169 The Regular Meeting of the Town Board of the Town of Wappinger was held on June 14, 1971, at the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:12 P.M. Presehtr Louis Diehl, Supervisor G. D. Finnan, Councilman Harry Holt, Councilman James Mills, Councilman Elaine H. Snowden, Town Clerk Absent: Louis',Clausen, Councilman Others Present: William Horton, Superintendent of Highways Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town The Minutes of the May 3rd, 1971 Special Meeting, May 10, 1971 Regular Meeting, and June 1st, 1971 Special Meeting, having been previously sent to the Board members, were now placed before them for their approval. MR. MILLS moved the Minutes of the May 3rd, 1971 Special, May 10, 1971 Regular and June 1, 1971 Special Meetings, as submitted by the Town Clerk be and they are hereby approved. Seconded by Mr. Finnan Roll Call Vote: 4 Ayes 0 Nays Reports for the month of May were received dap. the Supervisor, Building Inspector, and Town Justices. Also, Judge Francese sub- mitted a correction on his Annual Report. MR. FINNAN moved the May reports from the Supervisor, Building Inspector, Town Justices and the crrrection submitted by Judge Francese of his Annual Report be accepted and placed on file. Seconded by Mr. Mills. Roll Call Vote: 4 Ayes 0 Nays )r 1 70 The Annual Audit of the Town's finances, done by Frank Manning, Accountant, had been completed and the report submitted to the Board. MR. MILLS moved that Mr. Manning's report of the Audit be received. Seconded by Mr. Finnan. FINNAN moved the bills be paid, subject to audit. Seconded by Mr. Mills. Roll Call Vote: 4 Ayes 0 Nays The following letter was received: May 25, 1971 Town Board Town of Wappinger Town Hall Mill Street Wappingers Falls, N.Y. Gentlemen: As Receiver of Taxes, I am now collecting all water and sewer rents for the various districts operated and maintained by the Town of Wappinger. I would appreciate the members of the board setting a_ policy for the collection of these monies and suggest the following for consideration. 1/ Billing department will issue a warrant to the Receiver of Taxes covering each billing period. _ 2/ All past and present charges for each parcel of property will be listed, by tax map description, for each uitilty. 3/ Payments are due in full on or before the due date specified on the bill. Payments postmarked with the due date will be considered paid on same. 4/ Penalties will be enforced. Receiver of Taxes shall refuse payment of any bill where penalties are due and. not included. 5/ Monies will be disbursed to the Supervisor of the Town of Wappinger monthly. 6/ Receiver will submit to the Supervisor's office a settle- ment sheet at the end of each collection period. Such sheet will list, by tax map description, amount collected for water, interest, sewer, interest and charges remaining unpaid. 7/ A record of each parcel, charges and payments will be made available with the current school and realty tax rolls. This will provide more complete information regarding the property, when such information is requested. Respectfully submitted, s/ Amelia Crosby, Receiver of Taxes 3 MR. FINNAN moved the Town Board concur with the recommendations, as set forth above, by -Amelia Crosby, Receiver of Taxes, on the policy for the collection of all water and sewer rents for the various districts operated and maintained by the Town of Wappinger, and that she effectuate it immediately. Seconded by Mr. Holt. Roll Call Vote: 4 Ayes 0 Nays' Joseph Incoronato questioned, apropo of sewer and water rates, what the policy of the Board was concerning tenants to the water and sewer districts. He was referring to Jehovas Witnesses who had become tenants to the Fleetwood Districts, and who were not being billed on terms of depreciation and amortization of the capitalized bond, only for Operation and Maintenance and what he is saying that the rest if the district was subsidizing the customers, because they do not pay on a benefit basis. What can be done to rectify the situation, It should be a matter of Town Policy. Mr. Diehl said the Board would get back to this question later. The following letter was read: May 25, 1971 Town Board Town of WEappinger Town Hall Mill Street Wappingers Falls, N.Y. Gentlemen: I am now collecting all water and sewer rents for districts maintained and operated by the Town of Wappinger. I am request- ing $1,000.00 additional compensation for the time these duties will involve. Theappropriation in the 1971 budget for Receiver. of Taxes, Compensation of Employees if $7,500.00. As of May 28th, the balance in this account is $4,961.85, of which $2,884.50 is the remainder of my present salary for the year. Therefore, there is $2,077.35 in this account for compensation for any additional help I may require. Inasmuch as I have been working alone most of the time, this balance is excessive. These monies can provide for the increase in salary without the transfer of funds. Very truly yours, s/ Amelia Crosby Receiver of Taxes 1 71 X 7r '1 Mr. Mills commented he didn't believe it was a good policy to increase salaries_inthe middle of the year. He felt it should be done at year end. Mr. Holt said he would like an opportunity to review the,, comparison of labor expended with this policy in effect as opposed to the policy previously in effect. If there is seen a significant increase in labor cost here, then he might want to go along with the request. Mr. Finnan agreed with Mr. Holt, if the additional work does justify it. Supervisor Diehl ordered Mrs. Crosby's salary increase request tabled until the July meeting. A letter was received from the Planning Board with an attached opinion letter from the Attorney to the