Public Comment
The first resident to speak was Sal Credendino. He read into the record a letter that he wrote
sighting Bill Farrell's accomplishments and expressing the fact the he is in favor of renaming
Robinson Lane to William T. Farrell Memorial Fields. The next resident to speak was Joe
Ruggiero, past Supervisor of the Town of Wappinger. He stated that he wanted to echo the
statement of Mr. Credendino. He stated that when he was supervisor he would say that recreation
was the one area where the town became a community. No other program better symbolizes
recreation better than Little League and no person better symbolized Little League better than
Bill Farrell. Bill Farrell and other coaches volunteered their time to build the fields and the
program. For forty years Bill Farrell was there. He added that Bill Farrell lead the championship
around the state which got Wappinger noticed for what was accomplished here. He stated that
the board could do what cannot be done individually. They could collectively express the love
and the appreciation by renaming the ball facility in his honor. There are ball fields named after
children who played on them, that at their untimely death, the community came together and felt
it needed to recognize them. He added that the community, the children and the program are at
the meeting and the board represents them. The board is authorized, the precedent is there and
they have a petition of 781 signatures in favor. He stated that in his fourteen years as Supervisor
he has never seen a public petition with that many signatures on it. He continued stating he is
asking the board to amend the agenda one more time and rename the park William T. Farrell Ball
Field at Robinson. It will take another 40 years before another person's services will come up the
level of Bill Farrell. He asked the board for their support.

1. Grinell Library
Jennifer Gonzales presented the board with draft legislation for the Grinnell Library association
to become a Special library district and a draft letter of Home Rule that can be use and tweaked
to how the board see fit if they do approve the pursuit to becoming a special library district.

Roderick J MacLeod explained that the library was a trustee library and has explored becoming a
public library district where the board of trustees is elected and there is a specific district which
the library covers. The legislation given to the board would include the entire Town of
Wappinger except those who pay Beacon library taxes. Additionally it would include the entire
Village including the Town of Poughkeepsie side. They would like to have this submit to the
legislator by the spring so they can have the vote on the creation of the district, election for
trustees and the approval of the purposed budget in the fall. He added that it doesn't require a
home rule letter from the board but they would rather go forward with the board support as
opposed to without it. Supervise Gutzler asked how soon do they need a decision. Mr. MacLoed
stated as soon as possible. He added he is not expecting a vote tonight. Councilwoman
Czarniecki questioned how the funding would change if it became a Library district. Mr.
MacLoed explained that the funding that is in place now, the 414 funding, would continue. The
proposition that would be put before the voters would have three components', first to create the
Library district, the second to create a board of nine trustees, and the last would be to approve a
budget. If any of those do not pass than the 414 funding continues, if it all passes then it would
begin in January 1St 2013. The budget would be included in the Towns 2013 budget.
Councilwoman Czarniecki then asked how the Library budget is established. Mr. MacLoed
stated that the total budget is about $660,000.00 and they don't expect to get $30,000.00 that is
usually gotten from the village, once it becomes part of the district. He added that they will be
trying to make sure that the Town of Poughkeepsie contribution stay in place and that they will
also be doing fund raising. Councilman Beale asked if the funding goes through will the Library
still receive funding from the Town of Poughkeepsie. Mr. MacLoed responded yes. Councilman
Beale stated that the proportional expenses are not in proportion and he hopes this is heading in
the right direction. He added that he was happy that the Town of Poughkeepsie side was included
but would like to see the Sheafe Road area and the New Hamburgh area included also. Mr.
MacLoed stated that those areas are a very small portion and are included in the Poughkeepsie
Library which would mean that the Poughkeepsie Library would have to give them up and they
would not. Councilman Beale asked if there was any funding received from the Mid Hudson
Library System. Ms. Gonzales stated that other than services they don't. She explained that they
pay for delivery of service. For each item a patron checks out that was send from another library,
Grinnell absorbs the cost. Being part of the Mid Hudson Library system is a give and take for
each community. Councilwoman Czarniecki wondered if they had any idea who was
predominately using the library. Ms. Gonzales explained that they do know but the problem with
using zip codes is that they don't necessarily live in the Town of Wappingers if they have a
Wappinger zip code. Councilman Bettina stated he thought it was important to know who was
using the library. Councilman Beale asked what the impact per parcel would be. Mr. MacLoed
stated that he did not know yet. If this proposal passed the board of the Library would become
the taxing authority and the budget will have to be approved each year. Councilman Bettina
thanked Mr. MacLoed for transparence and the fairness. Supervisor Gutzler recommended the
board email any comments to Mr. MacLoed.
2. Petition Regarding Honoring William Farrell
Supervisor Gutzler stated she put this item on the agenda to acknowledge the petition that were
submitted and that the board will act on this by March 12th. Councilman Beale stated although he
did not know Bill Farrell he can see by the amount of the people that came out and the number of
petitions, that he certainly had an significant impact on the little league organization. He added
he looks forward to having open communications, to move forward and hopes to have good news
at the next meeting. Councilman Bettina stated that he knows the contributions that Bill Farrell
made and thanked the residents for coming out. He added that there are other fields named after
other people and that the board will take that into consideration. He added he is sure the board
will make the proper decision.
3. Recreation Field Fee Schedule
Supervisor Gutzler ask Mr. Price, Recreation Director, to explain the schedule. He stated that the
fees have not been increased. They removed a multiple use discount. Councilwoman Czamiecki
stated that she appreciated the fact that the fees have not gone up but was concerned that he cost
of operate has gone up. She wondered what the other towns were charging. Mr. Price stated that
he did call around to other towns and everyone is around the same charge. Some towns charge
more for non residents. Councilman Bettina stated he asked Mr. Price for the cost analyst and he
would like it by next meeting. Supervisor Gutzler asked the board if they were prepared to adopt
the fee schedule. She recommended to the board to adopt the schedule and amend it if Mr. Price
shows that they are losing money with the lights. Councilman Beale added he didn't know how
they are going to make money or break even by looking at the cost of the lighting.
Councilwoman Czarniecki suggested putting a premium on the light usage. She then questioned
how the lights get turned on and off. John Sullivan, Building and Grounds employee explained

