Resolution Authorizing Transfer of Funds Within the Highway Department Budget
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on April 23,
2012.
The meeting was called to order by Barbara Gutzler, Supervisor, and upon roll being
called, the following were present:

The following Resolution was introduced by Councilman Bettina and seconded by
Councilman Beale.
WHEREAS, the Town of Wappinger Highway Department has two (2) underground
petroleum storage tanks, one containing gasoline, and one containing diesel fuel; and
WHEREAS, the annual inspection of cathodic protection of those tanks revealed that the
tanks are failing and need replacement; and
WHEREAS, Highway Superintendent, Graham Foster proposes to replace those tanks
with new above ground rectangular tanks, in accordance with current regulatory guidelines; and
WHEREAS, because of the exceptionally mild winter, the Highway Department has
unexpended funds in its 2012 DB Salt Account, in excess of $100,000; and
WHEREAS, Superintendent Foster proposes to utilize said funds to remove the existing
underground storage tanks and replace them with two (2) above ground storage tanks in
accordance with Federal and State regulations with respect to the closure and removal of
underground bulk petroleum storage tanks; and
WHEREAS, Superintendent Foster has proposed to do the removal of the old storage
tanks and the installation of the new storage tanks with existing Highway Department personnel
under the supervision and guidance of Joseph Jordan of Enviro Clean Services, LLC (Enviro
Clean); and
WHEREAS, Joseph Jordan of Enviro Clean will provide engineering guidance and
coordinate all regulatory compliance relative to the removal of the underground storage tanks
and the registering of the new above ground storage tanks; and
WHEREAS, the engagement of services with Enviro Clean is exempt from competitive
bidding requirements of ~103 of the General Municipal Law, as well as the Town of Wappinger
Procurement Policy pursuant to Town Code ~46-3, with respect to the services to be provided by
Joseph Jordan, which the Town Board deems to be a professional service contract, subject to
State licensing and/or testing requirements that require substantial formal training; and
WHEREAS, the Highway Superintendent and the Town Board have determined that the
undertaking of this work is deemed a Type II action pursuant to 6 NYCRR 617.5(c)(20) and is
otherwise exempt from environmental review pursuant to the New York State Environmental
Quality Review Act (SEQRA).
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
The Town Board confirms that it is essential that the underground storage tanks
be removed and replaced with above ground storage tanks in compliance with
applicable Federal and State regulations.
The Town Board hereby authorizes the following budget line transfers from the
Highway Department as follows:

4. The Town Board further authorizes Highway Superintendent, Graham Foster
and/or Town Supervisor, Barbara A. Gutzler to employ the services of Joseph
Jordan of Enviro Clean to provide the professional oversight and necessary
regulatory compliance incidental to the removal of the underground storage tanks
located at the Highway Department and the registration of the new above ground
storage tanks.
The foregoing was put to a vote which resulted as follows:

On 4/4/12 we had our annual Cathodic Protection survey done on our gasoline and diesel tanks at our Highway
Deparbnent, both tanks fiilled. The cathodic protection of our tanks is required by DEC as part of our bulk petroleum
storage license. These tanks were installed in 1993 and normally have a projected life of20 years, so the fiillure is not a
total surprise.
Our best course of action is to replace these tanks with new state of the art, above ground rectangular tanks. They are
double wall steel tanks known as Fireguard UL2085.
I feel our best course of action is to obtain three quotes on these tanks, which I have done. Using my crew and under
the direction of our consultant Enviro Clean we can remove the old tanks and install the new ones. Enviro Clean will
also update our license.
Our total projected costs are as follows:

contingencies which may occur during this project and will not affect the overall 20 12 operating budget.
