The Regular Meeting of the Town Board of the Town of Wappinger
was held April 13, 1970, at the Town Hall, Mill Street, Wappingers
Falls, New York.
Supervisor Diehl called the meeting to order at 8:05 P.M.

MR. CLAUSEN moved that the Minutes of the Regular Meetings of Feb. 17,
1970 and March 9, 1970, and Special Meeting of March 31, 1970, be and
they are hereby accepted as submitted by the Town Clerk, seconded by
Mr. Finnan.

respondents, on an Article 78 with order to show cause.
MR. FINNAN moved the above mentioned summons be turned over to Allan
Rappleyea, Attorney, to answer on behalf of the Town of Wappinger.
Seconded by Mr. Clausen.

Arthur Bisom had requested to speak before the Board on his qualifi-
cations as an Assessor.
Mr. Bisom stated that he was bringing this up as a citizen of the Town,
He has had one years' experience as an Assessor, and feels he is now
qualified. When he became an Assessor he acquired an interest in
real estate, subscribed to periodicals, the cards and records in the
Assessors' Office testifying that the job has been done. It has been
extremely difficult to follow up the former men, but his experience
with Mr. Leskow and Mr. Walker showed Mr. Leskow he tried to do a
good job and was conscientious. He took the job not for the money
but as a citizen interested in the welfare of the Town. How are
men rewarded for doing a good job? Mr. Leskow has been critized
by a member of the Board for doing his job to the best of his ability
and pressure put on him to r@duce assessments. Do we want Assessors
to do their job right or ones who will cater to the whims and desires
of councilmen interested in their own political gain. Which is
wanted, assessments based on individual personalities or marketable
values. How were the Assessors rewarded for trying to do a good job.

Reappointments were tabled for two months, then the Board chose two
Assessors to their liking not based on ability or willingness to learn.
It appears that one of the qualifications for Assessors, whether full
or part time is based on the ability to pay the party on a former
campaign paying contribution. Is this the kind of representation
we want. He said he could in private, bring up names and dates (he
didn't want to do it in public). Now, why weren't he and Mr. Walker
reappointed, because we were conscientious on the job. You want a

man to be honest or crooked? If he is honest he doesn't get reappointed.

Assessment is not a true science, its a matter of a mans' judgment,
tied in with the knowledge of real estate. Is real property based
upon political affiliation or market value, tax payers have the right
to have their properties assessed by qualified men, not by political
affiliations. His final comment was that last year the three assess -
in
ors agreed there were many/equities in the village assessments and
were planning to correct them this year. They didn't know which way
to turn because of the indecision on the Town Board's part. He hopes
that the present Board of Assessors will correct the inequities ._
Everyone in the Town as well as the Village should pay their fair.
share of the taxes.
Mr. Diehl, attempting to answer some of Mr. Bisom's questions, first
commented that the people who were appointed as Assessors this year
were appointed by a majority, indicating they felt the appointees
were qualified and able to do a good job, and for the short time they
have been in office, Mr. Leskow, the Chairman, has said that the two
men are now doing a good job.
Mr. Clausen commented on Mr. Bisom's accusations by inuendo, if he
has some names and material -whereby the Assessors have been controlled
politically, give it to the Board. He and Mr. Finnan agreed it should
be brought out publicly.
Mr. Bisom then said he had been asked in October for a contribution
for the Democratic campaign and was reminded that Lou Diehl had voted
for him (for appointment as an Assessor) and also, that a Republican
Board member had asked him to lower an assessment (he said he wouldn't
mention any names unless the person he referred to was present.)
Mr. Clausen commented that at a recent executive meeting,the Chairman
of the Board of Assessors indicated that he hadn't gotten the proper
help that he -had anticipated or wanted, and elaborating, said that
Mr. Bisom didn't have the interest in doing -the job that he would
have liked to have had him do.
Mr. Finnan added a comment that the two new assessors were now attend-

ing school and repeated Mr. Leskow in saying that theywere doing a
good job.