that they can be manually turned on and automatically turned off. Supervisor Gutzler asked Rob
Wilson, president of Little League, for his comments. Mr. Wilson stated that he thought the
board was on the right track with the fee schedule but he felt that the board is going to find out
that the fee for the lights should be more like Two Hundred dollars for a night game. Councilman
Kuzmicz made the motion seconded by Councilman Bettina to increase the fee to Two Hundred
dollars. Councilman Bettina stated that he doesn't want non residents to use the field and the
residents that he represents have to pay for it. Mr. Price added that the fees collected are from
three users and that the bulk of the users are Little League. Mr. Wilson stated that with better
scheduling and the combined organization of Mark Price, Steve Frasier and John Sullivan the
town has the potential to do better than break even. He stated that more tournaments could be
scheduled. Councilman Bettina stated that this facility is a premium and it should be paid for. He
thanked Mr. Wilson for his honesty. Resident Roland Norris asked how much money was
collected for the lights last year and if any money was collected from the tournaments. He stated
that there were two tournaments that ran from Friday night to Sunday. He suggested that the
board look at the money collected to pay for lights before raising fees. Councilman Kuzmicz
stated that the board should adopt he fee schedule and revisit it at a later date. Councilman Beale
stated that at a later date he would like to meet with Roland Norris and Former Supervisor
Ruggiero to discuss nontraditional revenue in particular the ads that were along the fences. There
was an initiative to create revenue by selling ads along the fence. He would like to revisit that
idea.

4. Recall Season Employee
Steve Frazier, Building and Ground Supervisor, stated that a seasonal employee has given him
notice that he will be moving out of the area and will not be returning back to work. Mr. Frasier
was advised by the payroll clerk that the employee should be called back to work and then
should resign in order to terminate the unemployment obligations. Al Roberts, Town Attorney,
stated that this was the first he was hearing about it and does not have enough information to
respond. Councilman Beale suggested the matter be discussed in executive session with the labor
attorney that was at the meeting.
5. Restoration of Electricity to Martz Field
Supervisor Gutzler read part of the memo that Steve Frazier, Buildings and Grounds Supervisor,
sent to the board informing them of the power outage at Martz Field, Mr. Frazier stated that the
guide wire that supported the electrical line has rotted off at ground level. Central Hudson will
not restore power until it is fixed. He had gotten a quote that it will cost about1500.00 to fix. It
requires a special truck with a drill to put the stake in the ground. He added he doesn't have any
money in his budget. He continued stating that there is quite a bit of vandalism in that part and
when he spoke to the sheriffs the first thing they suggested was to get the lights working again.
Councilman Beale asked the Town Attorney if it was considered an infrastructure repair. Al
Roberts, Town Attorney, stated that it was. Councilman Beale suggested the use of park land
trust funds. Al Roberts questioned if the line should be underground. The board agreed
underground would be best. Councilman Beale asked if Mr. Frazier could get the board a
proposal by the next meeting. Councilman Bettina questioned how long the trench will need to
be and if Graham Foster, Highway Superintendent had a back hoe that could do the job. Mr.
Foster stated that they could dig the trench. Mr. Frazier added that he will present the quote to
the board at the next meeting.
Statement from County Legislature Donna Bolner
Donna Bolner, Dutchess County Legislator, stated that March 5`h is the start of the budget

