ADJOURNMENT I 255 The Regular Monthly Meeting of the Town Board of the Town of Wappinger was held September 13, 1971, at the Town Hall, Mill Street Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:07 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman G. Donald Finnan, Councilman Harry Holt, Councilman James Mills, Councilman Elaine H. Snowden, Town Clerk Others Present: William Horton, Superintendent of Highways Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town, . Mr. Diehl announced that, due tothe,number of. interested residents, the resolution concerning Dutchess He;igh.ts, Inc. will be the first consideration of the Board. The following Resolution was introduced by SUPERVISOR DIEHL who moved its adoptioi. WHEREAS the development known a&-Dutchess Heights Incorpora- ted has not been completed in accordance with the plat approval of the Town of Wappinger Planning Board,, and WHEREAS the Town of Wappinger extended the .time for the completion of the roads and improvements until September 15th, 1971. NOW THEREFORE, BE IT RESOLVED, that the Town Bui1ding.Inspector, Town,, Engineer, and the Attorney to the Town are! ..herebyautiorized and directed on September 16th,,1971, to commence any and all necessary proceedings to compel Dutchess Heights Incorporated and Peerless Insurance Company, its bonding company, to complete the construction and improvements in Dutchess Heights, Incorporated, Section I, and That pending the completion of said improvements, the Town Building Inspector is hereby authorized and directed not to issue any further building permits or certificates of occupancy for the development known as,Dutchess Heights.: Incorporated and BE IT FURTHER RESOLVED that, the Attorney to the Town is hereby authorized and directed to commence whatever actions are necessary to compel the completion of the, project in accordance with the :plans and aecifications as provided by the Town of Wappinger Planning Board. Further disiUss,ibn was held by the concerned residents with the Board regarding the responsibilities of all of the problems th' Tconnection' with these, 'tads, and the action the Board just took. Mr. Diehl called a Special• Meeting of the Town Board in order"• to meet' with the Engineer' to the Town, and Highway Superintendent to receive 'their reports'and discuss their findings on these problems. The residents were also informed that this would-be a public meeting. The reports for August were received from the Supervisor, Town Justices and Building Inspector. MR. CLAUSEN moved these ' `epdrts be accepted and placed on file. MILLS moved the bills be paid, 'subject t� audit. Seconded by: Mr. Clausen Motion Unanimously Carried Dorothy Alsdorf, Town Historian, spoke to'the Board regarding the Town Centennial. She mentioned that the 3rd meeting for the 1974 Centennial•would be held at 8:00 P.M. on September 22nd at'the Deerhill Conference Center and any interested resident of the -Town was welcome. At this time a nominating committee will be appointed. 3 257 , Mrs. Snowden stated that proposed budgets for the year 1972 for the Fleetwood Manor Water and Fleetwood Manor Sewer District have been delivered to her for submittal to the Town Board. Mrs. Snowden then read the following proposed budgets: PROPOSED 1972 BUDGET FLEETWOOD MANOR WATER DISTRICT BONDED AND OTHER INDEBTEDNESS ANTICIPATED EXPENDITURES - 1972 Serial Bonds proposed to be issued Oct. 15, 1972, $66,000.00 at an estimated rate per annum of 6% • with the first principal payment due March 1, 1972 and interest payments due March 1, 1972 and Sept. 1, 1972 Principal Reduction Payment Interest payable 3/1 & 9/1 Contingency Total Proposed Expenditures ANTICIPATED REVENUE 1972: Assessment levied against 158 units on the benefit basis, to be collected with 1972 Town Tax $1,800.00 3,411.00 319.00 .PROPOSED 1972 BUDGET FLEETWOOD MANOR SEWER DISTRICT BONDED. MILLS moved that the proposed budget for 1972 of the Fleetwood Manor Water District and the proposed budget for 1972 for the Fleetwood Manor Sewer District, covering the bonded and other indebtedness of said districts be filed with the Town Clerk and be placed on the proposed 1972 budget for the Town. Motion was seconded by Mr. Clausen, and upon roll call vote was carried. Mrs. Snowden informed the Board that she had received the resigna- tion of Eugene Schuele as a member of the Town of Wappinger Planning Board. MR. CLAUSEN moved that Mr. Schuele's resignation be accepted and placed on file. Seconded by Mr. Holt. Motion