The Rgular; Monthly Meeting of the Town Board of the Town of
Wappinger was held on August 14, 1972, at the Town Hall, Mill
Street, Wappingers Falls, New York.
Supervisor Diehl called the meeting to order at 8:14 P.M.

Mr. Zak, 7 Dorothy Heights had requested to speak before the
Board as a representative of ATAC (Area Taxpayers Against` 6ommer'=
cial). Mr. Lak wished the Board to clarify the set policy and the
rules for handling zoning requests. His particular interest in the
present rezoning of residential property to commercial in Tak`Map
#38. He felt this request was being handled differently than
others. He asked if a site plan shouldn't be presented to 'the

Town Planning Board or to the Town Board with this,request. He
veered to another subject, stating that he had heard that the
Sparkle Plenty Car Wash was asking the Vil=lage of Wappingers Falls
for a variance so that they might install gas pumps at their car
wash. Residents in the immediate area were concerned that there
would be fire hazards, higher insurance rates for themselves, and
also a possibility of gas leakage into their water supply. He
asked the Board to send its recommendations to the Village Board
stating, in behalf of the Town residents, their feeling of these
gas pumps right on the border of New Hackensack Road and Imperial
Boulevard. Mr. Rappleyea answered Mr. Zak as to what the require-

ments are, for instituting a zoning change. There was further
discussion between Mr. Rappleyea, Mr. Zak, Mrs. Hickman and Mr. &
Mrs. Warren Martin on this rezoning request.
Mr. Clausen commented that the Town Board has had correspondence
from the Planning Board in the past whereby they have asked the

Town Board not to forward rezoning requests unless they have pro-
perty boundaries and/or a site plan from which they may act. He
thinks the Board was remiss in passing this particular one to the
Planning Board without any other document, (nothing that was pro-
posed). In further action this evening at the Public Hearing, he
pointed out that Mr. Diehl"stated that the Board more or less denied
a rezoning request simply because the site plan was not submitted
and the Planning Board denied the request simply because there was
no site plan submitted. We told Mr. Totten if the Board denied
his request , he would have to come before the Town Board again
through the Planning Board. He suggested, since the Board knows

nothing of what Mr. Logan expects to do, that the Town Board
should direct a letter to the Planning Board asking them to hold
up any further consideration of this matter until Mr. Logan has
submitted to the Town Board a definite plan or proposal as to
what he wants to do in that rezoning. This, he thought would be
consistent in possibly setting a new policy whereby the Board has
a little bit closer control as to what is happening in the Town.
He stated he offered -this as a motion.
Me. Saland said he had assumed the Board had established this
policy earlier with Mr. Totten, when Mr. Diehl had said he was
committed to allowing Mr. Totten a commercial rezoning, and Mr.
Saland had said at that time that he didn't think the Board should
give it to him until he submitted a plan to the Planning Board
as requested by the Planning Board in their letter of June 7. He
thought the Board already had the policy, and he assumed, and he
thoguht it was the common understanding at that point, that that
was to be the Board's policy. Mr. Clausen said the point was that
he was following through with that policy, since the Board does
not have anything from Mr. Logan as a site plan, being consistent
asking the Planning Board not to consider anything further upon
this subject until Mr. Logan, as well as anyone else, submits a
definite site plan as to which can be acted upon. Mr. Saland's
argument was that this was already on the record, to make this a
matter of policy, by his motion during the public hearing. Mr.
Clausen reiterated, that this was to verify this again by sending
a letter to the Planning Board to this effect. Mr. Clausen sub-
mitted his motion again, to which Mr. Jensen took exception, point-
ing out that possibly, as Mr. Clausen stated, the Board has been
remiss in the past in not demanding from a petitioner a site plan.
Site plan is really not enough to satisfy everybody, since there
are stages in this. It would seem to him that any land owner in
the Town has a right to petition the Board, and it does not seem
to him that once the Planning Board receives the application from
the Town Board for review that it's fair for them to ask for a
plan and to keep prolonging the due processes, let it go through
the proper procedures and deny, or accept, on the merits of what
is before the Board. Discussion ensued again, generally pointed
at the Logan rezoning request.
MR. CLAUSEN moved that the Town Board direct a letter to the
Planning Board asking them not to act favorably upon the rezoning
request from Gutmann, Gutmann, Logan & Milner until and unless
there is a definite plan that they can act upon and recommend
upon its own merits.

