Supervisor Gutzler opened the floor to the public. The first resident to speak was Mary Schmalz.
She commented on the discussion portion, regarding the proposed Senior Housing, stated in the
last meetings minutes. Ms. Schmalz stated that the developer gets the tax write off and the
medium income people are the ones who pick up the taxes. She stated that what the town needs
is housing for seniors. The town doesn't have low income housing. Riverbend in the Village of
Wappingers Falls is for people who don't have a pension, if you have a pension you cannot rent
there. If there is going to be senior housing it needs to be for medium income people who
supported this town and paid their taxes. Senior housing should be for those who are selling
their houses so they won't have to move away. She asked the board to look into the history of

the housing needs before making a decision. She added that she is willing to bring to the board a
list of people who are opposed to the rezoning of the property.

Resolution Adopting "Local Law No. 10 of the Year 2012 Amending Chapter 46, the
Procurement Policy of the Town of Wappinger"
WHEREAS, a Resolution was duly adopted by the Town Board of the Town of
Wappinger introducing proposed "Local Law No. of the Year 2012 Amending Chapter 46,
the Procurement Policy of the Town of Wappinger"; and
WHEREAS, the Public Hearing was duly advertised in the Poughkeepsie Journal and the
Southern Dutchess News, the official newspapers of the Town; and
WHEREAS, the Public Hearing was held on April 9, 2012, and all parties in attendance
were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law
or any part thereof; and
WHEREAS, the Town Board determined that the proposed Local Law was not subject to
Environmental Review; and
WHEREAS, the Town Board of the Town of Wappinger after due deliberation finds that
it is in the best interest of the Town to adopt said Local Law; and
WHEREAS, said Local Law has been on the desks of the members of the Town Board
of the Town of Wappinger for at least seven (7) days exclusive of Sunday prior to the adoption
of this Resolution.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board of the Town of Wappinger hereby adopts "Local Law No. 6 of
the Year 2012 Amending Chapter 46, the Procurement Policy of the Town of
Wappinger", a copy of which is attached hereto and made part of this Resolution.
3. The Town Clerk is directed to enter said Local Law in the minutes of this meeting
and to the Local Law book for the Town of Wappinger and to give due notice of

LOCAL LAW OF THE YEAR 2012
A Local Law entitled "Local Law No. of the Year 2012 Amending Chapter 46, the
Procurement Policy of the Town of Wappinger".
BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section I: Title:
This Local Law shall be known and cited as "Local Law No. of The Year 2012
Amending Chapter 46, the Procurement Policy of the Town of Wappinger".
Section II: Legislative Intent:
The Town Board of the Town of Wappinger has reviewed its annual Procurement Policy
as required by § 104-b of the General Municipal Law and has determined that it is in the best
interests of the Town to increase the limits set forth in the Procurement Policy, as authorized by
amendments to General Municipal Law § 103.
Section M. Amendments to Specific Sections and Paragraphs of Chapter 46
Procurement Policy.
The specific Sections and Paragraphs of Chapter 46. Procurement Policy are hereby
amended to read as follows:
"§ 46-2. Items not subject to competitive bidding.
A. Purchase contracts under $20,000.00;
B. Public Works contracts under $35,000.00;

B. Any written RFP shall describe the desired goods, quantity and the particulars
of delivery. The purchaser shall compile a list of all vendors from whom
written/fax/oral quotes have been requested and the written/fax/oral quotes
offered.
C. A good faith effort shall be made to obtain the required number of proposals

or quotations. If the purchaser is unable to obtain the required number of
proposals or quotations, the purchaser will document the attempt made at
obtaining the proposals. In no event shall the failure to obtain the proposals
be a bar to procurement.
§ 46-6. Award of contracts to other than lowest bidder.
A. The lowest responsible proposal or quote shall be awarded the purchase or
public works contract unless the purchaser prepares a written specification
providing reasons why it is in the best interest of the Town of Wappinger and
its taxpayers to make an award to other than the low proposer. If a proposer is
not deemed responsible, facts supporting that judgment shall also be
documented and filed with the records supporting the procurement.
B. (4) Goods under $1,000.00 and public works contracts less than $2,500.00.
The time and documentation required to purchase through this policy may
be more costly than the item itself and therefore not be in the best interest
of the taxpayer. In addition, it is not likely that such de minimis contracts
would be awarded based on favoritism.

