Adjournment i 285 • The Regular Monthly Meeting of the Town Board of the Town of Wappinger was held on October 12, 1971, at the Town Hall, Mill Street, Wappingers Falls, New York. Deputy Supervisor Clausen called the meeting to order at 8:08 P.M. Present: Louis Clausen, Deputy Supervisor G. Donald Finnan, CoUncilman Harry Holt, Councilman Elaine H. Snowden, grown Clerk Absent:. Louis Diehl,.Supervisor James Mills, Councilman Others Present: William Horton, Superintendent of Highways Allan Rappleyea, Attorney to the -Town The Reports for September were received from the Supervisor, Town Justices and,. Building Inspector. MR. FINNAN moved the reports be accepted and placed on file. Seconded by Mr. Holt. 3 Ayes 0 Nays Mrs. Alsdorf reported to the Board on the September 22nd meeting of the Centennial Committee. A. nominating Committee was appointed. She asked for interested residents to participate. The next meeting will be held at the Old Chelsea School (Liberty St.) on the 17th of November at 8:00 P.M. FINNAN moved the bills be paid, subject to audit. Seconded by Mr. Holt. 3 Ayes 0 Nays Mr. Cornell had requested to speak before the Board regarding Wildwood Forest storm drainage and roads. He recalled his discus- sion with the Board at the September meeting regarding the drainage in Wildwood. Mr. Frederick E. Singer, P.E. had prepared a report (for Mr. Cornell) on the hydraulic condition of the Town's Storm Drainage system of Section 2 & 2A of Wildwood Forest on Widmer Road, installed by the Town designed by and under Rudolph Lapar, P.E. Mr. Cornell read from Mr. Singer's report and then filed it with the Town Board. (Mr. Holt, before Mr. Cornell began reading, asked simply that the report be submitted to the Board so that they might study it with the Engineer to the Town. prior to public discussion; (he was overruled.) MR. CLAUSEN moved the report of Mr. Frederick E. Singer, P.E. submitted by Mr. Cornell, be referred to the Engineer to the Town, Attorney to the Town and Highway Superintendent for purview and recommendation. Seconded by Mr. Holt. 3 Ayes 0 Nays Mr. Eck, having requested to speak before. the Board regarding water and sewage, first offered his services for the vacancy on the Plan- ning Board. He then referenced to last month's meeting at which he had spoken of a municipal water. He said he had spoken to two large water suppliers in the Town, and they have indicated they, would consider selling their systems at -about $500 a curb cock if they were sure, the Town was really interested. The Town should then proceed with,plans to.be submitted. to Audit & Control. He contends that the cost of the two large systems plus hiv_own would,be about $500,000,and.at.present these systems serve about 900 customers. If one district were formed, the rate wo41d_be approximately $50 a year a house, as compared to an approximate $100 a year they pay now. He added that Mr. Lapar had concurred with his statements. As for Atlas Water system or any other system wishing to extend their area, there should be no franchise given. Every foot of pipes put in the ground should be deeded to the Town immediately, so when the Town is ready to move on municipal water there would be no recourse from the developer. Also,. Fred Lafko and Dave Alexander should offer their water system to the Town for $500 a curb cock now. 3 287 f He concluded by noting that he had gone to Albany,on the Wappinger Sewer Improvement, with Town officials and several interested people last Friday (Oct. 1st) and was shocked that Messrs. Cornell Lafko and Adler -Brenner were able to hold up this sewer improvement. He asked that interested residents write Mr. Berns, Assistant Coun- cil, Department of Audit and Control indicating their desires to see the improvement area approval. MR. HOLT moved therules be suspended, seconded by Mr. Finnan and carried., Mr. Bisom asked Mr. Eck some questions on the capacity of the total water systems he was speaking about. Mr. Cornell spoke of a feasibility study requested by Audit and Control, between the Adler -Brenner report and Mr.Lapar's, and, that the Town Board should accept, by resolution,; the study, prior to submission to Albany. If Audit & Control approves the Improve- ment Area by the 17th, he'd do anything the Board asked of him. MR. CLAUSEN moved the rules be resumed, seconded by Mr. Finnan and carried. Mr. Lafko, having requested to speak before the Board in reference to the expansion