A Special Meeting of the Town Board of the Town of Wappinger was
held on August 26, 1970, at the Town Hall, Mill Street, Wappingers
Falls, New York.

was mailed to each Board member on August 21, 1970, by the Town Clerk
upon mutual request of all Town Councilmen.
Deputy Supervisor Louis Clausen called the meeting to order at 9:35 PM.

A letter had been received from Mr. John Barbero, representative
from Central Hudson, regarding a survey of intersections of State
and County Roads in the Town that could use lighting. These areas
are Route 376 with all remaining Town Road intersections; All Angels
Hill Road with all remaining Town Road intersections; Osborne Hill
Road and Smithtown Road; Middlebush Road with Pleasant Lane, Cameli
Road and entrance to Wappinger Central Junior High School; New
Hackensack Road with Dorothy Heights, Pine Hill Road and entrance
to Wappingers Falls Trailer Park. Mr. Clausen felt that both the
east and west entrances of Old Myers Corners Road on Myers Corners
Road should have lighting.
MR. CLAUSEN moved that Mr. Barbero be notified to draw up contracts
between Central'Hudson and the Town to proceed with all of his
suggested General Town intersection lighting, including the east and
west ends of Old Myers Corners Road on Myers Corners ::Road. Seconded
by Mr. Finnan.
Motion Unanimously Carried
Mr. Clausen asked if the Board wished to recommend their appoint-
ments to the Board of Ethics.
Mr. Mills' appointment would be the member named from the Town Officials,
who, according to the Code of Ethics, would remain anonymous.
Mr. Clausen recommended Rev. William Waters, Minister of the Metho-
dist Church, Wappingers Falls.
Mr. Diehl recommended Joseph Landolfi, Wildwood Drive.
Mr. Finnan recommended Edward Parsons, Jr. Route 376.
Mr. Holt was not prepared to recommend at this time.
MR. CLAUSEN moved that Rev. William Waters, Mr. Landolfi and Mr.
Parsons be appointed as members of the Town of Wappinger Board of
Ethics. Seconded by Mr. Mills.
Motion Unanimously Carried
A Public Hearing having been duly held on August 19, 1970 on Local
Law #3, 1970, entitled a Local Law relating to the imposition charge
and collection of sewerage rates for the Fleetwood Manor Sewer District
as well as the penalties and enforcement thereof, and Affidavits of
Posting and Publication having been duly offered for the record
at the Public Hearing, the matter was placed before the Board for
their consideration.
MR. FINNAN moved the adoption of Local Law #3 relating to the imposi-
tion charge and collection of sewerage rates for the Fleetwood Manor
Sewer District, as well as the penalties and enforcement thereof.
Seconded by Mr. Mills.
Motion Unanimously Carried

Mr. Clausen informed the Board that Mr. Diehl had tentatively made
arrangements to recognize the Town of Wappinger Little League State
Champions and has asked Joe Zahn if he would host the Little League
Team, (which he agreed to do). The question just remains when, where,
and what the program would be. Mr. Clausen forwarded the suggestion
from Mr. Diehl that Bob Foster chair a committee that would include
Douglas Heady, George Schlathaus, Don Finnan, and Lou Clausen.
MR. CLAUSEN moved that a committee comprised of Robert Faster,
Douglas Heady, George Schlathaus, Donald Finnan and Louis Clausen
be recognized as forming something in recognition of the Town of
Wappinger Little League State Champions. Seconded by Mr. Mills.

Ordinance Requiring License
For Sale of Merchandise by
Hawking and Peddling
Thefollowing ordinance was introduced by COUNCILMAN MILLS
who moved its adoption:
BE IT ORDAINED by the Town Board of the Town of Wappinger
as follows:
Section 1. License required: exceptions.
No person shall publicly sell, hawk or peddle any property
or article of merchandise on the streets of the town, nor shall
any person travel from house to house in any section of the town,
either on foot or with a vehicle or conveyance, carrying and selling
or offering for sale any property or article of merchandise, without
first obtaining a license therefor as hereinafter provided, but
nothing herein contained shall apply to sales made to merchants
for retail trade, or to sales made to any person of farm produce,
if such farm produce is peddled and sold by the producer thereof
or his servants or employees, or to persons delivering newspapers
or periodicals which have been previously contracted for. The
term "farm produce" shall not include nursery stock, potted plants
or cut flowers.
Section 2. Application for a hawking and peddling license.
E. Application for a hawking and peddling license shall be
made by the applicant in person to the Town Council, and after
approval of said application by that body, the town clerk shall

be authorized to issue such license, upon receiving the license
fee herein specified. The Town Board may refuse to grant said
permit in the event it determines that the proposed license is not
of good moral character or if the items sold represent a danger
to the health, safety, or welfare of the community.
Section 3. License fees.
The following fees for licenses are hereby established,
to be collected by the town clerk.
(a) For any person on foot or with vehicle drawn by
hand $2.00
(b) Farany person with vehicle drawn by horse
or any other an 5.00.
(c)L For any person with a motor vehicle or
motor truck 5.00
Section 4. Duration of license.
All licenses issued hereunder shall terainate on the
30th day of April next succeeding the issuance thereof.
•Section 5. Renewal of license.
License renewal applications shall be made in person to
the town clerk who shall issue the same in accordance with the
terms of this article. The town clerk, before issuing a renewal
of an existing license, shall request the Dutchess County Sheriff
to investigate whether the appliaant has been convicted of a crime
since the date of issuance of the original license. The said
Sheriff shall furnish to the town clerk in writing, the infor-
mation derived from such investigation. In the event that the
applicant was convicted of a misdemeanor or a felony, the Town
Clerk shall not renew said license but application must be made -
to the Town Board.
Section 6. Use of weighing and measuring devices.
All weighing and measuring devices used by peddlers
shall be attached to a fixed standard suspended from the vehicle
or conveyance used by such peddler, in order to insure the
accuracy.
Section 7. Identification of vehicle.
A person licensed under

No person shall stop, either on foot or with any
vehicle, in any of the streets, or on any of the sidewalks in the
town for the purpose of vending any goods or merchandise longer
than while actually engaged in selling at any one time. Such
stopping longer than permitted by this Section 8 shall be an
infringement of this ordinance and shall upon conviction be
punished as set forth in Section 9 herein.
Section 9.
Any person upon conviction of a violation of this

ordinance shall be deemed•_guilty of a violation as defined in
Section 55.10-3 Penal Law and shall be subject to the penalties as
provided by law.
Section 10.
This ordinance shall take effect immediately upon adoption,
posting, and publication as provided by law.

Mrs. Snowden informed the Board that she had been served with a
Tax Review from Brack Construction Corp. on August 20, 1970.
MR. FINNAN moved that Mr. Joseph D. Quinn, Jr. Attorney, be appointed
to answer and defend on behalf of the Town of Wappinger. Seconded
by Mr. Mills.
Motion Unanimously Carried
A letter was received from Michael Turco, Assessor, requesting per-
mission to attend two evening courses at Dutchess Community College
in Real Estate Appraisal and Real Estate Principals and Practices.
These are one semester courses.
MR. FINNAN moved that Michael Turco be granted permission to attend
two evening courses on Real Estate at Dutchess Community College,
and that the expense for these courses be a Town charge. Seconded
by Mr. Clausen.
Motion Unanimously Carried
MR. MILLS moved the meeting be adjourned, seconded by Mr. Finnan,
and unanimously carried.