The private Annual Audit of the Town's finances, for the year 1971,
had been submitted by Frank Manning R.P.A.
MR. CLAUSEN moved to accept and place on file Mr. Manning's Audit
Report.
Seconded by Mr. Saland.
Motion Unanimously Carried
Mr. Saland called attention to exhibit C of Mr. Manning's report
which contains the Audit Analysis. There are a number of things
contained in this exhibit he thought warranted serious consideration
of the Board. The Board should make an effort to comply. Mr. Diehl
commented that he would later in the meeting bring up the matter of
Comptroller or full time bookkeeper.
A letter was received from Russell R. Reinhard, President of the
Cedar Hill -Pine Ridge Civic Association, which recommended several
guide lines for preparing long-range plans for modifying the Town
Zoning Ordinance.
MR. DIEHL moved that Mr. Reinhard's letter be received and placed
on file.

Mr. Jensen, with the mention of the Town of Wappinger Zoning
Advisory Committee in Mr. Reinhard's letter, commented that there
had been no meetings during the summer of this Committee and he
again mentioned that if there were any residents interested in
serving on this Committee to submit their name, as this Committee
is trying to regroup.
A letter was received from John M. Coulter, Jr. Attorney, repre-
senting Mr. & Mrs. George Best. The complaint was regarding noise
created by barking dogs owned by George VandeCarr. Mr. Coulter,
being present, stated that George VandeCarr harbors approximately
forty dogs on his property. He also mentioned a letter signed by
a number of other residents in the immediate area voicing the
same complaint. He asked that the Zoning Administrator take what-
ever action can be taken on the Zoning Ordinance to give his clients
whatever relief they are entitled to.
Mr. Diehl, in answer to Mr. Coulter, commented that he had already
spoken to the Zoning Administrator in this regard. She had informed
him then that the VandeCarrs are legally non -conforming. He had
indicated to Miss Pike that he would offer it to the Board to direct
her to investigate, along with the Attorney to the Town for a report
back to the Board on their findings.
MR. DIEHL moved that Miss Pike be directed to investigate, in coop-
eration with Mr. Rappleyea, the complaint of Mr. & Mrs. Best regard-
ing the dogs belonging to the Vande Carrs, and report their findings
back to the Board.
Seconded by Mr. Clausen.

Mrs. Snowden informed the Town Board that she had received the
resignation of John C. Biasotti from the Recreation Commission.
Mr. Holt commented that he had spoken to Mr. Maurer, Chairman
of the Recreation Commission for his thoughts on a replacement

for Mr. Biasotti. He learned that the Recreation Commission is
going through their survey replies in hopes of finding a replace-
ment for Mr. Biasotti. The Board expects to be able to forward
recommendation for a replacement in the near future.
MR. HOLT moved to accept Mr. Biasotti's resignation, with regret,
and direct a letter be sent to express the Board's appreciation
of his work.

A letter was received from Herman Osten, publisher of the Southern
Dutchess News, asking that the Press be notified of Special Town
Board meetings.
MR. HOLT moved that the Town Clerk advise Mr. Osten of any Special
Meetings of the Board in time to send a representative.

Requests were received from both the members of the Town Planning
Board and the Town Zoning Board of Appeals to attend the Planning
Federation Convention at Kutshers Country Club, Monticello, New
York, October 15 through October 17, 1972.
MR. DIEHL moved that permission be granted to any member of the
Planning Board or Zoning Board of Appeals wishing to attend the
Planning Federation Conference October 15th through October 17th,
1972, and that their legitimate expenses be Town charges.