of Atlas Water Company, requested that he speak after the Engineer's report was read. The following report was read: ENGINEER'S REPORT IN THE MATTER OF THE APPLICATION OF ATLAS WATERWORKS CO. For Consent to Extend the service area and authorization to supply said service area. General: I have examined the map -and specifications- of Atla-s Water- works Co. as prepared by Wendell R. Inhoffer, P.E. Conceptually I have always been in favor of the extension of any water system that could eventually acrue benefits to the resi- dents of the Town of Wappinger. If the proposed extension of this system follows the pattern set up 1py the approval of the "Cpgar line" and the lines_in proposed Dutchess Heights, Section 2, then it certainly would be of benefit "conceptually" to the entire Town. 2 Specific Recommendations and Requirements: 1. All pipe to be either cast iron pipe or ductile iron pipe of the pressure class required as specified in the Town Water Law appendix. 2. It shall be required that the hardness of the water be reduced to normal limits (Water Supply Application #4151, Section 8 indicates a hardness of 140 ,parts per million.) 3. Any pressure deficencies within the system as evidenced by the many complaints from WPildwood, Section 2A must be eleviated and other problems within the system which may Occur therefrom, such as excess pressure in lower areas, must be adequately remedied. (A detailer hydraulic analysis must be submitted before any approval can be given.) 4. The possible breakdowns within the system due to the 3 pumping stations should be eliminated by consolidation into 1 or 2 pumping stations. Again this would aepend on the hydraulic of the system and the possible excess pressure• in the Quiet Acres portion of the system. However, any newer portion of the system would certainly not be effect- ed and should be designed to have only one pumping station. 5. The location of the proposed tank appears to be in a residential subdivision and if approved, adequate estetic considerations should be incorporated in the design. MR. FINNAN moved that the above report, as submitted by Mr. Lapar, be received. Seconded by Mr. Holt. 3 Ayes 0 Nays Mr. Lafko first commented that this report was neither signed or dated. He then noted, that in this report, according to Local Law #2, '67, Section 8, recommendation of approval or nonapproval must be in writing, and nowhere in this report does he find where this has been done. He further took exception to the first recommenda- tions for cast iron or ductile iron pipe-, indicating it had its drawbacks. Mr. Clausen interjected that there would be a public hearing on this application, at which time it would be appropriate to bring up the technical points, it was not appropriate at this time. MR. FINNAN moved that the rules be suspended, seconded by Mr. Holt, and carried.' Mr. Cortellino and Mr. DiMaria asked that the facts b e 289 presented to the public prior to the public hearing. MR. CLAUSEN moved the rules be resumed, seconded by Mr. Holt and carried. RESOLUTION SETTING PUBLIC HEARING ON APPLICATION OF ATLAS WATERWORKS COMPANY The following resolution was introduced by COUNCILMAN HOLT, who moved its adoption. WHEREAS Atlas Waterworks Company has filed a petition with the Town Board of the Town of Wappinger seeking its consent for the extension of a water system pursuant to Local Law #2 of 1967, and WHEREAS the matter has been referred to Rudolph E. Lapar who has filed his report thereon, NOW THEREFORE, BE IT RESOLVED That the Town Board of the Town of Wappinger shall conduct a public hearing on the 26th day of October, 1971, at 8:00 o'clock in the afternoon of that day at the Town Hall, Mill Street, Wappingers Falls, New York, to hear all persons concerning the petition of Atlas Waterworks Company. Seconded by Mr. Clausen 3 Ayes 0 Nays The following letter was received: October ,_1, 1971 10 Russ Place_ Wappingers Falls, N.Y. Town Board Town of Wappinger Mill Street Wappingers Falls, N.Y. Gentlemen: On date of March 24th, 1969, I advised the Town Board that there was a defective condition existing on the sewer line owned by the L&A Filtration Corp. This defective condition exists between the main sewer line and the hookup to my property at 10 Russ Place, Wappingers Falls, N.Y. The defective condition is entirely on the line now owned by the L&A Filtration Corp. I was advised by the Town Board that in the event the Town accepted or