1970-10-01 SPMWAIVER OF NOTICE OF SPECIAL MEETING OF THE TOWN BOARD OF THE TOWNOF WAPPINGER DUTCHESS COUNTY, NEW YORK The undersigned, being all of the members of the Town Board of the Town of Wappinger, Dutchess County, New York, do hereby waive notice of the time and place of the holding of a Special Meeting of said Town Board, and do hereby agree and consent that the same be held on the 1st day of October, 1970 at 7:00 o'clock in the afternoon of that day at the Town Hall of the Town of Wappinger, Mill Street, in the Village of Wappingers Falls, Town of Wappinger, Dutchess County, New York, for the transaction of all business which may properly come before the meeting or any adjournment thereof. 231 Supervisor C6uncilmain Due and timely notice of the above mentioned meeting is hereby admitted. Town Clerk Town of Wappinger A Special Meeting of the Town Board of the Town of Wappinger was held October 1, 1970, at the Town Hall, Mill Street, Wappingers Falls, New York. The above waiver having been signed by all Board members each for himself, Supervisor Diehl called the meeting to order at 7:25 P.M. The Town Clerk stated that all departments had filed their estimated budgets with her, and now presented the detailed estimates to the Town Board. n Communications were received from the Supervisor's Office informing the Board of over expenditures in Account #1002, Parks and Play- grounds. The following resolution was offered by MR. MILLS who moved its adoption: WHEREAS, the sum of $10,050 has been appropriated to Account #1002 -Parks and Playgrounds -Contractual Expenses. This account has been overexpended and overdrawn by the sum of $1,174.68 in order to meet bills presented for payment. The additional monies were obtained from Account #1003, Parks & Playgrounds -Purchase of Equipment. We, therefore, recommend that the Town Board authorize the transfer of the sum of $1,174.68 from Account #1003 to Account #1002 in order to eliminate the overdraft and reimburse said account and in order to ratify and confirm the previously unauthorized appropriation. RESOLVED, that the sum of $1,174.68 be and the same hereby is appropriated to Account #1002 and that the said sum is hereby transferred thereto from Account #1003. Seconded by: Mr. Clausen Motion Unanimously Carried RESOLUTION RE: ADOPTION OF ZONING ORDINANCE COVERING A TRACT OF LAND IN THE EAST SIDE OF ROUTE 9, TOWN OF WAPPINGER, DUTCHESS COUNTY, NEW YORK. The following Resolution was offered by COUNCILMAN CLAUSEN who moved its adoption: WHEREAS, an amendment to the Town of Wappinger Zoning Map has been introduced before the Town Board, and WHEREAS, said Ordinance proposes a change in the Town Zoning Map of a 40 acre parcel on the east side of Route 9 from R-20 (Residential) to SC (Shopping_Center), and WHEREAS, said proposed Ordinance was referred to the County of Dutchess Department of Planning and said Department of Planning has reported to the Town Board that it opposes the adoption of the proposed ordinance, and WHEREAS, a public hearing concerning the adoption of said Ordinance was duly held on August 26, 1970, after due public notice, NOW, THEREFORE, BE IT RESOLVED That the following Ordinance relating to the change in the Zoning Map of the Town of Wappinger be and the same hereby is adopted and the same shall be of full force and effect upon posting and'publication.of the same as provided by Town Law, and the following finding of this Town Board shall be considered part of this Resolution: 1. The proposed Zoning Map Amendment conforms to the Master Plan of the Town of Wappinger in that it generally provides for shopping centers along major arteries and at major highway inter- sections and the area involved in this change adjoins other lands 2 3 3 zoned SC (Shopping Center). 2. That the proposed zoning change will increase traffic in the area only to the extent that it would normally increase with the growth and development of the Town. 3. That the proposed zoning change will permit the develop- ment of a large shopping center consisting of many stores and businesses all of which will be within the complex and not depen- dent upon public streets or highway maintenanced by the Town of Wappinger. That said proposal will add substantially to the Tax base of the Town of Wappinger without a substantial demand for Town services. 