hold of Dutchess County Sherriff, Sergeant Begor.
D. Supervisor Gutzler
Supervisor Gutzler read a letter from Craig Robert, IT Consultant for the Town, stating the
server room is too hot and needs a solution. Councilman Paoloni suggested an exhaust fan.
Councilman Beale asked Mr. Gray, Engineer to the Town, to look at what was done in the TV
room to bring the temperature down.