A request was received from 'Chelsea Ridge Apartments, Inc. for a
20,000 Lumen Mercury Vaporstreetlamp to be installed at the inter-
section of Route 9D and Popula Boulevard.
Supervisor Diehl referred this request to the Lighting Committee
for investigation.
A letter was received from Chelsea Ridge Apartments Inc., requesting
installation of a traffic control light at the intersection of Route
9D and Popula Boulevard be considered.
Mr. Diehl referred this request to the Highway .Committee.
Mr. Finnan asked that the Town Clerk write the New York State Depart-
ment of Transportation requesting a traffic survey be made at the
requested intersection.
A letter was received from Russell Aldrich, Attorney for the Fleet-
wood Sewer and Water District, requesting a Public Hearing be set
concerning the rate schedule for each of the above districts.
As no rate schedule had been forwarded, and neither Mr. Aldrich,
or his representative was present, MR. FINNAN moved the matter be
tabled until the rate schedules were presented to the Board to sat
the Hearing on. Seconded by Mr. Clausen.

Gentlemen:
On March 9, 1970, the Town Board requested that Mr. William
Horton, Superintendent of Highways, and Mr. Rudolph E. Lapar,
Engineer to the Town, investigate the problem and cost of pro-
viding drainage for the residents of Alladin Court and Henry Road.
Since this is only one of the numerous drainage problems that have
been requested to be solved by the residents of the Town, I have
included it in the following list of projects with costs which
residents have asked for, and which both the Highway Superintendent
and I deem necessary.

Mr. Diehl indicated that the above report covered the..current
majority of known drainage problems that had been requested to be
solved by Town residents. The next step would be the financial
solution.
A resident of Henry Drive asked that the breakdown on Henry Drive
be repeated. Mr. Lapar obliged, and further explained that the
thought was that the -drainage ditch would discharge to the west side
of Losee Road. The line would go up Henry Drive from Alladin Court
to Myers Corners Road - Alladin Court would go to Losee Road.
Ruth Steinhaus asked if drainage was put on Montfort Road,would the
road and bridge be widened at the same time.
Mr. Blanding asked i -f there were any plans for a referendum and what
would be the time table for work to be done; Mr. Diehl answered that
hopefully it would be this year, the Board wv uld move as fast as it
can, bids would go out, then it would be up to the contractors.
Several other residents had questions regarding their drainage prob-
lems on Alladin Cour-t and Belaire Lane.
MR. CLAUSEN moved that Mr. Lapars' Storm Drainage report be referred
to the Attorney to the Town to investigate the necessary financing

and prepare necessary Resolutions. Seconded by Mr. Holt.

A letter was received from Hugh J. Maurer, Chairman of the Recrea-
tion Commission requesting permission for members of the Recreation
Commission to attend the Annual'New York State Recreation and Park
Conference at the Nevele Country Club, Ellenville,- New York April 12
to the 15th.
MR. FINNAN moved that permission to attend the conference be granted
to any member of the Recreation Commission wishing to attend, and
that their legitimate expenses become Town charges. Seconded by Mr.
Clausen.
Motion Unanimously Carried
MR. FINNAN moved for a ten minute recess, seconded by Mr. Clausen
and carried.

Supervisor Diehl called the meeting back to order at 9:20 P.M.
A letter of recommendation was received from the Planning Board
regarding the rezoning petition of Edwin Palmatier.
MR. CLAUSEN moved the matter be tabled until next meeting. Seconded
by Mr. Finnan.

Gentlemen:
Enclosed are copies of two letters received by the Town of
Wappinger Planning Board at its April 6th meeting, requesting
further extensions of the preliminary approvals of the above
projects. The Planning Board, upon receipt of these letters,
further extended both of these preliminary approvals to expire on
May 15, 1970.
The proposed Spook Hill Estates Subdivision (property of
Hankin Associates, Inc.) was granted preliminary approval on
April 5, 1965, after having applied for such approval on March 1,
1965. To date, the Planning Board has granted a total of eighteen
(18) extensions for the proposed Spook Hill Estates Subdivision.
The proposed Central Park Homes Subdivision (Property of
Mr. William Lisofsky) was granted preliminary approval on
February 7, 1966, after having applied for such approval on
December 6, 1965. To date, the Planning Baird has granted a
total of fifteen (15) extensions for the proposed Central Park
Homes Subdivision.
As you aware, these two projects are awaiting the formation
of a sewer district, as they have been denied permission to form
private sewage disposal corporations pursuant to the State Trans-
portation Corporations Law by a previous Town Board, based on
that Board's policy on Town Sewer Districts and private sewage
disposal systems.
It is the Planning Bard's recommendation, at this time,
that the Town Board grant permission to these two applicants for:
the formation of private sewage disposal corporations to serve
their developments.

