Supervisor Ruggiero opened the floor to public comment on the agenda items at 7:37
PM. There were no comments from the public.
Discussion
A. Viggiano Property - Jay Paggi
Supervisor Ruggiero opened the discussion at 7:39 PM and briefed the Board about the
situation at the Viggiano property. The property is being inundated with water and it appears
that the foundation is being undermined. The Town Engineer, Jay Paggi, had been asked to
investigate and report to the Board.
Mr. Paggi explained that he visited the site on May 11th, 2007. The area had been dry
from the time that the Nor'easter struck the area until the second week of May. Mr. Paggi
looked at the north shoulder of Kent road and noticed that the area (the shoulder on the north
side) was quite wet. The professionals spoke about the possibility of placing an interceptor
trench and drain on that side of Kent Road and tying it into an existing catch basin at the
intersection of Robin Lane. It could be done in the Town right-of-way. It would cut off the run-
off that travels from north to south, eventually making its way to the Viggiano property. Mr.
Paggi also believes that the property owner will need to install a perimeter drain around one side
of her property to take localized groundwater. The potential of installing this Town drain will
also be based on the fact that there are no existing utilities in that shoulder. Graham Foster,
Town Highway Superintendent, has called for a "mark -out", but is receiving conflicting
information. Mr. Paggi noted that he has a file in his library from a project that his firm worked
on 12-13 years ago. With the mapping already done, a plan and contract documents could be
compiled for this project in a fairly cost-efficient manner. He estimates the project will cost
between $65,000 and $75,000.
Mrs. Viggiano then described the situation and how it has worsened over the years.
Discussion about the possible causes of this problem and the proper way to fix the problem
followed. Supervisor Ruggiero asked if the Town professionals were sure that this problem is
not due to a water main leak. Mr. Paggi and Mr. Foster answered that the water system operators
have thoroughly studied this area and have determined that there is no such leak. Supervisor
Ruggiero then asked how long it would take to design and go out to bid. Mr. Paggi replied that
he could have bids by the end of July. Supervisor Ruggiero then mentioned the option of
integrating the Kent Road realignment project into the scope of this job. Discussion followed.
Mr. Foster commented that it would tie up the project considerably and significantly increase the
cost. .
Councilman Paoloni made a motion to authorize the Town Engineer to prepare design
and specifications in order to go out to bid for this project. The motion was seconded by
Councilman Bettina and passed unanimously. Supervisor Ruggiero asked that Mr. Paggi provide
the Board with firm costs and to document the "alligator" cracks in Kent Road near the Viggiano
property. Mr. Paggi agreed. Supervisor Ruggiero closed the discussion at 7:57 PM.

B. Carnwath Farms Update - Don Swartz
Supervisor Ruggiero opened the discussion at 7:57 PM. Don Swartz was on hand to
bring the Board up to date on the emergency work being done at Carnwath. Mr. Swartz used a
PowerPoint presentation to illustrate the work done and what remains to be done.
Supervisor Ruggiero asked if there were any questions from the Board. Councilman
Beale asked if the work was complete. Mr. Swartz replied that it should be complete by the end
of the next week. Jay Paggi, Town Engineer, agreed that the work should be complete by June
8th Councilman Beale then asked if the building would remain fenced in. Supervisor Ruggiero
replied that the fence will stay up. The Board will be discussing bid packages for other work
later in the summer. Mr. Paggi explained that the lease on the fence expires on May 31St. From
that point on, the Town will pay $100.00 a month for the fencing.
Councilman Beale stated that his main concern is that the public still has accessibility to
the park. Supervisor Ruggiero replied that the Town will have a summer theatre camp on the
property in June. Mr. Swartz added that the gates will be removed and stored in the Carriage
House. Mr. Paggi recommended that the Fire Department be notified to ensure that the width of
the gate opening is adequate.
Councilman Beale then asked when the park would be fully open. Supervisor Ruggiero
replied that it would probably be open June 10th. With no further questions, Supervisor Ruggiero
closed the discussion at 8:11 PM.
C. Meadowood Water Plant - Jay Paggi
Supervisor Ruggiero opened the discussion at 8:11 PM and gave a summary of the topic.
