The Regular Meeting of the Town Board of the Town of Wappinger was
held July 14, 1969, at the Town Hall, Mill St. Wappingers Falls, N.Y.
The Supervisor called the meeting to order at 8:14 P.M.
Present:

MR. MILLS moved the Minutes of the June 9th Regular Meeting and the
the June 23rd Special Meeting, as submitted by the Town Clerk be
and they are hereby approved. Seconded by Mr. Clausen. Motion
Unanimously Carried.
The monthly reports for June were received from the Supervisor,
Building Inspector and Town Justices, and a semi-annual report was
received from the Town Historian.
MR. CLAUSEN moved the reports be accepted and placed on file. Seconded
by Mr. Heady. Motion Unanimously Carried

MR. FINNAN moved the bills be paid subject to audit, seconded by Mr.
Mills. Motion Unanimously Carried.
The Board called on Malcolm Cornell to speak. Mr. Cornell stated
he had in hand petitions signed by most of the residents of Wildwood,
Sections 2 and 2A, requesting the Town Board to authorize Malcolm
Cornell, Inc. to pave the roads in these two sections with three
coats of oil and chip, - provisions of the Standard Requirements
for Establishing New Roads in the Town of Wappinger (Road Specifica-
tions) approved May 9, 1962, and, accept these roads upon their
completion in accordance with said provisions. Mr. Cornell stated
that the residents had given him these petitions and asked him to
give them to the Board and to ask the Board to give him an order to
pave these roads under the old specifications. Mr. Diehl replied to
Mr. Cornell that the Board contends that not only three coats of oil
and chip are required, but the final coat to go on those roads
is to be blacktop. Mr. Clausen wanted to know what information
the residents had in signing these petitions - then commenting,
Mr. Cornell wanted the Board to order him to put in oil and chip,
why hadn't he proceeded to do so. Mr. Cornell alledged that the
Town already owned the roads, and since April 26, he had requested
a letter of permission to pave, and hasn't gotten it. In essence,
Mr. Cornell contends the residents want the Board to waive the
blacktop. The Board and Mr. Rappleyea all stated that these
sections fall under the March 4, 1965 road spec, requiring the
final coat be blacktop. They said there was nothing preventing
him from putting on the base coat of oil and chip as these are
required prior to blacktop. The developer knows, when he gets
his approval as to what work has to be done, and it simply required
that before he proceeds to any stage of the work, he requests an
inspection from the Superintendent of Highways. Mr. Rappleyea told
Mr. Cornell that nothing was preventing him from putting down the
three ,coats of oil and chip, that is required prior to the final
application of blacktop, regardless of the litigation. Mx. Clausen
remarked that the point is that Mr. Cornell wants a petition approved
that would order the Board to allow him to go ahead and put in layers
of oil and chip when actually the residents didn't have to petition as
Mr. M. Cornell already has the responsibility to do it.
MR. CLAUSEN moved that the petition from Wildwood Section 2 & 2A
regarding those roads be received for study by the Attorney and
Engineer to the Town and Highway Superintendent and give Mr. Cornell
the answer to the findings. Seconded by Mr. Mills.
Motion Unanimously Carried
The Chair called for a motion for suspension of rules.
MR. HEADY moved to suspend the rules, motion failed for lack of a
second.
Town notices of claims against the Town of Wappinger, from Attorney
Leonard Klein, representing Lawrence Allan Dersh and Leonard Chaser
were received. These claims were for property damages sustained by

the claimants as a result of the fire at the
Wappingers Falls, New York on March 15, 1969.
Imperial Towers,
Notices of claims
were on the 9th day of June, and the Insurance Carrier for the Town
was notified shortly after receipt.
MR. CLAUSEN moved these claims be received and placed on file.
Seconded by Mr. Finnan.

The following letter was received:

Dear Sirs:
Enclosed is a copy of the letter received by this district
regarding our request that the New York State Department of
Transportation install a fire preemptor at signal #77 at the
intersection of Route 9 and Myers Corners Road. As this signal
is not in our district we would like to request that the town
consider installing the necessary equipment on the signal with
the•neighboring fire districts of Hughsonville and New Hacken-
sack being responsible for installing the necessary transmitters
in our trucks to trigger the signal.
I am enclosing the literature I have gathered on the
proposed fire preemptor with a price list.

