CLAUSEN moved that the bills be paid, subject to audit. Seconded by Mr. Holt. Motion Unanimously Carried Joseph Incoronato, being recognized by the chair, commented on vandalism at the Fleetwood Water Plant, more specifically, cement blocks removed from the building itself, and recommended the area be fenced. Mr. Diehl informed him that informal bids were already 1-1 being solicited for this, and a price was being investigated regard- ing steel plating for the building. Applications were received from Martha Joyce Meigs, Gino R4' P. Cerbeta, John A. Clark, and James W. Foley, for Peddlers and Hawkers Licenses. These applications had been referred to the Dutchess County; Sheriff's Office, and returned indicating no criminal record on file; with -the exception, of Mr. Foley, for which there was a notation. MR. CLAViEN moved to approve thecapplications and grant Martha J. Meigs,47ino Cerreta, and John A. Clark licenses for Hawking'end Peddling, in the Town of WappingetOthditable James Foley foe'further review. Seconded by Mr. Saland. Motion Unanimously Carried Mrs. Snowden informed the Board that she had received the resignation of.Catherine DeRonde, Election Inspector District #1 (R). MR. SALAND moved that Norma O'Rourke be appointed to fill the IMcanCy created by the resignation of,Catherine DeRonde, term expiring 'gulp, 1973. Seconded by Mr. Holt Motion.Unanimously Carr1ed MR. HOLT moved that the following public places be designated as Polling Places in the Town of Wappinger: f 3 Polling Place District Mesier Park (Police Station) 1 Town Hall 2 Garner Engine House 3 Myers Corners Elementary School 4 Ketcham High School 5 New Hackensack Fire House 6 New Hackensack Fire House 7 Ketcham High School 8 Mt. Hope Grange 9 Mt. Hope Grange , 10 Myers Corners Elementary School 11 Hughsonville Fire House 12 Hughsonville Fire House 13 Chelsea School House 14 (across from Chelsea Fire House) Seconded by Mr. Jensen. Motion Unanimously Carried 163 Letters were received from both Town Justices requesting permission to attend the Judicial Conference at St. Lawrence July 16th to 21st 1972. MR. HOLT moved permission be granted William Bulger and Vincent Francese, .Town Justices, to attend the Judicial Conference July 16th to 21st, 1972, and that their_ legitimate expenses be a Town charge. Seconded by Mr. Clausen. Motion Unanimously. Carried A memo was received from Joseph E. Ludewig, Chairman of the Board of Assessment Review, requesting the payment for stenographic services. Appropriations were not made in the budget for payment of any expenses incurred by this Board, and since the Law requires minutes be kept, the Board had seen fit to engage the services of a stenographer for part of the hearings. It was, therefore, requested that the bill for this stenographer be paid. MR. CLAUSEN moved that the bill presented for payment by the stenog- rapher engaged by the Board of Assessment Review be paid, and charged to Account #A1620.4. Seconded by Mr. Holt. Motion Unanimously Carried A request.had been made by Mr. Paul Stear to speak before the Board regarding Forest View Road (Cedar Hill Area) but he was not present to be heard. Mr. Diehl directed Mr. Stear's request be tabled until the next regular meeting, and a letter be forwarded to Mr. Stear so stating. A letter was received from William Ohlerking regarding a drainage problem he was experiencing from conditions on Kent Road and adjoin- ; ing properties. Mr. Ohlerking was present, and further detailed the problems. Water backs up from Kent Road on to his property and has, on occasion, flooded his basement severely. His property is lower than Kent Road and when the water backs up the only way it can go is through private property,,through a drain that empties into Lake Oniad. Mr. Horton' -s recommendationWould be that the storm drain would have to go down Kent Road to empty into the low point in the stream. MR. CLAUSEN moved that Mr. Horton and Mr. Lapar be directed to look into the area drainage problem on Kent Road, and submit a recommenda- tion, as to the solution, to the Board. Seconded by Mr. Holt. Motion Unanimously Carried Mr. Cortellino, being 'recognized by the Chair,. commented on the construction aspect of HUD. A letter Was redeived from Irene Bennett, DeGarmo Hills Road, regard- ing a "dumping ground" and trespass problem connected with the Town's leasing of the adjoining Schuele Property. Mr. Diehl stated