purchased the sewer lines from the L&A Filtration Corp. that I would .be rensible for this portion of the sewer line that has this defective condition. Be advised that this defective condition has again shown up as evidenced by the enclosed bill for rental of a router to clear this defective condition. Be also advised at this time that I completely reject your conten- 9 tion that if the Town of Wappinger takes over this existing sewer line that I will be responsible for all future repairs. I refuse to accept ownership or responsibility for the portion of the sewer line under the Town road. Having had prior notice of a defective condition, I believe the Town of Wappinger to be legally responsible and in the event of future problems shall take all legal steps necessary for my protection. By this letter, I am requesting the Town Board to stipulate at this time that they will be responsible for any and all repairs on the above mentioned portion of the sewer line. Correspondence was received from Dutchess County Department of Planning regarding the surplus land disposal at Castle Point. MR. HOLT moved this correspondence be received, placed on file and a copy forwarded to George Schlathaus. Seconded by Mr. Clausen. 3 Ayes 0 Nays The matter of appointments for the Board of Assessment review was placed before the Board. MR. CLAUSEN moved that appointments for the Board of Assessment review, and vacancies on the Planning Board and other committees be tabled to the November regular meeting (Items 4g and 4K on AGenda). Seconded by Mr. Holt. 3 Ayes 0 Nays MR. HOLT moved the rules be suspended, seconded by Mr. Finnan and carried. Mr. Bisom asked several questions on the Board of Assessment review. MR. CLAUSEN moved the rules be resumed, seconded by Mr. Holt and carried. Mr. Rappleyea had forwarded Mr. Justice Hawkins decision on Nattin 291 Realty, Inc. vs. Joseph E. Ludewig, Zoning Administrator and Building Inspector and the Town Board of the Town of Wappinger. The decision was favorable to the Town, sustaining the Town's actions in the zoning of certain lands on March 9, 1971. MR. CLAUSEN moved that Mr. Justice Hawkins be received and placed on file. Seconded by Mr. Finnan. 3 Ayes 0 nays MR. FINNAN moved the rules be suspended, seconded by Mr. Holt and carried. Dr. Engleman spoke regarding the decision. MR. HOLT moved the rules be resumed, seconded by Mr. Finnan and carried. September 29th, 1971 Town Board Town Hall Mill Street Wappingers Falls, Ny Re: Louis Eck, et al vs. Town of Wappinger, et alJvs. Town of Wappinger, et al Account No. 12.0341, Account No. 120350, Account No. 119655, Account No. 120360, and Account No. 119705 Gentlemen:_ As you are aware, the hearings were conducted by a Referree in the above entitled matter. The Referee has rendered his report and has found that; 1. Account No. 120350 - assessment correct 2. Account No. 1196551- assessment excessive to the extent of $2,570.00 3. Account No. 120341•- assessment.excessive to the extent of $3,190.00 4. Account No. 120360,- assessment excessive to the extent of $3,040.00 54- Account No. 119705.- assessment correct The Referree's findings would have to be confirmed by the Supreme Court which would require further proceeding. In the interval, I have received the enclosed letter from Mr. Effron wherein he ,proposes that all five (5) proceedings would be withdrawn if the Town were to pay the stenographer's fee and the Referee's fee. In the event the Referee's findings were confirmed, the Town would be obliged to pay three-fifths (3/5ths) of these fees anyway and in addition, refund that portion of taxes for which there is an over assessment. 292 As you may be also aware, there is only one (1) year involved in this proceeding. Under all the circumstances and in consideration of the proposed settlement, I recommend that the Town Board concur in the settlement of these claims as proposed by Mr. Effron. Allan E. Haven in each of the'proceedings to review the assessments on the 1969 Assessment Rolls for the above accounts. In view of the determinations by Referee Haven, we believe, without prejudice, that all five proceedings can be disposed of if the Town of Wappinger will pay the Court Stenographer Fees and the Referee's fees for all five proceedings. If the Town Board agrees to this, the Petitioners will waive all tax refunds and court costa due them pursuant to the Referee's - Reports. Very truly yours. s/ Merrill S. Effron MR. FINNAN