Discussions A. Widmer Inn Restaurant Corp ( Villa Borghese) Rezoning - Gutzler David Stolman, Town Planner, explained the rezone request for the Ville Borghese. The request is for a small part of the property to be rezoned to fit the rest of the property. Mr. Stolman added that at this point he needs direction from the board to prepare the package for the Local Law. The board also needs to decide who will be the lead agency for this project. Supervisor Gutzler suggested the planning board be the lead agency for this project. Discussion continued. VII. She questioned the Grinnell Library tax that was spoke about in the minutes. Councilman Bettina explained that the residents who are in the Beacon school districts will no longer pay taxes to Grinnell Library. They will continue to pay the Beacon Library tax. He added that Mr. McCloud the attorney for Grinnell stated that it still needed to be voted on by the trustees and an adjustment will be made. Ms. Schmalz then asked for an explanation of Resolution 2011-343. Supervisor Gutzler stated it was a resolution that was previously tabled and they need to cover expenses from the summer recreation program. The next resident to speak was June Weyant. She questioned that since the Beacon tax was higher than Grinnell was there any way they could pay Grinnell and be exempt from Beacon. Al Roberts, Town Attorney, explained that the Grinnell Library was going to be creating a library district that will exclude the beacon school district from the district that will fund Grinnell. The funding for the Library is through the school district taxes. Councilman Bettina explained the history of how the exemption came about. Councilman Beale added that he just found out that the people who live outside the Beacon City School District could end up in the defined service area of Grinnell could end up paying more because the service area will be smaller and they will have to compensate for the smaller service area. He continued that the other side of the bridge in the Village of Wappingers will not be included in this district because they are paying the Mid Hudson Library tax, therefore the people included in the Grinnell Library district will be paying more. RESOLUTION: 2011-350 Resolution Adopting Local Law No. 20 of 2011 Amending Chapter 230, Vehicles and Traffic, of the Town Code Prohibiting the Overnight Parking of Heavy Commercial Vehicles on Town Roads in Residential Zoning Districts WHEREAS, the Town Board of the Town of Wappinger has determined that Chapter 230, Vehicles and Traffic, of the Town Code should be amended so as to prohibit the parking of heavy commercial vehicles on Town roads (the "Proposed Action"); and Town of Wappinger Page 4 Printed 1216/2011 Paaidnr Maatina Minutes November 14, 2011 WHEREAS, the Town Board has determined that the Proposed Action is a Type II action pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known as SEQRA) and pursuant to Chapter 117 of the Town Code (the Wappinger Environmental Quality Review (WEQR) Law which establishes locally designated Type I actions) because the Proposed Action is the enactment of a traffic regulation; and WHEREAS, Type II actions do not require any further environmental processing in accordance with the requirements oiL SEQRA and WEQR; and WHEREAS, the proposed Local Law has been on the desks of the members of the Town Board for at least seven (7) days exclusive of Sunday prior to the adoption of this resolution. Town of Wappinger Page 5 Printed 121612011 LOCAL LAW # 20 OF THE YEAR 2011 A Local Law entitled "Local Law # 20 of 2011, for the purpose of amending Chapter 230, Vehicles and Traffic, of the Town Code so as to -prohibit the overnight parking of heavy commercial vehicles on Town roads in residential zoning districts. BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section 1: Title This Local Law shall be known and cited as "Local Law #_ of 2011, for the purpose of amending Chapter 230, Vehicles and Traffic, of the Town Code so as to prohibit the overnight parking of heavy commercial vehicles on Town roads in residential zoning districts. Section 2: Legislative Intent The Town Board believes that it is reasonable and appropriate to amend Chapter 230, Vehicles and Traffic, of the Town Code so as to prohibit the overnight parking of heavy commercial vehicles on Town roads in residential zoning districts. This local law is determined to be an exercise of the police powers of the Town to protect the public health, safety and welfare of its residents. Section 3: Code Amendments 1. Section 230-16.B, Parking Prohibited at All Times, of Chapter 230, Vehicles and Traffic, of the Town Code shall be revised to read as follows: § 230-16. Parking prohibited at all times. A. No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule XII (§ 230-46), attached to and made a part of this chapter. B. No person shall park a commercial vehicle between 7:00 PM and 7:00 AM on any Town road in any residential zoning district, except in the event of an emergency. For the purposes of this section, a "commercial vehicle" shall be a vehicle which exceeds eighteen thousand (18,000) pounds in gross vehicle weight, and includes tractors, road tractor -trailers, rollers, tractor and truck cranes, power shovels, road -building machines, snow plows, road sweepers, sand spreaders, tank trailers and buses, and any other such vehicle used for, intended to be used for, registered for or potentially registered for commercial purposes. Notwithstanding the above, the following shall be exempt from this section: (1) Any police, fire or emergency service vehicle. (2) Any vehicle owned by a municipality or corporation engaged