Roll Call 44Vote: 4 Ayes 0 Nays 2 Dorothy Alsdorf had submitted her semi-annual Historian Repbrt this day, ;;Supervisor Diehl directed dherreport be held for acceptance until the next regular meeting. Arthur Bisom had requested to speak before the Bbard in regard to either a full time Supervisor or Comptroller. He opened his:dis- cussion by recalling that last year one of the Councilman had made a resolution about having a full time Supervisor, wh.ich.hadbeen tabled. He then mentioned that Wappinger was now large enough to be entitled to their own four County Representatives because of the Town's population growth. With a Townthis large, a full time Supervisor or Comptroller is needed. If there were aful1 time Supervisor monies would not be going down the drain; why was the full time Supervisor tabled. f Mr. Finnan ansWered, and concluded that he now is not so sure that a full time Supervisor is the answer; he thinks before the .end of the year he is going to push for a Comp troller, again. Mr. Bisom then asked if the Board would make a motion .that it's about time this Town has either a full time Supervisor or Comptroller to check on the funds going out. He commented that he has brought this up time after time, and pursued the areas where he felt mon.iRs had not been properly handled. He dwelt on the additional compensation allowed Mrs. Crosby, and indicated he felt it should be a district charge. Mr. Diehl and Mr. •Rappleyea both verified this must be a General Town Charge. Going back to a Comptroller.$ he asked the individual Board members their feelings. Mr. Diehl was opposed, Mr. Milts was. in favor of a full time Comptroller, and added there would probably be some kind of a decision this year as to which way it will go. Mr. Bisom hoped it wouldn't drag. on for another six years. The folloWing letter was received: Town Board., Town of Wappinger Wappingers Falls, N.Y. June 22, 1971 3 2 a,5 Gentlemen: I, Thomas Sammartino, property -owner North side of Curry Road, Town of Wappinger, do hereby protest boundary of said road. I feel there is an injustice being done, whereas too much footage is taken on one side, and not enough: on the other. In fact, it is so close, when the snow plow clears the road, it knocks down the young trees and hedges.. I replant, and the same thing happens again. I request the Town Engineer be sent down to center the road and take -equal -parts from each side. , It. is not right to have about twenty inches leeway on one side, while there is a fifteen to twenty:foot clearance on the other. Yours truly, - s/ Thomas Sammartino Mr. Diehl asked Mr. Horton to give his recommendations or findings as to Mr. Sammartino's complaint. Mr. Horton commented that the 20" was actually 10', the road has been in for about twenty years, the Town, however, has stayed within the 50' ROW. Mr. Horton, on numerous occasions, has discussed Mr. Sammartino's complaints with him and he further indicated that it would.be excessively expensive to move the road and in no way is the existing road on Mr. Sammartino's property. Mr. Diehl directed the Town Clerk to send a letter to Mr. Sammartino telling him basically what Mr. Horton had reported, that due to the fact .that Mr. Horton has remained within the ROW of the Town road, and not on his property, there is no reason for action. MR. Pope petitioning the Town - Board for a zoning variance to permit a mobile home to be installed on her -property, on,Spook Hill Road for a period of two years. MR. MILLS moved that this be forwarded to. the Zoning Board of: Appeals and requested that the Town Clerk write Mrs. Pope indicating that ,she should make application to the Zoning Administrator, which will result in an appeal before the Zoning Board of Appeals for a variance. Seconded by Mr. Holt... Roll Call Vote: 4 Ayes 0 Nays - Mrs. Snowden informed the Board that she had received Mr. Ed Valentine's resignation from the CATV Committee. MR. MILLS moved Mr._Valentine's resignation be accepted and placed on file, and also a letter of appreciationbe sent to him for the excellent job he has done. Seconded. by Mr. Finnan. Roll Call Vote: 4 Ayes 0 Nays Mr. Diehl suggested a letter be directed to the CATV Committee asking if they had any recommendations -to fill the vacancy created by Mr. Valentine's resignation, and also ask when they meet with Mr. Calhoun, if there was any possibility of the local channel picking up Town of Wappinger Recreation activities, ball games, meetings and so forth, which was originally the intent of this corporation. A petition was received from residents of Vandewater Drive, seeking a.street lighting district in their area. This subject had been discussed at a prior meeting and Mr. Crans, Central Hudson represen- tative had been contacted and was in the process of evaluating the feasability of a district in this area. A letter was ,received from the Town of Wappinger Planning Board requesting clarification on the proposed zoning amendment of Section 412.02.. This matter was tabled to. the next Regular Meeting. 