A Special Meeting of the Town Board of the Town of Wappinger was
held December 7, 1970, at the Town Hall, Mill Street, Wappingers
Falls, New York.
(Notice of a Special Meeting was mailed to each of the Board members
on December 2, 1970, notifying them of time, place and purpose of
meeting.)
Supervisor Diehl called the meeting to order at 7:10 P.M.

The following resolution was offered by COUNCILMAN MILLS, who moved
its adoption:
A RESOLUTION AUTHORIZING THE CONSTRUCTION OF A TOWN
HIGHWAY GARAGE IN AND FOR THE TOWN OF WAPPINGER,
DUTCHESS COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED
COST OF $50,000 AND AUTHORIZING THE ISSUANCE OF
$50,000 SERIAL BONDS OF SAID TOWN TO PAY THE COST

BE IT RESOLVED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section 1. The construction of a Town highway garage in and
for the Town of Wappinger, Dutchess County, New York, to be located
on lands owned by said Town on the present highway garage site on
old Route 9 in said Town, is hereby authorized at a maximum estimated
cost of $50,000.
Section 2. The maximum estimated cost of such specific object
or purpose is $50,000, and the plan for the financing thereof is
by the issuance of $50,000 serial bonds of said Town, hereby author-
ized to be issued pursuant to the Local Finance Law.
Section 3. It is hereby determined that the total investment
of the Town of Wappinger to date in buildings designed to store
highway machinery, all as authorized by Section 142 of the Highway
Law, does not exceed $50,000.
Section 4. It is hereby determined that the period of probable
usefulness of the aforesaid specific object or purpose is thirty years,
pursuant to subdivision II (a) (1) of paragraph a of Section 11.00
of the Local Finance Law. It is hereby further determined that
the maximum maturity of the serial bonds herein authorized will not
exceed five years, that no down payment is required pursuant to Section
107.00 of the Local Finance Law, and that this resolution is not
subject to referendum procedures under the Highway Law or the Local
Finance Law.
Section 5. The faith and credit of said Town of Wappinger,
Dutchess County, New York, are hereby irrevocably pledged to the
payment of the principal of and interest on such bonds as the same

respectively become due and payable. An annual appropriation shall
be made in each year sufficient to pay the principal of and interest
on such bonds becoming due and payable in such year. There sahll
annually be levied on all the taxable real property in said Town
a tax sufficient to pay the principal of and interest on such bonds
as the same become due and payable.
Section 6. Subject to the provisions of the Local Finance
Law, the power to authorize the issuance of and to sell bond anticipa-
tion notes in anticipation of the issuance and sale of the serial
bonds herein authorized, including renewals of such notes, is hereby
delegated to the Supervisor, the chief fiscal officer. Such notes
shall be of such terms, form and contents, and shall be sold in such
manner, as may be prescribed by said Supervisor, consistent with
the provisions of the Local Finance Law.
Section 7. The validity of such bonds may be contested only if:
1) Such bonds are authorized for an object or purpose for
which said Town is not authorized to expend money, or
2
The provisions of law which should be complied with at the
date of publication of this resolution are not substantially
complied with,
and an action, suit or proceeding contesting such validity is commenced
within twenty days after the date of publication, or
3) Such bonds are authorized in violation of the provisions
of the Constitution.
Section 8. This resolution, which takes effect immediately,
shall be published in full in W&SD News, the official newspaper,
together with a notice of the Town Clerk in substantially the form
provided in Section 81.00 of the Local Finance Law.
The question of the adoption of the foregoing resolution was
duly put to a vote on roll call, which resulted as follows:

RESOLUTION OF THE TOWN BOARD OF
THE TOWN OF WAPPINGER, DUTCHESS
COUNTY, NEW YORK, ACCEPTING THE
LOW BID FOR CONSTRUCTION AND IN-
STALLATION OF SAND FILTERS AT THE
ROCKINGHAM FARMS SEWER DISTRICT
TREATMENT PLANT, APPROVING AND
AWARDING THE CONTRACT FOR SUCH
PROJECT AND AUTHORIZING THE TOWN
SUPERVISOR TO JOIN IN THE EXECUTION
OF SUCH CONTRACT.
The following resolution was offered by -MR. MILLS who moved