Years ago, there was an agreement between the Town and Steve Domber that he would build a
packaged water plant and the Town would purchase it from him. There have been some
additions and deletions to the plant. Jay Paggi, Town Engineer, has gone over the costs incurred
and a change order is now needed.
Supervisor Ruggiero further explained that the Town was originally concerned that it was
not following the normal bidding process. At that point, the State Comptroller's Office provided
the opinion that the normal bidding process need not be followed if the Town purchased the plant
as a package. Discussion followed.
Mr. Paggi went on to say that the changes made to the plant are listed on the May 10th
letter that he submitted. Some of the changes were removals which result in credits to the Town.
The net additional cost was approximately $76,400. Mr. Paggi recommends that the change
order be approved. The plant is up and running, it has been tested and the certification letter to
the New York State Department of Health has been sent. A response from the Department of
Health is expected within a week. The source of water will supply 300 gallons per minute with
the possibility of upgrading to 400 gallons per minute. On a daily basis, that would be over
400,000 gallons of water.
Supervisor Ruggiero asked if the map, plan and report needed to be amended to allow the
change order. Al Roberts, Attorney to the Town, replied that it did not. Supervisor Ruggiero
asked if the final component of this project is the demolition of the tanks at Rockingham. Mr.
Paggi confirmed and added that the Town is currently going out to bid for that. Councilman
Paoloni asked if it was safe to say that the Rockingham wells will never be back in use. Mr.
Paggi again confirmed. Discussion followed.
Supervisor Ruggiero asked Mr. Roberts to prepare a Resolution for the Board for the next
meeting. He then asked Mr. Paggi when the closing would be. Mr. Paggi replied that he was
waiting for the Certificate of Completion from the New York State Department of Health. He
estimated that the closing could take place around mid-June. With no further comments or
questions, the discussion was closed at 8:20 PM.
D. Well Testing Local Law
Supervisor Ruggiero opened the discussion at 8:20 PM. Al Roberts, Attorney to the
Town, explained that this Local Law is a composite of what was promulgated by the County
Executive's office for the individual towns to adopt and the proposed Local Law recommended

by the County Legislature. The Wappinger version was then condensed to a "test, disclose and
file" law. Mr. Roberts explained certain parts of the Local Law. Prior to the sale of a piece of
property, the well has to be tested for certain parameters. The parties are free to negotiate who is
going to pay for the testing. The results are disclosed to the buyer and seller and are filed with
the Town and County. For non-residential and multi -family properties, there is a requirement
that the well water be tested within 12 months. Test results for non-residential properties have to
be disclosed to the tenants or occupants. Mr. Roberts then compared the Wappinger version to
the Fishkill version. Councilman Bettina asked if the well needed to be tested every three years.
Mr. Roberts explained that the test results were good for three years. If you wanted to sell the
house within the three years, you did not need a new test. If you did not plan on selling the
house, you would never need a test. Councilman Paoloni commented that it didn't make sense
that the resident could be drinking bad water for years. Mr. Roberts and Councilman Bettina
replied that it is recommended by most Health Departments and Agencies that residents
periodically have the wells tested. Discussion followed.
Councilman Beale asked if rental properties were addressed in the Local Law.
Supervisor Ruggiero replied that they are, but they are treated differently. Councilman Bettina
asked if there was a similar Law on the State level. Supervisor Ruggiero answered that there is a
Bill that has passed the Assembly.
Councilman Beale asked how the Local Law would be enforced. Supervisor Ruggiero
answered that financing can't go through until a well test is on file. Discussion followed
regarding single family homes that are rented out. Councilman Beale asked how much it costs to
get a well tested. Supervisor Ruggiero replied that it would cost about $500.
Supervisor Ruggiero asked Mr. Roberts to add a clause requiring landlords to notify the
residents when a well fails a test. Mr. Roberts replied that he would. With no other comments or
questions, Supervisor Ruggiero closed the discussion at 8:55 PM.
