The Regular Monthly Meeting of the Town Board of the Town of
r`oWappiager was held June 12, L972, at the To Hall, Mill Street,
Wappingers Falls, New York.

Supervisor Diehl called the meeting to order at 8:02 P.M.
The minutes of the May 8, 1972 regular monthly meeting having been
previously sent to the Town Board members, were. now placed before
them for their approval.

An application was received from Louis Palla for a Hawking and
Peddling License. The application had been referred to the Dutchess
County Sheriff's Office, and returned indicating no criminal record
in file.

MR. CLAUSEN moved to approve the application and grant Louis Palla
a license for Hawking and Peddling in the Town of Wappinger.
Seconded by Mr. Jensen.

Several letters were received from Mrs. Donald Estabrook requesting
a study of the speed limit on Old Hopewell Road. She had experienced
several incidents of near accidents due to imprudent speed by motor-
ists.
MR. DIEHL moved that the Board request a speed study from Edgar
Petrovits, Commissioner of the Dutchess County Department of Public
Works; and further, notify the Sheriff's Department of the problems
existing on Old Hopewell Road, that they may pay special attention
to it.
Seconded by Mr. Holt.

A recommendation was received from the Town of Wappinger Planning
Board regarding the rezoning request of Eugen Schuele for a portion
of his property on Myers Corners Road (east of DeGarmo Hills Road).
Recommendations had previously been received from the Dutchess County
Department of Planning.
MR. DIEHL moved to refer Mr. Schuele's rezoning request to Mr.
Rappleyea, Attorney to the Town, to prepare an Ordinance Amending the
Ordinance, for the Board's consideration, and to set a Public Hear-
ing on.
Seconded by Mr. Holt

A letter was received from Mrs. Ronald Evans regarding lack of
recreation, and, the possibility of using the Big Scott building
for a roller skating rink.

MR. DIEHL moved that this letter be referred to the Village of
Wappingers Falls and also the Town Recreation Commission, and so
notify Mrs. Evans of the action.

Mrs. Casner, Executive Director of the Dutchess County Youth Board,
having arrived, was given the floor to address the Board. She was
accompanied by Mr. Lazarus, one of the Board members, who, as she
indicated, would assist her in explaining to the Board and residents
present, the purpose and services of the Youth Board. Mrs. Casner
gave a very enlightening speech on the functions of the Board, and
various aspects of the work she is involved in. A director of Social
Resources in Dutchess County, was presented to the Town, along with
various pamphlets of coordinated programs.
A memo was received from Vincent C. Kelley regarding Rockingham Sewer
District sewer test certification. Attached was the Engineer's certi-
fication (Herbert Kartiganer) to Schoonmaker Brothers Inc. indicating
locations, lines tested etc. of test taken May 10, 1972. Mr. Kelley
recommended the Board's acceptance of the certification.
MR. CLAUSEN moved that the certification be received and refer it to
the Attorney to the Town for his review and recommendation, especially
with regard to the exfiltration on Dwyer. Lane.

A letter was received from Mr. Karol Sekeley asking if there were
any new developments as to the investigation of State Laws regarding
a Noise Ordinance for the Town.
Mr. Rappleyea reported that he had received several proposed Ordinan-
ces from the Association of Towns and examined them. He feels, after