Mr. John Costa had requested to speak to the Board regarding the
dam at Chelsea Ridge Apartments . He stated that for the last two
years, since a pond was built behind his property, water from it
has been backing up on to his property, causing him a lot of aggra-
vation. Last May and June after sudden rain storms, his property

and garden were flooded. He spoke to Mr. Rosenberg at the time and
was informed that the pond didn't cause the flooding. Mr. Rosenberg
claimed the land behind the garden was swamp and always held water.
Dr,. Miller and Mr. Diehl saw it and did say I had .a problem and it
should be corrected. All Mr. Costa is asking is that Mr. Rosenberg
keep the overflow of his pond low enough so that the water will drain
off his land, as it used to before the pond was built. He added
that even the fields for his septic tank were being affected due to
the high water table due to the pond. He concluded by asking the
Board to do everything in their power to solve the problem.
Mr. Diehl in response to Mr. Costa stated that previous procedures
have been, in cases like this, to have the engineer of the Development
certify to the, dam (.in this case) its condition and its right to be
there, and so forth and this has been certified to by their engineer,
this is standard procedure. The Board, as of now, has directed Mr.
Lapar to make a specialfield study of this particular problem, which
is something new in our workup here, but we feel there could be a
serious problem there, and in effect, Mr. Lapar is ging to double
check their engineer.
At the March 9th meeting a Conservation Committee was formed to be
known as the Wappinger Conservation Committee.
MR. HOLT moved that the Wappinger Conservation Committee be desig-
nated as,and henceforth known as, the Town of Wappinger Conservation
Advisory Council. Seconded by Mr. Clausen.

Where permanent drainage easements are granted to the Town,
The Developer must install drainage pipe in said easement.
Drainage easements must have a minimum width of 25' which shall
be provided for in the approved plan.
I recommend that the aforementioned updating be approved.
Because of the constant changing of prices, I suggest that a
cost revision be made a minimum of every two (2) years.

or Law Regulating the Laying
of Blacktop on Town Property
Gentlemen:
After a discussion with Mr. Rudolph E. Lapar, Engineer to the
Town, I would like to request an Ordinance or a Law to prevent
private contractors from blacktopping drive -ways extending onto
Town property with complete disregard to newly constructed gutters.
Poor blacktopping procedures completely disregard the gutters and,
in fact, create a damming effect diverting the waters back into
the streets causing my department drainage and. icing problems.
I wo uld _appreciate your prompt action in this matter.

MR. CLAUSEN moved that the Attorney to the Town prepare an ordinance
regulating blacktopping private driveways on Town property. Seconded
by Mr. Holt.

Gentlemen:
This letter is written in response to your request for informa-
tion pertaining to the possibility ofproviding for the appointment
of the Town Clerk and Highway Superintendent as employees of the
Town with competitive status under Civil Service.
The Town Clerk and Superintendent of Highways are elected
town officers. The Town Law provides that these offices may be
changed to the appointive status provided a resolution is passed

by the Town Board at least 150 days prior to the biennial Town
election. Such a resolution would be subject to a permissive
referendum and, if adopted, each office would thereafter be
appointive. Of course, separate resolutions would have to be
made for each office.
I find that there is no provision which provides for the
appointment of the Town Clerk or the Town Superintendent of
Highways pursuant to competitive examinations. The only alter-
nate to the election of such officers would be the appointment
for a term which, in effect, would be for two years.

Mr. Clausen commented that the original thought was to look into
the possibility of having. the Town Clerk and Highway Superintendents'
positions Civil Service,: not politically elected officers. It appears,
as Mr. Rappleyea advises, these cannot be Civil Service positions.
This satisfies his question, and thanked. Mr. Rappleyea for his
indulgence.
MR. CLAUSEN-moved Mr. RappleyeAs'letter be accepted and placed on
file. Seconded by Mr. Finnan.