MR. MILLS moved this letter be referred to the Fire District Committee
(Mr. Heady & Mr. Mills) for further study. Seconded by Mr. Clausen.

A letter was received from Mr. Cortellino requesting information
regarding the drainage in Wildwood Forest:
1. What are the target dates for the completion of the work?
2. Will the residents of Wildwood be able to see the plans
for the work proposed and is a copy available for the
residents to review?
3. What is the amount of money set aside for the closing
of the ditch?
Mr. Diehl commented there would be a resolution later in the meeting
authorizing the soliciting of bids for the second portion of the
drainage project.

Mr. Cortellino asked whether or not the Board anticipated the
ditch in Wildwood would be covered this year. Mr. Lapar replied
that he could not say definitely whether it would be covered this
year or not, depending largely on a number of problems being resolved,
such -as several easements. Mr. Cortellino wanted to know if the
plans could be reviewed prior to letting the contract.

and unanimously carried. Recess at 8:47 P.M.
The Supervisor called the meeting back to order at 9:15 P.M.
Harold L. Mangold, Attorney for U.S. Cablevision and Highway Displays
was present, requesting approval of the Board for:
a) The assignment of the existing CATV franchise
to the operating corporation
b) The proposed change in ownership of the operating
corporation.
MR. CLAUSEN moved this request be referred to the CATV Committee
and Attorney to the Town for their study, report and recommendations.
Seconded by Mr. Finnan.
Motion Unanimously Carried
The annual Town audit report done by Frank Manning, Accountant, was
placed before the Board.
MR. FINNAN moved it be accepted and placed on file. Seconded by
Mr. Clausen.
Motion Unanimously Carried
MR. CLAUSEN moved the following Election Inspectors be appointed
for one year, from July 15, 1969 to July 15, 1970.

Wappingers Falls, N.Y.
Dear Sirs:
I would appreciate it very much if the Town Board would
give its permission to Mr. Horton to do something about the
road at the end of Dorothy Heights, as it is a mess. Being
that I am paying taxes the same as the other residents on
Dorothy Heights, I would like the town property, that is
supposed to be a turn -around in front of my house, black
topped. Now that the town has a copy of the original map of
Dorothy Heights, which I had turned over to Mr. Diehl, there
should not be any doubt that they have 50 feet of road at this
end of the street. As it is now, cars do not know where they
can turn around, and keep using my driveway. I would appreciate
it very much if something was done about it. Please acknowledge
this letter.

to go ahead with the removal of the fence referred to by Mr. Swan

to adopt a resolution authorizing the rate of pay for Edeline M.
Keebler, a recent employee for the Justice Court, be established
at $2.50 per hour.
MR. MILLS moved that this Letter be receivedandthe request be
taken under advisement. Seconded by Mr. Clausen.

Re: Cornell and Eck v.
Town of Wappinger
Gentlemen:
On October 7, 1968 we entered judgment in favor of the
Town of Wappinger against Malcolm D. Cornell and Louis Eck in
connection with the above captioned special proceeding which
was then pending in the New York Supreme Court. The amount of
the judgment recovered was $85.00.
On July 10, 1969 the judgment debtors paid the claim
against them in full with interest from October 7, 1968. As
attorneys of record, we executed a. satisfaction piece to
reflect this fact. We are pleased to forward herewith the
check of Ureka, No. 1157, dated July 10, 1969, drawn on
County National Bank, Wappingers Falls Office, and payable to
the order of the Town in the amount of $89.25.