studying these Ordinances and various State and Town Laws, that at
the present time the Town is not equipped either by its own police
force or the position whereby it can hire sufficient technical staff
to monitor a Noise Ordinance of a sophisticated type. He feels the
Town, under the circumstances, would only be doing a disservice by
putting such an Ordinance on the books. Those people who have
problems with noise should be advised to make use of the available
Ordinances and State Laws involving nuisances, public disismbances,
and other complaints relating to that type of problem. He thinks
there are sufficient laws now available whereby a complaint to the
Sheriffs Office, or a complaint to the Town Justices about a 'particu-
lar troublesome disturbance in the area could be met by appropriate
action without the problems that the Town would get into with a
specific Noise Ordinance. The Town is a little bit too small and
too understaffed, to undertake a complicated ordinance.
Mr. Diehl requested the Clerk see to it that Mrs. Sekeley receive
the opinions of the Attorney to the Town on this matter.
A letter was received from Robert L'Archevesque, regarding the
Dutchess County Environmental Management Council. It appears an
appointment is requested for a representation of the Town of Wappin-
ger as a member of this council.
MR. HOLT moved that Charles Cortellina be app6inted as the Town of
Wappinger's representative to the Dutchess County Environmental i
Management Council.
Seconded by Mr. Clausen.

A memo was received from Joseph Gutmann on the lack of service roads
into the two, district water wells. He recommended that two 20'
gravel roads be constructed to permit access to these wells in case
of an emergency.
Mr. Holt recommended this subject be referred to the Superintendent
of Highways for a cost estimate.
A letter was received from Mrs. John MacDonald concerning "pot holes"
on the edge of Myers Corners Road opposite Kent Road. She claims
the deeds of the neighboring properties call this entrance Old Myers
Corners Road. She states that these owners wish this road to be
cared for by the Town.
Mr. Diehl commented that there had been communication from the County
to Mr. Horton on this(which Mrs. MacDonald also made note of) and
he himself had discussed this with Mr. Horton. There seems to be
some disagreement as to the road being referred to. It has been
referred back to the County Highway Department for further research.
MR. DIEHL moved to wait for a final decision from the Dutchess County
Department of Public Works and at the same time, refer it to the
Attorney to the Town.

Recommendations were received from both the Dutchess County Department
of Planning and the Town of Wappinger Planning Board regarding the
rezoning request of Arthur Totten, Sr. Both recommendations were
read since Mr. Totten was present. Both recommended against the
requested rezoning. Mr. Totten, in response to the Town Planning
Board's reason for denial (which was that there was no specific plan
or intended use submitted) stated that his proposed use would be for
a small nursery.
MR. DIEHL moved that the Attorney to the Town prepare an Ordinance,
amending the Town of Wappinger Zoning Ordinance upon Mr. Totten's
request, for the Board's consideration, for the purpose of setting
a Public Hearing.

A rezoning, requestwasreceived from Thomas Logan, Joseph Gutmann,
Harry Gutmann, Daniel Milner, for therezoning of Tax Map #38 from

MR. DIEHL moved to refer this rezoning request to the Town of
Wappinger Planning Board and the Dutchess County Department -of
Planning for their review and"recommendation.

We are enclosing a copy of a letter received from -Dr. Robert
W. Young, Superintendent of the Wappingers Central School District
No. 1, regarding the transporting of handicapped children to
private camps.
We would appreciate the opinion of the Town Board and/or
Mr. Rappleyea so that we may reply to Dr. Young.

Municipalities in the Wappingers School Dist.

There are two groups of school age children who attend summer
camps to try to compensate for severe 'handicaps; (1) The ACLD
(learning disability) Summer Camp; (2) the Rehabilitation Center
(multiply -handicapped children) also operates a camp.
The Wappingers District cannot legally transport the children to
these camps because the camps are run privately. I am of the opinion
that the laws causing this prohibition were not written with severely
handicapped children in mind.
After researching ways to provide the transportation, I have found
the only recourse to be through the Recreation Departments. If you
will sponsor the camps as a recreation service, we can bus the children
free of charge.
We could not extend the same service, free of charge, to all groups,
but for these few needy children I will do anything possible to help.
I would appreciate your reaction to this idea.

MR. DIEHL moved that the Town of Wappinger would be willing to
sponsor such camps for the handicapped children as a recreational
service upon the condition that there will be no cost to the Town, and
that the Town of Wappinger will be in no way responsible, and further
H. J. Maurer, Chairman of the Town of Wappinger Recreation Commission
is authorized to investigate and report back to the Town Board, and,
if there are any agreements, these will have to be executed by the
Town Board.