4. That the Town of Wappingers Zoning Ordinance contains a requirement for site plan approval by the Town Planning Board. That said Planning Board may further consider traffic problems and solutions on any proposed site plan. Seconded by: Councilman Mills 5 Ayes 0 Nays Resolution duly adopted Oct. 1, 1970 MR. CLAUSEN moved that the Recreation Commission be directed to proceed with the proposal for consulting engineering services for a comprehensive Park and Recreation Study (which was allocated in the 1970 Budget under Recreation for this purpose not to exceed a total of $12,000, which would involve description of the Town's present facilities and also any future needs for Town development, and further authorized the Supervisor to sign the contract with the Recreational Consultant. Seconded by Mr. Finnan. Motion Unanimously Carried The Recreation Commission had written the Town Board requesting approval of compensation, in the amount of $.40 (_forty cents) per hour, in the form of a bonus, to be given the youths who worked this summer under the State Beautification program. MR. MILLS moved the request for the bonus of 40 per hour for the youths who worked on the Beautification Program, be approved, subject to Mr. Rappleyea's recommending an area of transfer of funds in order to prevent an overdraft in the account. Seconded by Mr. Clausen. Motion Unanimously Carried MR. CLAUSEN moved the Supervisor be authorized to sign the rider to the agreement for engineering services, relative to the Storm Drainage Projects (original agreement signed June 26, 1969.) Seconded by Mr. Mills. Motion Unanimously Carried 2 3 4 The following letter was received: October 1, 1970 Town Board Town of Wappinger Town Hall Mill Street Wappingers Falls, New York Re: Rockingham Farms Sewer District, Town of Wappinger, Dutchess County, New York Gentlemen: We transmit herewith a_copy of a proposed agreement which we have drafted to cover engineering services rendered and to be rendered to the Town by Milton Chazen, the engineer previously designated by your body for a contemplated project involving the installation of sand filters at the Rockingham Farms Sewer District plant. Essentially, the attached agreement prescribes the (1) work to be performed by the engineer, and (2) the fees (generally in terms of percentages) to be paid for design, survey work, consultation and inspection of the project. In a letter forwarded to you under date of July 9, 1970, the Chazen firm estimated that these fees would amount to $14,000.00. As a prerequisite to obtaining (1) authorization to award a contract for construction of the project to Hall & Company, Inc., the low bidder, and (2) federal and state aid for the project, the proposed agreement must be executed by the parties thereto and submitted by our office to the Federal Water Pollution Control Administration and the New York State Department of Environmental Conservation. Accordingly, we recommend that you act at your meeting tonight - to approve the attached agreement as to form and content, and that you authorize and direct the Town Supervisor, Mr. Diehl, to execute, acknowledge and deliver the agreement on behalf of the Town of Wappinger. CLAUSEN moved that a letter also be written to Milton Chazen Associates, under the Supervisor's signature, to come forth with the Feasibility Study that had been due by August 15th (with copy to Quinn and Reilly.) Seconded by Mr. Clausen. Motion Unanimously Carried 235 MR. FINNAN moved for a recess, seconded by Mr. Clausen and carried. Recess called at 7:35 P.M. Supervisor Diehl called the meeting back to order at 8:45 P.M. (full Board present.) The following letter was received: September 21, 1970 Town Board, Town of Wappinger Mill Street Wappingers Falls, N.Y. Re: Town of Wappinger- Fleetwood Manor Water District Bid for water hydrants. Gentlemen: 1 On Friday, Sept. 18, 1970 at 11:00 A.M., bids for the above contract were opened and read by the Town Clerk. The bids were as follows: 1. Lombardi & Son Inc. $7,380.75 2. Lafko Assoc.• Inc. 8,602.50 3. C&E Const. Inc. 8,663.75 4. K&A Contr. Inc. 11,990.00 I have examined the bids and find that they are in order. I therefore recommend that Lombardi & Son Inc. be awarded the contract as soon as possible in order to complete the project this year. Very truly yours, s/ Rudolph E. Lapar MR. HOLT moved that Lombardi & Son, Inc. construct 3 hydrants and appertenances in the Fleetwood Manor Water District, based on unit prices, not to exceed $4,446.00, and further authorize the Supervisor to sign the contract.