MR. FINNAN moved Mr. Quinns' letter be accepted and placed on
file. Seconded by Mr. Mills. Motion Unanimously Carried
Mr. Mills reported that there would be a three day Seminar at
Spring Glen, New York for the New York Planning Federation, and
as the appointed Board member to the County Planning 1990 Committee
he requested permission to attend.
MR. CLAUSEN moved that Mr. Mills be given permission to attend the
31st Annual Planning Federation - New York Planning Federation,
at Homowack Lodge Inc. Spring Glen, New York Oct. 19 - 21st, and
that his legitimate expenses be authorized Town charges. Seconded
by Mr. Heady. .Motion Unanimously Carried.
Mr. Clausen reported on the Highway Committee's findings in regard
to the Planning Boards' request for investigation of possible traffic
problems, at theintersection of Kent Rd. and All Angels Hill Road,
that might arise from the site plan approval of a Medical Clinic
at this intersection. Mr. Clausen, Mr. Finnan and Mr. Horton all
agree that there will be no traffic problem created by building an
office at this site. A letter was directed sent to the Planning
Board informing them of the committees' findings.
MR. MILLS moved the rules be suspended, seconded by Mr. Heady and
carried.
Mr. Cortellino asked whether or not the Planning Board had checked4-
if it was to be a clinic - to find out if the applicants had complied
with the Department of Health regulations.
MR. CLAUSEN moved the rules be resumed, seconded by Mr. Heady and
unanimously carried.
A Public Hearing had been duly held on the inclusion of an OR
(Office Research) classification on June 26, 1969 .
AN ORDINANCE AMENDING THE
ZONING ORDINANCE OF THE
TOWN OF WAPPINGER
The following Ordinance was proposed by COUNCILMAN CLAUSEN
who moved its adoption:
BE IT RESOLVED AND ORDAINED by the Town Board of the Town
of Wappinger, Dutchess County, New York, in pursuance of the
authority conferred by the Town Law of the State of New York,
that the Zoning Ordinance of the Town of Wappinger adopted
January 29, 1963 as amended, is further amended as follows:
Section 1 - Article III entitled "Establishment of Districts"
is amended by adding thereto the following classification
"OR Office Research".
Section II - Article IV entitled "General Regulations" is
hereby amended by adding thereto the following subdivisions:
Section 425 - Office Research -- (O -R) Zone
The intent of this district is to encourage and facilitate
the orderly development of office and industrial research enter-
prises in a setting conducive to public safety, economic stability
and growth; protection from blight, deterioration, and encroach-
ment of non -compatible uses, and efficient traffic movement.
Section 425.01 - Uses
In an OR Office Research District, no building or land shall
be used, and no building shall be erected or altered, which is
arranged, intended, or designed to be used, in whole or in part,
for any uses, except the following:
A. Uses allowed of right. None
B. Uses allowed subject to site plan approval by the
Planning Board:
1. Offices - Places where financial, insurance, real estate,
data processing, or like businesses, or professional, accounting,
or like services are supplied or performed, including, but not
limited to, buildings or rooms in which clerical work is performed,
or buildings or rooms utilized for the work of administration.
2. Research and/or development and/or engineering
laboratories.
3. Normal accessory buildings and accessory uses.
C. Any change of use from that set forth in original
application for site plan approval shall require a new application
to the Building Inspector for a Certificate of Occupancy.
Section 425.02 - Site Plan Approval
The procedures set forth in Section 440 shall be followed.
Uses subject to site plan approval must conform to the
following provisions:
a) No smoke, gas, dust, fumes, odors, or other atmospheric
pollutant, noise, vibration, glare, radiation beyond building in
which such use is conducted.
b) Such use shall not constitute a fire, explosive or
other physical hazard.
c) No water, atmospheric pollution or other health hazard
shall result from the use of such land or structure.
d) No worts or services shall be performed except in an
enclosed, permanent structure, except for the maintenance of
the grounds.
Section 425.03 - Buildings or Structures - Height
No building, structure or portion of a structure shall be
erected to a height in excess of thirty-five (35) feet. A
water tower, however, may be erected to such height as permitted
by site plan approval.
Section 425.04 - Lot Area and Frontage
Each lot in separate ownership must front on public street
at least to the extent of 50 feet.
Section 425.05 - Maximum Coverage
All buildings on any lot, oncluding main and accessory
buildings, shall occupy no more than a total area of twenty-five
per cent (25%) of the area of such lot.
Outside Parking area may not exceed thirty-five per cent
(35%) of lot area.
Open Space: Area without any structure or parking area,omust
be maintained at least to the extent of 40% of lot area. Such area
shall be maintained as lawn or in its natural state, except for road-
ways or access drives.
Section 425.06 - Yards
Yards shall be subject to site plan approval. No buildings
on any lot shall be erected nearer to any street right-of-way line
than 125 feet, or nearer than 200 feet to any Residence Zone
Boundary.
Section 425.07 - Screening and Landscaping
Sufficient hedges, fences, or walls, of a design and material
subject.. to approval by the Planning Board, shall be provided. All
required screening and landscaping shall be maintained throughout
the life of any use for which a Certificate of Occupancy is granted.
Section 425.08 - Ingress and Egress
For each lot there shall be adequate ingress and egress drive-
ways with a minimum width as follows:
A. For one-way driveways - 16 ft. pavement width
B. For two-way driveways - 25 ft. pavement width
Section 425.09 - Off -Street Parking Requirements
No parking area shall be closer to a Residence Boundary than
fifth (50) feet. There shall be provided not less than two square
feet of parking area (inclusive of aisles, but exclusive of acess
drives or roads)for every square foot of gross. floor area with
not less than the following number of spaces for the following
exceptions:
A. Banks, business offices not otherwise specified, one
space for every 200,square feet of gross floor area plus one
parking space for every three employees.
B. Business service offices - one space for every 500 square
feet of gross floor area plus one space for each two employees.
C. Offices of architects, attorneys, accountants, engineers,
real estate offices, insurance offices, and other professional
offices in which the ratio of visitors to employees is similarly
low - one space for every 500 square feet of gross floor area,
plus one parking space .for each two employees.
D. Professional offices of Practitioners of Healing Arts and
Sciences: ten (10) spaces shall be provided for the first practi-
tioner; eight (8) spaces each for the second and third practition-
ers, and six (6) spaces for each additional practitioner.
E. Research and/or development labotatories: One space for
every two employees for which the building is designed, but not
less than one space for every 600 square feet gross floor area.
Section 425.10 - Off -Street Loading Requirements
All loading and unloading shall take place entirely on the lot,
wither on the side or in the rear of any building, and not nearer
than 100 feet from any Residence District Boundary.