that he had visited the property with Hugh J. Maurer, Chairman of the Recrea- tion Commission and although Mrs. Bennett had actually understated the problem from their viewpoint, there was not much to do -except recommend -posting her property with "No Trespassing" signs. He and Mr. Maurer agreed that, first, fencing was not feasible, since there was only a year to year lease, and second, even abandoning this area as a Town site would not eliminate the problem since it was an attrac- tive location, and the children would continue to frequent it under any conditions. s- 165 A memorandum was received from the Planning Board concerning "Planned Unit Development", accompanied by a draft of the proposed amendments. The Planning Board asked that the Town Board set a Public Hearing at an early date on these proposed amendments. Mr. Diehl proposed a motion to direct the Attorney to the Town to draw up an Ordinance regarding PUD, but withdrew it when Mr. Saland indicated there were areas of question'in,the proposed amendments. Mr. Diehl then directed that an executive meeting be arranged with the Planning Board to discuss in depth, the proposal. Mr. Lafko had requested to speak before the Board regarding'Wappingers Central Water Expansion Plan, but he was not present. The Board, therefore, went on to the next order of business. A petition was received from residents of the Schoonmaker Development, more specifically on and around Balfour Drive, regarding open storm drains, and a large open swamp area. They fell that the swamp area should be fenced to prevent children from going into it, since they understand it;won't be built upon until 1973. Mr. Diehl reported that, upon his request, Mrs. Snowden had contacted Robert Fields, President of the Corporation, who in turn investigated the complaint. Mr. Fields, after inspecting the area, reported that he was uncertain as to the exact location of this swampy area referred to, but would gladly meet with a representative of these petitioners in order to rectify' the problem, if in fact, there was one. MR. DIEHL moved that the Town Clerk contact Mr. Purdy, or whomever was the originator of the Petition, and confirm a date with him and Mr. Fields for an on-site inspection. Seconded by Mr. Clausen. The following petition was received: Town Board Town of Wappingers Falls New York 12590, Gentlemen: Motion Unanimously Carried July 10, 1972 ; ReWhite Gates 16 .I would like to petition this Board for an exemption by request, of Local Law Number 2 '67. This request is based on Section 14 of Local •Law Number '2, for the follo*ing reasons: a. The system will be self-contained and will not be deeded out. b. The system will be located on property owned by and including the entire project known as White Gates. e., nooutside people will be served by said system. d. no water will be sold. I would appreciate it if you would set a public hearing in order that I might substantiate my position formally. Very truly yours, s/ Herbert C. Stenger MR. CLAUSEN moved that a meeting be arranged with the Board and Mr. Stenger to discuss his request, and that his petition be received and placed on file. Seconded by Mr. Holt. Motion Unanimously Carried A letter was received from Mr. Gregory J. Walsh requesting permission to hook into the Rockingham Farm Sewer District. His property is located at 2 Edgehill Drive, and he apparently is ekperiencing a serious_ sewerage problem, the leach fields from the 'septic tank are completely saturated, and he is having to have the septic tank pumped out very frequently. MR. JENSEN moved to table Mr. Walsh's request until the Board resolves the question of Rockingham Farms Sewer District, and the proposed ex- pansion of it. Further Mr. Walsh's request be brought to the attention of both the Attorney and 'Engineer to the District. Seconded by Mr. Holt. Motion Unanimously Carried A recommendation was received from the Dutchess County Department of Planning on,the Logan, Gutmann, & Milner rezoning request. MR. CLAUSEN moved that this recommendation be received and placed on file. Seconded by Mr. Holt. Motion Unanimously Carried 1 L 167 Mr. Diehl made note of receipt of a letter from Mr. James Coombs, Attorney for John ,orndran, in regard to the Rockingham Farms Sewer District. At this time Mr. Diehl turned it over to the Town Clerk to forward on to Mr. Quinn, Attorney to the District and Mr. Kelley, Engineer to the