1969-09-08 RGMThe Regular Meeting of the Town Board of the Town of Wappinger was held Sept. 8, 1969, at the Town Hall, Mill Street, Wappingers Falls, New York. Deputy Supervisor Clausen opened the meeting at 8:15 P.M. (Mr. Clausen noted that Supervisor Diehl was absent due to a virus illness.) Present: IIIMUMMINI II1 '435 , Louis Clausen, Councilman G. Donald Finnan, Councilman Leonce Heady, Councilman James Mills, Councilman Absent: Louis Diehl, Supervisor Others Present: Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town William Horton, Superintendent of Highways Deputy Supervisor Clausen called for a minute of silence in memory of John Pantaline, Village Justice, who passed away recently. The Building Inspector, Town Justices and Supervisors' Reports for the month of August were received. MR. HEADY moved the reports be accepted, and placed on file. Seconded by Mr. Mills. Motion Unanimously Carried Bills in the following amounts were presented: General Fund $61,335.49 Highway Fund 46,432.47 OKWD $249.05 OKSD 692.79 RFSD 515.54 Flt.Water 2,590.81 Flt. Sewer2,917.86 MR. FINNAN moved the bills be paid, subject to audit. Seconded by Mr. Heady. Motion Unanimously Carried A rezoning petition was received from Herbert Stenger requesting the rezoning of a parcel of land on Rt. 9, (south of and adjacent to the Colonial Restaurant) from RD -20 to HB -2. MR. FINNAN moved this petition be referred to the Dutchess Planning Board and the Town of Wappinger Planning Board for their review and recommendation. Seconded by Mr. Mills. Motion Unanimously Carried itWc • The resignation of Emma Fisher, Election Inspector (R) District 8 was received. MR. MILLS moved that Mary Kelley be appointed as a Republican Election Inspector to fill the vacancy in District #8. Seconded by Mr. Heady. Motion Unanimously Carried Notice had been received from the Department of Agriculture and Markets that a dog enumerator(s) must be appointed for the Town. MR. MILLS moved that Janet Dean and Bernice Roarabough be appointed as dog enumerators for the Town of Wappinger. Seconded by Mr. Heady. Motion Unanimously Carried A Tax Base Committee Report from the Brinckerhoff taxpayers Asso- ciation was received. MR. MILLS moved the report be received and placed on file. Seconded by Mr. Heady. Motion Unanimously Carried A rezoning petition was received from Stephen Shapiro, requesting the rezoning of a parcel of land, adjacent to Oakwood Knolls, Section I, from R-20 to RD -20. MR. FINNAN moved this petition be referred to the Dutchess County Planning and the Town of Wappinger Planning Board. Seconded by Mr. Mills. Motion Unanimously Carried Three informal bids had been received for fencing around the air conditioning equipment in back of the Town Hall. A-1 Fence, @ $255.00; Pioneer Fence Co. Inc. for $215.00 and Dutchess Fences, Inc. for $104.75. MR. MILLS moved that Dutchess Fence Inc., be awarded the bid @ $104.75 to fence in the air conditioning equipment. Seconded by Mr. Finnan. Motion Unanimously Carried Tax Review notices had been served on the Town Clerk by Brack Construction Corp. vs. Town of Wappinger Assessors; City of New Y37 York vs Town of Wappinger Assessors, Wappingers Apts. Corp; Wappingers Apts. 2nd Corp. vs. Town of Wappinger Assessors; and Dutchess Associates vs. Town of Wappinger Assessors. MR. HEADY moved that these five tax reviews be assigned to the law firm of Quinn & Reilly to represent the Town in these actions. Seconded by Mr. Mills. Motion Unanimously Carried Notification was received from the New York State office for Local Government of a Regional Meeting on "Local Government moves into the 70's, to be held at the Hotel Thayer West Point on Sept. 18th and 19th, 1969. MR. HEADY moved that any Town official wishing to attend would be approved and their legitimate expenses be a town charge. Seconded by Mr. Mills. Motion Unanimously Carried Mr. Mills gave a brief report on "Dutchess County 1990" specifically the 701 project - that of hiring a consultant for the planning of Southern Dutchess-Fishkill, East Fishkill, Wappinger and Village of Fishkill and Wappingers Falls; 5/6 of the total cost of the consul- tants fee is borne by Federal and State Grants - Mr. Mills was seek- ing a basic approval, or interest, of the Board to go into this with the other municipalities. MR. HEADY moved the suspension of the rules, seconded by Mr. Mills and carried, to permit questions from Mr. Cortellino and Mr. Steinberg regarding the 701 project. MR. HEADY moved the rules be resumed, seconded by Mr. Mills and carried. Mr. Clausen reported on his finding on the traffic light on Rt. 9D and Old Hopewell Rd. Having contacted the N.Y. State Dept. of Transportation in Poughkeepsie, he stated that the Town cannot install a traffic light on a state road without first receiving permission from the N.Y. State Dept. of Transportation. Senator Rolison had been contacted and informed of this, and had responded that he would do all he could in the direction of installation of this light. Mr. Mills suggested that a letter be forwarded to Assemblyman Willis Stevens also for his help. Mr. Clausen asked Mr. Horton for a report on the Sheriffs' substation