§ 46-7. Effect on purchase under bid limits.
No portion of this Chapter shall be construed as preventing the competitive bidding
of purchase contracts under $20,000.00 or public works projects under $35,000.00, if
so desired."
Section IV: Reconfirmation and Ratification:
Except as herein specifically modified, the remaining Sections and Paragraphs of Chapter
46. Procurement Policy is hereby reconfirmed and ratified.

If any part or provision of this Local Law or application thereof to any person or
circumstance shall be adjudged invalid by any court of competent jurisdiction, such judgment
shall be confined in its operation to the part of the provision or application directly involved in
the controversy in which judgment shall have been rendered and shall not affect or impair the
validity of the remainder of this Local Law or the application thereof to other persons or

circumstances, and the Town of Wappinger hereby declares that it would have passed this Local
Law or the remainder thereof had such invalid application or invalid provision been apparent.
Section VI: Numbering for Codification:
It is the intention of the Town of Wappinger and it is hereby enacted that the provisions of
this Local Law shall be included in the Code of the Town of Wappinger; that the sections and sub-
sections of this Local Law may be re -numbered or re -lettered by the Codifier to accomplish such
intention; the Codifier shall make no substantive changes to this Local Law, the word "Local Law"
shall be changed to "Chapter," "Section" or other appropriate word as required for codification; and
any such rearranging of the numbering and editing shall not effect the validity of this Local Law or
the provisions of the Code effected thereby.
Section VII: Effective Date:
This Local Law shall take effect immediately upon filing in the office of the Secretary of
State in accordance with Section 27 of the Municipal Home Rule Law.

OF THE YEAR 2012
of the Year 2012, Amending Chapter 236 -
BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section I: Title:
This Local Law shall be known and cited as Town of Wappinger, "Local Law No.
of the Year 2012, Amending Chapter 236-6.B. of the Town of Wappinger Code."
Section II: Legislative Intent:
By the adoption of Local Law No. 1 of the Year 2011, the Town Board established
capital buy -in fees for new parcels being added to the jurisdictional boundaries of Water and
Sewer Districts. Due to an inadvertence, typographical errors occurred resulting in erroneous
capital buy -in fees for Water and Sewer Districts being reversed. The Town Board seeks to
correct these errors by the adoption of this Local Law.
Section III: Amendments to the Code:
The following sections of Chapter 236-6.B. of the Town of Wappinger Code are hereby
amended to read as follows:
"§ 236-6.B.(1)(b)[1]
[1] For single family residential parcels with no more than four (4) bedrooms per
residential unit, the average daily usage shall be deemed to be 320 gallons per
day, resulting in a capital buy -in fee of $4,800.00.
§ 236-6.B.(2)(b)[1]
[ 1 ] 'For single family residential parcels with no more than four (4) bedrooms per
residential unit, the average daily usage shall be deemed to be 320 gallons per
day, resulting in a capital buy -in fee of $3,200.00."
Section IV: Reconfirmation and Ratification:
Except as herein modified, the remaining sections of Chapter 236-6 entitled "Buy -in Fees
to Sewer and Water Districts" are hereby reconfirmed and ratified.
Section V: Separability:
The provisions of this Local Law are separable and if any provision, clause, sentence,
subsection, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any
person or circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability, shall
not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or
parts of this local law or their application to other persons or circumstances. It is hereby declared
to be the legislative intent of the Town Board of the Town of Wappinger that this Local Law
would have been adopted if such illegal, invalid or unconstitutional provision, clause, sentence,
subsection, word or part had not been included therein, and if such person or circumstance to
which the Local Law or part thereof is held inapplicable had been specifically exempt therefrom.
Section VI: Numbering for Codification:
It is the intention of the Town of Wappinger and it is hereby enacted that the provisions
of this Local Law shall be included in the Code of the Town of Wappinger; that the sections and