IV. Resolutions
RESOLUTION: 2007-95
Resolution Authorizing Refund of Unused Escrow for 29 Paulette Lane for Seeding and
Driveway
WHEREAS, on or about February 12th, 2007, JBR Construction deposited Two
Thousand Seven Hundred Dollars and 00/100 ($2,700.00) with the Town of Wappinger for the
property located at 29 Paulette Lane for seeding and driveway, and
WHEREAS, JBR Construction has requested a refund in the amount of Two Thousand
Seven Hundred Dollars and 00/100 ($2,700.00), and has been approved by Salvatore Morello,
Code Enforcement Officer, in letter dated May 21St, 2007, to the Town of Wappinger Town
Board.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. Payment is approved in the amount of Two Thousand Seven Hundred Dollars and 00/100
($2,700.00) made payable to JBR Construction, Account Number 2006-0867, for the
refund of the unused escrow deposited for the property located at 29 Paulette Lane.

Resolution Authorizing Refund of Unused Escrow for 141 Robinson Lane for Seeding,
Driveway and Grading
WHEREAS, on or about March 13th, 2007, JBR Construction deposited Three Thousand
Five Hundred Dollars and 00/100 ($3,500.00) with the Town of Wappinger for the property
located at 141 Robinson Lane for seeding, driveway and grading, and
WHEREAS, JBR Construction has requested a refund in the amount of Three Thousand
Five Hundred Dollars and 00/100 ($3,500.00), and has been approved by Salvatore Morello,
Code Enforcement Officer, in letter dated May 21St, 2007, to the Town of Wappinger Town
Board.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and

Public Access
WHEREAS, the Town of Wappinger is the owner of a dormitory building located upon
the Camwath Estate; and
WHEREAS, the Town of Wappinger entered into the "Revocable License Agreement
for the Sports Museum of Dutchess County" dated April 11th, 2005 (hereinafter the License),
with the Sports Museum of Dutchess County (hereinafter the Sports Museum); and
WHEREAS, paragraph 3 of the License requires the Sports Museum to pay a monthly
usage charge of $500.00 for its use of the dormitory building and paragraph 14 of the License
requires the Town to provide Public Access to the dormitory building; and
WHEREAS, a State of Emergency was declared with respect to Carnwath Estate on
January 27th, 2007, because of structural defects in the Mansion and the Carriage house and said
defects created a potential for items falling from the Mansion onto pedestrians in the area
therefore public access to Carnwath Estate was denied; and
WHEREAS, public access to the Sports Museum was denied during the months of
February, March and April 2007; and
WHEREAS, the State of Emergency has been lifted and public access has been restored
to the Sports Museum.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board determines that no
monthly usage charge is due from the Sports Museum, pursuant to the terms of the License, for
the months of February, March and April 2007 due to the lack of public access to the dormitory
building.
BE IT FURTHER RESOLVED, that the Town Clerk is directed to transmit a copy of
this duly executed resolution to the Sports Museum.

V. New Business
1. Councilman Beale New Business
A constituent asked Councilman Beale if the Agendas for the Town Board Meetings were
available on the website. Gina Basile, Confidential Secretary to the Supervisor, replied that they
are posted on MinuteTraq on the Friday before each Meeting.
Councilman Beale then asked for a meeting to be set up to address problems with the
Town website. Supervisor Ruggiero will set the meeting up.
A member of the Zoning Board of Appeals contacted Councilman Beale regarding
reimbursements for the Association of Towns Conference. Supervisor Ruggiero replied that the
Comptroller had reviewed and audited the bills. The Comptroller will be notifying the people
that submitted claims shortly.
Councilman Beale also wanted to follow up on the Ambulance Local Law and Tow
Truck Local Laws. Al Roberts, Attorney to the Town, commented that the Board had asked to
meet with him before proceeding. Discussion followed.
2. Councilman Bettina New Business
Councilman Bettina mentioned a meeting that took place between a constituent, Al
Roberts, Attorney to the Town, and Jay Paggi, Town Engineer. Supervisor Ruggiero explained
what took place during that meeting. Back in March, Mr. Paggi, Mr. Foster and Supervisor
Ruggiero went out to Riverview Drive to meet with the property owner. The resident would like
to subdivide, but there is an issue with road frontage. The resident also had a problem with water
draining from the adjacent unused Recreation property onto his property. The Town Attorney
was asked to research the issue. Mr. Roberts added that Riverview Drive is a dead end road.