5- 27 Malcolm Cornell had requested to speak before the Board regarding Sections 2 and 2A of Wildwood Forest. Mr. Cornell, upon addressing the Board, -presented the Board with a ,"Petition for Final Accept- ance of Roads in Wildwood 2 and 2A, Town of Wappinger" with some Wsignatures representing 90 homes out ,of the 102. This petition specifically asks the Board to move tonight and accept the roads. The Petition reads "We, the undersigned, being resident -owners of property located on roads as outlined on Map #3349, request that the Town Board enter into a stipulation with Malcolm_Cornell, Inc., whereby the Town accepts the roads on Map #3349 as official Town roads if the following conditions of acceptance are complied with by Malcolm Cornell, Inc.,: install street signs - install copper weld monuments, install over existing pavement one coat of oil and chips, consisting of Yi gallon of R-6 bituminous oil per square yard for final wear surface. We respectfully request this petition be acted on at the next regularly .scheduled Town Board meeting on July 12, 1971 at 8:00 P.M." Mr. Diehl commented that there is at least one problem yet to be resolved, and possibly a definite meeting could be arranged with Malcolm Cornell, Mr. Rappleyea and Mr. Lapar to see if this problem could be resolved. Fred DiMaria, being recognized by the Chair, asked if these roads met Town Specifications; what does the Town say it should have. Mr. Diehl answered that this was the question that was in the courts right now, Mr. Cornell contending he was only required to put in oil & chip, the Town maintaining he was required to put in the final surface of black top. The one point where this question can be resolved is 'by Mr. Cornell putting in black top. Mr. Cornell said - • there was no way under the sun that he will put any blacktop on the streets in Wildwood Forest. Mr. Mills commented that he understood that the people signing Mr. Cornell's.petition were told it was to force the Town Board to go to court. Mr. Cornell replied he gave no suchre?ison; he promised those people if the Board did not act on this petition he would take the Town to court. Mr. Mills countered 20 "we're alreadylin court"; Mr. Cornell replied that that was. from the Town's side of the fence, he would go to court from his Isid& of the fence. A little more discussion followed along this same line. A letter was receivedfrom Town Justice Vincent Francese, requesting permission to attend a Seminar at Cornell University on August 13 and 14th, 1.971. MR. MILLS moved that Judge Francese be granted permission to attend the Seminar at Cornell University on August,13 and 14, 1971, and that his legitimate expenses be a Town charge. Seconded by Mr. Finnan. Roli Call Vote l 4 Ayes. 0 Nays Mr. Diehl reported that Mr. Gutmann had notified him that Richard Hodge would be unable to continue as the water plant operator for the Oakwood Water District, due to a serious illness, The Board would necessarily need to find a replacement. MR. MILLS moved a letter be written to Mr. Hodge thanking him for his services, and express the,Board's sentiments on his illness. Seconded byrMr. Holt Roll Call Vote:- 4 Ayes 0 Nays Under Committee reports, Mr. Mills asked the following letter be read: June 25, 1971 Mr. James Mills, Jr. Town Councilman Town,of Wappinger 7 Brian Place Wappingers, New,York Dear Mr. Miils:r TO_oomplete processing of the Comprehensive Planning Assistance Program of the Southern Dutchess Joint Planning Group for the year 1971-72,designated N1P:246, we ,will_need a resolution of the Town's legislative body agreeing to have available, in the year 1972, the sum of $1,088.00. - The total,loeal share if $3,887.00, which is one-sixth of the cost of the 1971-72 Comprehensive Planning Program. Each of the five member municipalities of the Southern