A letter was received from Joseph D. Aivaz, Helen Drive, regarding
a drainage problem, and the subsequent flooding of his property
and basement as a result. He claims that the flooding of his
house was directly attributable to the inadequate drainage system
installed in the Quiet Acres development. He was further concerned
about the loss of personal property due to this flooding condition,
attributable to the storm of July 8, 1972. Mr. Aivaz was present,
and addressed the Board regarding his complaint. He had, in the

past, asked that action be taken, and now, he is asking that the
Board at least determine the adequacy of the drainage system within
the Quiet Acres Area, and in particular, the drainage system as it
applies to his residence. He has experienced, within a one year
period, flooding conditions to his house. As a result of the storm
Doria last year, he suffered considerable damage to real and personal
property. He stated that the second occasion did not cause as severe
a loss to personal property as the first, bur he did suffer some
personal loss. He wished to know the Town's postion on reimburse-
ment of Such loss as it applies to his condition or situation, and
the Town's position of reimbursement of other residents of the Town.
Mr. Horton stated that the last time he was called, it was a question
of whether or not a basin top was plugged over with grass. He went
to see it while it was raining to see whether the pipe took the
water or the top of the basin itself was plugged, but could not
ascertain what the cause was. The only other thing he could
recommend would be that the Engineer to the Town should figure the
drainage area to see if the pipe was adequate.
Mr. Rappleyea, regarding the personal property loss, stated that
in order for the Town to even consider it, accepting a claim under
the provisions of Section 50eq of General Municipal Law the verified
claim must be filed with the Town within 90 days of the occurrence.
Mr. Diehl informed Mr. Aivaz that he would recommend that the Engineer
to the Town investigate and study the drainage problems to see if it
is capable of taking the overflow. Mr. Diehl directed Mr. Lapar to
get together with Mr. Horton and Mr. Aivaz and report back to the
Board his recommend ation.
A letter was received from Carl H. Swenson, New Hackensack Road,
seeking permission to remove some piles of dirt from his property,
which he claimed were left over from his original mining operation
of several years ago.
MR. DIEHL moved that Mr. Swenson's request be referred to Mr. Lapar
and Miss Pike to investigate and determine the extent of the pile
of dirt in question arid''. secure h. tabographical mapfor determination

as to compliance with the original mining permit, and report their
findings back to the Board.

Portion -VA Hospital
Reservation, Castle Point,
New York (V -NY -454F)
The application for conveyance of the Federal surplus property
referenced above has been approved and the General Services
Administration has assigned the property to the Secretary of
the Interior for disposal for public park and recreation use.
We will continue to expedite final legal requirements so that
we can convey title as soon as possible. If you are required
or wish to conduct a title search of the property, we suggest
that you initiate such action at this time as we expect that
the Town will be ready to accept title when the deed is delivered
in the near future. A copy of the proposed deed is enclosed for
your review so that you may determine if the contents are accept-
able.
In the mea-itime, pursuant to condition 4 on page 2, Part "A",
of your application, it is hereby requested that the Town of
Wappinger take possession of the land described in the application
and designated as Portion -VA Hospital Reservation, Castle Point,
New York (V -NY -454F) within fifteen (15) days following receipt
of this letter. From and after the date the Town takes possession
of said property, the Town shall assume the obligation of manage-
ment, maintenance, and protection thereof.
By copy of this letter we are notifying the General Services
Administration, New York City, New York, of our request. We
would appreciate your acknowledgement of this request by
completing the attached statement and returning one (1) copy
to this office. Also, please notify us as to whether or not
the proposed deed meets with the Town's approval, and if not,
what revisions are believed necessary.

MR. SALAND moved that the Town of Wappinger accept that portion
of Federal surplus property designated as "Portion -VA Hospital
Reservation, Castle Point, New York (V -NY -454F)" and further, to
authorize the Supervisor to sign a document to that effect. Along
with the acceptance of this property it was directed that the
Insurance Agent for the Town of Wappinger be so notified of this
acquisition in order to provide the Town with all necessary
insurance coverage, including liability.

MR. JENSEN moved that the Town Planning Board be authorized to
accept a lump sum payment to the Town for those subdivision plats
where the Planning Board does not wish to accept land for recreation
purposes and that said lump sum payment shall be computed at the
rate of $100 per lot.
Seconded by Mr. Clausen.