A Public Hearing having been held on June 1, 1972,, in the matter
of the Establishment of the Central Wappinger Water Improvement Area
in the Town of Wappinger, Dutchess County, New York, pursuant to
Article 12c of the Town Law; Affidavits of Posting and Publication
being duly offered for the record at that time, and all persons
desiring to be heard were heard, the matter was placed before the
Board for their consideration.
MR. HOLT moved the following letter be accepted and made part of the
record, seconded by Mr. Diehl and carried.

Gentlemen:
Although I am unable to attend the regular scheduled June meeting
of the Town Board, I believe that there is a matter of great
importance upon which my views as Councilman of the Town of Wappin-
ger should be expressed.
Realizing that I cannot cast my vote in absentia, I wish to make
known to the Board that I am in favor of the proposed Central
Wappinger Water Improvement Area No. 1. Although the public hear-
ing held on June 1, 1972 was not as well attended as I would have
hoped, my analysis of those who spoke is that the overwhelming
sentiment was in favor of the Water Improvement Area.
I feel compelled to add it was only a. matter of months ago that I
campaigned for the office which I presently hold and at that time
indicated my belief in the need for municipal water and sewer in
the Town of Wappinger. As I indicated then and believe now, the
improvement area concept is a step in that direction.

SUPERVISOR DIEHL moved that the Order in the Matter of the Estab-
lishment of the Central Wappinger Water Improvement Area in the
Town of Wappinger, Dutchess County, New York, pursuant to Article
12c, be adopted, seconded by Councilman -Holt and passed by 4 affirma-
tive votes and none oppOging. A copy of said Order is attached hereto,
and made a part hereof, of the minutes of this meeting.
A Public Hearing having been duly held on June 22, 1972, on the
rezoning request by Roy Guarino and Lawrence Pereira, the matter was
placed before the Board for their consideration:
MR. CLAUSEN moved that the Attorney to the Town be directed to prepare
a resolution to adopt the rezoning request of Guarino -Pereira.

The following Resolution was offered by COUNCILMAN CLAUSEN, who
moved its adoption:
WHEREAS, the sum of $2,000.00 has been appropriated to Account
#A9040.8 (Workmans Compensation). This account has been overexpended
and overdrawn by the sum of $32.37 in order to meet bills presented
for payment. The additional monies were obtained from Account #
A1990.4 (Contingent -Town Wide). We, therefore recommend that the
Town Board authorize the transfer of the sum of $32.37 from Account
#A1990.4 to Account #A9040.8 in order to eliminate the overdraft
and reimburse said account, and in order to ratify and confirm the
previously unauthorized appropriation, and
WHEREAS, the sum of $1,400.00 has been appropriated to Account
#A9060.8 (Hospital & Medical Insurance). This account has been over -
expended and overdrawn by the sum of $14.84 in order to meet the
bills presented for payment. The additional monies were obtained
from Account #A1990.4 (Contingent -Town Wide). We, therefore,
recommend that the Town Board authorize the transfer of the sum of
$2,450.00 from Account #A1990.4 to Account #A9060.8 in order to
eliminate the overdraft and reimburse said account, and in order
to ratify and confirm the previously unauthorized appropriation, and
in order to meet the monthly bills for the remainder of the 1972
fiscal year, and
WHEREAS, the sum of $8,000.00 has been approriated to Account
#89010.8 (State retirement -Part Town). This account will be over-
expended and overdrawn for the year by the sum of $679.50. In order
to meet the bills presented for payment, the additional monies were
obtained from Account #81990.4 (Contingent -Part Town). We, therefore,
recommend that the Town Board authorize the transfer of the sum of
$679.50 from Account #81990.4 to Account #B9010.8 in order to elimin-
ate the overdraft and reimburse said account, and in order to ratify
and nfirm the previously unauthorized appropriation, now therefore
be it