moved, based on the recommendations of Mr. Rappleyea, that Mr. Rappleyea be authroized to settle Mr. Ecks' tax reviews as quickly as possible. Seconded by Mr. Holt. 3 Ayes 0 Nays MR. FINNAN moved tosuspendthe rules, seconded by Mr. Holt and carried. Mr. Lafko asked if the attorney's fees, in this instance, fall under the terms of his contract with the Town. Mr. Rappleyea answer- ed "no". Mr. Rappleyea briefly explained the costs. - MR. HOLT moved the rules be resumed, seconded by Mr. Clausen, and carried. A letter was received from Mr. Rappleyea., with attached information, indicating that a special preference for a November trial on the Town of Wappinger vs. Peerless Insurance Company and Malcolm 290 Cornell had been granted, (referring to the bond for the roads in Wildwood 2.) MR. FINNAN moved to receive Mr. Rappleyea's information. Seconded by Mr. Holt. 3 Ayes 0 Nays Letters were received from Mr. Carmen Guido, 6 Gary Place, Mr. & Mrs. D.M. Howard, Circle Drive, Mr. & Mrs. N. Bishop and Mr. & Mrs. C. Jensen, Myers Corners Road, all indicating some type of drainage problem. Mr. Clausen asked Mr. Horton if he was aware of these problems, and if he had any recommendations regarding them. (Mr. Holt added the name of Mr. & Mrs. Dursee, Gold Road to the list.) MR. CLAUSEN moved that these problems mentioned tonight and the letters received regarding drainage problems be referred to Mr. Horton, Mr. Rappleyea and Mr. Lapar for their recommendations. Seconded by Mr. Finnan. 3 Ayes 0 Nays A request had been received from Mr. Ponte, principal at the Wappinger Junior High School for the use of two voting machines at the Jr. High for a school election, October 14th and 15th. MR. FINNAN moved the Wappinger Central Jr. High School be granted permission to use two of the Town's voting machines, under the supervision of one of the voting machine custodians, on October 14th and 15th. Seconded by Mr. Holt. 3 Ayes 0 Nays An invitation was extended to all Town Board members from the Town of Wappinger Recreation Commission to attend the Annual Horse Show on October 17th, and take part in the presentation of trophies. A request was received from John Holler, Building Inspector, seek- ing permission to lease a portable transmitter for the Building Department for the remainder of 1971 and 1972, at an approximate cost of $35.00 per month. Mr. Clausen directed this request be tabled for further information. 29 The following letter was received: October 7, 1971 Town Board Town of Wappinger Mill Street Wappingers Falls, New York 12590 Re-: Oakwood Knolls Fuel Oil Distribution System Gentlemen: Confirming my telephone conversation with Mr. Rudolph E. Lapar, P.E., please be advised that in compliance with the present -New York State Law, we are in theprocess of arranging to have our storage tanks filled with a slurry mixture before abandoning them. We have completed the disconnecting of the piping serving this distribution system and all the product has been removed from the lines negating any problems that could possible arise. CLAUSEN moved this letter be received and placed on file. Seconded by Mr. Finnan. 3 Ayes 0 Nays A letter was received from Nicholas S. Johnson, President of the - Royal Ridge Homeowners Association, updating the Board on the progress of the expanded water supply for this development. The Chair recognized Mr. Johnson, who stated that he only wanted to report to the Board, that, so far, all they -have is a hole in the ground and a runaround. Mr. Holt suggested the Town Clerk to address a letter to John M. Reed, local attorney for Tri-Pac, and ask him the status of the water supply for Royal Ridge at this date. At a meeting earlier this year, a meeting had been held in Mr. Reed's office, at which time it was understood that Tri-Pac would proceed, without delay, to install a well and a 30,000 gallon tank to sup- plement the water supply for Royal Ridge. A letter was received from Susan Pike, Acting Zoning Administrator it 295 requesting that Betty Ann Geoghagan be appointed as Secretary to the Planning and Zoning Boards and set an annual salary. The matter was tabled until Mr. Diehl was present and could recommend a salary. Under committee reports, Mr. Finnan asked that a- letter be read from the New York State Department of Transportation, in answer to the Town's queries regarding .the completion of :the lights and paving at the intersections of Myers Corners and"Old Hopewell