Unanimously Carried Mrs. Snowden informed the Board that she had received the resigna- tion of Mr. Sidney Lipmann from the CATV Committee. MR. MILLS moved Mr. Lipmann's resignation be accepted and placed on file. Seconded by Mr. Holt. Motion Unanimously Carried Mrs. Snowden informed the Board that she had been served with Real Property Tax Assessment Reviews by the City of New York vs. the Assessor, on August 16, 1971, and the Board of Review; and Brack Construction vs. the Assessor and Board of Review, on August 26, 1971. MR. FINNAN moved that Joseph D. Quinn, Attorney, be appointed to answer and defend these Tax Reviews on behalf of the Town of Wappinger. Seconded by Mr. Clausen. Motion Unanimously Carried Mrs. Snowden informed the Board that she had been served with a Notice of Petition in the Matter of the Application of Peter Burga- zoli and Livio Burgazoli vs. the Town of Wappinger Zoning Board of Appeals on August 18, 1971. L L L L 259 MR. FINNAN moved that Allan E. Rappleyea, Attorney to the Town, be appointed to answer and defend this action on behalf of the Town 1J of Wappinger. Seconded by Mr. Clausen. Motion Unanimously Carried MR. FINNAN moved that Janet Dean and Barbara Visciarelli be appoint- ed as Dog Enumerators for the Town of Wappinger for the year 1972. Seconded by Mr. Mills. Motion Unanimously Carried The following letter was received: August 10, 1971 Elaine H. Snowden Town Clerk Town of Wappinger Town Hall Wappingers Falls, New York Case 710181 Area Speed Request Myers Corners. Area, Town of Wappinger Dear Ms. Snowden: Dutchess County This is in further reference to a 35MPH speed limit requested for the Myers Corners area, in the Town of Wappinger, Dutchess County. The investigation relative to your request has been completed and the warrants necessary for a speed restriction have been satisfied. Upon completion of the proper posting of this area speed limit, _please return both copies of the Notice of Completion to this office. Sincerely yours, s/ D. Weinstock Asst. Civil Engineer 1213.29 Town of Wappinger (a) 35 MPH within the:Myers Corners area, the boundaries of which are described in paragraph (1) exclusive of the County Road listed in: paragraph (2). 1. _Area Description: Beginning at the; intersection of the easterly right-of-way line of All Angels Road, CR94, with the southerly right-of-way line of Route 376; -thence easterly and southeasterlyalong:the southerly and south- westerly right=of-way line of Route 376 to its intersection with the westerly shore line of Sprout Creek; thence - southerly along the westerly shore line of Sprout Creek to its intersection with the northerly right-of-way line of 260 Brown Road; thence westerly along the northerly right- of-way line of Brown Road to its intersection with the northerly right-of-way line of All Angels Hill Road, CR94; thence westerly, northwesterly and northerly along the northerly, northeasterly and easterly right-of-way line of All Angels Hill Road and All Angels Road, CR94, to the point of beginning. An application was received from Jean Lee for a Hawking and Peddling License (the application had been referred to the Dutchess County Sheriff's Department, and returned indicating no criminal record in file.) MR. CLAUSEN moved to approve the application and grant Jean Lee a license for Hawking and Peddling in the Town of Wappinger. Seconded by Mr. Mills. Motion Unanimously Carried The following letter was received: Pleasant Lane Wappingers Falls, N.Y. August 16, 1971 Wappingers Town Board Town of Wappingers, New York Dear Sirs: My home is situated near the south end of the east side of Pleasant Lane, whichis at deadi end street in. the Town of Wappingers. Pleasant Lane has only one storm drain that I know of, and it is located at the northern end of the road at the intersection of Camille Drive and Pleasant Lane. My driveway is located such that it acts as a natural drain for the entire east side of Pleasant Lane south of the abovementioned storm drain. About 100 to 150 yeards of road drains naturally into my driveway. The drainage of Pleasant Lane into my driveway is especially a problem to me in the winter, since then the ground is frozen and the melted snow runoff can not soak into the ground. The water freezes solid at night and, because my driveway slopes upward toward the street, it is impossible for me to get my car out. This, of course, means that I must park at least one car on the street all winter, which interfered with Town snow removal operations. Mr. -R. Lapar, the