IN THE MATTER OF THE ESTABLISHMENT OF
THE CENTRAL WAPPINGER WATER IMPROVEMENT
AREA IN THE TOWN OF WAPPINGER, DUTCHESS
COUNTY, NEW YORK, PURSUANT TO ARTICLE 12c
OF THE TOWN LAW.
WHEREAS a map, plan, and report have been prepared in such
manner and in such detail as has heretofore been determined by
the Town Board of the Town of Wappinger relating to the establish-
ment of a proposed Water Improvement Area to be known as the
Central Wappinger Water Improvement Area in the Town of Wappinger,`
Dutchess County, New York, pursuant to Article 12c of the Town
Law, and
WHEREAS said map, plan, and report have been duly filed in
the Clerk's office of the Town of Wappinger for public inspection,
and
WHEREAS said map, plan, and report were prepared by Rudolph
E. LaPar, a competent engineer, duly licensed by the State of
New York, showing the boundaries of the proposed Improvement
Area and a general plan for the water system, and
WHEREAS the improvements proposed as set forth in said plan
and report consist of water supply, water storage facilities,

water mains, pumping stations and associated facilities located
in the Town of Wappinger, and
WHEREAS the improvement will provide for the central area
of the Town of Wappinger,and
WHEREAS the Town Board.of the Town of Wappinger did adopt
an Order on or about May 8th, 1972, providing that on June 1,
1972, a public hearing would be held upon said map, plan and
report at the Roy C. Ketcham High School, Myers Corners Road,
Town of Wappinger, and
WHEREAS it was subsequently determined that said Roy C.
Ketcham High School was not available that night for the public
hearing and the Town Board of the Town of Wappinger adopted a
subsequent Order at a special meeting duly called and held on
May 15, 1972, wherein and whereby the place of the public hearing
was changed to the Wappinger Junior High School, at 8 o'clock
P. M., Eastern Daylight Time, on June 1, 1972, and
WHEREAS the said Order was duly posted and published and
the public hearing was held on June 1, 1972, at 8 o'clock P. M.,
Eastern Daylight Time, when several persons appeared and spoke in
favor of said proposal; now, upon the evidence given at said

RESOLVED and determined that (a) the map, plan and report
of Rudolph E. LaPar, Engineer, duly complies with the Town Law
requirements and is sufficient as to its description of the
proposed improvements and costs thereof; (b) all the property
and property owners within the proposed improvement area are
benefited thereby;

(c) all the property and property owners benefited are included
within the limits of the proposed improvement area and (d) it
is in the public interest to create the water improvement area;
and it is further
RESOLVED and determined that the establishment of a water
improvement area be approved; that the improvements set forth on
the map, plan and report be constructed and the service therein
mentioned be provided for upon the required funds being made
available or provided for; and that such improvement area shall
be designated and known as the "Central Wappinger Water Improve-
ment Area" and shall be bounded and described as follows:
All that tract of land in the Town of Wappinger
bounded and described in Schedule A, attached
hereto and made part hereof.
and, it is further
RESOLVED and determined, that the proposed improvements,
including the costs of rights of way, construction costs, legal
fees and all other expenses shall be financed as follows: by a
bond issue over a period not to exceed forty years, and it is
further
RESOLVED and determined that the maximum amount to be ex-
pended for said improvement is $3,200,000.00, and it is further
RESOLVED and determined that the aforesaid bonds which are
to be issued, together with the interest thereon, are to be paid
for in the first instance by assessments levied upon the several
lots or parcels of land within the improvement area as described
aforesaid in just proportion to the amount of benefit which the
improvements shall confer upon the lots or parcels within said
improvement area; and it is further
RESOLVED and determined that the Town Clerk shall, within

ten (10) days after the adoption of this resolution,
certified copies hereof, in duplicate, in the office
Department of Audit and Control at Albany, New York,
with an application by this Board, in duplicate, for
to create the improvement area herein; and that such
shall be, executed by and on behalf of the Town Board by the
Supervisor of the Town, and it is further
RESOLVED and determined that the resolution shall take
effect immediately upon its adoption and as provided by Town Law..