VIII. Discussions
A. Recycle Center - Beale (:20)
Councilman Beale gave a presentation on the recycle center. He stated that the board needs to be
on the same page in regards to the objective of the Recycle Center. Some of the objectives are to
improve accountability at the center, effectively recovering over head, and improving efficiency
in the level of service. He went over the current rate schedule and stated that for the most part the
stickers for the Freon and computer monitors are being used and seem to be working, other items
to talk about are propane tanks and tires. Graham Foster, Highway Superintendent, stated that
they do get forty percent for the metal of the propane tanks as well as all metals. The center does
accept tires but to charge for them have never been discussed. Councilman Beale added that the
stickers currently are good until the end of 2012. If they are to change the permits to annual
month permits, the permits would require some kind of punch process. He feels that doing
anything different would slow down the process at the gate. As of now the color is what proves a
permit is valid. The color will have to be changed in 2013. The board will have to determine
when to start selling the 2013 permits. He added that at one point there was talk about bar coded
permits, but at this time he feels that the current system is the best. He stated that the Board will
have to decide how to handle renewals, whether a letter will be sent out or a sign at the gate, but
they will have to have a discussion about that in the future. Some other things to discuss will be
if the Town should offer a military discount, signs on the dumpsters, and the line on the road
directing traffic. The dumpster signs are worn and may need additional signs. He added that the
flag pole should be fixed and used at least when the center is open. Councilman Beale went over
the man power that is needed to run the center. He suggested that in the future the board may
want to discuss reducing the man power especially in the winter. A thesis paper, done by a
Marist student stated that replacing a full time employee with two part-time employees on
Saturday would save $16,000. He then discussed future proposals such as opening up the center
once week a year to help with storm clean up and also considering bulk pick up. He explained
that maybe if a resident has something to go to the center but can't get it there and they are
willing to pay more, have someone go out and pick it up. Councilman Beale asked Graham
Foster to explain the We Recycle program. Mr. Foster explained that there was a company that
would take anything with a plug and using this program could save the town money. He would
like to have a representative talk to the Board about the program. Councilman Beale stated that
he thinks shared service should be looked into with the Dutchess County Resource Recovery
Agency. He suggested having a bin available to residents for the hazardous waste materials and
then have Resource Recovery come to collect it. Councilwoman Czarniecki added that an
appointment is needed to go to the Dutchess County Resource Recovery and the wait is weeks
out, so if something could be set up it would be great. Councilman Beale continued stating that
there are other entities that will collect old cell phones and other things. Since the facility is
already in place it will take a few bins to collect these items. He feels by doing this it will
support the mission statement. He added that Mr. Foster is doing a great job at the recycle center
although some residents are not happy with paying the fee they can't do a fair analysis of
revenue until the end of 2012. He added that he feels that they are doing the best they can do
with the resources available. Supervisor Gutzler stated she put on the dais the reports provided
by the Accountant, Fredrick Awino. Councilwoman Czarniecki questioned whether anything has
been done in regard to solicit members for the Recycle Committee. Councilman Beale stated that
it was in the paper and it is on the web site. He recommended calling the Supervisors office if
they are interested. Supervisor Gutzler recommended a slide be put on the T.V channel.
Councilman Beale stated that in the past the policy regarding recreation dumping the trash at the
recycle center may need to be reviewed. What seemed to be a money saving idea in fact may not
be. During Little League season the Recreation Department fills a dump truck with trash that fills
a whole dumpster with trash at the Recycle Center. Something to look into is whether it is more
cost efficient to drive it out to Royal Carting and dump it there. He suggested Mark Price,
Recreation Director, and Steve Frazier, Building and Grounds Supervisor, take a look at which
would be more cost effective.
Jennifer Nelson, a resident of the Town of Poughkeepsie, stated that she owns a two family
house in the Village of Wappingers Falls. When she came to get a Recycle Center permit she
was told that it was not available because she was not a resident. She feels that she owns the
property, she pays the taxes and is willing to pay the fees she should get a permit. She doesn't
understand why she cannot get a permit. Councilman Beale stated that the issue is common. The
board had to tighten up on the use of the facility because there are many absentee landlords that
don't live in the town but want to use the Recycle Center. Ms. Nelson questioned if there was a

