Public Comment
Christian Paggi spoke on behalf of Villa Borghese. He stated that the Villa Borghese wanted to
add one and a half acres to the back of the property for parking. He added that the zoning for the
Cranberry Hills property is zoned R20 and Villa Borghese is NB. In order for the site plan go
through it would have to be rezoned.

VII. Discussions
Councilman Beale
Councilman Beale gave an update on the status of the sign in front of Town Hall. He stated that
the sign is up and is just missing the seal that is being created. Steve Frasier, Supervisor of
Building and Grounds, is in touch with the electrician to have it tied into the power. He also
added that additional letters may need to be purchased so that there will be enough letters.
Councilman Bettina
Councilman Bettina state that he wanted to put Councilman Czamiecki in touch with Jonah
Mandlebaum. He is purposing to bring in Affordable Senior housing and since the property is in
her area he wanted to inform her.

Public Comment
The first resident to speak was Gary Lindstrom. He inquired about the resolution that was tabled
at the last meeting. He stated that it was not tabled to a specific date and wanted to know when it
would be discussed. He also stated that he believed the board needed to appoint a Deputy
Supervisor that was not done at the reorganization meeting and he didn't see it on the agenda.
Supervisor Gutzler stated that the appointment was a late resolution and would be coming from
the dais. She added that the tabled resolution was tabled without a date and it might have been
the intent to table it indefinitely. She referred to the board for help. Al Roberts, Town Attorney,
explained that the board motions to table a resolution, then in the future, motions to un table and
therefore the resolution resurrects itself for reconsideration by the board.
The next resident to speak was Mary Schmalz. She questioned two vouchers. Supervisor
Gutzler stated that she would have to go back and look since it was a month old. Graham Foster,
Highway Superintendent, explained that he thought that the one voucher in questioned was for
the Highway Department.

IX. Resolutions
RESOLUTION: 2012-46
Resolution Adopting Proposed Amendment to Town Comprehensive Plan (Villa Borghese)
WHEREAS, the Town Board is considering an amendment to the Town Comprehensive
Plan for the purpose of adding property to the Commercial designation; and
WHEREAS, the subject property is part of Tax Parcel 6158-04-951382, which is located to
the rear of the Villa Borghese parcel on Widmer Road (the "Subject Property"); and
WHEREAS, for the purposes of the New York State Environmental Quality Review Act
(SEQRA), the Proposed Action is the rezoning of the Subject Property, an amendment to the Town
Comprehensive Plan regarding the Subject Property, site development plan approval for the
improvement of the Subject Property as an additional parking area for Villa Borghese, and a lot line
realignment to add the Subject Property to the Villa Borghese parcel; and
WHEREAS, the Proposed Action is a Type I action under the Wappinger Environmental
Quality Review (WEQR) law and the Town of Wappinger Planning Board has declared its intent to
become the Lead Agency for the Proposed Action in accordance with SEQRA; and
WHEREAS, on January 4`", 2012 the Planning Board, as Lead Agency, issued a Negative
Declaration with respect to the Proposed Action, thereby ending the SEQRA process.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board hereby adopts and incorporates the recitations and statements set
forth above as if fully set forth and resolved herein.
2. The Town Board of the Town of Wappinger hereby adopts the Proposed
Amendment to the Town Comprehensive Plan dated December 7, 2011 in the form
annexed hereto; except as specifically modified by the amendments contained
therein, the Comprehensive Plan as originally adopted is to remain in full force and
effect and is otherwise ratified, readopted and confirmed.

RESOLUTION: 2012-45
Resolution Adopting Local Law —of 2012 Which Would Amend the Town's Zoning Map
for the Purpose of Rezoning Property to the Neighborhood Business (NB) Zoning District
WHEREAS, the Town Board is considering the adoption of Local Law No. 1 of
2012 that would amend the Zoning Map of Chapter 240, Zoning, of the Town Code for the
purpose of rezoning property to the Neighborhood Business (NB) zoning district; and
WHEREAS, the property to be rezoned is part of Tax Parcel 6158-04-951382,
which is located to the rear of the Villa Borghese parcel on Widmer Road (the "Subject
Property"); and
WHEREAS, for the purposes of the New York State Environmental Quality Review
Act (SEQRA), the Proposed Action is the rezoning of the Subject Property, site
development plan approval for the improvement of the Subject Property as an additional

RESOLUTION: 2012-51
Resolution Authorizing Loan from the Town's B Fund to Pay for Highway Department
Operations
WHEREAS, the Town's Accountant has advised the Supervisor that the Town has not
received the CHIPS reimbursement for the 2011 financial year; and
WHEREAS, the Town's Accountant has been informed that the NYSDOT will not
process the CHIPS reimbursements until on or about March 15, 2012; and
WHEREAS, real property tax revenues for fiscal year 2012 have yet to be received by
the Town; and
WHEREAS, in consequence of not receiving CHIPS reimbursement by the close of
fiscal year 2011, there are insufficient funds in the operating account for the Highway
Department to pay for Highway Department operations; and
WHEREAS, the Accountant to the Town has advised that the Town's B Fund has funds
available to loan to the Highway Department account; and
WHEREAS, the Town's Accountant recommends borrowing the sum of $150,000.00
from B Fund to pay for the operating expenses of the Highway Department, which loan will be
repaid upon the Town's receipt of the CHIPS reimbursement funds from NYSDOT, or upon
sufficient receipts from the 2012 real property tax levy.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby authorizes a loan from the Town's B Fund to the
Highway Department operating account to pay for Highway Department
operations pending receipt of the CHIPS reimbursement funds from the
NYSDOT, or in the alternative, pending sufficient receipts from the 2012 real
property tax revenues.
3. The loan from B Fund to the Highway Department Operating Account shall be
repaid to the B Fund on the earlier occurrence of either the receipt of the CHIPS
reimbursement funds from NYSDOT, or upon sufficient receipts from the 2012
real property tax revenues.