in repairs or improvements to any service provided by the Town of Wappinger or its authorized agents. (3) Any vehicle owned by a municipality or corporation engaged in repairs or improvements to any street or right-of-way maintained by the Town of Wappinger. (4) Any vehicle which is in the process of picking up or delivering merchandise or other property. (5) The temporary parking of any vehicle on a road while the driveway 'where said vehicle is normally parked is being repaved. Section 4. Ratification. Readoption and Confirmation Except as specifically modified by the amendments contained herein, the Code of the Town of Wappinger as adopted and amended from time to time thereafter is otherwise to remain in full force and effect and is otherwise ratified, readopted and confirmed. Section 5: Inclusion in Code It is the intention of the Wappinger Town Board and it is hereby enacted that the provisions of this local law shall be included in the Code of the Town of Wappinger; that the sections and subsections of this local law may be renumbered or relettered to accomplish such intention; and that the word "local law" shall be changed to "chapter," "section" or other appropriate word, as required for codification. Section 6: Renumbering The location and numerical designation of this local law and the sections included herein shall be delegated to the discretion of the codifier, General Code, which may renumber this local law and sections as are necessary to accommodate these amendments. 2 Section 7: Codification This local law shall be incorporated into the Code of the Town of Wappinger and shall be assigned a chapter number and appropriate section numbers by the codifier, General Code, in accordance with the numbering system of the Code. Section 8: Codifier's Chances This local law shall be included in the Code of the Town of Wappinger. The codifier shall make no substantive changes to this local law, but may renumber, rearrange and edit it without first submitting it to the Wappinger Town Board. Any such rearranging, renumbering and editing shall not affect the validity of this local law or the provisions of the Code affected thereby. J-11 Section 9: Separability The provisions of this Local Law are separable and if any provision, clause, sentence, subsection, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or parts of this Local Law or their petition to other persons or circumstances. It is hereby declared to be the legislative intent that this Local law would have been adopted if such illegal, invalid or unconstitutional provision, clause, sentence, subsection, word or part had not been included therein, and if such person or circumstance to which the Local Law or part hereof is held inapplicable had been specifically exempt there from. Section 10: Effective Date This Local Law shall take effect immediately upon adoption and filing with the Secretary of State as provided by the Municipal Home Rule Law. 3 Rnaidnr nnocatina Minutes November 14, 2011 RESOLUTION: 2011-351 Resolution Authorizing Refund of Unused Post Planning Escrow for Friendly Motorcars Site Plan (Account 10-6020PP) WHEREAS, on or about August 6, 2010, Michael Ostrow, President of MDA Associates, on behalf of Friendly Motorcars (hereinafter the "Applicant") made a deposit in the amount of Five Thousand Dollars ($5,000.00) into an escrow account with the Town of Wappinger in connection with post planning review for site plan approval under Application Number 10-6020 PP; and WHEREAS, additional deposits in the amounts of Five Thousand, Four Hundred Sixty Dollars and 50/100 ($5,460.50), Ten Thousand Dollars ($10,000.00) and Fourteen Thousand, Three Hundred Fifty -One Dollars and 32/100 ($14,351.32) were respectively made on March 2, 2011, April 11, 2011 and June 16, 2011; and WHEREAS, the site plan application was approved and the Resolution of Approval was signed by the Planning Board Chairman on July 15, 2011; and WHEREAS, all professional fees incurred during the review of the application have been paid and a balance of One Thousand, One Hundred Eighty -Four Dollars and 92/100 ($1,184.92) remains in escrow account number 10-6020 PP and Applicant has requested a refund of said unused escrow balances; and WHEREAS, the Town Accountant has audited the escrow account and has verified the amount due to the Applicant. RESOLUTION: 2011-354 Resolution Adopting Annual Budget for Year 2012 WHEREAS, on November 9, 2011, the Town Board, pursuant to and in accordance with the provisions of Section 106 of the Town Law and other applicable provisions of law, adopted the Preliminary Budget, by verbal Resolution on October 24, 2011 and WHEREAS, in accordance with verbal Resolution on October 24, 2011a Public Hearing on the Preliminary Budget was held on November 9, 2011 at 6:30 p.m. and all parties in attendance were permitted an opportunity to speak on behalf or in opposition to the proposed Annual Budget for the fiscal year 2012; and WHEREAS, the Town Board has taken into consideration the comments made by the public at the Public Hearing. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. Pursuant to and in accordance with the provisions of Section 109 of the Town Law and other applicable provisions of law, the annexed detailed statement of expenditures and revenues of the Town of Wappinger is hereby approved and adopted as the Annual Budget of the Town of Wappinger for the fiscal year beginning January 1, 2012. 3. The Town Clerk is hereby directed to enter the Annual Budget adopted herein in the minutes of the Town Board. 4. The Town Board further directs that the amounts identified in the Annual Budget adopted herein shall be appropriated.