at at the Highway buildings. Mr. Horton said it was working out very well, and two more men will be added for a 24 hour manned station. Street Lighting Authority Order, from Central Hudson, for changes in the Chelsea Light District (Order #8361 and Order #8363) were received. MR. CLAUSEN moved that the Supervisor be empowered to sign the orders for lighting changes in the Chelsea Lighting District. Seconded by Mr. Finnan. Motion Unanimously Carried Street Lighting Authority Order, from Central Hudson, for the installa- tion of one 20,000 lumen mercury vapor (amp. at the Town Garage was received. (General Town). MR. CLAUSEN moved that the Supervisor be empowered to sign the order for installation of a street light at the Town Garage. Seconded by Mr. Mills. Motion Unanimously Carried The Clerk placed before the Board a local law, to be known as Local Law #3 1969, on Fleetwood Water Rates. MR. CLAUSEN moved that the Town Board of the Town of Wappinger hold a Public Hearing on Local Law #3, 1969 entitled "A Local Law Relating to the Imposition and Collection of Water Rents and Establishing Rules and Regulations for the Operation of the Water System existing in the Fleetwood Manor Water District, at the Town Hall, Mill Street, Wappingers Falls, N.Y. on the 2nd day of Oct. 1969 at -8:30 P.M. Seconded by Mr. Finnan. Motion Unanimously Carried The Clerk placed before the Board a local law, to be known as Local Law #4, 1969, on Fleetwood Sewer Rates. MR. CLAUSEN moved that the Town Board of the Town of Wappinger hold a Public Haring on Local Law #4 1969, entitled "A Local Law Relating to the Imposition and Collection of Water Rents and Establishing -Rules and Regulations for the Operation of the Sewer System existing in the Fleetwood Manor Sewer District" at the Town Hall, Mill Street, Wappingers Falls, N.Y. on the 2nd day of Oct. 1969 at 9:00 P.M. Seconded by Mr. Finnan. Motion Unanimously Carried MR. CLAUSEN moved that -the $35,000 received from the Revenue Antici- pation Note (1969) be transferred in contingency-Townwide. Seconded by Mr. Mills. Motion Unanimously Carried The following Resolutions were offered by MR. HEADY who moved their adoption: WHEREAS, the Acct. #510 (Construction and Permanent Improve- ments to the Town Hall)has been overexpended and overdrawn by the sum of $4,397.25, BE IT RESOLVED, that the Supervisor be authorized to transfer $4,397.25 from Acct. #1202 (Contingency) to Acct. #510 in order to eliminate the overdraft and reimburse said account. WHEREAS, the Acct. #903 (Census) has been overexpended and overdrawn by the sum of $2,979.49, BE IT RESOLVED, that the Supervisor be authorized to transfer $2,979.49 from Acct. #1202 (Contingency) to Acct. #903, in order to eliminate the overdraft and reimburse said account. WHEREAS, the Acct. #1302 (Town Share of Employees' Retire- ment) has been overexpended and overdrawn by the sum of $1,088.36, BE IT RESOLVED, that the Supervisor be authorized to transfer $1,088.36 from Acct. #1311 (Contingency -Part Town) to Acct. 1302 in order to eliminate the overdraft and reimburse said account. WHEREAS, the Acct. #1003 (Parks & Playgrounds -Purchase of Equip.) has been overexpended and overdrawn by the sum of $1,329.84, BE IT RESOLVED, that the Supervisor be authorized to transfer $1,329.84 from Acct. #1202 (Contingency -Town Wide) to Acct. 1003 in order to eliminate the overdraft and reimburse said account. WHEREAS, the Acct. #901 (Dog Warden) has been overexpended and overdrawn by the sum of $1,414.70, BE IT RESOLVED, that the Supervisor be authorized to transfer $1,414.70 from Acct. #1202 (Contingency-TownWide) to Acct. 901 in order to eliminate the overdraft and reimburse said account. WHEREAS, the Acct. #1008 (Youth Agency -Purchase of Equipment) has been overexpended and overdrawn by the sum of $219.92, BE IT RESOLVED, that the Supervisor be authorized to transfer $219.92 from Acct. #1202 (Contingency- Town Wide) to Acct. 1008, in order to eliminate the overdraft and reimburse said account. WHEREAS, the Acct. #1001 (Parks & Playgrounds -Compensation of Employees) has been overexpended and overdrawn by the sum of $1, 613.16, BE IT RESOLVED, that the Supervisor be authorized to transfer $1,613.16 from Acct. #1202 (Contingency -Town Wide) to Acct. #1001 in order to eliminate the overdraft and reimburse said account. WHEREAS, the Acct. #1007 (Youth Agency -Compensation of Employees) has been overexpended and overdrawn by the sum of $817.93, BE IT RESOLVED, that the Supervisor be authorized to transfer $817.93 from Acct. #1202 (Contingency -Town Wide) to Acct. #1007, in order to eliminate the overdraft and reimbi.lxse said account. 3 Seconded by: Mr. Mills Motion Unanimously Carried Two Reports were submitted by Rudolph E. Lapar, Engineer to the Town, one regarding Amherst Lane Storm Sewer Project, the other regarding the Town of Wappinger Storm Sewer Contract #2. MR. MILLS moved that these two reports from Mr. Lapar, be received and placed on file for further study. Seconded by Mr. Heady. Gentlemen: As you know, the Planning Board has been reviewing the Sections of the Zoning Ordinance dealing with the regulation of signs for possible amendment.