_Section 425.11 - Outside Storage
No material, supplies, goods, debris, or work products
shall be located or stored outside of any building. All areas used
for refuse disposal or storage of waste cans or other waste appara-
tus shall be enclosed by suitable screening or fencing as required
by Planning Board in Site Plan Approval.
No trailer, temporary structure, trailer truck or
other structure which has not been approved by the Planning Board
in the site plan approval shall be used or placed on the premises
for storage or any purposes except during the period of construction
of any permanent building on the premises.
Section III - This ordinance shall take effect immediately
upon adoption and posting as provided by law.

A Public Hearing had been duly held on the petition of Thomas
& Madlyn Marcojohn for a rezoning of a parcel of their land on
Route 9 on June 26, 1969.
The following Ordinance was proposed by COUNCILMAN HEADY
who moved its adoption:.
BE IT RESOLVED and ordained by the Town Board of the Town
of Wappinger, Dutchess County, New York, in pursuance of the
authority conferred by the laws of the State of New York, as
follows:
Section 1. The Town of Wappinger Zoning Ordinance and Map
adopted January 29, 1963, as am ended from time to time, is hereby
further amended by rezoning the following described parcel, of
land from "RD -20" (Residential Zones) to "HB I" (Highway Business)
said tract or parcel of land being situated in the Town of
Wappinger, County of Dutchess and State of New York, more particu-
larly bounded and described as follows:.
Beginning at a point in the middle of .Cooper Road leading
from the Fishkill-Wappingers Falls State Road to Brinckerhoff at
the Northwesterly corner of lands of Mayer and running thence
with the middle of _said Cooper Road the following courses and
distances North sixty seven (67) degrees forty four (44) minutes
West two hundred six and forty six hundredths (206.46) feet;
thence North seventy four (74) degrees thirty seven (37) minutes
West two hundred forty four and fifty seven hundredths (244.57)
feet to the intersection of the mi.ddle of Cooper Road with the
Easterly line of the Fishkill-Wappingers Falls State Road; thence
with the said Easterly line of the Fishkill-Wappingers Falls
State Road the following courses and distances South fourteen
(14) degrees fifty seven (57) minutes East sixty five and twenty-
nine hundredths (65.29) feet to a concrete monument set; thence
South nineteen (19) degrees. thirty nine (39) minutes East ninety
nine and eighty two hundredths (99.82) feet to a concrete monu-
ment set; thence South thirteen (13) degrees,. forth two (42)
minutes thirty (30) seconds East two hundred and one tenth (200.1)

