Appeal No. 09-7390
Brett & Toni Ann Slal!le- Seeking an area variance of Section 240-37 of
District Regulations in an R-20 Zoning District.
- Where a rear yard setback of 40 feet is reQuired, the applicant is
proposinl! a rear yard setback of 12 feet. to allow for a 18' X 33' above
ground pool with surrounding deck (10' X 24 '), thus reQuestinl! a variance
of 28 feet.
The property is located at 4 Carroll Drive and is identified as Tax Grid No.
6257-02-952622 in the Town of Wappinger.
Mr. Prager:
I did a site visit today already and was very impressed
with your drawings.
Mr. Slagle:
I've enclosed a survey to show that I have two
easements on my property. One is because of the creek
running through and the other is a sewer easement in
the front of my house which is why they built my house
so far back. Now there really is no room for a pool
with setbacks and I really have no other option. I
would also like a wrap around deck so that I can
monitor my children.
Ms. McEvoy-Riley: Do your neighbors have pools?
Mr. Slagle:
Yes and there was a pool on my property when I bought
my home.

Mr. DellaCorte:
Who will be building your deck?
Mr. Slagle:
I believe I will. In order to save money and because I
want to pick out good materials.
Ms. McEvoy-Riley: This looks like it is a tough lot.
Mr. Prager:
I will schedule the site visit for this Saturday, March
14th and your public hearing for March 24th.
Mr. Slagle:
Thank you.