meetings with the budget director, as opposed to November so she will be able to keep the
Towns apprise of the budget. Other obstacles' in the County are the voting, revisiting electoral
district and redistricting at the county, which will affect the towns. Councilman Beale added he
would like Legislator Bolner to convey to her colleagues that he doesn't know how the town can
continue with the unfunded mandates like Dial a Ride and the election charge back formula. He
added that it still does not make any since to him. The commissioner of the Board of Elections,
Erik Haight, was at the last meeting and stated that there will be an increase with the added
primary in 2012. He stated that the residents of the town cannot afford the increases. Legislator
Bolner stated that all the towns are conveying the same message. Unfortunately the towns have
mandates, the county had mandates and it all gets passed down. Supervisor Gutzler thanked
Legislator Bolner for coming and setting an example of the cooperation between the County and
Town Government.

RESOLUTION: 2012-101
Resolution Authorizing Use of Schlathaus Park for the Town of Wappinger Community
Day Ceremony
WHEREAS, the Town of Wappinger Recreation Department will be sponsoring and
coordinating the Town of Wappinger Community Day Ceremony to be held on Saturday, June
30, 2012; and
WHEREAS, the Town of Wappinger Recreation Department requests the use of
Schlathaus Park for the Town of Wappinger Community Day Ceremony and to expend required
funds therefore.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby authorizes the use of Schlathaus Park on Saturday, June
30, 2012 for the Town of Wappinger Community Day Ceremony, under the
direction and management of the Town of Wappinger Recreation Department.
3. The Town of Wappinger Recreation Department is authorized to expend funds
not to exceed the sum of Ten Thousand Dollars ($10,000.00) for entertainment,
fireworks, facility supplies and tenting. Said funds are to be paid out Budget Line
A7550.400. The event budget is exclusive of payroll for staff working the event
which is separately budgeted in the respective payroll line items.

RESOLUTION: 2012-102
Resolution Authorizing Refund of Application Fee Paid in Connection with Change of
Occupancy and Operational Permits
WHEREAS, Gjerj Shala, owner of Shear Success (hereinafter the "Applicant"), paid an
application fee of $500.00 for a Change of Occupancy Permit; and
WHEREAS, the application fee for the Change of Occupancy Permit was only $250.00
resulting in an overpayment of $250.00; and
WHEREAS, the overpayment of $250.00 for the Change of Occupancy Permit fee was
to be applied to cover the Applicant's Operational Permit fee which would have been due in
August of this year; and
WHEREAS, by letter dated December 16, 2011 to Hon. Barbara Gutzler, the Applicant

has advised the Town Board of his intention to close the business and not apply for the
Operational Permit, and requests the return of the overpayment in the amount of $250.00.

RESOLUTION: 2012-103
Resolution Introducing Local Law_ of 2012 Which Would Amend the Zoning Map Based
Upon the Town Comprehensive Plan for the Purpose of Rezoning Properties to the R-40,
R-40/80 and R-80 Zoning Districts
WHEREAS, the Town Board of the Town of Wappinger has determined that the
Zoning Map should be amended based upon the Town Comprehensive Plan; and
WHEREAS, the Town Board is considering the adoption of Local Law _ of 2012
which would amend the Zoning Map of Chapter 240, Zoning, of the Town Code for the
purpose of rezoning properties to the R-40, R-40/80 and R-80 zoning districts; and
WHEREAS, the Town Board prepared a Draft Generic Environmental Impact
Statement (DGEIS), a Final Generic Environmental Impact Statement (FGEIS), a
Supplemental Draft Generic Environmental Impact Statement (SDGEIS), and a
Supplemental Final Generic Environmental Impact Statement (SFGEIS) regarding the new
Comprehensive Plan and Associated Zoning Changes (the "Proposed Action"); and
WHEREAS, the Town Board prepared and adopted a Findings Statement regarding
the Proposed Action, thereby completing the State Environmental Quality Review Act
(SEQRA) with respect to this matter.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The Town Board hereby adopts and incorporates the recitations and
statements set forth above as if fully set forth and resolved herein.
2. The Town Board of the Town of Wappinger hereby introduces for
consideration of its adoption proposed Local Law —of 2012 in the form
annexed hereto; except as specifically modified by the amendments contained
therein, the Zoning Law as originally adopted and amended from time to time
thereafter is to remain in full force and effect and is otherwise ratified,
readopted and confirmed.
3. The Town Board hereby schedules a public hearing regarding the adoption of
the annexed proposed Local Law —of 2012 for 7:30 PM on the 26th day of
March 2012 and the Town Clerk is hereby directed to publish notice thereof
in the Town's official newspapers not less than ten (10) days prior to said
public hearing date.
4. The Town Board hereby directs the Town Clerk to act as follows with respect
to the proposed Local Law:
a. To serve a copy of this resolution, the annexed proposed Local Law,
and the public hearing notice to the municipal clerk of each abutting
municipality not less than ten (10) days prior to said public hearing;
b. To serve a copy of this resolution, the annexed proposed Local Law,
and the public hearing notice to the Dutchess County Department of

