1972-01-26 SPMA Special Meeting' of the Town Board of the Town of Wappinger was held on January1 26, 19172, at .the Town Hall, Mill, Street, Wappingers Falls, New,York.. The meeting was called by Supervisor Diehl for 7:00 P.M., January 26, 1972,. Notification of the meeting was mailed to each Board member. op January 2.0, 1972. Present: Louis Diehl, Supervisor Louis Clausen, Councilman Harry Holt, Councilman Leif Jensen, Councilman Stephen •Saland,. ,Councilman Elaine H. Snowden, Town Clerk Others Present: Allan E. MR. CLAUSEN moved the,bill be paid subject to audit. Seconded by Mr. Holt. Motion Unanimously Carried Mr. Diehl announced that this meeting+had been called prinfaril'y for the purpose.of'bus.iness before the,Board with regard to Atlas Water Company. The following report was received: ENGINEER'S REPORT IN THE MATTER OF.A PROPOSED WATER IMPROVEMENT IN THE AREA OF QUIET ACRES AND WILDWOOD SUBDIVISIONS AND WAPPINGER SEWER IMPROVEMENT #1 USING THE FACILITIES OF ATLAS WATER COMPANY Presently existing and proposed project adjacent to existing lines and the lines contemplated inthe proposed expansion of the Atlas Water Company show approximately 800 units. The Atlas Water Company claims that by mid 1973 there would be 2,000 units. Using the Atlas Water Company's figure of $0.50/100 ft. the gross income per year would be approximately $40,000. A conservative Operation and Maintenance figure of $60,000 plus the cost of water of $0.26/100 cubic feet would require an income of over $80,000 per year, meaning that the cost to the individual taxpayer would{be in excess,of $1 per 100: cubic feet. In conclusion, it is Myprofessional opinion that the ecomo- mics of the proposed Water Improvement are so questionable that I must recommend that it not be undertaken by the Town Board. Respectfully' Submitted, s/ Rudolph E. Lapar Engineer to the Town, Mr. .Diehl asked if this was -the complete.report. When told that was all, nothing, else accompanied it, he asked how Mr. Lapar ascertained his income as being $40,000 on thei basis' of. 200,000 units. Mr. Lapar said he didn't use 200,000 units. Mr. Lafko continued questioning the validity of the report, figures, and units used for its basis. Mr. Lapar stated that his units were based on present plans in the works dn. the. Planning Board plus the existing subdivisions. Mr. Lafko continued to expound on both Mr. Lapar's report and the report he submitted to the Board on January 15, 1972. Mr. Saland pointed out that Mr-. Lafko himself had cautioned: the Board at the Public Hearing on the Town wide water .a strictm.abo.ut over -estimating. users. Discussion drifted into the realm of the_ Environmental Conservation hearing, at which point Mr. Clausen 'attempted to draw the discussion back to the fact that Mr. Lapar's report was based solely on the proposal Mr. Lafko had submitted ,to, "then +B' atd on, January 15th. J.-Lafko and Dave Alexander be made part of the minutes so that it corresponds to what Mr. Lapar has.sub- mitted to the Town Board. . He admonished the Board for not allowing him to expand in the area at his own risk and depriving residents of the area of reduction in water rates and reduction of their fire rates. There was further discussion on the subject between the Board, Mr. Eck, Mr. Cortellino, Mr. Rappleyea and Mr. Lafko. Mr. Diehl stated that the Board had read Mr. Lapar's report, heard his statements, Mr. Lafko's questioning of the report, and heard Mr. Rappleyea's advice, so at this time its time to act in regard to a Special Meeting that washeld here in the Town on January 15, 1972, at which time all councilman, the Supervisor, Town Clerk, Allan Rappleyea and Fred J. Lafko were present. A Resolution was offered at that time by Mr. Holt and seconded by Mr. Diehl, summarily stating that the Town of Wappinger hereby withdraws any opposition to the application of Atlas Water Co. for the extension of its consent area, and further directing the Attorney to the Town to so notify the Department of Environmental Conservation of this action. Mr. Diehl asked Mr. Holt if he would rescind his motion. MR. HOLT moved to rescind his resolution, regarding withdrawal of objection to the application of Atlas Water Company extension of January 15, 1972. Seconded by Mr. Diehl. Motion Unanimously Carried Mr. Diehl stated there was a second resolution adopted at the January 15, 1972 meeting, offered by Mr. Holt and seconded by Mr. Clausen, summarily stating that Allan E. Rappleyea and Rudolph E. Lapar be directed to prepare legal and engineering plans for the formation