Dutchess Joint Planning Group, in turn, contributes its portion based on its population as established for the 1971-72 program, now reaching completion. r7 209 '. A copy of a suggested resolution authorizing the Town's participation in the C.P.A. Program is enclosed. We would appreciate receiving three copies of the resolution. The copies may be xeroxed .or may be carbon, but the validating signature, seal and certification must be original on each of the three. Please forward to this office the resolution at the earliest date convenient to you and the Town Board so that we can complete processing the Planning Group's application. A letter was received from Father Alexander Choate, Chairman of the Town of Wappinger Narcotic Council, in response to a communica- tion directed to him from the June 14th meeting. In essence, Father Choate had no further progress to report. Mr. Diehl commented that he had recommended, at a Narcotics Council meeting, the membership be enlarged to 10 or 12 members. He would like, if the Board condoned, to contact Father Choate and ask his recommendations for additional names to be members of the Council. He felt the additional members might help add incentive to stimulate activity in the YELL Program. Mr. Mills said he had spoken to Mr. Gunthert, member of the Citizens Drug Action Committee, and they were going to contact the Jay -Cees to try to get involvement from this area. He also indicated that Dan,Costantini might be interested in serving on the Narcotics Council. Mr. Diehl asked the Town Clerk to address a letter to_Father Choate referring to this discussion on expansion of the Council, and the Board would be interested in hearing their recommendations and advice. Mr. Mills reported on the Zoning.Regulations_Advisory,Committee, commenting there were 10 members now and had shown enthusiasm at their first meeting. Several of the points they discussed were inadequate low cost housing, lack of recreation facilities, inade- quate sewer and water, insufficient traffic arteries, no encourage- ment for cooperative form of apartment construction, no encourage- ment for variation in housing, no allowance for proper growth for small retail business in densely populated areas and apartment construction.. not properly monitored. Once these are put into some order of priority and the Committee starts working on them, they can come up with a total package and get together periodically with) the Planning, Town and .Zoning Boards, for discussion -and guidance. Mr. Rappleyea reported on Mr. Finnan's request to him to make inquiry as to what was going on with regard to underground trans- mission facilities. There has been prepared a report of the Public Service Commission, and basically Mr. Boschwitz has recommended that future developments of four or more houses be required to have underground utilities. Also a sweeping recommendation as to • overhead transmission lines. The full Board of the Commission must now act on the recommendations, and whatever the decision, the control will be in the hands of the Public Service Commission, probably not involving local planning but will be State Law. Mr. Finnan commented on the notification from the State Department of Transportation regarding erection of Stop signs at the inter- sections of N. Mesier Avenue and Scenic Drive with Route 9. Lights were requested at this intersection, but the State saw fit to install only Stop Signs. The following Ordinance was introduced by SUPERVISOR DIEHL who moved its adoption: Be it Resolved and ordained by the Town Board of the Town of Wappinger, Dutchess County, New York, in pursuance of the. authority conferred by the laws of the State of New York, as follows Section 1. The Town of Wappinger Zoning Ordinance and Map adopted January 29, 1963, as amended from time to time, is hereby further amended by rezoning the following described parcel of land from "RD -20" (Residential Zones) to "HB 2" (Highway Business) said tract or parcel of land being situated in the Town of Wappinger, County of Dutchess and State of New York, more partic- ularly bounded and described as follows: - Map #61, Block 1, Lot #36 Section 2. This ordinance shall become effective immediately upon adoption, posting and publication as provided by Town Law. Seconded by: Councilman Holt MR. FINNAN moved that a Public Hearing be set for 7:00 P.M. EDST on August 9, 1971, at the Town Hall, Mill Street, Wappingers Falls, New