There followed a short discussion on this subject between the
Board and Mr. Incoronato, who was opposed to the adoption of the
foregoing policy. He insisted it was not enough money and actually
money should not be accepted at all. He believes in obtaining as
much land as possible to keep "green belts",
Mr. Holt reported on the Narcotics Committee. In September or
October a YDA (Youth Drug Administration, under a new head, Dennis
Peri, will become active in the County. He intends to retrace the
Town's steps in the organization of the Narcotics Council and would
also invite anyone interested in serving in this capacity to get in
touch with Mrs. Snowden.
Mr. Clausen reported that a traffic light has been installed at
the intersection of All Angels Hill Road and Old Hopewell Road.
The committee is still trying to get a traffic light at the inter-
section of Old Hopewell and Route RD, without much success at this
point however.
Mr. Incoronato reported for Mr. Cortellino-regarding the Environ-

mental Council. Mr. Cortellino asked that the Board be informed
that he has been appointed to two committees on the Environmenta
Council; one is the Qualifications Committee, to select a profes-
sional planner and environmentalist and the second was a Prioriza-
tion of Problems Committee. It was Mr. Cortellino's request that
the Town Board appoint additional members to the Council.
MR. CLAUSEN moved to direct a letter to Mr. Totten and the Planning
Board advising each that Mr. Totten will resubmit a request for
rezoning with appropriate site plan.

The following Resolution was introduced by COUNCILMAN SALAND, who
moved its adoption:
WHEREAS the Town of Wappinger previously be resolution
adopted in July 1966 provided standards for the acceptance of
private roads, and
WHEREAS the Highway Superintendent of the Town of Wappinger-
has recommended that the said resolution be abolished,
NOW THEREFORE be it resolved that the resolution of the
Town Board adopted at a meeting on July 1966 establishing speci-
fications for the acceptance of private streets be and the same
is hereby rescinded, and
BE IT FURTHER RESOLVED that any private street not offered
for dedication by September 1, 1972 and brought up to the 1966
road specifications and accepted by the Town on or before October
31, 1972 will not thereafter.be accepted by the Town unless it
complies with the current road specifications at the time the
said road is offered to the Town.

Resolution Duly Adopted
The following Resolution was offered by COUNCILMAN HOLT who moved
its adoption, seconded by Councilman Clausen, to wit:
A RESOLUTION AUTHORIZING THE ISSUANCE OF $3,963,320
SERIAL BONDS OF THE TOWN OF WAPPINGER, DUTCHESS COUNTY,
NEW YORK, TO PAY THE COST OF IMPROVEMENTS IN AND FOR
WAPPINGER SEWER IMPROVEMENT NO. 1 IN SAID TOWN.
WHEREAS, by proceedings heretofore had and taken under Article
12-C of the Town Law and more particularly an approving order of
the State Comptroller dated November 30, 1971, and an order of
this Town Board dated May 25, 1971, a Town improvement designated
Wappinger Sewer Improvement No. 1 has heretofore been authorized