Town Engineer, has come out to my house (on August 13, 1971) to view the situation. He agreed that I do have a problem and requested that I write this letter to the Town Board. L L 261 I would like to request that the Town Board instruct the Town of Wappingers Highway Department to make the necessary repairs and/or changes to the east side of Pleasant Lane such that my driveway no longer acts as a natural drain for the street. I would also appreciate it if this could be done prior to winter. Thank you very much. Very truly yours, s/ George. K. Schafer Mr. Diehl directed this problem of Mr. Schafer's be referred to Mr. Lapar and Mr. Horton. An application was received from Klein and Alexander for a gravel mining permit, on the east side of Route9, north of Old; Hopewell Road. Mr. Mills. commented that Mr. Alexander presently has a soil mining permit for the corner property on New Hackensack and St. Nicholas Roads and the only problem he would suspect was that that permit has probably expired and this property has not been brought up to grade. (Mr. Rappleyea was asked to look into this matter and whether this permit had -or_ had not expired.) MR. MILLS moved that the Messrs. Klein and Alexander gravel mining application be_. referred: to Mr. Lapar, Mr. Horton and the Acting Zoning Administrator, Susan Pike, ;for.their review and recommendation. Seconded by Mr. Holt. Motion Unanimously_Carried A letter was received from H.J. Maurer, Chairman of the Recreation Commission requesting a ruling or opinion from the Board regarding the parking of a camper, owned by John T. Mowrr, at the Dan Brouthers Park next summer. Mr. Mowry has been handling the mowing of the recreational -fields and although he is going to Florida, for the winter, will return in the Spring and would again handlethemowing, and the Board feels his presence at this field would help to prevent vandalism. MR. CLAUSEN moved this matter of parking a camper at this site be referred to the Attorney for his opinion. Seconded by Mr. Finnan. Motion Unanimously Carried 262 I. The following letter was received: August 31, 1971 Town. Board Town of Wappinger Mill Street Wappingers Falls, N.Y. Attention: Mrs•. Elaine H. Snowden, Town Clerk Subject: Martz Field - Section II Drainage Gentlemen: When the above subject property was originally purchased we understoodthat when storm sewers were installed at Pye Lane and Montfort Roads, the Shale Drive storm sewer (of which Martz is part) would be incorporated in this system. Storm sewers have been completed in these areas but Martz Field - Section II has been eliminated. We would appreciate being advised as to the action being taken by the Town Board and/or Mr. Lapar to correct this over- s ight. Very truly yours, s/ Hugh J. Maurer, Chrmn. Recreation Commission Mr. Finnan commented that he looked -at this situation with Mr. Schlathaus and asked. Mr. Lapar if he was familiar with it, and what now was necessary. Mx. Lapar answered ,that theyhadn't intended to do any work in Martz field, and he -hasn't been directed to do it. Mx. Mills asked if Mr. Lapar would bring in a cost figure so it could be included in the '72 Budget, if it hasn't been done this year. The Planning Board, Acting -Zoning Administrator and Secretary to the Planning. -Board, requested permission to attend -the Planning Federation Convention, to be held at the Kutsher's Country Club, Monticello, New York October 10 through the 13th. MR. MILLS moved that permission be granted to any member of the Planning Board, their Secretary, and the Acting Zoning Administra- tor to attend the Federation Convention at Monticello, and their legitimate expenses be a Town charge. Seconded by Mr. Finnan. Motion Unanimously Carried L L A letter was received from Mrs. George VanDeCarr regarding a dog problem she was involved in. The letter was directed to the Mayor of the Village, but since she felt the Town was involved, a copy had been forwarded and asked that the matter be placed on the agenda. Mrs. VanDeCarr was not present, however for further discussion on the matter. - Mr. Clausen recommended the letter be accepted and placed on file, and asked the Town Clerk to contact the Dog Warden to see if the problem has been'resolved. MR. MILLS moved the Town Clerk write''both dog wardens and Dr. Hannigan to keep the Town Cle±k's' office informed of any dogs that have been picked up and are being held at Dr. Hannigan's office so it may be published in the Southern Dutchess News. - Seconded by Mr. Holt. Motion