WHEREAS, the Town Board of the Town of Wappinger has heretofore
taken proceedings pursuant to Section 202(b) of the Town Law deter-
mining that it is in the public interest to increase and improve

existing treatment facilities of the Rockingham Farms Sewer District
consisting of the construction and installation of sand filters to
provide tertiary sewage treatment, and
WHEREAS, the Town Board has heretofore solicited and received
bids for the construction of such improvements, and
WHEREAS, Hall & Company, Inc., of Delmar, New York, is the
lowest responsible bidder furnishing the required security after
advertisement for sealed bids, having submitted a bid of $133,585.00
for the project, and
WHEREAS, Milton Chazen Associates, consulting engineers to the
Town for the project,have heretofore made written recommendation
to the Town Board that a contract for construction of the improvement
be awarded to Hall & Company, Inc., and
WHEREAS, the Town of Wappinger has heretofore applied for State
Aid for construction of the improvement and has received a commitment
therefor from the New York State Department Environmental Conservation
as well as a construction permit for the project, and
WHEREAS, the Town of Wappinger has heretofore formally accepted
the Offer of Federal Pollution Abatement Assistance from the Federal
Water Quality Administration pursuant to the provisions of the
Federal Water Pollution Control Act and amendments thereto, the
improvement having been designated as State Water Pollution Control
Project No. WPC -NY -340, and
WHEREAS, the Town's consulting engineers have, at the direction
of the Town Board and with the assistance of special counsel for the
Rockingham Farms Sewer District, prepared a contract for the execution
of the improvement work and submitted the same to the Town Board for
examination and approval, and
WHEREAS, the Federal Water Quality Administration has heretofore
given written authorization to the Town of Wappinger to award a
contract to Hall & Company, Inc. to construct the aforesaid sewer
improvement for its lOw bid price of $133,585.00, and
WHEREAS, the Town Board has heretofore adopted a resolution
dated August 10, 1970, authorizing the construction at a maximum
estimated cost of $181,000.00 and autha1zing the issuance of serial
bonds of said Town in said amount, or so much thereof as may be
necessary, to finance the cost of the project,
NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town
of Wappinger as follows:
Section I. That the low bid of Hall & Company, Inc., of
Delmar, New York, to construct the aforesaid sewer improvement at
the Rockingham Farms Sewer District Treatment Plant, in accordance
with plans and specifications previously approved by this Town Bard,
for the sum of $133,585.00 be and the same is hereby accepted.
Section 2. That the contract for the execution of such
improvement work heretofore prepared and submitted by the Town's
consulting engineers be and the same is hereby approved as to form
and content.
Section 3. That the contract in the approved form be and
the same is hereby awarded to Hall & Company, Inc. to construct the
aforesaid sewer improvement for the sum of $133,585.00.

Section 4. That Louis D. Diehl, Supervisor of the Town of
Wappinger, be and he is hereby authorized and directed to execute
and deliver the aforesaid contract with Hall & Company, Inc. on
behalf of the Town of Wappinger and the Rockingham Farms Sewer
District.
Section 5. That this resolution shall take effect immediately.

RESOLUTION OF THE TOWN BOARD OF
THE TOWN OF WAPPINGER, DUTCHESS
COUNTY, NEW YORK, DESIGNATING A
FISCAL OFFICER TO MAKE APPLICATION
FOR, TO RECEIVE AND TO DISTRIBUTE
FUNDS PURSUANT TO SECTION 1263-b
OF THE PUBLIC HEALTH LAW.
The following resolution was offered by MR. HOLT, who moved
its adoption:
WHEREAS, Section 1263-b of the Public Health Law of the State of
New York provides financial aid for the construction of sewage treat-
ment works with an advance payment for the purpose of assisting the
municipality in defraying expenses of an eligible project.incurred
in advance of construction; and
WHEREAS, THE TOWN OF WAPPINGER, Town Hall, Mill Street,
Wappingers Falls, New York 12590, hereinafter called the applicant,
has made application for State Aid for construction of sewage treat-
ment works, State Water Pollution Control Project No. WPCNY-340; and
WHEREAS, the municipality has formally accepted the Offer of
Federal Pollution Abatement Assistance pursuant to the provisions
of the Federal Water Pollution Control Act and amendments thereto; and
WHEREAS, it is necessary that an application be made for such
State Aid on behalf of the Town of Wappinger, now
THEREFORE BE IT RESOLVED by the Town Board of the Town of
Wappinger, the governing body of said applicant, as follows:
1. That Louis D. Diehl, Supervisor of the Town of Wappinger
be designated as the Fiscal Officer of said applicant to make
application for advance grant and to receive and distribute such
funds as the authorized fiscal officer of the applicant in connection
with said project; and
2. That five (5) certified copies of this resolution be prepared
and sent to the New York State Department of Environmental Conserva-
tion, Albany, New York, together with the signed voucher; and
3. That this resolution shall take effect immediately.