Town, regarding a proposed amendment to the Town of Wappinger Zoning Ordinance(which would proposed add language to Article I/by the Wappingers Conservation Association). A recommendation on this proposed amendment was also received from the Dutchess County Department of Planning. Supervisor Diehl recommended this matter be tabled in order to have the Attorney to the Town look at the county report. Mr. Rappleyea commented that the problem as he sees it is that the State power is specifically set forth, and copied almost word for word in the Town of Wappinger Ordinance and when one starts.expand- ing that wording, it would seem that one would be invading the right of New York State legislature, and thereby, perhaps, fouling up the entire ordinance for the sake of doubtful additional values to the ordinance, because its very specific what the New York State legislature says that the Town may promote, that's the health, safety, and morals for the general welfare of the community and that's what the Town of Wappinger ordinance says. He also said he would like to see what the County Attorney says on the matter. Letters were received from George Reid, Dutchess County Republican Committee Chairman. and, Glenn Von Brammer, Dutchess County Democratic Committee Chairman with their recommendations for the Republican and Democratic Election Inspectors for the Town of Wappinger. 173 ;. MR. DIEHL moved that Dutchess Heights, Inc. Performance Bond, in the sum of $105,000 be returned to Dutchess Heights, Inc. upon the presentation of a new Performance Bond in the sum of $44,000, to the Town Board, in a form approved by the Attorney to the Town. Roll Call Vote: 4 Ayes 0 Nays The following letter was received: May 20, 1971 Town of Wappinger Town Hall Wappingers Falls, New York Attention: Hornorable Louis Diehl, Supervisor Gentlemen: This refers to the contracts listed below under which electric service is provided for street lighting and other general town lighting purposed in the Town of Wappinger. You are hereby notified in accordance with Section E of those contracts that the contracts will terminate on the dates listed below: Street Light Chelsea Hughsonville General Town Cameli Acres District Charge Contract Date September 1, 1961 September 1, 1961 September 1, 1961 December 1, 1961 Termination Date September 1, 1971 September 1, 1971 September 1, 1971 December 1, 1971 Increasing costs experienced during the last few years, made it necessary for us on March 9, 1970 to file an application with the Public Service Commission for an increase in our filed rates for both electric and gas service. Similarly, it will be necessary to increase charges applicable to services provided by contract to municipalities and governmental agencies. We are presently in the process of reviewing all services which we provide by contract. Upon completion of that review and prior to September 1, 1971, our representative will be in 7 contact with you to discuss specific terms applicable to future street lighting service. FINNAN moved that the Board accept the letter from Central Hudson, and place it on file. 115 Seconded by Mr. Mills Roll Call Vote: 4 Ayes 0 Nays A Petition to extend the Rockingham Sewer District was received from Jeffery C. Richards, Attorney for Messrs. Schuele and Thomann. The requested extension consists of 28.2 acres on the southeast corner of All Angels Hill Road and Pye Lane. MR. DIEHL moved this Petition be referred to Joseph D. Quinn, Jr. Attorney for the District and Milton Chazen Associates (Vincent Kelley) Engineers to the District. Seconded by Mr. Finnan. Roll Call =:•Vote: 4 Ayes 0 Nays The following letter was received: May 19, 1971 Hon. Louis Diehl Presiding Supervisor, Town of Wappinger Wappinger, New York Re: Ye Old Apple Orchard Dear Mr. Diehl: Formerly, we have been in correspondence with the Township, and have previously forwarded all documents requested for accept- ance by the Town of the sewer pipes installed in the development of Ye Olde Apple Orchard, Inc. All of the work which had been requested to be performed was done. A surprising situation exists, in that none of our corres- pondence has ever been answered. The lift station was completed months ago and the fence required by the Town will be installed on Saturday. We, there- fore again request that the sewer lines and lift station be accepted. The deed and bill of sale covering the lines was received and retained by the Town Attorney last year.. We have never received any comment concerning any additions or corrections thereto. Certainly, more than adequate time has elapsed after all of the corrected work was completed for acceptance by the Town. We, therefore, request that this matter be placed on your agenda for your next Town Board meeting so that the acceptance of the foregoing may be concluded. Very truly yours, s/ Julius M. Gerzof Mr. Diehl commented that he had spoken to Mr. Quinn today on this subject and he was informed the Town should have a report in from the Engineer to the District shortly, and Mr. Quinn is working on it also. Mr. Diehl further stated that a letter should be directed to the Engineer and Attorney asking them to have the information, in regard to this matter, available for the Town Board at their next meeting. Mr. Dangler asked if it would be possible for the Board to propose a motion that the Town accept the pipes, subject to the legal documents being conveyed, to close out the matter. Mr. Diehl said he would be reluctant to act and should wait for the report from the Engineer to the District. Mr. Mills and Mr. Finnan agreed with Mr. Diehl on this. Mr. Dangler asked, in the event it didn't arrive in time for the next meeting, at that time could that motion be adopted? Mr. Diehl said he wouldn't comment on that. The Clerk was then instructed to write Milton Chazen Associates and Mr. Quinn to 'get the information to the Board before its next meeting, with a copy to Mr. Gerzof. The following letter was received: June 1, 1971 Town Board Town of Wappinger Mill Street Wappingers Falls, New York Re: Rockingham Sewer District Subcontractor Approval WPC -NY -340 Gentlemen: The Contractor, Hall & Company, Inc. requests approval of sub-, contractors as follows: Ninnie Construction Co.