York on the Petition of Kathleen Hesse for the Rezoning of her property on Route 9 from RD -20 to HB -2, at which time all interested persons will be heard. Seconded by Mr. Holt Roll Call Vote: 4 Ayes 0 Nays The following Ordinance was introduced by COUNCILMAN FINNAN who moved its adoption: Be it Resolved and ordained by the Town Board of the Town of Wappinger, Dutchess County, New York, in pursuance of the authority conferred by the laws of the State of New York, as follows: Section 1. FINNAN moved that a Public Hearing be set for 7:30 P.M. EDST on August 9, 1971, at the Town Hall, Mill Street, Wappingers Falls, New York on the Petition of Joseph Rossetti for the rezoning of his property on Route 9 from RD -20 to HB 1, at which time all interested persons will be heard. 212 Seconded by: Mr. Holt Roll Call Vote: 4 Ayes 0 Nays An Order in the Matter of the Establishment of the Wildwood Sewer District in the Town of Wappinger, Dutchess County, New York, pursuant to Article 12-A of the Town Law was placed before the Board for their consideration. Mr. Diehl asked if there were any questions or comments. Malcolm Cornell requested the Board not to -take any action tonight because there is a petition coming to the Town tomorrow that will ask for hearings on the Adler -Brenner study of the entire section. He'd like to see the Town wait on their vote until this is done. Mr. DiMaria asked if it had even been established who owns the pipes in Wildwood Section 2. Mr. Cornell here contended he owned them. Mr. DiMaria further asked , this plan to purchase L&A and lines, is there a stipulation as far as purchasing the lines as they exist or purchasing the property of L&P, Filtration, you can't buy some- thing you don't own. Mr. Diehl answered it was for the purchase of the plant and all lines. Mr. Rappleyea added that you don't have to know necessarily who owns them yet, because if the district is approved and it becomes an entity the question then will be, if necessary, proceedings in court to determine who gets paid if there is any money to be paid. _We don't get into this at this point despite the fact that the Board does have an estimate and a recom- mendation from Barger & Russ certifying that those are the lines of L&A Filtration Corp. Mr. Lafko indicated again that none of the L&A facilities are for sale. He then asked the Board at this time if that description that was read is exactly as the map was at the Public Hearing of June 1, 1971, or had there been any amendments whatsoever, Mr. Rappleyea said to his knowledge the map that's on file with the engineer's report is stillthe same map that is being referred to. were Charles Cortellino asked if the lines/correctly located in Wildwood as to depth, easement and location. kLLAN E. Mr. Finnan commenting on Mr. Maurers reply, said the whole thing he has against it is it seems the Recreation Commission has arbitrarily dismissed the services of the Engineer to inspect, and taken it upon themselves. They have permitted alterations and there seems to be no indication of credit given on the elimination of the 5 L L L 2 1 5 ! windows, he would like to knbw what the credits are goint to be . Mr. Holt mentioned that on the blue prints submitted with the bids the windows were marked "omitted". It was decided to meet with Mr. Maurer, to ascertain what has been eliminated, and what credits the Town would receive because of them. It was agreed to set an executive meeting,at the Town Hall, for 7:30 P.M., July 21st to discuss the Dan Brouthers Mem'l Park Building with Mr. Maurer. Letters were received from both the Engineer and Attorney to the Rockingham Farm Sewer District regarding the pumping station installed by Ye Olde Apple Orchard, and associated items. Diehl recommended a meeting with Mr. Quinn, attorney to the District. It was agreed to set an executive meeting with Mr. Quinn for July 21st, to resolve the problems concerning Ye Olde Apple Orchard. MR. Town Board June 28, 1971 Town of Wappinger_ - _ Mill Street Wappingers Falls, N.Y. 12590 Gentlemen: Re: Ye Old Apple Orchard Rockingham Farms Sewer District 6 - This is in reply to Mrs. Snowden's letter to me of June 23, 1971 referring to Mr. Gerzof's letter to the Board of May 19, 1971. We had previously reported to the Board on sewer lines in Ye Olde Apple Orchard by letter dated November 2, 1970, to the effect that all defects revealed by T.V. Inspection had been repaired. Subsequent