Planning and Development for advisory review in accordance with

New Business
Councilman Beale
Councilman Beale asked David Stolman, Town Planner, to update the board on the Senior
Housing Overlay process. Mr. Stolman explained that the series of zoning map changes are the
third and final zoning map changes. The next step flowing from the Comprehensive plan is the
senior over lay zone.
Councilman Kuzmicz
Councilman Kuzmicz introduced John Flanagan, President of the Sports Museum of Dutchess
County. Mr. Flanagan explained the memo he sent to the board requesting to use the Chapel.
They are planning on having an Auto Racing Display and would need the Chapel for a lecture by
Roger Liller on Auto Racing in Dutchess County. They would also like to park stock cars around
the flag pole. He added he would like to use some chairs and tables if possible. Supervisor
Gutzler asked Steve Frasier the condition of the area. He stated it should be ok. Councilman
Bettina asked about the event with Tracy Patterson. Mr. Flanagan stated that the year is filled
with different events they are trying to coordinate at the Sports Museum. Councilman Beale
made a motion to allow the Sports Museum of Dutchess to use the Chapel and parking lot,

Supervisor Gutzler
Supervisor Gutzler explained to the board that in 2008 the town was told not to send the well
testing data to the county because they didn't have the personnel to process the data. The Town
should just hold on to it and if they needed it they would ask for it. Supervisor Gutzler stated that
she received a call from the County Health Department asking why the Town has not been
sending the well testing reports. They are now requesting all the data be entered in to a spread
sheet on a disk to be sent to the County. The Town must enter the data for the 273 wells test at
10 pages per report. She considers this to be an unfunded mandate. She added that the Town
does not have money for comp time over time or the extra personal to comply. She stated that
communication broke done in the Health Department and the Town is bearing the brunt of it. She
asked County Legislator Bolner convey her opinion to the County Legislators. She asked the
board to consider using a volunteer to enter the data for community service credits. Because the
tests are listed by grid number there will not be any breech of confidentially. Al Roberts, Town
Attorney, stated that he was involved with drafting the law and believes that there was
correspondence stating not to send the reports to the county. He believes that the Town would

only have to send the copies of the reports. He questioned why the Town doesn't just send the
reports for them to enter. Supervisor Gutzler stated that the County came in and said the Town
had to enter the data. Councilman Beale stated that it was Local Law No. 8 of 2007 and the Law
says that the information will be on file with the Building Department and the Health
Department. He added that the impression he had was that it was not the responsibility of the
town to file it; it was the responsibility of one of the parties involved in the sale. He went to the
County website and there are three towns listed on the site that have mandated well testing
Wappinger, Fishkill.and East Fishkill. Fishkill has none listed, Wappinger through 2008 and East
Fishkill is over a year out of date. He stated that he believes there is a problem with the County
not the Town. Al Roberts, Town Attorney, stated that the town was prepared to have the
recording as a predicate to anyone receiving internal information regarding zoning violation,
code violation or C.O violations. They wouldn't be prepared unless the report was on file.
Initially it was going to be sent to the County, but then the Town was told they didn't have the
ability to digest the information. He questioned on what basis are the county was requesting the
data. Supervisor Gutzler stated that the Health Department is stating the Town has to do it.
Discussion continued.
Supervisor Gutzler stated that the board had on the dais a letter from the Justice Court requesting
to keep Jennifer Prophe covering until April. The funds are being transfer from 1110.104A to
1110.109A. Councilman Bettina made a motion to accept second by Councilman Beale.