—Excavation & Concrete 51 Henry Street Beacon, New York Black Electric Inc. -Electrical Fishkill Plains, Wappingers Falls, New York 1 7 The contract rec4uireSapproval of subcontractors by the Owner. Roll Call Vote: 4 Ayes 0 Nays The following letter was received: Town Board Town_of:Wappinger • Mill Street Poughkeepsie, New York Re: Gentlemen: June 9, 1971 Rockingham S.D. WPC -NY -340, Change Order No. 1 We_request approval of Change Order No. 1 providing for a railing on the inboard side of the dosing tank pump platform. This rail should be in place to prevent a workman from falling off the platform while performing maintenance duties. The rail was not included on the plan. Upon approval the Change Order should be signed by the Supervisor, one copy retained for the District file and five copies returned to us. We in turn will submit three copies to the N.Y. State Dept. of Environmental Conservation who, in turn, will submit two copies to the Federal Water Quality Office. The Federal approval will be noted by the return of one approved copy to the Town. Roll Call Vote: 4 Ayes 0 Nays Mr. Finnan asked that the following letter be read: 178 May 20, 1971 Supervisor Diehl Town of Wappinger Mill Street Wappingers Falls, New York Re: Rockingham Sewer District WPC -NY -340 Community Requirements Dear Mr. Diehl: I am enclosing a packet of material furnished to us by the State for transmittal to you. The packet describes various requirements for the receipt of the project grants. The major item is the setting up and keeping of construction accounts. This must be done immediately. The packet mentions payroll reporting and checking. We will do this for you as part of our supervisory and inspection service. The work on the project has started and requires resident inspection. In accordance with our contract we will provide this service and will do so automatically unless we hear from you to the contrary. In this respect we will assign a man to the project on a fulltime status just as soon as construction begins on a full time basis. If there is any question about the packet material, please do not hesitate to call. Very truly yours, s/ Vincent C. Kelley, P.E. Mr. Diehl indicated he had received the packet referred to in Mr. Kelley's letter, and was implementing it. A letter was received from David Goldman asking if the Master Plan for Sewerage in the Fishkill Wappinger Creek Drainage basin had been adopted by the Town and if so, did the plan provide for a sewer system affecting his property on Smith Crossing Road. Mr. Mills commented that this was the County Plan that had been dropped before ever coming to a referendum. Mr. Diehl directed'a letter be addressed to Mr. Goldman to inform him as to this, and also advise him of the fact the Town is going forward with sewer projects and improvement areas of its own, which, in the -future could possibly be tied into a Master Plan. A request was received from William Bulger, Town Justice, to attend the annual training session for Magistrates sponsored by the Judicial Conference July 19-23, 1971 at St. Lawrence University, Canton, N.Y. #/ 1 79 MR. ,FINNAN moved that Judge Bulger be granted permission to attend the Annual Training Session at St. Lawrence University, July 19-23 and that his legitimate expenses be a Town charge. Seconded by Mr. Mills Roll Call Vote: 4 Ayes 0 Nays Mr. Karol Sekely had requested to speak before the Board regarding a Noise Ordinance. Mr. Sekely first asked if it were not true that the Town had a Go -Kart Ordinance (which in fact it does) and if it could be amended to establish a level of noise. He was mainly concerned with rock music, the way it was being played. Mr. Diehl referred this to Mr. Rappleyea to prepare an ordinance that would encompass the overall picture of noise. Mr; Don Feeney had requested to speak before the Board with regard to,the_Dan BrouthersMemorial Park Building. Mr. Feeney first asked that an excerpt from the May 10; 1971 Minutes be read, concerning the awarding of the bids for this building. (Pg. 153, last paragraph was read.) Mr. Feeney said that the way he under- stood those minutes, he thinks a grave injustice had been done to the firm of Hicks ,& Feeney. Secondly, they (Hicks & Feeney) could get..a Performance Bond .and they also gave a certified check for $912.00 as 5/ of contract price (bid bond). He was appalled at the way the Town. Board relies on the_Town,-Recreation Commission for _thew&r .hearsay advice... He felt, that at this time a motion was in order to both clear his firm's name and his own reputation. Mr. Finnan said he would so move that the Board does owe Mr. Feeney and apology. Mr. Diehl asked that the following letter be read: May 19, 1971 Hicks & Feeney Inc. c/o Mr. Donald Feeney Thompson Terrace ,r Wappingers Falls, N.Y. Dear Don, We have been informed by the Travelers Insurance Company that they will be most happy to issue a security bond for purposes of bidding the Town of Wappingers' Recreation Commission structure to be built in the near future in the Wappingers district. 