compromise that could be met. Highway Superintend Graham Foster stated her tenants could get
a permit. Councilman Beale suggested that the tenant get the permit and assist in getting rid of
the items she needs to dispose of. Discussion continued.
B. John Lawrence and Maloney Road Water District - Kuzmicz(.20)
Supervisor Gutzler welcomed John Lawrence, owner of the Route 376 Realty, and Bridget
Barkley, Dutchess County Water Authority. Patrick Moore, representative for John and Kim
Lawrence, owners of the Route 376 realty, was the first to speak. He stated that they were there
to give a presentation of what they would like to see happen in the formation of a water district.
The Route 376 Plaza currently is serviced by a well. He explained that the properties east on
Maloney Road are all served by wells and the water quality and fire suppressions are poor. There
is a water line that runs along the Rail Trail with a fire hydrant on the corner of Maloney Road
and the Rail Trail. Mr. & Mrs. Lawrence sought the participation of the residents in the potential
formation of a water district, with the purposed purchasing of water from the Dutchess County
Waste Water Authority, who own and control the water there. They received positive input from
the residents in the area. He continued that the Maloney Road section is approximately seven
tenth of a mile. After meeting with Bridget Barkley they received a purposed memorandum of
understanding from the County outlining a process for the formation of a county district. Mr.
Moore and his clients as well as Ms. Barkley understand that the Town of Wappinger has the
option of creating an administrative district. He stated that they will abide by the determination
of the Town Board and the exercise of their discretion. He stated that they have concerns that he
wanted to express. He stated that this is a quality of life enhancement, that they are looking to
achieve at a minimal expense to the residents. The area is small and there are some limitation by
the language of the agreement of the Joint Water Board and the County Water Authority. The
County must abide by the pricing structure in the agreement and the concern is that if the Town
of Wappinger were to administer the district it would add additional taxpayer costs and fees in
addition to the district. He stated that if a developer puts in 200 lots the developer would incur
the cost. The distinction is that they are dealing with existing residents and tax payers that are
looking in improve their quality of life. He added that nearby is the boarder of the Town of
LaGrange. If the district was to expand into the Town of LaGrange is would be easier for the
County to administer rather than piece meal it together. He added that the way the agreement
between the City Town Water board and the County District is written there is a limitation in the
amount of 250,000 per day in ten year increments, which he is not sure if it would affect the
bonding process, but it may provide a price adjustment at the end of ten years. Mr. Moore stated
that his purpose was to bring to the Boards attention the little level of complication introduced,
by the town administering a district for water that it doesn't own. The creation of a water district
is usually for water you control not for water you're purchasing from a third party. Mr.
Lawrence explained the water line and stated the there is no easements but all the property
owners along the route are willing to give up what is needed to widen the road. Ms. Barkley was
the next to speak. She stated that the County Water and Waste Water owns and operates the
Central Dutchess Water line which is purchased from the Joint Water Board. There is a purchase
agreement which dictates the terms at which they can sell water to others. She stated that there
are no capacity issues and they are selling to East Fishkill IBM and East Fishkill Hopewell
Glenn. There is plenty of water available and capacity in the line. There is specific terms and
conditions for which they can sell the water. The authority policy is that they do not establish
water service or sewer service area in a municipality without the agreement of the municipality.
The town will ultimately have the authority to determine if they would like to establish the
district to provide the service or would like the Authority to. They are not a Dutchess County
department but work with them. She explained the process in which to create the district and
how the Authority is willing to facilitate the provision of water to these properties. Councilman
Kuzmicz stated he would be in support of this. Councilwoman Czamiecki questioned if there
was a possibility of expansion in the future. Ms. Barkley stated it could be expanded in two
ways, one being to create a new district and the other being expanding the boundaries. This
would be done in the same process in which a town district would expand. Councilman Bettina
stated that there is water on McGee Rd in the Town of LaGrange and it would be more cost
effective to petition LaGrange to tie into that. He questioned if Mr. Lawrence has looked into
that aspect. Mr. Lawrence state he could look into it. He added that this would be phase one and
that phase two could be the water main coming down Airport Drive to the Wornock house and
provide water there also. He feels it would help a lot of people. Councilman Beale questioned
who would control the price. Ms. Barkley explained that there were a couple components to the
price. There is a cost of purchasing the water from the Joint Water Board, which is set by the
Authority and the Water Board with an escalator clause which ties into the rate of inflation. The
additional cost is what it cost to run the Central District water line which is established each year
by a budget through the board of directors. That determines the cost at the connection point. If it