of a water improvement area generally in the Wildwood- Quiet Acres area as well as the area known as the Wappinger Sewer Improvement #1 and lands along Route9 and that such plan include lease or purchase of Atlas Water Company. MR. HOLT moved to rescind his resolution regarding direction to Mr. Rappleyea and Mr. Lapat to prepare plans for the formation of a Water Improvement Area, of January 15, 1972. Seconded by Mr. Clausen. Motion Unanimously Carried MR. DIEHL moved to again direct the Attorney to the Town to object to the extension of the area in the application of the Atlas Water Company and so notify the Department of Environmental Conservation. Seconded by Mr. Saland. Motion Unanimously Carried Mr. Lafko asked on what basis were they objecting. Mr. Diehl said that in his mind various questions had arisen of the feas- ibility. Mr. Saland added -that the adequacy with which Mr. Lafko had been serving his existing area was, and has been -questioned, at various times. Mr. Rappleyea submitted that it was also a r question as to whether or not its in keeping with the Town's plan to enter into public water facilities; and also evident at the time of the Public Hearing that projections of the customers that would support this proposal of Mr. Lafko's was based upon several rezoning propositions. Mr. Diehl summed it up saying that generally the objection is basically on the objections that the Board has previously had, and further information that has come before the Board. A request for permission to hook up to the Rockingham Farms Sewer District as a tenant was received from Donald A. Jones Sr. All Angels Hill Road. This had been referred to Vincent C. Kelley, Engineer to the District. Mr. Kelley's recommendation is as follows: Town of Wappinger,Mill Street Wappingers Falls, New York Attention: Mr. Lou Diehl January 25, 1972 Re: Connection of Mr. Don Jones To Rockingham Sewer District 41 e Gentlemen: I have investigated the request of Mr. Jones to connect to the Rockingham District system. Mr. Jones' situation is such that he cannot, except at extra- ordinary expense, solve his own sewage disposal problems. I recommend that he be permitted to connect. The conditions of connection should be the same as previously stipulated for two other out -of -district residents permitted to connect. In making this recommendation, as with the two prior recommendations, I am well aware that the plant is already over -committed on a design basis. The extent of the over-committment is, however, of such magnitude that, in my opinion, several additional single family house connections made to alleviate severe hardship has no significance to the overall problem. Very truly yours, s/ Vincent C. Kelley MR. DIEHL moved that Donald A. Jones, Sr. be granted permission to become tenants to the Rockingham Sewer District, subject to the following conditions: 1. The connection is to be made at Mr. Jones expense and subject to inspection by the Town Plumbing Inspector. 2. That the Tap fee of $240.00 be paid prior to connection to the sewer line. 3. That Mr. Jones agree to pay the, same sewer service charge as the district residents. 4. That Mr. Jones agrees that he will become part of any Sewer District or Sewer Improvement Area formed in the future which would include his property under ordinary circumstances, and he hereby waives any objections to the formation of such district or Improvement Area. Seconded by Mr. Holt. Motion Unanimously Carried MR. DIEHL moved that, effective immediately, any property owners on record wishing to connect as a tenant to any Town Sewer District or Water District in the future, and said persons are outside of the said district, will be subject to the conditions :previously established, with the exception of the service charges. These service charges for either/or both Water and Sewer Districts hereby t? L 1 are established at double the established rates of said district or districts. Applications will be considered by the Board upon re- view as to the nature of the need of the applicant by the engineer to the district and receipt of his recommendation. Seconded by Mr. Holt. Motion Unanimously Carried MR. JENSEN moved that a letter be addressed to the Engineer to the various district instructing them that any future customers outside the district wanting to become tenants would have to show a definite need, a type of need outside of economics, that cannot be solved in any other way, since a committme-nt'.. is owed to the people that are in those districts and the expansion of those districts.