1180 The bonding company has indicated if your firm is the successful bidder, they will execute the required material and performance bonds and the proper forms as required by the principle. It is my understanding that this particular job will be something under $25,000 for general construction. Assuring you of our willingness and interest to provide this protection for you I remain, Very truly yours, s/ R. J. Stearns Mr. Feeney commented that he had requested this letter, when he found out what had happened, so he -could turn it over to the('Town. Mr. Finnan said that he was already aware of this before Mr. Feeney received the letter. Mr. Mills said, since he was the one who had made the motion (of awarding the bids at the May meeting) he certainly' apologized on the part of the Town -Board; but in a direct correspondence -with two members of the Recreation Commission in an executive -session he was told, very specifically, that neither one of the two low bidders could obtain a performance bond. Mr. Feeney said he would suggest in the future the Town Board talk to the bidders personally. Mr. Finnan commented that this was a very difficult thing for, if this was the case, the Board would have to follow the same policy with every bid that went out, the Board acted on good faith from the Recreation Commission, it's not the first time they've fouled the Board up, and he joins Mr. Mills in apologizing. Mr. Feeney asked the Attorney if a certified check comes in with a bid, doesn't the Town have the right to keep it if he couldn't perform. Mr. Rappleyea said he didn't believe so, unless it was in keeping with the specifications. Mr. Diehl added that it was his feeling, and that of the rest of the Board's that certainly Mr. Feeney acted in the -best of faith and it's quite apparent, and no question, that Mr. Feeney could furnish any performance bond necessary and due to poor communications the Board did act under this condition and certainly he apologizes too. Mr. Feeney then asked who was making periodic inspections of the building, if anybody. Mr. Diehl answered, J 3 81 as he knows it, the inspections would be by Barger & Russ, and also in theipast•George Schlathaus has generally inspected it. Mr. Feeney came back that the specs indicate the Town can't make a partial pay - men -ton. ay -menton the contract without the Engineers Estimate of the work done, and he doesn't think Mr. Schlathaus is qualified to make that judgment. There has been no building permit, so the Town Building Inspector isn't making inspections, so, as far as he sees it there has been no inspection; he would like to see an inspection on it. He also wanted to know who has the right to make changes in the plans and specifications. Mr. Finnan said it was his understanding that the specifications have been changed, windows have been elimin- ated and a few other things. Mr. Diehl stated that the Town Board had not been advised of any changes. Mr. Feeney then asked if the water and septic systems for this building had been let for bid. When he was answered "no", he asked if they would be. Mr. Mills commented that in any event he guaranteed these would not be -an extension of the original contract. Mr. Finnan said the Engineer to the Town should inspect the building to see if it does:meet specs, and he, for one, would not sign any vouchers if the Building isn't up to specs. ` •'This would not mean that Mr. Lapar would be responsible for the' Engineers -estimates of'work.completed, that was still the responsibility of*Barger & Russ. He also agreed to make the inspection with Mr. Lapar: -ML FINNAN moved that-Mr:-:Lapar, Engineer to the Town, make an inspection of the Dan Brouthers Memorial.Park Building, to see if it meets with the Specifications, and report his findings to the Town Board. Seconded by Mr::Mills. Roll -Call Vote: 4'Ayes -0 Nays The next' item on_the agenda was a request from Mr. Lafko to speak in reference to the Atlas Water=.Company. Mr. Lafko_requested that this be brought up under New .Business . 82 r The Town Clerk informed the Board, that both -the Highway Superin- tendent and Supervisor had been served (June 14th and June 1st respectively) -with a summons and complaint in an action brought by Anthony LaRose vs: Town of Wappinger, claiming property damage and personal injury, due to a motor vehicle accident January 22, 1971 (Notice of Claim was served February 18, 1971 and referred directly to the Insurance Agent for the Town of Wappinger.) MR. FINNAN moved that the summons with complaint in the action brought by•Anthony LaRosa vs Town of Wappinger be referred to Mr. Q.-Groenwegen of the Marshall & Sterling Insurance Company, Wappingers Falls Branch, as the insurance agent for the Town. Seconded by Mr. Mills. Roll Call Vote: 4 Ayes 0 Nays - Three applications for Hawkers and Peddler`s Licenses were received. Holly Wentworth, Valarie Elswick, and Thomas P. Salotto. Miss Wentworthand Mrs. Eiswick's applications had been forwarded to. the•-Dutehess County Sheriff's Office and returned indicating no criminal record ill file for either. Mr. Salotto's application has-been forwarded -but -not returned as of this -date.