The resident has approximately 50 feet of frontage on the Town road. It is complicated because
there is an extension of Riverview Drive. It is marked on the map as an easement, in the favor of
the Town, that leads to the unused Recreation parcel that lies contiguous to this resident's parcel.
At the end of Riverview Drive, there was another lot that was permitted access over the right-of-
way. Under normal circumstances, the resident would have to extend a Town road, and bring it
up to Town specifications. The resident does not want to do that. Mr. Roberts then explained
the options that the resident has. Discussion followed. Councilman Bettina asked for a memo on
this topic. Supervisor Ruggiero directed the Legislative Aide to get the file to Councilman
Bettina.
3. Councilwoman McCarthy New Business
Residents of Nicole Drive have asked Councilwoman McCarthy if a "school bus stop
ahead" sign could be erected on Old Hopewell Road near Kendell Drive. Graham Foster, Town
Highway Superintendent, replied that he would make a request to the County Department of
Transportation. Al Roberts, Town Attorney, recommended that the School Board be contacted
about this.
The residents also asked for an update about the drainage problems at Nicole Drive.
Councilwoman McCarthy stated that the residents are satisfied with the Toll Brothers swale, but
are not happy with the Town ditch. Supervisor Ruggiero asked if the Town could just extend the
rocks past where it currently stops. Mr. Foster replied that it is in both wetlands and a Central
Hudson easement. There is also a major gas main through there. Discussion followed.
Councilman Beale asked where the water is ending up. Supervisor Ruggiero and Councilwoman
McCarthy answered that the water is ending up in the people's yards. Mr. Foster disagreed. He
stated that the water goes into a pipe and under Nicole Drive. Councilwoman McCarthy added
that a resident goes out frequently to clean out the pipe. Discussion followed.
Mr. Paggi commented that there is a solution to the problem and he will develop a plan

for it. Mr. Foster asked if the same is going to be planned for the other side of Kendell Drive.
Supervisor Ruggiero asked if Toll Brothers caused this problem. Mr. Foster replied that they did
not. Supervisor Ruggiero then asked why it is only now an issue. Mr. Foster answered that it
was due to a laborer blocking the stream. Now there is the same problem in the back yards of
Kendell Drive. The water is coming out into the residents' yards. The Town will now dig out
the ditches, as it did for the Nicole Drive properties, which is not in compliance with what is
required as an MS4 community. Supervisor Ruggiero commented that the homes and properties
are being impacted. Mr. Foster replied that the homes are not being impacted. During the last
major water event, the homes did not get flooded. Councilwoman McCarthy then stated that the
residents don't feel that the ditch is properly maintained. Mr. Foster has not seen any resident
maintain the ditch since he dug it out last spring. He asked that he be contacted before another
resident goes out to clean the ditch. Discussion followed.
4. Councilman Paoloni New Business
Councilman Paoloni asked that the Town look into the traffic circle situation at the New
Hackensack Road and All Angels Hill Road intersection. Supervisor Ruggiero replied that the
Town could ask the State to look at the intersection again.
Councilman Paoloni next asked for a status report on the sign for Spring Terrace. Gina
Basile, Confidential Secretary to the Supervisor, commented that she has ordered them and has
yet to hear back.
5. Councilman Bettina New Business
Councilman Bettina has had several constituents call to complain about the Vilardi
property. The residents are concerned about West Nile Virus and stagnant water and have been
assured that the property would look nice. He commented that the residents feel like they have
been duped and want to know what is going to be done. Councilman Bettina then asked George
Kolb, Director of Code Enforcement, and Jay Paggi, Town Engineer, to explain what is going to
be done about the water in the ditches and the general appearance of the property. Mr. Kolb
replied that the last letter he received was back in late April. Supervisor Ruggiero and Mr. Paggi
mentioned a letter that came in on Friday, May 25th, from the DEC. That letter stated that the
path that the Town was proceeding on is proper. The Town does have the right to issue or not
issue a grading permit. Discussion followed.