in and for the Town of Wappinger, Dutchess County, New York; and
WHEREAS, it is now desired to authorize the construction of
such improvements and the financing thereof; NOW THEREFORE, BE IT
RESOLVED, by the Town Board of the Town of Wappinger, Dutchess
County, New York, as follows:
Section 1. The specific object or purpose for which the
serial bonds herein authorized are to be issued is the construction
of improvements in and for Wappinger Sewer Improvement No. 1 in
said Town consisting of Sewer Plant & Lines together with original
furnishings, equipment, machinery and apparatus necessary therefor.
Section 2. The maximum estimated cost of such specific object
or purpose is $3,963,-320 and the plan for the financing thereof
is by the issuance of $3,963,320 serial bonds of said Town, hereby
authorized to be issued pursuant to the Local Finance Law.
Section 3. It is hereby determined that the period of probable
usefulness of the aforesaid specificobject or purpose is 40 years,
pursuant to subdivision 4 of paragraph a of Section 11.00 of the
Local Finance Law. It is hereby further determined that the maximum
maturity of the serial'bonds herein authorized will exceed five
years.
Section 4. The faith and credit of said Town of Wappinger,
Dutchess County, New York, are hereby irrevocably pledged to the
payment of the principal of and interest on such bonds as the same
respectively become due and -payable.' _ , There shall be .annually
apportioned and assessed upon the several lots and parcels of land
within said Wappinger Sewer Improvement No. 1 which the Town Board
shall determine and specify to be especially benefited -by the
improvement, an amount sufficient to pay the principal and interest
on said bonds as the same become due, but if not paid from such
source, all the taxable real property in said Town shall be subject
to the levy of ad valorem taxes without limitation as to rate or
amount sufficient to pay the principal of and interest on said
bonds as the same shall become due.
Section 5. Subject to the provisions of the Local Finance
Law, the power to authorize -"the issuance of and to sell bond
anticipation notes in anticipation of the issuance and sale of
the serial bonds herein authorized, including renewals of such
notes, is hereby delegated to the Supervisor, the chief fiscal
officer. Such notes shall be of such terms, form and contents,
and shall be sold in such manner, as may be prescribed by said
Supervisor, consitent with the provisions of the Local Finance
Law.
Section 6. The validity of such bonds may be contested
only if:
1) Such bonds are authorized for an object or purpose for
which said Town is not -authorized to expend money, or
2) The provisions Of law which should be complied with
at the date of publication of this resolution are not
substantially complied with,'
and an action, suit or proceeding contesting such validity is
commenced within twenty days after the date of publication or
3) Such bonds are authorized in violation of the provisions
of the Constitution.
Section 7. This resolution, which takes effect immediately,

shall be published in full in W&SD News, the official newspaper,
together with a notice of the Town Clerk in substantially the
form provided in Section 81.00 of the Local Finance Law.
The question of the adoption of the foregoing resolution'
was duly put to a vote on roll call, which resulted as follows:

The following Resolution was introduced by COUNCILMAN CLAUSEN
who moved its adoption.
WHEREAS Wappinger Sewer Improvement No. 1 has been approved
by the New York State Comptroller and all ,legal proceedings
attacking the validity have been resolved, and
WHEREAS it' is necessary to commence the construction phase
of the facility, and
WHEREAS it is necessary to enter into an agreement with
Rudolph E. LaPar, the •engineer for the Improvement Area,
NOW THEREFORE be it resolved that the Supervisor is hereby
authorized and directed to execute the attached contract.

Gregory Walsh Connection
Gentlemen:
In reference to the request of Mr. Gregory Walsh of 2 Edgehill
Drive to connect to the sewer main located in Edge Hill Drive,
please be advised that 1 have inspected the Walsh property and
am familiar with the problems defined by Mr. Walsh in his letter
to the Board of July 5, 1972.
Mr. Walsh's sewage disposal problem is substantially as he stated.
I doubt very much whether Mr. Walsh could reconstruct his system
into workable order short of installing a sewage treatment plant.

I recommend strongly that Mr. Walsh be permitted to connect to
the Rockingham District as a tenant.

Mr. Holt indicated that he would like to hear the Attorney to
the District respond on this matter as to how this will add to,
or maybe set a precedent, for other cases in Rockingham, with
respect to its expansion.
Mr. Diehl directed Mr. Kelley's letter to Mr. Quinn to forward
his opinion as to what the results of a pattern of this nature
might have.
The matter of Mr. Kelley's letter to the Board recomm Onding the
Board accept the Schoonmakers Engineers Certification of certain
sewer line tests in Rockingham Sewer District, was again placed
before the Board.
Mr. Clausen asked if there was any other way that the Board can be
assured that these lines were in proper shape. Mr. Rappleyea
suggested referral to Mr. Quinn.
MR. CLAUSEN moved that this matter be referred to Mr. Quinn,
Attorney to the Rockingham District, for his recommendations.
Seconded by Mr. Holt.