District. Mr. Harold Young, being recognized by the Board, stated that some ten residents in Edge Hill Section III were experiencing some drainage problems in the area of Vorndran Drive and Pye Lane. The water drains of property behind Vorndran Drive, and the storm sewer on the east side of Vorndran Drive is: completely filled and will not allow water to pass through. He strongly recommended this problem be looked into by the Board, because when the portion of Deer Run Road that has been partially blocked off, is opened up again, there will be a serious problem at a later date. It appeared to Mr. Rappleyea that it was more of a problem between landowners, the storm sewers could be checked out by Mr. Horton. MR. DIEHL moved that the Town Clerk direct- Mr. Sbhuele to clean out and open any street drainage that are on any of his holdings, and, at the same time have Mr. Horton and Mr. Lapar have a site inspection of the area that has been stripped and might possibly be causing flooding of nearby homes, and determine if there are any violations. Seconded by Mr. Clausen. Motion Unanimously Carried (Mr. Clausen noted that a copy of the letter to Mr. Schuele be sent to the Building Inspector.) Under Committee Reports, Mr. Clausen asked Mr. Rappleyea if he had anything to report to the Board with regard to progress on the Schuele property being considered for a Town Hall site. Mr. Rappleyea first stated that the property was in the name of the XYZ Corp. of which Mr. Schuele is one of the principal stockholders, and he has negotiated with him on option price, which is not binding on the Town, but simply gives the Board until August 31st, 1972, to make an election as to whether or not the Town wishes to purchase the property. The next s step is to hire a professional engineering and real estate appraiser to determine whether or not the option price is one that is fair and reasonable under the circumstances. If the expert opinions do not justify the option price of $350,000,&of course the Town is not obliged to do anything. MR. CLAUSEN moved that the Town Clerk direct a letter to the Village of Wappingers Falls Trustees Houlihan and Sullivan, who are represent- ing the Village on a possible joint Village/Town Hall site, stating that the Town has obtained an option and if they feel there is any other need for a meeting or progress reports from the Town, for them to please so advise the Town Board immediately and Mr. Clausen and Mr. Jensen would be glad to meet. Seconded by Mr. Jensen. Motion Unanimously Carried The following resolution was introduced by COUNCILMAN CLAUSEN who moved its adoption: WHEREAS, an application was made to the Town Board of the Town of Wappinger by Roy O. Guarino and Lawrence Pereira for a rezoning of a parcel of land in the Town of Wappinger located on Route 82, and WHEREAS said application.was referred to the Dutchess County Planning Board and the Town of Wappinger Planning Board, and WHEREAS, the Town of Wappinger Planning Board reported to the Town Board on April 4th, 1972, that it favors said change as as the change'would be in conformity with other existing uses in the area, and WHEREAS the County Planning Board on April 26th, 1972, reported to the Town Board of the Town of Wappinger that it opposed said zoning change on the ground that said site is part of the flood plan of the Sprout Creek, and WHEREAS the Town Board of the Town of Wappinger introduced a public heaing on June 12th, 1972, and such public hearing was held on that date after due notice to the Town of East Fishkill and no one appeared at said public hearing in opposition to said zoning change, NOW THEREFORE, BE IT RESOLVED that the said zoning amendment as set forth in the attached zoning ordinance amendment be adopted for the following reasons: 169 1. The proposed zoning change would result in the use of the property in a manner compatible with the neighborhood. 2. Despite very substantial rainfall during the past year which has surpassed many previousrecords, the area has not been flooded and is not flood prone. 3. The owners of the property are knowledgeable concerning the problems of the site and intend to develop it in a manner compatible with such problems. 