1972-06-22 SPMI A Special Meeting of the Town Board of the Town of Wappinger was held 9n June 22, 1972, at the Town Hall, Mill Street, Wappingers Falls, New York. This meeting was called called for and confirmed for 22, ,1972,,,at the Regular Monthly Meeting of the June,r12, 1972, for the purpose of action on the 7:45 P.M. June Town Board held roads in the devel- 154 opment known as Angel Brook Estates (Dutchess Heights, Inc.) and any ather,business that may properly come before the Board. Mr. DiGiacomo asked when the residents could expect completion: Mr. Horton commented that with weather conditions as they are, realistic completion could be expected by the end of September. MR. DIEHL moved to authorize Rudolph E. Lapar and William Horton to prepare the plans and spedif'ications, and the preparation of the Bids with regard to the road work''in'Angel Brook Estates (Sectiori !I)' on which this meeting is lteirig held; and to `advertize for bid, 'the comple- tion date of the bid wou=ld'be October 1, 1972. All Board members, with the exception of Mr. Saland were present. ria; A Public Hearing having been duly held on June 22, 1972 on the matter of the Resolution of the Town Board of the TTOwn of i ppinger, tDltchess County, Ndw''York, dissolving the Oakwood Knolls Sewer District; AM - davits of Posting and Publication were offered for the record at the tifne ' of the .-Public Hearing-;- and all persons desiring to ` be 1 a.effi vElf'e #. the -matter -Was p;laoc d b.bre. the° )Board. ftdv itheir c1:1onsideora.ion. :.r i 1 rnric:.rtr 3 156 The following resolution was offered by COUNCILMAN CLAUSEN who moved its adoption: WHEREAS, pursuant to the provisions of Article 12c of the Town Law -of the Town of Wappinger, Dutchess County, New York, did on the 25th day of May, 1971, adopt a Resolution providing for the estab- lishment of the Wappinger Sewer Improvement #1, and WHEREAS the map, plan, and report for such improvement area provided, that all of the property and lands of the Oakwood Knolls Sewer District be served by and included in the Wappinger Sewer Improvement #1, and WHEREAS the map, plan and report of the Wappinger Sewer Improve- ment #1 provided that the sewage treatment plant of Oakwood Knolls Sewer District be upgraded, improved and reconstructed to provide service for the entire benefited areaof the Wappinger Sewer Improve- ment Area #1, and WHEREAS the outstanding bonds and notes of the Oakwood Knolls Sewer District does not exceed the sum of $55,000.00, and WHEREAS the map, plan, and report of the Wappinger Sewer Improvement #1 provided for the dissolution of said Oakwood Knolls Sewer District and the assumption of its outstanding indebtedness by the Wappinger Sewer Improvement #1, Now, therefore, and BE IT RESOLVED by the Town Board of the Town of Wappinger, as follows: 1. That the Oakwood Knolls Sewer District, a Sewer District created pursuant to Article 12 of the Town Law of the State of New York in accordance with a resolution of the Town Board adopted February 11, 1965, and an -order of the New York State Comptroller dated July 27, 1965, be dissolved. 2. That upon dissolution as provided by Town Law, the function of the Oakwood Knolls Sewer District shall be thereafter managed•, maintained, operated and repaired as a function of the,'Wappinger Sewer Improvement #1. 3. The principal and interest on the bonds or other obliga- tions unpaid upon the effective date of the Oakwood Knolls Sewer District dissolution shall be paid for by 'assessments levied upon the several lots or parcels ofland in the Wappinger Sewer Improve- ment #1 Area in just proportion to the amount of benefit which the improvements shall confer upon such lots or parcels. 4.. ,This resolution is:subject to a permissive referendum. Any.such referendum shall:be held in the area of the Wappinger Sewer -Improvement #1,as,described hereafter set forth. 5. Upon the dissolution of Oakwood Knolls Sewer District the cost of management, maintenance, operation, and repair of such improve- ment and service shall be a charge upon the area outside of the Village of Wappingers Falls and shall be levied and collected in the same manner as the costs of management, maintenance, operation, and repair of the Wappinger Sewer Improvement #1. Roll Call Vote: 4 Ayes 0 Nays The following Resolution was offered by SUPERVISOR DIEHL who moved its adoption: WHEREAS, the Town of Wappinger, in order to provide for a planning study contributing to an overall program for its future community development, desires to participate in the Federal - State Comprehensive Planning and Management Assistance Program as authorized by Section 701 of the Housing Act of 1954, as amended, and Article 26 of the New York State Executive Law, and WHEREAS, the New York State Office of Planning Services, under authority of Article 26 of the New York State Executive Law, is the official State planning agency designated to administer Federal and State funds under the provisions of Section 701 of the Housing Act of 1954; as amended, now therefore, be it RESOLVED, that the Town Board of the Town of Wappinger hereby requests the New York State Office of Planning Services to provide planning:'assistance under authority of -Article 26 of the New York State Executive Law, with such financial assistance as may be pro- vided by the United States Department of Housing and Urban Develop- ment, under authority of Section 701 of the Housing Act.. of 1954, as amended. Such planning assistance is more particularly described in the project application. RESOLVED, that if the aforesaid application is approved and accepted by both the Director of the New York State Office of Planning Services and the Department of Housing and Urban Develop- ment, the Town of Wappinger