Frank Bettina, Chelsea Road, had requested to speak to the Board
about the odors and location of the disposal plant for the Chelsea
Ridge Apartments.
Mr. Bettina started by reading an article from the Poughkeepsie
Journal regarding the fining by the New York State Department of
Health of the Gailo's for violations of the Fleetwood Sewer Plant.
He indicated that there seemed to be a lot of passing responsibility
of these problems on to various departments and agencies. What he
wanted to know was where does he stand and who is going to take care
of the odors, as he contends where there is odor there are malfunctions.
He stated that the Dutchess County Department of Health has no
record of any problem at Chelsea Ridge. He's spoken to the Dutchess
County Department of Health and been told that when the plant is
functioning there should be no odor - the plant meets specifications,
but there are still_ odors. Now --what will the Town Board do about
it?
Mr. Diehl stated that there would be a meeting Wednesday, April 15,

1970, with the State and County Health Departments at the Town
Hall to discuss all these problems. There would be some represen-
tation from the Chelsea area group and some other people who are
going to come in to state specific cases to these agencies. He
has already written to Mr. Lapar asking what can the Town do to
increase the standards and specifications for these sewer plants.
Mr. Bettina asked what's to stop the Town from raising the standards
to what they require.
MR. CLAUSEN moved the rules be suspended, seconded by Mr. Finnan
and carried. ,
Charles, Cortellino asked if anyone with the Dutchess County Department
of Health wasa. qualified, Engineer; is Jack Hill a qualified Engineer
or is the title by Civil Service.
Mrs. Engleman asked about the Multiple Residence Law -one section
referring to nuisance, wouldn't this apply to apartments.
MR. CLAUSEN moved the rules be resemed, seconded by Mr. Holt, and
carried. _
Mr. Clausen, going back to the letter from the Planning Board regard-
ing the extensions for Spook Hill Estates & Central Park Homes ,
asked Mr. Steinhaus if the 30 day extension was the request of the
Developers, or was is the normal 6 months? Mr. Steinhaus referred
back to the letter, and said they had been giving 3 month extensions
but the last had been 6 month extension. Mr. Clausen asked a note
be made of the fact that the Planning Board should extend a 6 month
extension to the two developers instead of the 30 days granted.
Mr. Mills had askedthere be discussion on t1e vandalism taking
place at the Fleetwood Sewer and Water Plants.
Mr. Diehl reported that apparently the fence existing is neither
high. enough nor adequate enough to keep grown children out of the
plant. Some of these children have been in the plant at various
times and looted and done serious damage. Mr. Lapar will be con-
tacted and asked.to lookintonecessary fencing for the plant. Mr.
Diehl further stated that it has been reported. that rubbish is being
dumped in various places and the Sheriff has been notified to watch

the area.
A revised rezoning request was received. from S. J. Reynolds. 'The.
request now was for only the R-20 area to be rezoned to GB (General
Business .-)
MR. DIEHL moved the revised rezoning petition from S. J. Reynolds
be referred to the Town of Wappinger Planning Board and the Dutchess
County Department of Planning for their review and recommendation..

A letter was received from Town Justice William J. Bulgerrequesting
permission to attend the Regional Traffic .Court Conference -sponsored
by the American Bar Association, to be held at the School of Law,
Fordham University, New York, June8thto 12th, 1970,Registration
Fee $100.00.
MR. DIEHL moved permission be granted Mr. Bulgerto attend the
Regional _Traffic Court Conference, and that his legitimate expenses
be a town charge. Seconded by Mr. Finnan.

