As W oodhill Green is a private community, the establishment of an escrow must be completed prior to the Town Engineer initiating his study, which will be an estimate of municipal capacities and costs to connect to municipal services. Based on the recommendation of the Town Engineer, the Town Board approved an escrow amount of Five Thousand Dollars ($5,000.00). You will receive a monthly statement, including invoices, to support any deductions from the escrow account. Upon closure of the matter, any funds left in balance will be refunded after an internal audit of the account. Upon approval of your Board, please issue a check payable to the "Town of Wappinger." It is recommended that the check include a notation designating such for the establishment of the sewer/water escrow account. You further advised that the Village of Wappingers Falls is currently unable to provide you with sewer and/or water services. The Town Board, at its meeting of November 18th, starting at noon, will be considering a resolution authorizing the Town Engineer to perform a preliminary desktop study which will consider the capacities of our water and sewer facilities, and provide you with an estimate of cost and practicality. While you have only requested a water connection in your letter, it is recognized that your community operates a sewer facility for which concerns also exist. It is recommended that the preliminary desktop study include a sewer connection, or that you provide the Town with advice that an alternate plan is being proposed. As the Woodhill Green Condominiums complex is a private residential community, it will be necessary that an escrow be established to fund this study. I have contacted the Town Engineer and requested his input on an amount necessary to perform this study, and such will be presented as part of the resolution deliberations at the Town Board meeting. It is recommended that a representative of Woodhill Green Condominiums be in attendance at the November 18th Town Board meeting which will start at noon. Sincerely, Christopher Colsey, Supervisor Town of Wappinger 2010-362 Resolution Authorizing the Town Engineer to Produce a Preliminary Desktop Study for Water and Sewer Connections for the W oodhill Green Condominiums At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on November 18,2010. The meeting was called to order by Christopher Colsey, Supervisor, and upon roll being called, the following were present: PRESENT: Supervisor Councilmembers Christopher J. Colsey William H. Beale Vincent F. Bettina Ismay Czarniecki Joseph P. Paoloni ABSENT: The following Resolution was introduced by Councilwoman Czamiecki and seconded by Councilman Paoloni. WHEREAS, the W oodhill Green Condominium complex is a residential community within the Town of Wappinger overseen by a Homeowners Association; and WHEREAS, Woodhill Green Condominium complex has reported water and sewer concerns from their privately maintained systems; and WHEREAS, the W oodhill Green Condominium complex has approached the Village of Wappingers Falls for water and/or sewer connections to serve the community and were currently unable to provide service; and WHEREAS, the Woodhill Green Condominium complex has petitioned the Town of Wappinger seeking advice on the ability to connect to Town facilities; and WHEREAS, a preliminary desktop study is necessary to provide the Town Board with the ability to properly respond to the W oodhill Green Condominium complex; and WHEREAS, as the Woodhill Green Condominium complex is a private community, an escrow in the amount of Five Thousand Dollars ($5,000.00) must be established to permit the Town Engineer to perform a preliminary desktop study. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board hereby authorizes the Town Accountant to establish an escrow account on behalf of the W oodhill Green Condominium complex in the amount of Five Thousand Dollars ($5,000.00). 3. The Town Engineer is authorized to perform a preliminary desktop study on behalf of the W oodhill Green Condominium complex in respect to water and sewer connections upon establishment of the escrow account. We are currently working with Lee Felshin at the Dutchess County Dept of Health on our chloride issue. When I spoke to you last, you thought that we would maybe have a chance at "hooking" into the Village of Wappingers Falls water system. Attached is a copy of a letter from the Village engineer about the Village's unwillingness to help us because it is the Village Water Commissioner's policy not to serve out of Village residents with Village water. At this time we would like to know what other avenues are available to us from the Town to be compliant with the Department of Health. We are looking forward to your response on this matter. I had a discussion with the Water Commissioners, Chairman Rob . Alfonso, Commissioner Matthew Alexander, and Commissioner Patrick Chase at the June 14th, 2010 Water Board meeting. Currently, it is the Village Water Commissioners' policy not to serve out of Village residents with Village water because: 1. As you are aware, we are in the midst of redeveloping our source, supply and treatment facilities. This is a big step for the Village, and even though we have detailed, specific hydrogeologic work on the wells and capacities of the pumping and treatment facilities, we want to assure ourselves with actual real time operating capabilities. 2. The Village is currently taking a serious look at their master plan and contemplating development of undeveloped parcels and potential redevelopment of existing built parcels in the future. Planning water capacities for that is difficult, and therefore, if the Village does face small excess, reserving capacity for those purposes would be advisable. As you are aware, the recently approved plans for the rebuild of the Village water system has a finite capacity of 700 GPM. This has been determined to be the maximum day billed out for the Village and current customers that are served out of the Village. I trust this addresses your request.