shall enter into a formal agreement with the New York State Office of Planning Services to undertake the project described in the approved application and to pay to the State of New_York its share of the estimated total cost of the said project, together with such other terms and conditions as may be deemed necessary and appropriate to carry out the said project. RESOLVED, that the Town of Wappinger hereby agrees to have available, in the year the project is to be completed, the sum of One Thousand, three hundred and eight dollars ($1,308.00) or so much thereof as may be necessary to contribute a sum not to exceed Four and Seven/Tenths per centum (4.7%) of the total cost of said project, to be paid to the State of New York, on condition that the above- mentioned application is approved by both the Department of Housing and Urban Development and the Director of the New York State Office of Planning Services. RESOLVED, that the Town of Wappinger shall:assume-_the costs of operating and maintaining its own planning board or commission including such services ascclerical- personnel, office space, equip- ment, materials, communication and travel, as such costs cannot be charged tothe Comprehensive Planning and Management Assistance Program. 1 59 RESOLVED, that it is understood that current planning services may not be charged to -the Comprehensive Planning and, Management Assistance Program. - - RESOLVED, that the Supervisor of the: Town of Wappinger be and - hereby is authorized and empowered to execute in the name of the Town of Wappinger all necessary applications, contracts and agree- ments to implement and carry out the purposes specified in this resolution. CLAUSEN moved to accept Mr. Horton's estimate and authorize Mr. Horton to proceed with the work of building roads into both the Oakwood and Fleetwood wells. Seconded by Mr. Jensen. CLAUSEN moved that the Town Board accept the -proposal submitted by Vincent Kelley dated February 9, 1972, total figure was $5,000 (Phase I & Phasell) $3,000 of which will not be expended without further authorization of the Town Board; also that Mr. Joseph Quinn, Jr. be authorized to prepare a resolution for the feasibility study, 1 in relation to the payment plan, as far as the enlargement of the Rockingham Farms Sewer Plant is concerned. Mr. Kelley's report to be submitted by July 20, 1972. Seconded by Mr. Holt Roll Call Vote: 4 Ayes 0 Nays MR. CLAUSEN moved that a letter be sent to Mr. Vincent Dangler, developer of Ye Olde Apple Orchard and Mr. Eugen Schuele, developer of Edge Hill Manor directing them to inspect and repair any infil- tration or other problems connected with the 10" trunk line going from Edge Hill to the Rockingham Sewer Plant, and request a reply` by July 20, 1972, as to their plans. Seconded by Mr. Holt Roll Call Vote: 4 Ayes 0 Nays MR. CLAUSEN moved that Vincent C. Kelley be authorized to prepare specifications and advertize for bids on the equipment and supplies as described in his letter of November 20, 1971 with regard to the Rockingham Sewer District Plant repairs. Louis Diehl opened the Public Hearing and asked Mr. Rappleyea to explain reason for dissolution of Oakwood Knolls Sewer District. Mr. Rappleyea explained that he had bee authorized back in 1971 to review financing Of Oakwood Knolls Sewer District and bringing it Lip to date. In that respect and in regard to the function of Wappinger Sewer Im- provement #1, it was his opiniOn that the functions of Oakwood Knolls Sewer District would become part of Wappinger Sewer Improvement #1.. It is beneficial and necessary to dissolve the Oakwood Knolls Sewer District The choices are that it remain a separate entity it must undergo -serimue construction costs and these costs would have to be borne by the residents of that area. If taken in by the larger system it is useful as a sewer plant in part and it would be benificial to those people in the larger area. If taken over we will have one uniform system and one uniforip rate, all residents will be charged the same benefit assessment & Operation & Maintenance Rate. The costs will be higher than the present rate paid by Oakwood Knoll residents but it would also be considerably lower than the rate they would eventually pay if they remain a separate entity. He further explained that the notes that were procured to purchase the plant were renewed from year to year with only the interest being paid, not the principal. They then procured pernament bonding which still exist & if the plant contunues on its own the residents of the district will bear this cost plus the cost of operating the plant. In this proposal of dissolution of the plant, when the pian is effective which would be January 1, in the year auccedding its adoption, the obligation of the district will be taken over by the district at large. Herb Arndt concerned about Oakwood Plant being used for the Improvement Area in regard to present capacity of handling runoff. o Mr. Bingham asked how effluent of the enlarged sewer plant affect the development capability of the sewer. Mr. Metzger asked about a double cost to the homeowner when the system was implemented. He also asked if they would impplement the system in a serial fashion or gross fashion. Mr. Rappleyea discussed the permanent bonding & amount of years they would go and how they arrived at the rate. There would still be a $4000 debt that the Oakwood residents would be obliged to pay. Jim Howell asked about the Spook Hill development would they elks tie in and bear the cost. Dane Crone - Wm fire or ten years from now what size plant are you going to need. Mr. Porter asked if there was any other alternative in regard to paying off the indebtedness of the district. Was this dissolution purpose the most feasible.