- MR. -FINNAN moved -to -approve the applications and grant Holly - Wentworth and'Valarie--Elswick a license for Hawking and Peddling in--the-'mown of Wappinger, and approve the application and grant Thomas Salotto a license for Hawking and Peddling -in -the Town of Wappinger subject to notification from the-Dutchess County Sheriff's Office -that he has no --criminal record in their file. Seconded by-Mr;Mills. Roll Call Vote: 4 Ayes 0 Nays A letter was received from Mr. R. V. Oswald, Pleasant Lane, requesting permission to close the lower half of Pleasant Lane (dead end street), on July 31, 1971 between 1:00 P.M. and'9:00 P.M. so -the residents may hold a block party. - MR. FINNAN moved that permission be granted Mr. Oswald to block off the lower half of Pleasant Lane on July 31, 1971, providing one lane is left open to permit access for emergency vehicles and L residents to their homes, and also conditioned on assigning a Fire Policeman, at their expense, in cases -of emergency. Seconded by Mr. Holt. The time has novcome when we need extra chlorinators at each sewer plant for chlorinating return sludge to obtain better settling, odor control and even for emergency back up of the good chlorinators at all sewer and water plants. For these purposes the present machines would answer adequately. The new Wallace and Tiernan hypochlorinators wpuld cost $300.00 each. Joseph Gutmann Mr. Mills recommended this letter be referred to the individual Engineers to the districts to ascertain if Mr. Gutmann's request is in keeping with proper upgrading of equipment and if they are the right ones to get. The following letter was received: Memo to: Town Board From: Joseph..Gutmann: Subject: Rockingham Sewer Plant Date: June 14, 1971 We have had trouble at Rockingham.with debris collecting in the pumps. This condition is progressively getting worse as more and more houses are connected and the flow becomes greater. - On Sunday, June .6th, I hada talk with Mr. Vincent Kelley, Engineer to Rockingham Sewer District, about inadequate screening of rags, sticks, paper, toys, steel potcleaners, etc., that flow into the wet well and clog up our pumps. Satruday, June 5th, my brother and I, along: -with Mr. H. Wiegard, a local plumber, whose Roto Rooter we had to get, spent most of the afternoon and evening clearing out the suction lines -trying to get—:the plant back in operation. My request is to get a mechanically cleaned screen installed in the incoming sewer line to get rid of most of the material that gives us the trouble before it gets to the wet well. 183, 18 4 Next I would like to see the Comminuter (which is like a' big garbage grinder) moved from the useless spot where it is now installed and put next in line after screening device to grind up any debris that passed through it. Also, I would like to have air difussers installed in the wel well which I feel would keep this unit clean and would prevent sediment from forming and becoming septic. If this could be done I feel it would solve a lot of problems at this plant and I do not feel we would have any problems with our:present pumping equipment. I also asked Mr. Kelley if a system of piping andvalves could be installed on our present installation of sludge air lifts to waste thickened sludge to the sludge holding tank;. In my opinion, this should have been included in the original installation. Joseph Gutmann Mr. Mills recommended that this letter be referred to Vincent Kelley of Milton Chazen Associates for their remarks on Mr, Gutmann's suggestion. A letter was received from Elliott M. Weiner, Attorney, represent- ing William Lisofsky, forwarding a proposal for the development of his_property that he intends to submit to the Town Planning Board. The Board agreed to wait for a report from the Planning Board regarding this proposal. MR. FINNAN moved for a 15 minute recess, seconded by Mr. Mills and carried. The Board recessed at 9:20 P.M. Supervisor Diehl called the meeting back to order at 9:49 P.M. with all Board members present except Mr. Clausen. Mr. Mills stated that he had spoken to Mr. Sherow,.the Janitor for the Town Offices, and he indicated there was a major problem with the furnace on the Town Halliside of the building. Mr. Mills referred this problem to Mr. Lapar, to submit a report next month, so this_may be put out to bid. Mr. Horton commented that bids had not been putout for the furnace for tree/ new additional Highway Building; perhaps these could be both be done at the same time. Mr. Mills brought up the request from the Town Justices regarding painting the Justices Chambers and Court Room. Four informal bids had been received, ranging from $260 to $290 for labor and material. 35 MR. MILLS moved the informal bid of $290, submitted by Thomas _ c Kennel and Robert Rhodes, for painting the Town Justice courtroom ceiling, side walls, and wainscoting, adjoining office ceiling, side walls and closet exterior. He said that over the past month and a half he had picked up a list of names of people who would volunteer to serve on this committee. He suggested Wednesday, June 23, 1971, at 8:00 P.M. at the Town Hall, for this meeting, and asked that a copy of the present Zoning Ordinance be sent to each of these people also. Mr. Mills brought up discussion on the Narcotics Council on a meeting that he and Mr. Diehl had attended. He comented that the people attending were supposed to come back with some recommenda- tions for a new slate of officers. Since nothing has happened, he thought the Board should formally put out a request for anyone willing to serve, and also send a letter to the Chairman and Secretary of the Narcotics Guidance Council telling them if they 1 _ aren't going to do anything, we better, it's dragging too long, they haven't done anything for some number of months. The problem is very much in evidence and we should have somebody involved in the Council someplace in the Town of Wappinger. Mr. Diehl added 186 that about a month ago there was a meeting with representatives of YELL in the City of Poughkeepsie, and from that meeting the Narcotics Board felt they had a good direction to go in, that YELL was quite successful up there. The Town of Poughkeepsie was contacted and they indicated they were interested and also combining efforts with the City of Poughkeepsie YELL, Town of Poughkeepsie and Wappinger. A group met several weeks ago with Mr. Silvers from the Narcotics Bureau at the State level and at that time Mr. Silvers was to find out how much monies was available from the State and the plan was to have a store fron or house following the proceedure of YELL. Anne Buckholtz representing r. the Town of Poughkeepsie was interested and felt the 'Town of Poughkeepsie would join in this effort, likewise the Wappingers Council. Since that meeting, Mrs. Buckholtz has indicated the Town of Poughkeepsie is not interested, but Mr. Diehl.