A letter was received from the Town of Wappinger Planning Board
regarding Ye Olde Apple OrChard.Recreation area. In view of the
Attorney's opinion to the Planning Board advising rejection of the
offer of this recreation land, they would appreciate being advised
of any action the Board takes in this matter.
MR. JENSEN moved to take Mr. Rappleyea's recommendation, that the
Town not accept the recreation land offered by YOAO, and forward
his recommendation to the Planning Board and other agencies.

Mr. Rappleyea informed the Board that there was some question regard-
ing sewer hook-up payment regarding several lots in YOAO. The prob-
lem was that these lots had been sold to third parties, the question
was, was the hook-up fee charged to them or was it the responsibility
of the Developer. If these fees were paid by the purchasers of the
property, this would reduce the obligation of the Developer. He
deemed it the best solution not to give anyone any permits.
MR. DIEHL moved that John Holler, Building Inspector hold up on
the issuance of Building Permits for YOAO, after receiving the
opinion of the Attorney to the Town.

An informal bid was received from James E. O'Shea for the installa-
tion of a traffic signal at the intersection of All Angels Hill Road
and Old Hopewell Road.
The first bid was for a wooden pole and its installation plus span
wire @ $350.00.
The second bid was for a 3 section, 4 way traffic light, and one
adjustable time traffic controller @ $2,475.00.
MR. CLAUSEN moved to accept Mr. O'Shea's bids for the pole with
installation, and the traffic light with adjustable time controller,
at $2,475.00 and $350.00 respectively.

Mr. Horton brought up the subject of maintenance on these lights,
and indicated that the Board should look into contracting with some
firm for this express purpose.
Under New Business the Chair recognized Peter Borzi who stated that
he had been late for the Public Hearing on the Guarino rezoning
application, and wished to register an objection to the request.
George DeGiacomo, being recognized by the Chair, brought up the
roads in Angel Brook Estates. They have been kept well informed by
Mr. Rappleyea of the proceedings by the numerous parties involved.
However, nothing is being done again, and all be would like to ask
is that if, within the next week or so, we don't see some concrete
evidence of road work being done, perhaps the Board could discuss
some of the alternatives at their next special meeting. Mr. Diehl
stated that this matter was discussed with Mr. Rappleyea, whose
opinion was that no direct' action could be taken until July lst.

Mr. Rappleyea stated that on June 22nd, if the Board has had no
evidence that the developer is working, the Board authorized Mr.
Lapar to make a survey, and authorize the bidding of the job, and
then, come August, when the Board has some bids they can make a
decision as to what is to be done.
MR. DIEHL moved that Mr. Rappleyea be authorized and empowered to
take whatever necessary steps for the June 22nd Special Meeting, to
make them as forceful and direct and positive as possible to see that
the work is done on the roads in Angel Brook Estates.

Superintendent Horton brought to the attention of the Board, the
problem of tree stumps, since the Landfill will not accept either
these or demolition materials. The question is what to do with them.
Mr. Diehl commented that the County should supply a place, and it
has been recommended to them that right across Rt. 376 from the
Landfill could be used for burning purposes, under the control of
the County.
MR. CLAUSEN moved that, in lieu of the fact that the Poughkeepsie-
Wappinger Landfill no longer accepts debris, tree stumps and demoli-
tion materials, a letter be sent to the Wappinger County Representa-
tives asking them to find an immediate solution to the problem and
so direct the Town Board.

on June 12, 1972, at the Town Hall, Mill Street, Wappingers Falls,
New York, on an Ordinance Amending the Zoning Map of the -Town of
Wappinger.
Supervisor Diehl opened the Hearing at 7:35 P.M.