was a town district, the town would have the authority to set the retail price to the customers in
the district. If it were a zone of assessment in the county water district it would be owned and
operated by the Water Authority and their board would determine the cost. Councilman Beale
stated that it was something that needs to be kept in the front of the Boards minds because there
have been issues in other municipalities where there have been very expensive charges and the
Boards are blamed because they are the ones approving it. He added that he has a sour taste for
this water line since he was at a fire and there was a lock on the hydrants and he couldn't get
water out of the hydrant. Ms. Barkley stated that there are fire hydrants all along the line and
there is a memorandum of understanding with the fire districts. She added that there are hydrants
that are flushing hydrants that could be damaged if used as fire hydrants. There are hydrants at
every major street crossing. Councilman Beale stated he supported Mr. Lawrence's presentation
he feels that if the town is going to be a subsidiary of a district the board needs to understand all
the price points. Mr. Smith, a resident from Crestwood Apartments, stated that he feels it would
be better to have town water rather than well water. Ms. Barkley explained the fire suppression
system involved. Supervisor Gutzler suggested the Board look over the material then contact Mr.
Lawrence and Ms. Barkley with questions. Mr. Moore respectfully requested a quick decision.
C. Forgotten Wappinger Hamlet - Kuzmicz/Cavaccini
Supervisor Gutzler introduced Joey Caviccini to speak about the forgotten Wappinger Hamlet.
Mr. Caviccini is a 7`" grader, a member of the Dutchess County Historical Society, and a member
of the Fishkill Historical Society. In September 2011 the Town of Wappinger made a
proclamation in Mr. Caviccini's name declaring the day to be Wappinger Heritage and Historical
Appreciation Day stating that he would be an honorary historian for the rest of 2011. He gave a
brief history of General Jacobs Swartwout and Swartwoutville. Mr. Caviccini stated that the
General and the area named after him is unknown by many people and he is trying to make its
history be known. The area of Swartwoutville is located in the Southeast corner of Wappinger,
with its borders being Cedar Hill Rd., Old Hopewell Rd. Sprout Creek and Route 82 at the
Wappinger and Fishkill Town line. He is purposing signs at the six entrances at the hamlet and if
possible he will try to raise the funds for the signs. He would like the sign to be similar to the
signs that are at the entrances of the developments and Hamlets in the town. Councilman
Kuzmicz stated that he sponsored this discussion item because he feels that the Hudson Valley is
rich with history and he likes to see young people interested in history. He encouraged Joey as
well as others to continue the good work. The Board praised Mr. Cavaccini for a job well done
and thanked him for enlightening them to the history. They are all in support of his work and
goal. Supervisor Gutzler stated that she feels as a board she would like to give Mr. Cavaccini all
the help they can provide. Councilman Bettina stated that he would like to give Mr. Cavaccini a
certificate of appreciation for his hard work. Councilwoman Czarniecki state she agreed.
Supervisor Gutzler motioned to endorse Mr. Caviccini concept and do whatever they can to help
out, the motion was seconded by Councilwoman Czarniecki. All were in favor.
Resident Gary Lindstrom added that he met Mr. Caviccini at the Van Wyck Home in Fishkill
and commended him. He stated that in the 1940's and 1950's Swartwoutville was a place like
Hughsonville and referred to as such. Since then, it has dropped off the map as a place people
refer to. Councilman Beale stated that Dutchess County is appointing a Historian again. He
stated that he hoped Mr. Caviccini would be an ambassador to the Dutchess County Historian to
help make sure the towns' communities are recognized. He feels that the small Hamlets need to
be recognized. Supervisor Gutzler invited Mr. Caviccini to come back and update the Board as
well as to put together a display for the Town Hall display case. Mrs. Fuimarello also requested
Mr. Caviccini's information be displayed at the Grinnell Library.
D. Recreation: Summer Playground Fees - Gutzier/Price (:10)
Supervisor Gutzler explained that the summer camp program has been running at a deficit and in
order for it to recoup some of the funds the program fees will need to be changed. Mark Price,
Recreation Director put an analysis together for the board regarding the summer camp program.
He proposed closing of Quiet Acres and increases in the camp fees. Mr. Price explained the
program and how it has evolved. After looking at all the information he compiled, he stated that
it is his recommendation to close one of the smaller camps to see if one of the other camps would
absorb those kids, since the other camps are close. He stated that the reason for the discussion
was to get the boards decision on the program as to the closing of one camp and camp fees.
Supervisor Gutzler stated that raising the fee to $250 would be a 13% increase, $275 would be
25% and $300 would be a 47% increase. Councilwoman Czarniecki stated that when you look at
the weekly cost its $42.85. She suggested a multi family discount. Councilman Kuzmicz
questioned if Mr. Price anticipated any drop off in enrolment if the costs were to be raised. Mr.
Price stated that it would be hard to predict. He added it is still a super program based on the