-had..no_ further information. Mr. Mills said he was more interested in the Wappinger Council, whether the present officers were still interested or get their recommendations whether they were going to change the list of officers. Mr. Diehl said then 'maybe direct a letter to them. Mr. Mills elaborated commenting that the Council be asked if they had come up with any change in the officers, if not, what their plan of action is going to be to increase their participation. Mr. Diehl asked if Mr. Mills would include in the letter a report on YELL, what has formulated in regard to joining with the organization known as YELL. Mr. Holt reported on a meeting he and Mr. Mills attended with representatives of the Town Planning and Zoning Boards and the Fire Commissioners of the New Hackensack & Hughsonville Fire Districts. The meeting had been precipitated by a letter from the Secretary of the Board of Commissioners of the New Hackensack Fire District indicating concern over firemanic problems with regard to new developments; a healthy discussion was held and many of the matters that involve firemen, such as turnarounds and parked cars in fire lanes, and it was asked that they come back with some specifics in /7 a 8 7 writing. Mr. Mills added that it was also accepted that each Fire Chief would review the plans for any proposals and give back to the Planning Board their recommendations in any area regarding firemanics. Mr. Finnan stated that he had had a request from a woman in the Town to establish a lighting district. As far as he knows it's the first request for a lighting district in a development (Harbor Hill-VandeWater Drive Area). He informed her to petition the Board for the formation of a district, at which time Central Hudson would be asked to make a study to see what the cost would be. He asked the Town Clerk if Central Hudson could be contacted now to give an approximate cost. Mr. Finnan then commented on an article in the Town Topics regarding municipal control of underground transmission lines. It seems the Town does have the statutory authority to control this type of thing. It may require in the Zoning Ordinance. He said he would like to instruct the Attorney to the Town to set forth the necessary paper work, and he would make the resolution at the next meeting. Mr. Rappleyea noted that at the same time there is a study going on at the level of the Public Service Com- mission to deal with the question of underground transmission lines. Mr. Diehl stated that the Board had to set a hearing on the L&A Filtration Corp. rates. Mr. Rappleyea, on this subject said, in respect to the L&A Filtration Corp., the matter of the suit by the Town has been submitted to Judge Hawkins, he had adjourned it to the 17th of June for further submission of further papers. In the meantime, however, since time is progressing and since some material has been received from Mr. Lafko, he'd recommend to the Board that they consider setting a date, at which time a public meeting will be held with stenographic minutes taken and an opporr, tunity be presented to the L&A Filtration Corp. to present its books 188 and records for consideration. The records received to date, while allecjed to be certified by accountants, are not so certified, and from Mr. Brennen's reports that there are other documents that he believes, and Mr. Rappleyea concurs, are necessary for determina- tion as to rate. Mr. Rappleyea also stated, pursuant to his duties as Attorney to the Town in this particular case, he got a couple of the bills that had been sent out and submitted them with his papers. One bill was $133 for the quarter for the sewerage treat- ment and an examination of the bill, it was the first time that he had seen it, indicates that a gallonage rate has been imposed. Now, it's his understanding that there is no gallonage meter on the sewer lines. He would assume, therefore, that since one bill that he saw referred to the fact that a swimming pool was leaking that the gallonage referred to is the gallonage for the water use. He knows of no authority to charge a rate which is based upon gallonage, although Mr. Lafko refers to something in his letters that the Town Board set some type of minimum gallonage. This is not true as far as any record that he can find. Mr. Mills asked if this meeting had to be advertised, and Mr. Rappleyea said there was no legal requirement to it. Mr. Lafko, being recognized by the Chair, said he'd been expecting tonight that if any contact with the Counsel, as far as L&A is concerned the Town moved into the courts with the rate case and that's where it's going to stay. He will not further indulge Mr. Rappleyea's Town Hall rhetoric one way or the other. When you have the law that says that there's a public hearing we'll present it to the judge. Mr. Diehl questioned, what he was saying then that even if a meeting was set, Mr. Lafko will not attend until the --Mr. Lafko said what he smix1 was saying was that Counsel has advised that we're now in the court with the rate case and that's the courts adjudicate. Mr. Rappleyea asked if he would advise his counsel that his answer to the Town's com- plaint is due today. Mr. Lafko told him to present his motion to 189 the