to this work a pump station has been installed to handle flow from what may be considered Section II of Ye Olde Apple Orchard. This pump station, with lateral sewers and force mains is now in operation and is handling the wastes from the four houses on Kent Road which have, in the past, posed sanitary waste problems. -We have -inspected this installation and it appears to be working properly. We did not inspect the construction of the work, except for one inspection of the lateral sewer in place prior to backfill. In this case we advised the developer of visual deficiencies, they were corrected and backfill made. The pump station, which is a reliable product of the Smith and Loveless Company was put into operation by Michael Morris, P.E. If the Board accepts this system the remaining warranty on the pump station, if any, should be transferred to the Town. We wish to emphasize to the Board again that, as Engineers to the District, we do not want to be put in the position of making recommendations to the Board on the acceptance of work on which there has been no resident inspection by qualified inspectors. Gerzof, attorney for and president of Opalo Realty Corp., the owner of the above captioned subdivision, has applied in writing to your body requesting that (1) Opalo's domestic sewer lines and appurtenances be accepted for the Rockingham Farms Sewer District, and (2) Opalo's subdivision roads, Cider Mill Loop and Wine Sap Lane, located in Section 1 of the Apple Orchard Development, be accepted as and for public streets in the Town of Wqppinger. You have referred this matter to us and you have asked for -our written recommendation. At the outset, we would inform you that we have discussed this application with Mr. Vincent C. Kelley of the Chazen firm, engineers for the Rockingham district, various representatives of entities claiming amounts due for sewer work, your Supervisor, Mr. Diehl, your Clerk, Mrs. Snowden, Mr. Vincent Dangler, Opalo's local representative, and with Mr. Gerzof himself. In connection with this application, Mr. Gerzof has delivered to us (1) an executed, acknowledged bill of -sale from Opalo transferring title to the sewer lines and appurtenances to the Town, and (2) an executed, acknowledged deed of Opalo dedicating the fee of the roads to the Town and reserving title to water lines installed in,the roadbeds and access easements to such water lines. We approve of the form, content and manner of execution L L L 21 if - of these instruments, with one exception. We do not know whether the bill of sAle includes the pumping station which Opalo installed at your direction and without our knowledge or that of the engineers. If an additional instrument of title is required for the pumping station, that paper will have to come to us from Mx. Gerzof and be approved. All mortgage releases indicated by a final title search which we will make will have to come in to us for approval. Three firms have given informal notice of claims against Opalo for work on its domestic sewer system. The claimants and the amounts sought by each are: Robinson Pipe Cleaning Co.($823.15), Video Pipe Grouting, Inc. ( $1329.65) And Smith-& Loveless ($9800.00,plus). None of these claims were ever reduced to liens on the real property invalved. Mr. Gerzof has agreed to save the Town -harmless against the Robinson & Video demands and to provide the Town with a full defense against suits which they might institute. In our opinion, his word is good and his agreement suffices. With respect to the Smith & Loveless claim, it appears that an escrow arrangement will satisfy this demand, provided that Mr. Gerzof and claimant's attorneys so advise you in writing. Two claims asserted by the Town of Wappinger must also be disposed of satisfactorily before the application may be granted. The first of the Town's claims amounts to $917.62 in the aggregate and covers sewer charges for nine properties occupied by various Opalo vendees prior to title closings by arrangement with Mr. Vincent Dangler. Mr. Gerzof has agreed in writing to pay this claim, if the Town's right to collect is established. We do not think this is enough. Mr. Egan, the Supervisor's aide, has assured us of the validity of this demand. ,We think that the $917.62 should be paid in full before you act on the application. The Town's second claim cuts deeper than the first. It involves a balance of $16,800.00 which remains due on the $24,000.00 contribution owing from the developers of Apple Orchard to the Rockingham District. Opalo, as well as the other builders in Rockingham, were permitted to pay off this $24,000.00 contribution in installments of $240.00 to be paid each time a building permit was issued. That was by arrangement made with the Town Board in 1966. As far as Opalo is concerned, the arrangement has proven to be quite unproductive. Mr. Gerzof takes the position that the balance of $16,800.00 should be paid by a Mr. Brescia, who has apparently contracted to purchase some or all of the undeveloped lots in Apple Orchard. In fact, he informs us that your body.recently-modified the old arra- ngement by increasing to $480.00 the amount to be paid when future building permits are issued. Your:Supervisor and Clerk tell us that the modification was intended to cover one building permit only,.which was issued to Mr.'iSrescia a short time ago. TheSupervisor is of the opinion that the $16,800.00 figure should be paid in full bediore you act on the application. We are.in full accord with him. However, this is a decision which you must make as a body by formal board action. _ As far as the physical condition of the sewer lines is con- cerned, the engineers have advised you in writing that you may_ take these lines now. The engineers have made no -recommendation with respect to the pumping station, since it was constructed with your authorization and without notice to them. Inasmuch as the engineers were not privy to this phase of the work, accept- ance or rejection of this facility rests with you alone. Implicit in that part of the application which involves road acceptance is a request for exoneration of the developers' sub- division improvement bond and discharge of the principals,and surety on that obligation... If the offer of dedication is to be accepted and the bond released, both your body and your Highway Superintendent should act in compliance with Highway Law, s5171(1Y. We suggest written recommendation by the Superintendent and the adoption of a formal resolutionc,by your body. We think that it is safe to say that the bonding company will require a certified copy of the latter paper. Mr. Horton replied that he had met with Spoor-Lasher, and he went over the roads with Spoor, they are to get with their engineer and Alpert. Should be within two,weeks, there should be action on it. He didn't know the answer to Mr. Mills' question about the hydrants. Mr. Diehl asked if they (Spoor) were gointt to complete the whole job when they got there, and Mr. Horton said yes, but one section had to be torn out, which would take abouta month. Under New Business, the Chair recognized Chas. Cortellino. Mr. Cortellino; referring to Local Law #2-'67 requested consideration of an amendment, specifically, where there were power failures, generators for emergencies for all water districts. Mr. George Bergerman, attorney representing Atlas Water Works, was present for the purpose of presenting petitions, pursuant to Local Law #2-67, to extend the boundaries of the Water District operated by the Atlas Water Co. and also to make certain improve- ments in their existing Water District. Mr. Bergerman presented 3 copies of the Petition and 3 Copies of the Map, 'Plans and specifications to the Board. He requested this be processed in accordance with the provisions of the Local Law. Mr. Diehl 20 i commented there would be no action taken on this petition to- night and Mr. Bergerman only asked that it be processed in accordance with the usual proceedure and he would specifically like to request that, 1 if this is referred to the Engineer to the Town, and prior to the time a Public Hearing is scheduled, he be furnished a copy of the Engineers comments and -suggestions. Mr. Karol Sekeley addressed_the Board, asking what had been _ done about a noise ordinance. Mr. Rappleyea replied that he had written to the State, and to the Association OfTownsfor proposed recommendations, and has not as yet had any response. Mr. Fred DiMaria asked what was the plan now for the Wildwood Sewer District. It seemed to him thatit would have been a good idea for a -referendum on it. He thought the Board should re- consider it. Mr. Diehl replied that he was sure it could be -introduced again, as of tonight he did have questions on it. The intent of his vote tonight was not to stop everything, he -still feels the Town needs Townwide-Sewer and Water.