Unanimously Carried Mr. Lafko had requested to speak before the Board to ask the status of the Atlas Water Company expansion application. Mr. Diehl in- formed Mr. Lafko that the Board has taken no action as there was some question as to what the request was. Mr. Rappleyea said briefly- that reading the application, it wasn't clear to him as to what it was in terms of whether it was an application pursuant to Local Law #2, Year 1967, or whether it was in relation to Mr. Lafko's application for an expansion of an area. Mr. Lafko asked first if there was a written report filed by the Engineer, and then, in re- sponse to Mr. Rappleyea's question, he stated that the application was filed pursuant to and in full compliance to Local Law #2, '67. Mr. Eck had requested to speak before the Board. He began by stating that as president'of his -water corporation, before selling his water system, he was offering it to the Town of Wappinger for $500.00 a curb cock. He feels this price is more than adequate for this Town to pay for any water system in this 1'own. If the Town does not pick up his option for the water system he wanted the Town Board 63 1 264 to go on record that the people he sells this system to will receive theuial eration from this Board if they want to expand this system. He said_to this Town Boar4 to rescind all franchises, given in good faith, for -,the benefit of the taxpayers in the Town unless these people : tha.t own a water company come forward and offer their water, system to this Town for $500.00 a curb cock. The Board should publically advertize stating this Town Board is not responsible_ - for the purchase pf any water system in the Town of Wappinger without first the purchaser, notifying the Board what his intentions are and inquiring what therules and regulations are with refer-__ ence towater systems. ,Politics should be put aside,and everyone should work toward better sewer and water -in the Town with reliable people. Mr. Diehl commented that Mr. Ecks' statements had merit, and perhaps if Mr. Lapar can take this one particular offer up with Mr. Rappleyea for the next Board meeting,it might be the first step in munici- pal water, supply in Wappinger. The following letter was received Mr. S. I. Petvai 2 Bell Air Lane Wappingers Falls,, N.Y. September 8, 1971 The Wappingers Town Board Mill Street Wappingers Falls, N.Y. Gentlemen: Due to the inadequate way the road was constructed and the inadequate drainage facilities on Bell Air Lane, the heavy rain- fall on August 27 and 28, 1971, resulted in thousands of dollars worth of damageto my property. I and my family were out of town when the damage occured. Upon our return, I telephoned Mr. Lapar and Mr. Horton and asked immed- iately for help. On September 7, 1971, Mr. Horton informed me that he would present the case to the Board and Mr. Lapar will create plans to solve the problem. I asked Mr. Horton to inform me within a week about when and what will be done on the towns property to prevent another.disaster of this type. As you know, the fall rainy season is almost upon us and the Creek along my property will have to be opened up and a large catch basin extending the total width of the road above my property should be constructed to protect me from any further damage of this kind. In addition, one more catch basin along my property on Aladin Court and black top gutters on Bell Air Lane and Aladin Courts are needed for proper drainage. Mr. Lapar and Mr. Horton indicated that my cooperation might be needed, by doing work on my property so the Towns construction could be carried out. I am willing to cooperate with any agreeable arrangement. I respectfully request you to give my application urgent attention before the inadequate drainage system permits more injury to my property. s/ S.I. Petvai Mr. Horton reported that he had referred this to Mr. Lapar for a drainage estimate. Mr. Horton further stated that he was familiar with the problem that this stream has flooded for many years, and he had advised Mr. Petvai before he built of the conditions. They have closed up part of the stream and the drainage is inadequate. Mr. Diehl directed the. Clerk to notify Mr. Petvai that Mr. Lapar is studying the problem, and will present engineering plans in regard to the drainage, and Mr. Horton feels there is no immediate relief that can be given. Mr. Petvai came forward and discussed his problem in depth and asked permission to open up the stream next to him, so as to pre- vent the rest of his