hours served. The program is an enrichment program. Supervisor Gutzler questioned the Board
as to whether or not they want more time to deliberate. Councilman Bettina state he would like to
study a little more. Mr. Price stated that they are just coming to the season where he likes to
generate interest but there is still a little time left before he has to raise awareness. Councilman
Beale questioned if expanding the camp to 8 weeks was an option. Mr. Price stated that he runs
an 8 week program in Beacon and generally what he finds is that the staff drops off toward the
end because of vacations and starting college. Councilman Kuzmicz asked for the
recommendation of Mark Price. Mr. Price stated that he likes the break even scenario, but it
makes sense to step the fees to $275 and go from there. Councilman Beale supported the
recommendation of the Recreation Director to increase the fees to $300 and break even.
Councilman Bettina stated that he also supports it. All programs should be self sustaining. As
long as it's a wash he supports it. Supervisor Gutzler question the idea of a quantity discount.
Mr. Price added that he will email the board some scenarios. Councilwoman Czarniecki state that
she agrees with Councilman Bettina, that the programs be self supporting. Councilman Beale
made a motion seconded by Councilman Kuzmicz to adopt the recommendation for the $300
program cost as per the recommendation of the program director. All were in favor. Councilman
Beale stated he would like Mr. Price to help people understand that Wappinger is still the
cheapest program around.
Councilman Beale added that he would like the director to adopt a more stringent policy in
reference to the Town cell phones. Supervisor Gutzler stated that she did have a conversation
about that with Mr. Price last year.

E. Fees for lights at Robinson Lane - Gutzler (:10)
Supervisor Gutzler distributed the letters from Mr. Walton and Mr. Norris who had concerns
about the fee schedules regarding the lights at Robinson Lane. Mr. Norris, manager of the
Wappinger Yankees, gave a brief history of the Wappinger Yankees League. He stated that in
the past the town gave them some money but recently the town has not given them any money.
He has sold sign advertisement to offset the cost of the lights. This year the fees have been raised
and now he will have to pass the cost along to the players which he is not in favor of. He has
volunteered where he can to help to keep the fees low. He stated that if the fee was only $150 a
night he could probably absorb the difference. Councilwoman Czarniecki stated that no one
disputes the fact that Wappinger Yankees are a phenomenal ball club. She stated that the
difficulty is that he is asking the town to subsidize. Mr. Norris stated that he is asking the town
not to raise the fees so much. He added there are only two clubs that use the lights.
Councilwoman Czarniecki stated that they stand on the proposal that every program has to be
self supporting. To allow a change in the fee would open flood gate. Mr. Norris added that he
was disappointed that no one could tell him how much recreation collected in fees. Mr. Price,
Recreation Director stated the he has a spread sheet of all the fees collected as it came through
his office. He added that he thought what Mr. Norris is speaking of is the request for use that
does not come through recreation. Councilman Beale stated that what needs to be made clear is
that the Yankees are a sanctioned organization. Little League received funding because of the
intent to provide a service to the youth of the town whereas the Yankees are over 18 therefore
they don't receive any subsidy. He added that it is time to look at outside sources for revenue.
There are signs on the fence now that were sold to subsidize the Yankees. He asked if they still
sell advertizing and where the money goes. Mr. Norris explained that he has collected $2000.00
and if there were any extra money he has bought things for the field. Councilman Beale
suggested continuing seeking out side revenue through advertizing. Supervisor Gutzler invited
Adam Walton, president of Dutchess County Men's Senior Baseball League, to speak to the
board. Mr. Walton stated that the league has been around for 22 years and in business with the
town for 15 years. He was fully prepared to pay a 20% increase. Because of the way the program
runs he has to start everything early and accounted for an increase. The problem came in when
he had already set his fees and started collecting money from the players and he did find out the
fee had been raised until the end of March. The league is 3 week out from the start and now he
has to collect more money to offset the increase in fees. It is very hard for him to go to the