Mr. Diehl reported that the Town -wide clean-up mould be. Monday,
April 20th, on the _west side of Route 9 and Monday April 27th on
the east side of Route 9.
There were no Committee Reports.
Bids had been advertized,/received for a Street Flusher for the
Highway Department. Bids. were opened on April 10, 1970. Two bids
were received for the Street Flusher: R. B. Wing & Son Corp. @
$7,695.00 and Ralph C. Herman Co., Inc. @ $8,310.00. One bid was -
received for the Cab and Chassis; McCormack Ford, Inc. @ $5,566.21.
William Horton, Superintendent of Highways recommended the bid for
the Cab and Chassis be awarded to McCormack Ford, Inc. and R. B.
Wing & Son Corp. for the Flusher, as low bidder.
MR. CLAUSEN moved to accept the Highway Superintendents recommenda-
tion and award thebid for the Cab & Chassis to McCormack Ford, Inc.
@ $5,566.21 and; R. B. Wing & Son, Corp. be awarded the bid for the
Flusher @ $7,695.00. Seconded by Mr. Finnan.

The following Zoning Ordinance was introduced by COUNCILMAN CLAUSEN,
who moved its adoption:
BE IT RESOLVED AND ORDAINED by the Town Board of the Town of
Wappinger, Dutchess County, New York, in pursuance of the authority
conferred by the laws of the State of New York, as follows:
Section 1. The Town of Wappinger Zoning Ordinance and Map
adopted January 29, 1963, as amended from time to time, is further
amended by rezoning the following described parcel of land from
"RD -40" (Optional Dwelling) to "R-40" (One Family Residential)
District, said tract or parcel of land being situate in the Town
of Wappinger, County of Dutchess and State of New York and more
particularly describe& as follows:
BEGINNING at a point, said point being 390+ feet from the
intersection of the northerly side of Wheeler Hill Road and
the westerly side of Old State Road;. thence northeasterly along
the easterly side of lot 34, Block 1, Tax Map 77 1380+ feet to
a point, said point being the north easterly corner of Lot 34
Block 1, Tax Map 77; thence northwesterly along the southwesterly
side of Lot 8, Block 1, Tax Map 77, 480+ feet to a point, said
point being the southwest corner of Lot 8, Block 1, Tax Map 77;
thence northerly and westerly along Lot 8, B1. 1, Map 77, Lot
27.1.1, Bl. 1, Map 77, Lot 1.1, B1. 1, Tax Map 77, and Lot 17,
B1. 1, Map 75, 4300+ feet to a point on the easterly line of
Lot 17, Bl. 1, Map 75; thence southeasterly through Lot 17 and
along the southern line of the Hughsonville LB district, 500+
feet to a point 125+ feet westerly from the western side of
Route 9D; thence southerly on a line parallel to and 125 feet
westerly from the western side of Route 9D and not crossing Old
State Road but continuing on a line parallel to and 125 feet.

Ordinance Amendment, for May 25th 1970, at 8:00 P.M., at the Wappinger

William Horton, Highway Superintendent informed the Board that he
had an obsolete oiler that he would like to sell. The Town of

Stanford wishes to purchase this oiler, and Mr.:Horton stated_ that
the Highway Department no longer had any use for this piece:of:.

MR. DIEHL moved- that_ Mr. Horton be given permission to sell the.
oiler, and with the assistance of. Mr. Rappleyea, make the. necessary
arrangements for the sale of the oiler to the Town of Stanford for
$500.00. 'Seconded by Mr. Holt.

Mr. Finnan noted that the County was looking for a site to dump
debris from the Hudson and Mr. Diehl said any suggestions would be
forwarded to the County.
Mr. Cronin had.a•question on the motion regarding the .Cen tral,Park
Homes. Why grant them extensions?
Mr. Diehl answered that in his opinion, this is a question where,,
if the Town granted the Developer approval and went ahead, with their
approximate 100 homes, this would mean a sewer •plant - in these:
locations there are no streams, - nothing there to warrant a sewer
plant. In his opinion, he will delay and use whatever measures he
can to forestall it. He can only see another monster; he',s not.
willing totake the gamble that it wouldn't go through, for once
it's there, there's nothing that can be done.
Mr. Clausen added that the Town wanted to go for municipal sewage
and if they came in for permission to form a Transportation Corpora-
tion and they got underway within the time period, the Town could
conceivably wind up with poor roads, poor drainage and another sewer
plant. The longer the Town can cooperate with them until we qet
municipal sewerage, the better off the Town is.
MR.'CLAUSEN moved the meeting be adjourned, seconded by Mr. dolt_
and unanimously_carried.