property being washed away. Mr. Horton said he had recommended a year ago this stream not be closed and Mr. Petvai could open it at his own expense. A request was received from Ketcham High School to use two of the Town's voting machines on September 17th for the senior class elec- tions. MR. FINNAN moved that Ketcham High School be granted permission to use two of the Town's voting machines, on September 17th under the supervision of one of the voting machine custodians. Seconded by Mr. Holt. Motion Unanimously Carried The following letter was received: September 9, 1971 Mrs. Elaine Snowden Town Clerk Town of Wappinger Mill Street Wappingers Falls, New York 265 266 Dear Elaine: Re: Following Correspondence for Meeting of Town Board on 9/13/71 I wish toexpress to .the public, through -your office, my thanks to many. My thanks to them in the spirit of cooperation and assistance given by each personally or as an organization during the week-long problem and emergency at Smith Crossing Rd. I wish to thank the Town of Poughkeepsie Highway Department and Stanley Still, Superintendent; the Village of Wappingers Falls Fire Department; the Civil Defense of Dutchess County and the - Sheriff's Department under the direction of Undersheriff Dakin. 3: also thank the residents of Smith Crossing Road, particu- larly the Mike Plew family who were seriously damaged, for their courtesy and understanding and for preparing hot coffee and sand- wiches for the men on duty. A personal letter has been sent to Bill Horton and Bud Pottenburg and men. MR. FINNAN moved for a 15 minute recess, seconded by Mr. Holt and unanimously carried. Recess called at 9:40 P.M. Supervisor Diehl called the meeting back to order at 10:00 P.M., All Board members were present. Mr. Finnan reported on the status of the Vandewater Drive street lighting petition. He commented that, in addition to the original petition for the lighting, for which there has been added another 39 names, a petition has been received signed by residents in opposition to a lighting district. He proposed to set an informal hearing on this lighting district for Tuesday, September 21st, at 7:30 P.M. at the Town Hall. He would like Mr. Rappleyea and any members of the Board that can attend and Mr. Elmer Crans. He also asked that a letter be sent to Mrs. Hauck and Mr. Corbin informing them of this meeting. Mr. Finnan reported on having inspected the traffic situation on the connector road between Edgehill Drive and Brothers Road. The residents immediately involved at this intersection have requested /3 267 .I stop signs, especially since this is now a bus stop also. Mr. Horton had told him earlier that a yield sign would be more appro- priate. Mr. Horton said he could probably have these signs erected within a week or two. Mr. Finnan brought up again the intersections of Myers Corners Rd. and Old Hopewell Road. He asked thatagain a letter be forwarded to the County and the New York State Department of Transportation asking when the right turn lanes will be completed so the right turn arrows can be utilized to their capacity. Mr. Cortellino mentioned, while a letter was being sent to Mr. Petrovits that he be asked when the drainage pipe under the'road at the Karas property would be enlarged (New Hackensack Rd.) Mr. Mills reported that on September 15th the Southern Dutchess Planning group is having a joint meeting, hoping to get the Town, Village and County Planning Board along with their councils to- gether. There will be less meetings in the future, due to a reduced budget, that will be open to the public. The topic for Wednesday night will be_public facilities and utilities report, open space and recreation report, physographic study, business and industrial development part III. Mr. Clausen reported on a meeting with Mr. L'Archevesque, Mr. Reich, Lions Club and Men's Basketball Team, regarding the Junk Car Program. The Lions Club had approximately 100 releases left of cars that haven't been removed from the Town. Reich is in the process of removing these, and also asked for any other releases to be given before he has to close his plant in November or December. Approx- imately 200 cars have so far been removed. A report was read from George Schlathaus regarding a meeting he attended, as representative of the Town, for the Castle Point pro- perty. MR. FINNAN moved that Mr. Schlathaus continue to'pursue this with the Town of Fishkill, and, if necessary, the Engineer to the Town to give him any assistance that he may