players and collect the money. The problem he has is that the increase is 60%. The only way he
would be able to keep his dates is to set the number of hours for a game and pay on a per hour
bases. Otherwise he will have to pull some of the dates, he is not sure how it will affect the town
but he does know how it will affect them. He added that there are about five fields in the county
that have lights and one set of fields that they use charges half of what the Town of Wappinger is
charging. They charge $80 under the lights with full field preparation. If they want field
preparation in Wappinger they have to go to little league. Steve Frazier, Buildings and Grounds
Supervisor, stated that as he recalls part of the fee included a salary for a town employee to
switch the lights on and off because in the past years they had quite a bit of unauthorized use.
Supervisor Gutzler stated that there were several occasions that she had to send a town employee
out at time and a half pay to turn off the lights and that was one of the reason for the increase.
Mr. Norris stated that if it happens again to please call him and he will do it. Supervisor Gutzler
asked the board for their opinion. She stated that she feels they made a decision and should stick
to it. Councilman Beale question how many games the men's league played on the fields. Mr.
Walton stated that they play 46 days. Councilman Beale stated that the board needs to understand
that the Wappinger Yankees are presented as a sanctioned organization and maybe should be
give a different rate or another avenue to advertize of offset the cost. There are multiple fields
that use lights and contribute to the cost. Little League uses lights as well but because they are a
sanction youth organization and they don't get charged. He added that the fees should be laid out
in a way that is fair to all parties involved and that they prioritize the Town of Wappinger
sanction organizations. Councilman Kuzmicz stated that he does agree with Councilman Beale
and maybe a penalty could be instill to offset the cost if an employee has to go out and turn on
and off the lights. Mr. Walton questioned if it was possible to charge by the hour, that way he
would be able to keep within the price structure and play all his games. Councilwoman
Czamiecki stated she was not sure if it was possible to charge that way without the technology.
Councilman Bettina stated that everything is going up and the fees need to stay. Discussion

WHEREAS, the Town of Wappinger applied for and received an additional grant from
the Community Development Block Grant (CDBG) program in the amount of $100,000.00 for
additional design and construction of amenities at the Challenger Little League Field located at
the Robinson Lane Recreation Complex; and
WHEREAS, CDBG requires the Town to request proposals from qualified professional
engineering firms to provide the design and formulation of construction plans, specifications and
complete bid documents and associated contract administration and inspection services and any
necessary coordination with the Dutchess County Department of Planning and Development as
more particularly set forth for in the "Request for Proposals for Engineering Services for the
Challenger Little League Field at the Robinson Recreation Complex", a copy of which is
attached hereto.

Resolution Authorizing Change Order Nos. 2 & 3 for Cider Mill Loop Water Storage Tank
Demolition and Replacement Contract
WHEREAS, by Resolution adopted by the Town Board on August 8, 2011, the Town
Board awarded a bid to Sun Up Enterprises, Inc. in the amount of $809,129.00 for the demolition
and replacement of the Cider Mill Loop Water Storage Tank; and
WHEREAS, by Resolution adopted by the Town Board on November 14, 2011, The
Town Board approved Change Order No. 1 to the aforementioned contract in the amount of
$11,135.00, which resulted in a revised contract sum in the amount of $820,264.00; and
WHEREAS, the Engineers to the Town, Morris Associates Engineering Consultants, PLLC,
have approved two additional Change Orders as hereinafter set forth, which two Change Orders
will result in a new contract price of $827,880.56.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby approves Change Order No. 2 which decreases the total
contract price by the amount of $5,875.00, resulting in a new contract price of
$814,389.00, a copy of which Change Order is attached hereto and made a part

3. The Town Board further approves Change Order No. 3 which authorizes the
installation of a paved driveway to the project at a cost of $12,800.00, as well as

of $827,880.56, a copy of which Change Order is attached hereto and made a part
hereof as Exhibit "2".