4. Any use of the property will be subject to site plan approval by the Town Planning Board BE IT RESOLVED by the Town Board of the Town of Wappinger, Dutchess County, New York, pursuant t� the authority conferred by the laws of the State of New York as follows: Section 1. The Town of Wappinger Zoning Map adopted January 29, 1963, as amended from time to time is hereby further amended by rezoning the following described parcel of land so that said parcel of land is hereafter zoned in its entirety to LB (Local Business), said tract or parcel of land being situated in the Town of Wappinger, County of Dutchess and State of New York, more particularly bounded and described as follows: Lot 7.1, Block 5, Town of Wappinger, Tax Map #65 Section 2. This ordinance shall become effective immediately upon adoption, posting and publication as proveded by Town Law. Duly Adopted The following resolution was introduced by MR. HOLT who moved its adoption: BE IT RESOLVED AND ORDAINED by the Town of Wappinger, Dutchess County, New York, pursuant to the authority conferred by the laws of the State of New York and the ordinances of the Town of Wappinger as follows: Section 1: The Town of Wappinger Zoning Ordinance and Map adopted January 29, 1963, as amended from time to time is further amended by rezoning the following described parcel of land from "R-20" to "HB -1". Lot 35, Block 1, Map 61 of the Tax Maps of the Town of Wappinger. The said premises being located on the easterly side of Route 9 and being now or formerly owned by Arthur J. Totten, Sr. io 70 Section 2: This ordinance shall become effective upon adoption, posting and publication as prescribed by Town Law. Seconded by: Councilman Clausen MR. CLAUSEN moved that a public hearing be set for Aug. 14, 1972 at 7:00 P.M. EDST at the Town Hall, Mill Street, Wappingers Falls, New York, on the Ordinance Amending the Zoning Map of the Town of Wappinger, on the Petition of Arthur Totten Sr. at which time all interested persons wishing to be heard either in favor of or in opposition to it will be heard. Seconded by Mr. Holt. Motion Unanimously Carried . The following ordinance was introduced by COUNCILMAN CLAUSEN who moved its adoption: BE IT RESOLVED AND ORDAINED by the Town of Wappinger, Dutchess County, New York, pursuant to the authority conferred by the laws of the State of New York and the ordinances of the Town of Wappinger as follows: Section 1: The Town of Wappinger Zoning Ordinance and Map adopted January 29, 1963, as amended from time to time is further amended by rezoning the following described parcel of land from "R-40" to "LB". All that parcel of land situate in the Town of Wappinger, County of Dutchess and the State of New York. Beginning at a point on the Northerly line of Myers Corners Road, said point being the intersection of the Northerly line of said Myers Corners Road with the Westerly line of lands of now or formerly Uessen and running thence along the Northerly line of said Myers Corners Road, Westerly 150 feet more or less to a point; thence leaving said line and running over and through lands of Eugene Schuele, the grantor herein, the following: North 19-48-20 East 400 feet more or less to a point; thence South 70-11-40 East 280 feet more or less to a point on the Westerly line of lands of now or formerly aforesaid Jessen; thence along the Westerly line of lands of now or formerly said Jessen, along the remains of a stone wall and wire fence, Southwesterly 430 feet more or less to the point of beginning containing 2.05 acres of land be the same more or less. EDST, at the Town Hall, Mill Street, Wappingers Falls, New York, on the Ordinance Amending the Zoning Map of the Town of Wappinger, on the Petition of Eugen Schuele, at which time all interest- l l ed persons wishing to be heard either in favor of, or in opposition to it will be heard. Seconded by Mr. Holt. Motion Unanimously Carried A vacancy on the Zoning Board of Appeals still remaining, the matter was placed before the Board for their consideration. The following resolution was offered by MR. HOLT who moved its adoption: RESOLVED, that Angelo M. Limardo be and he hereby is appointed to fill the vacancy on the Zoning Board of Appeals of the Town of Wappinger which has occurred by reason of the resignation of Gordon Hirt, and it is further RESOLVED, that said Angelo M. Limardo be and he hereby is appointed to fill such vacancy for the remainder of the term which shall expire on February 1, 1975. Re: Abolishing 1966 Private Road Specifications Gentlemen: It is my feeling that the specifications for private street, adopted in July of 1966, should