need. Seconded by Mr. Clausen. Motion Unanimously Carried 268 Mr. Clausen, with reference to the condemnation of a piece of Shapiro property on Widmer Road, mentioned that he had spoken this night to Mr. Horton about the dangerous curve, and Mr. Horton agreed that this is still a serious situation. MR. CLAUSEN moved that this matter be referred to Mr. Rappleyea,- Mr. Horton and Mr. Lapar for a recommendation -at the next meeting. Seconded by Mr. Finnan. Motion Unanimously Carried Mr. Diehl mentioned that he had spoken to the Attorney today, attempting to introduce a local law in regard to dognapping. There is, however, a State law governing this, which would make it diffi- cult to introduce a local law. He also spoke to Mr. Rood, SPCA, on this and the dropping of kittens and cats. Mr. Rood indicated that his group was promoting, and sponsoring, to the State that the animal laws be revised, updated, and strengthened. Mr. Rood felt a motion from this Board in that direction would be of great -help to the SPCA. MR. DIEHL moved that a letter be sent to Mr. Rolison, Mr. Betros, and Mr. Stevens supporting the strengthening and updating of the animal laws, in the areas of dognapping and abandoning of cats and kittens. . Seconded by Mr. Mills. Motion Unanimously Carried The following resolution was offered by -MR. That the application of the Atlas Water Company be approved upon the evidence presented before the Board but if approved, subject approval be conditioned upon or subject to the consent of the Town Board of the Town of Wappinger pursuant to Local Law #2 of 1967. 2. That the Department of Conservation be advised of the position of the Town of Wappinger which has been previously stated that the Town wishes to form a Town wide public water system and has undertaken studies to that end. 3. That prior to the approval by the Department of Environ- mental Conservation to applicant shall grant perpetual options to the Town of Wappinger to purchase all lines in the street, in the new area together with all other water facilities for the sum of $100. Diehl be and is hereby authorized to execute said agreement on behalf of the Town of Wappinger. Motion Unanimously Carried Mr. Kasperzak,_being recognized by -the Chair, asked if Mr. Lapar had a report on the water problem he -.brought before the Board at the August meeting. _Mr. Lapar reported that, by investigation, he found that Mr. Cornell has failed to put in some 800 -feet of 24 inchpipe, between 400 and 500 feet of 30 inch pipe, and about seven catch basins. Mr. Cornell asked the locations. Mr. Lapar said it is the outfall 24 inch line, the outfall between Wildwood Ditch and Widmer Road, the 30 inch_goes=from that point to a catch basin in front of Mr. Kasperzak's house and catch basins all along the line, (one of the 12" in the street in front of Mr. Cornell's house.) Mr. Cornell asked if this shows on the Planning Board approval of the map of the Wildwood Forest Section II. Mr. Lapar answered yes, verified by the engineers that drew the map. Mr. Lafko, being recognized by the Chair, noting discussion earlier, on recommendations of Environmental Control and under Section 10, Pa.F, the Attorney has been informed that Atlas Water's application was filed under Town Law ##2, that the Town's law has already been breeched by the Board itself, and he brought it up to see if it was done with intent or just with naiveness. (he then read Section 10, Pa.F, Local Law ##2, 1967). Mr. Diehl answered that there was no intent. Mr. Mills, under new business, indicating that since April with the resignation of Mr. Ludewig, the Town has been operating with an Acting Building Inspector and an Acting Zoning Administrator. He felt the time has come to consider at least one of these offices as a permanent position MR. MILLS moved that John Holler be appointed as Building Inspector for the Town of Wappinger. Seconded by Mr. Finnan. Motion Unanimously Carried Mr. Cornell, being recognized by the Chair, showed the Board pictures of catch basins installed by the Town, and continued to discredit the construction of this, and the storm drainage in the area. He then again asked the Board if they would consider a resolution to take over the roads in Wildwood 2 & 2A. Discussion followed on the question of blacktop, what these residents expected, what he intended to do or what he would not -do. -Several of the residents participated in a lengthy discussion which included more discussion on the drainage question and the roads in Wildwood 2.