Action was tabled on the submission of the Town Planning Boards
PUD recommendations.
The matter of Mr. Paul Stear and his request to discuss Forest
View Road was tabled due to the fact that Mr. Stear was not present.
It was recommended that Mr. Stear be notified of the Resolution
adopted with regard to the 1966 Private Road Specs.
Mr. Herbert Stenger's request for exemption to Local Law #2, '67
was again placed before the Board. Mr. Saland requested that this
matter be tabled until the next meeting, for further information,
and Mr. Stenger be so notified.
Mr. Diehl appointed Mr. Holt and Mr. Clausen as a committee to
begin immediate clarification and investigation and preparation to
1 92 the Town advertizing for a comptroller; and that inbestigation to
come under the jurisdiction and recommendation as to salary pay,
what would be expected of a comptroller in regard to his work etc.
and to report back to the Board at the next meeting. Mr. Holt
suggested the word "comptroller" be modified to darned good book-
keeper since comptrollers fall in a salary catagory over and above
what has been allocated for in the budget.
Mr. Eck asked to address the Board regarding the County reappraisal.
He mentioned that the Board had, a year ago, addressed the Director
of Real Property, asking for sample assessments made in Wappinger
by the County reappraisal firm. He presented the Board with a
sample of his estimate for property from 1965 through 1972. He
then suggested taking 7 locations: Cedar Hill, Fleetwood, Oakwood
Knolls, Orchard Homes, Wappinger Park Homes, Quiet Acres, Wildwood
I, and the Village of Wappingers Falls, asking for 20 samples from
each showing the Board the formula used by the reappraisal firm.
If they do come up with a formula the Town can accept or not the
assessments. From his chart he estimated that a person who had
paid about $470 taxes in 1965 would in 1972 pay over a thousand
dollars in taxes on the same house, a 140% increase, this is why
he's so concerned about knowing what the County reevaluator's are
going to do. Assessments should be stabilized. Mr. Rappleyea
gave a brief interpretation of the County's intentions and reasons
for the reevaluation which stimulated further discussion into the
processes of assessing. Mr. Eck continued, with reference to
sitting on the Grievance Board saying that out of about 3,000
increases in assessment this year, there were only 250 grievances.
He used a formula of 15% of these 250 grievances, the majority had
been increased from 20% to 50% and the grievance Board used his
formula and reduced them to 15%. He took Wappinger Park Homes as
an example of how the Board of Review had lowered assessments and
it was his contention that assessments should be equal in each area,
assessments:: shouldn't be based on what one or two people pay for
their homes, everyone in the Town should be assessed on their 1964

assessment 15%, right through the entire Town. The Village should
be assessed 10% and by doing this you can straighten this whole
Town out. Mr. Eck continued discussion briefly on the techniques
of assessing, the effect of equalizing assessments, percentages
based on construction costs and so forth, and tried to get his
point across that assessments and tax rates should not be both
raised, let the assessments remain stabilized even if the tax rate
fluctuates.
Mr. Zak, under new business, spoke with reference again to the
Sparkle Plenty Car Wash. It is his understanding that the Village
Planning Board denied their requedst to install gas pumps, and it
is now before the Village Zoning Board of Appeals for a variance.
His concern is what can the Town Board do for the citizens in this
case.
Mr. Diehl indicated there was no official action the Town can take,
only a request and recommendation.
MR. DIEHL moved that a letter be directed to the Village of Wappin-
gers Falls, the Village Clerk, Mayor Furnari and Board of Trustees,
that the Town Bca rd would ask the Village Officials to give serious
consideration in regard to the request by Sparkle Plenty to install
gasoline pumps for the reason that nearby adjacent resident of the
Town of Wappinger depend on individual wells for their water supply
and the possibility of polluting these well supplies from any gas
leakage could be very serious.
Seconded by Mr. Clausen.

Mr. Saland having read a report in the Poughkeepsie Journal on the
report on Dutchess County Airport, thought in light of Stewart
Airport, there really is no need for an expanded Dutchess County
facility. At the facility at the Airport right now, they are
recommending a three plus million dollar expansion, the wisdom of
which he would seriously question. On top of this, the Board of
Representatives, virtually, in unanimity, passed a resolution in
oppostion to Stewart. He thinks it somewhat hypocritical if the
Board of Representatives voted in favor of expanding the Dutchess
County facilities.
MR. SALAND moved that the Town Board go on record as being opposed
to the expansion of the Dutchess County Airport.
Seconded by Mr. Clausen.