Roads. it was indicated that the telephone strike was the underlying cause of the delay. Mr. Rappleyea reported, with respect to Dutchess Heights, (roads), that he had been in touch with the Bonding Company and they have advised him that they are attempting to press the matter of forcing the principles to perform the work. He has been in touch with the principle and the contractor who is supposed to do the job, there is still some hope that it can be done. A lawsuit is being pursued, however. - A letter was received from Edgar Petrovits, Commissioner Dutchess County Department of Public Works, regarding the renewal of the contract and agreement between the Town and County for the control of snow and ice on county roads. Mr. Horton recommended this resolution be tabled until he received a committment on how much more the County would undertake. MR. FINNAN moved, based on the Highway Superintendent's recommenda- tion, this matter be tabled until the November Regular Meeting. Seconded by Mr. Holt and carried. The following report was received: IN THE MATTER OF THE ESTABLISHMENT OF THE WILDWOOD SEWER DISTRICT IN THE TOWN OF WAPPINGER, DUTCHESS COUNTY, NEW YORK, PURSUANT TO ARTICLE 12-A OF THE TOWN LAW I, ELAINE H. SNOWDEN, duly elected and acting Town Clerk of the Town of Wappinger, do hereby certify that a petittion was filed with me on August 20, 1971, requesting a Referendum 'be held pursuant to Section 209E of the Town Law upon the proposi- tion concerning the establishment of the Wildwood Sewer District. 2 The said proposition was thereafter submitted by me to the Town Board of the Town of Wappinger as follows: Shall the Wildwood Sewer District be established pursuant to the Resolution of the Town -Board of the Town of Wappinger dated July 21, 1971, providing for the approval of the map, plan and report covering the Wildwood Sewer District, which said map, plan and report provided for the financing of said district by the issuance of serial bonds in the sum not to exceed $412,500.00 to mature in annual installments over a period not to exceed thirty years (30) ? The Town Board of the Town of Wappinger thefreafter, by Resolution dated August 30, 1971, ordered a Referendum to be held on the 28th of September, 1971, on said proposition. That, said Referendum was duly held on September 28, 1971, after due notice, and the results of said Referendum are as follows: Yes: 232 No: 30 Blank: 2 Total Vote Cast: 264 Said Proposition was duly adopted as said Referendum. Elaine H. Snowden Town Cleri Town of Wappinger Mrs. Snowden informed the Board that the above report had been filed with the Department of Audit and Control, and the Dutchess County Clerk, and the application for the Wildwood Sewer District has been filed for the approval of Audit and Control. MR. CLAUSEN moved the report on the Referendum on the Wildwood Sewer District be received and placed on file, and accepted that it has been properly filed with other agencies. Seconded by Mr. Finnan 3 Ayes 0 Nays Mr. Clausen asked if there were any questions from the floor. Walt Cronin referred back to the traffic problem, first thanking Messrs. Finnan & Clausen for their drawing to the attention of the Village and the State the problem at the intersection of Route 9 and New Hackensack Road. He pointed out that traffic is now cut- ting through the shopping center to avoid this light, and with MacDonalds opening something else will have to be done regarding this intersection. He also noted that in New Jersey the green arrow light goes on before the signal light turns green. Mr. Clausen directed that the Town Clerk address a letter to the New York State Department of Transportation and Dutchess County Department Public Works indicating a request to restudy the cycle at the intersection of New Hackensack and Route 9, (the time lapse doesn't allow enough traffic to pass from New Hackensack on to Route 9), suggesting the left turn arrows go on before the light turns from red to green. (four way red lights preceeding the left turn arrows.) Mr. Bisom, being recognized by the Chair, asked if a Comptroller will be considered for 1972. Mr. Lafko, referring back to drainage problems, asked where the problem was on Gary Place, then commented that the Town had just put in drainage in that area last year. Mr. Knud Clausen had a few questions regarding increases in salaries in the tentative budget, indicating he didn't feel large raises appropriate. MR.