Judge. Mr. Rappleyea said he just wanted to put Mr. Lafko on notice:of that, as he's the principle. Mr. Lafko said when Mr. Rappleyea sends, with the Town's permission, a law where you have a public hearing to his counsel' who will present it to the Judge, maybe he will be granted but his request, in front of the Court, not the Town Hall. Mr. Diehl then said, so under those conditions it would be best not to set a hearing, he could see -no need for it. Mr. Rappleyea said now the Board should notify Mr. Lafko under the circumstances since he's present here, again, subject to the Board's decision that at this time without presentation of pertinent material there will be no action on his request for rate increase. Mr. Diehl directed that the Town Clerk so send a letter that there'll be no action on a rate increase until he agrees to a hearing. Mr. Rappleyea asked this be in the form of a Resolution. SUPERVISOR DIEHL moved that, in view of Mr. Lafko's statement that he will not present any further material to the Town Board on the question of the L&A Filtration Corp. rate increase request, that the L&A Filtration Corp. be advised that the Town of Wappinger would not act upon its request for a rate increase until its books, records and tax returns were presented to the Town Board for their study and review. My clients have been aware that there -is a problem in connection with the water supply system, even though the same has been constructed in accordance with the plans that were approved by the Dutchess County Board of Health and Water Re- sources Commission of the State of New York. Since my clients are concerned over this problem, as I am sure you are, we have met with your Supervisor and Town Engineer and have had -field studies made and had extensive consultations to determine what might be done in order to improve the water supply. As a result of the studies and the engineering information we have obtained, it is our considered opinion that the best way to proceed is to expand the facility by the installation of a - 30,000 gallon storage tank and also the drilling of an additional well. The storage tank will give 200 percent more storage capacity to the existing system and the additional well will provide a source of water in the event any problem should arise with the mechanical controls on the existing well, this putting the water supply system in a position where it will be able to continually supply water to the residents of the subdivision. Before proceed- ing with the expense of expanding the facility, however, my clients would like to have your authorization in writing indicating your consent_to the steps ;that are being taken in order to expand the existing facility and also, your waiving of any requirements under local law no 2 or any other ordinances that might be applicable so that we can proceed with as much haste as possible before the peak water useage of the summer months arrives. Mr. Finnan regarding the vouchers submitted by the Dog Warden, questioned the mileage. He requested that the-TowP Clerk notify Mr. Guarino that in the future, before the Board honors any more mileage vouchers from him, the nature of the complaints and name and address be included on the voucher and notify the Assistant 198 1.1 11 IJ IY��IiYnILYI+JYiWY Dog Warden of the same requirements. Mr. Finnan, with regard to the attempts being made to make Highway Superintendent and Town Clerk four year terms, it seems that they've ignored the Supervisor. He said he would like to recommend that the Supervisor's office be established as a four year term, effective January 1, 1974 term, as the feeling of Mr. Mills and himself is that it would provide an overlapping between the Town Clerk and Supervisor so they would not be coming up for election at the same time, as these two people probably know more about what is going on in the Town. He feels it would be more beneficial to have it set up this way. It was discussed about holding a Public Hearing and Mr. Mills questioned time periods in order to place a proposition on the ballot at the November Elections. Mr. Finnan then directed the Attorney to prepare papers for a Local Law to provide for the Supervisor's term of Office to be four years. Recommendations were received from both the Dutchess County Depart- ment of Planning and the Town of Wappinger Planning Board regarding the rezoning petitions of Kathleen Hesse, and Joseph Rossetti. Mr. Finnan said he would like to take action , as soon as he looks into it a little bit further. Supervisor Diehl instructed the Attorney to the Town to prepare resolutions for rezoning. UnderAinfinished business, Supervisor Diehl asked if anyone had anything to bring up. Mr. Incoronato, with regard to the Town Planning Board's approval of "White Gates" Apartments, read a letter he, as _president of the Wappinger Conservation Association Inc., had written to Supervisor Diehl. It referenced to a purported letter written to the ToWn, Board from the Hill Top Water Corp. regarding modification of Local Law #2, Year 1967, that would allow Hill Top to service White Gates with water. Mr. Incoronato's letter further stated 197 that he had notified the Town Planning Board Chairman that Eugene Schuele, as -a principal in this water company, should be disquali- fied from voting on the apartment siteplan, but in fact Mr. Schuele did vote, despite a potential conflict of interest. He, therefore, was requesting that the Town Board of Ethics investigate the proprie- ty of Mr. Schuele's recent'involvement in the Planning Board's deci- sion to -approve White Gates. The last paragraph cautioned the Board that the courts might nullify the,decision on the basis of undue and unwarranted