be phased out. I would recommend that any privatestreet which has not been offered for dedication by September 1, 1972, and brought up to the 1966 specifications and accepted by October 31st, should be made to comply with current specifications in effect at the time the private road is offered to the town. CLAUSEN moved that Allan Rappleyea, Attorney to the Town, be directed to prepare a resolution stating the recommendations of Mr. Horton, Highway Superintendent. Seconded by Mr. Saland. Motion Unanimously Carried Mr. Saland, under unfinished business, asked Mr. Rappleyea what, if anything, ever occurred with Mr. Alexander and St. Nicholas Rd. Mr. Rappleyea indicated that Mr. Alexander had made some efforts to comply and he has asked for an updated inspection from Miss Pike, Zoning Administrator. He had been out working around the 20th and 21st but had been hindered due to unusual weather conditions. If Mr. Alexander hasn't made substantial progress, Mr. Rappleyea will start action. Mr. Saland brought up the question that had arisen at the May meeting concerning unexpended balances. At that time there had been a dis- cussion between himself and Mr. Egan about the per capita aid situations and he had questioned the discrepancy between 95 and 85 thousand. Mr. Egan answered that there was no written notification on the aid, it had been a verbal recommendation of a 10% reduction in figuring out the per capita state aide, but this would be up to the Town. MR. CLAUSEN moved to direct a letter to Mr. Schuele and Mr. Dangler reminding them of the date of July 20, 1972, to forward a report to the Town Board on their intentions of inspecting the 10" line for infiltration. Seconded by Mr. Holt. Motion Unanimously Carried (a copy of the reminder to be cEorwarded to Messrs. Quinn & Kelley.) Mr. Incoronato, being recognized by the Chair, asked if Mr. Rappleyea had looked into the feasibility of obtaining permission from the property owners in Green Fly Swamp, so that the State could remove some of the debris blocking the outlets. i3 173 Mr. Cortellinoi being recognized by the Chair, asked the names of the members,of.the Town of Wappinger,Conservation Advisory Council, since he had been appointed to the County Council, he was interested in getting -opinions of the Town council. Mr. Saland, under new business, stated that he'd received phone calls concerning the hazardous intersection of Rt. 9D and Old Hope- well Road in Hughsonville. He had also been advisedthat studies have been made and that the State says that this intersection is one which doesn't warrant a traffic light. He feels it should be looked into further._: Mr. Diehl stated that he had discussed this situation with John Wood, Dutchess County Fire Coordinator, and Mr. Wood said he was looking into the avenue of getting a traffic light there through the Bureau of Fire Control. Mr. Clausen, referring to a letter directed to the County Representa- tives, asking for direction as to what the municipalities can do as far as dumping trees and building materials etc. asked if anything had been heard from them. There had been no communications received. Mr. CLAUSEN, moved that,.a letter be"direetdd'to.the Wappinger County Representatives, asking if they couldn't arrange to have one of the four representatives present at the Town Board meetings, for a short period of time, each month so that the residents and the Town Board can ask them about county matters and get some direction from them, and them from the Board. Seconded by Mr. Holt. Motion Unanimously Carried Mr. Saland, referring to the minutes of the May 5, 1972 Sanitary Landfill minutes, noted that Mr. Mihans, the Manager, was going to be instructed to advise the State and County to cease using the landfill site without authority to bring in trees. Mr. Diehl answered that they haven't been bringing in trees, the only thing the landfill accepts from them is material that can be used for cover which would be an asset. Mr. Clausen, on the same subject, asked Mr. Diehl if he had attended the meeting with Mr. Schueler on a possible landfill site. Mr. Diehl indicated he had, and all he saw was a piece of land, and he had requested that a helicopter •ride be taken -over. the site so that highways, schools, etc. could be put in proper perspective. He mentioned that it would make a beautiful recreation area since there was a beautiful lake and streams on it, MR.