X. Items for Special Consideration
A. Supervisor Gutzler
Supervisor Gutzler introduced Christopher Villari, Outreach Lead, and Dan Michaud to speak in
regard to the Shaft 6 project. Mr. Villari stated that they came to discuss the program to repair
the Delaware Aqueduct. It provides the City with half a billion gallons of water per day and is
currently leaking approximately Thirty-five million gallons a day. The proposed plan is to
construct a shaft site in Wappinger and Newburgh and then connect them with the bypass tunnel
that will replace the existing leaking tunnel. In doing the site plan application it became evident
that they are going to have to provide the shaft site water, both audible and for the construction
site at shaft 6. In light of the previous request for a future tap for water that could then provide
water to Wappinger from the Delaware Aqueduct. There is a win win situation where a water
main could be extended from the Greater Wappinger United Water District to their site for the
use over the next couple of years during the construction. Then in the future that main could be
used to take water from the shaft site back to the United Wappinger Water district. They are
asking the board to adopt a resolution endorsing the plan to build the pipe. They will provide the
funding and ask the town to construct the pipe down to the shaft site. Then the Town will own
the pipe for the future to provide water to the water district from the shaft site. They added that in
negotiation in the short term they would like to sign an agreement, in principal which would not

be a contractual obligation but an agreement of intent of both parties followed by an inter-
governmental agreement where an actual transaction could happen to the permit the town to
build the water line. Al Roberts, Attorney to the Town stated that Lee requested that somebody
be designated to act on behalf of the town to negotiate the terms and condition of the
memorandum of understanding. He suggested that the Supervisor be authorize to negotiation
with them. It would have to be brought it to the Board, since that is the authority, to work out the
terms and conditions. Then bring it back for formal adoption of a memorandum of
understanding. Councilman Bettina made a motion seconded by Councilman Beale, to authorize
the Supervisor to move forward with a memorandum of negotiations and understanding. All

WHEREAS, by Resolution adopted by the Town Board on June 20, 2011, the Town
Board awarded a bid to Sun Up Enterprises, Inc. in the amount of $198,300.00 for the
construction and installation of a handicapped accessible baseball/softball field designed to meet
handicap accessibility requirements which is to be known as the Challenger Field, located at the
Robinson Lane Sports Complex; and
WHEREAS, by Resolution adopted by the Town Board on August 22, 2011, the Town Board
approved Change Order No. 1 to the aforementioned contract in the amount of $6,465.00, which
resulted in a revised contract sum in the amount of $204,765.00; and
WHEREAS, Greg W. Bolner, P.E. of Clark Patterson Lee Design Professionals, the
Engineer for this project, has identified additional work necessary to make the Challenger Field
compliant with handicapped accessibility requirements, and has recommended that the Town
Board approve Change Order No. 2 to the Contract in accordance with his letter dated April 9,
2012; and
WHEREAS, the Town is committed to having the Challenger Field available for play for
individuals with handicapping conditions this 2012 recreation season and particularly for Little
League opening day, April 21, 2012; and
WHEREAS, upon completion of the work authorized by the Change Order, the
Challenger Field will meet handicap accessibility requirements.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby approves Change Order No. 2 to the above mentioned
Contract in the amount of $36,613.50 which Change Order will bring the revised
Contract sum to the amount of $241,378.50 all as set forth in a letter dated April 9,
2012 from Greg W. Bolner, P.E. of Clark Lee Patterson Design Professionals to the
Town Board, a copy of which is affixed hereto and made a part hereof.
3. The Town Board further directs that the funding for this Change Order shall be paid
out of the Parkland Trust Fund.

forward next month to put a proposal and a discussion about the Pop Warner and football
program

Councilwoman Czarniecki stated that she wanted to mention that Community Day will be June
30'.
Supervisor Gutzler
Supervisor Gutzler stated that along with Community Day the board is entertaining the
possibilities of the cleanup of various streets or parks which she feels would dovetail nicely with
Community Day. Details will be forth coming.