influence arising from conflicts of interest. Mr. Incoronato continued, elaborating that the action of certain members on the Planning Board cast a grave shadow of a doubt on the integrity_of the Board. He would like to see appropriate action taken. Mr. Eck commented that he had attended the Planning Board meeting referred to, and Mr. Incoronato hadn't. He mentioned, with reference to water, it was agreed the apartments would drill wells, or, if the Town comes through with water, they would buy it from the Town. He felt Mr. Schuele wasn't wrong because he voted on wells, he didn't vote on his own water, that there was no conflict there. Mr. Cortellino voiced agreement with Mr. Incoronato indicating that he felt Mr. Schuele's areas of interest were in conflict with the Planning -Board. MR. DIEHL moved that the Town Board instruct Eugene Schuele to ask the Board of Ethics for his part, cares and his voting on this be investigated in this matter. Motion failed for lack of a second. Mr. Lafko, referring to the Schuele discussion, asked for the date of the instrument in which Mr. Schuele informed the Board that he had heard from these developers (letter dated May 3, 1971.) He then said he putout a notice to people in Quiet Acres and the area that Atlas Water is being served, mainly because he had been contacted by the engineer to the various developers in the same area. He had discussed with Mr. Schuele his plans and informing him of the requests that had come informally to the Atlas Water, 198 then he hears tonight that Mr. Schuele has been contacted to supply water into the area that Mr. Lafko had laid out. The. announcement published in the paper that there would be a peti- tion to the Town whereby existing customers would be benefited with their fire protection andalso, if the Town so wished, could get fire protection and water service right to the southern boundary of the Town line. Mr. Schuele knew all this. Mr. Lafko's idea was to give the Town the opportunity, before going ahead with a petition, to see' if they want to form a district, or if they would rather choose that the water companies do the work, privately, and turn it over to them for cost. Certified costs as they go along so that the Town could possibly get moving this year. He said he would like to request of the Board that the present Town Engineer be asked to abstain from evaluating the plan. It would be both beneficial to Mr. Lapar and himself, but maybe for the benefit of the Town, that this petition is evaluated by somebody else, Mr. Lafko continued, saying he wished the record cleared up, regarding some statements Mr. Rappleyea made tonight, Mr. Lafko doesn't know where he gets the idea that there never was -a minimum charge. He doesn't know of one sewer company in the entire State that has found a metering device for individual homes that can meter effectively. If Mr. Rappleyea had read the L&A papers more thoroughly he would see that if the customer does not have a. meter, Mr. Lafko would install a meter and the charge would be $80. Returning to the question of the petition, Atlas will still present the petition, the Town can make the decision. Atlas has an excess of water, -Mr.. Schuele's system does not have an excess in its wells, and he again mentioned that under the circumstances he didn't feel the Engineer to the Town could do a fair evaluation of that petition. Mr. Lapar, at this point, asked Mr. Lafko to personally sign, in front of a notary (two of which were present) a letter, written on L&A Filtration Corp. letterhead to the customers of L&A, under Mr. Lafko's name. (This letter was regarding Mr. Lafko's opinion of the Wappinger Sewer Improvement #1 and Mr. Lapar's professional capabilities). Mr. Lafko refused to sign said letter. Mr. Rappleyea asked to speak in answer to a few of Mr. Lafko's remarks. He reviewed briefly the original agreement between the Town and L&A Filtration and commented on the present question of the rates and the limited cooperation of Mr. Lafko in obtaining pertinent information, for review by the Board. Fred DiMaria asked about the present restraining order of the Court regarding the L&A billing, did that mean the customers should only pay the $69.30. Mr. Rappleyea answered that the restraining order says that he shall not charge any rates greater than that set forth in the agreement dated April 6, 1964, which, in Mr. Rappleyea's opinion is $69.30 per annum. Mrs. Mills asked, in regard to a request of the Receiver of Taxes for an increase in salary due to the added duties of setting up and collecting sewer and water rents for the Town, felt this should be district charges. John Schouten spoke about the State Law regarding left and right turn on arrow lights, Central Hudson high tension lines and extended heighth of towers, and finally about apartments, paying their fair share of taxes, they should be made to pay a full unit basis, they should be considered the same as a private home. Mr. DiMaria asked the status of the Wildwood Sewer District. Mr. Diehl answered the Board hadn't taken any action as yet. MR. Arthur Bisom questioned why a resolution for a full time supervisor or a comptroller was tabled, inasmuch as that was more important than the four year term now being discussed. He suggested putting the full time supervisor or comptroller on the same referendum as the Town Clerk and Superintendent of Highways. James Mills advised that most probably the Supervisor would be put up for four years and arranged so the Town Clerk and Supervisor would not be turned out of office the same year. 2 o o Mr. Bisom requested to be placed on the next Town Board meeting agenda to speak out in favor of a full time Supervisor or Comptroller.