MR. CLAUSEN moved as to the request of Mr. Eck, the Board should
direct a letter to the Dutchess County Director of Real Property
tax, asking him what their time -table is as far as finishing
appraising the County, coming up with the formula, asking if they
have developed a formula for the Town and Village of Wappingers
Falls and possibly what are their methods or proceedure in coming
up with a formula, and at least asking for a courtesy by answering
the Town's letters as to why they are having diffulty coming up
with a formula at this time. Please advise the Town Board as to
their progress and problems.
Seconded by Mr. Diehl.

Mr. Clausen, indicated that, in communication with Miss Pike, when
she was inspecting Junk Yards, she had advised the Board that Mr.
Bonnerwith should advise his potential buyer that the license for
dealing in junk cars does not go with the sale of property. She
advised the Town Board to so indicate this to Mr. Bonnerwith.
MR. CLAUSEN moved that the Town Clerk direct a letter to Mr. Bonner -
with advising him that should he sell his property, that he should
advise any potential buyer that he is a non -conforming use, and
that the license for selling junk cars does not automatically go
with the land and jthe potential buyer or owner would have to reapply
for such a license.
Seconded by Mr. Jensen.
Motion Unanimously Carried.
MR. HOLT moved the meeting be adjourned, seconded by Mr. Saland
and unanimously carried.

A Public Hearing was held by the Town Board on August 14, 1972,
at the Town Hall, Mill Street, Wappingers Falls, New York, on an
Ordinance Amending the Zoning Map of the Town of Wappinger (Totten).
Supervisor Diehl opened the Hearing at 7:08 P.M.

A Public Hearing was held on August 14, 1972 at the Town Hall,
Mill Street, Wappingers Falls, New York on an Ordinance Amending
the Zoning Map of the Town of Wappinger (Schuele).
Supervisor Diehl opened the Public Hearing at 7:32 P.M.
Present:
Louis Diehl, Sppervisor
Louis Clausen, Councilman
Harry Holt, Councilman
Leif Jensen, Councilman
Stephen Saland, Councilman
Elaine H. Snowden, Town Clerk
Others Present:
Allan Rappleyea, Attorney to the Town
The Town Clerk offered for the record the Affidavits of Posting
and Publication duly sworn to and notarized by Albert Osten, of the
W&SD News.
(These Affidavits are attached hereto and made a part hereof of
the Minutes of this Hearing).
The recommendations from the Town and County Planning Boars were
that this rezoning would not be detrimental to the area, The County,
did state that if this land were fully developed, it could become
a large community shopping center an mtlaatiened: if the TOWn wanted
this.
Mr. Herb Stoller said he was a resident of the district to be
rezoned and was interested for that ton; he did not talk for or
against.
Mr. Schuele WAS not prent; the Board wanted more information from
him.
MR. SALAND moved to adjourn the Public Hearing to August 23rd at
7:30 P.M. seconded by Mr. Clausen and carried.
The Hearing adjourned at 7:47 P.M.

BE IT RESOLVED AND ORDAINED by the Town of Wappinger, Dutchess
County, New York, pursuant to the authority conferred by the taws of the State of;
New York and the ordinances of the Town of Weppinger as follows:
Section 1: The Town of Wappinger Zoning Ordinance end Mep adopted January,
149, 1963,es amended from time to time Is further amended by rezoning the following,
;described parcel of land from "R•40" to "LB"
All that parcel of land situated in the Town of Wappinger, County of Cutches and
•the State of New York.
Begiming ata point m the Northerly Ilse of Myers Corners Road, said polnt being,
the Intersection of the Northerly line of said Myers Comers Road with the Westerly
Ilne of lands of now or formerly Jessen end running thence along the Northerly line
,of said Myers Comers Road, Westerly 150 feet more or less to a point; thence'
leaving said line and running over and through lands of Eugene Schuele, the grantor