Beginning at a point formed by the intersection of the
northeasterly highway boundary of S.H. 5154 with the division
line between the property of Thomas Marcojohn and Madlyn
Marcojohn (reputed owners) on the north west and the property of
Nicholas D'Angelico (reputed owner) on the southeast, said
point being 70+ feet distant northeasterly measured at right
angles from Station F297 + 20+ of the hereinafter described F
survey base line for the proposed reconstruction of Fishkill
Village-Wappinger Falls S.H. 5154; thence northwesterly along
said highway boundary 391+ feet to a point on the southerly
highway boundary of Smithtown Road, said point being 50+ feet
distant northeasterly measured at right angles from Station F301
+10 + of said F. Survey base line; thence easterly along the last
mentioned highway boundary 113+ feet to a point, said point being
148 feet distant northeasterly measured at right angles from Station
F300+53+ of said F. survey base line; thence South 33 degrees 14
minutes 09 Seconds East through the property of Thomas Marcojohn
and Madlyn Marcojohn (reputed owners) 351+ feet to a point on the
division line between the property of Nicholas D'Angelico (reputed
owner) on the southeast and the property of Thomas Marcojohn and
Madlyn Marcojohn (reputed owners) on the northwest, said point
being 167 feet distance northeasterly measured at right angles from
Station F297 + 03 + of said F survey base line; thence southwesterly
along the. .last mentioned division line 98 + feet to the point of
beginning, being 0.812 acres more or less.
The above mentioned F. survey base line is a portion of the
survey base line for the proposed reconstruction of Fishkill Village-
Wappinger Falls, S.H. 5154, Dutchess County, as shown on a map and
plan on file in the office of the State Department of Public Works
and described as follows:
Beginning at Station F296 + 50; thence North 30 degrees 07
minutes 43.2 seconds West 650.00 feet to P.O.L. Station F303 + 00.00.
All bearings referred to true north.
Section 2. This amendment shall become effective upon adoption,
posting and publication, as prescribed by Town Law.

A report on the feasibility of a Sewer District for Wappinger Park
Homes, and further recommending that a study similar to the North
Wappinger Sewer Improvement, encompassing the whole area drainage
basin for sewerage treatment facilities, be authorized by the Board.
MR. MILLS moved that the Board acknowledge receipt of Mr. Lapar's
report, and take it under advisement (Mr. Lapar's recommendation
for an additional study.) Seconded by Mr. Heady.

Under new business, Mr. Diehl asked -if there were any problems
that anyone on the floor wished to bring before the Board.
Mr. S. William Berg, St. Nicholas Road, spoke on the mining permit
issued to Dave Alexander (for property on the corner of St. Nicholas
Road & New Hackensack Rd.) He contended that Mr. Alexander had not
complied with the resolution passed permitting him to mine, namely,
he did not clear within the 50' line or replace Mr. Bergs' fence
that was down. Mr. Berg wished to know if there was some action
the Town could take to have these fences repaired.
Mr. Diehl referred this problem to Mr. Rappleyea, Attorney to the Town.
Mr. Walter Cronin asked what the status was of the North Wappinger
Sewer Improvement and, when the ditch in Wildwood Drive is covered,
has consideration been given to the capacity of the water coming
down from the other roads.
Don Mendorf, 3 Split Tree Drive, would like the Board to direct
Mr. Cornell to begin work on the roads in Section 2 & 2A of Wildwood.
MR. HEADY moved that Mr. Rappleyea formulate a letter again directing
Mr. Cornell to complete the roads in compliance with the road speci-
• fications that existed at the time of the approval of the subdivi-
sion, and authorizing the_Supervisor to sign said letter. Seconded
by Mr. Mills.

Mr. DeMaria asked about the water pressure problem he spoke to the
Board about at the last meeting - (in Wildwood Section II). -
Mr. Rappleyea informed him that, as it is_a private water company,
the Public Service Commission would be the proper authority to
contact. Mr. Diehl asked Mr. Rappleyea if the Town had the legal
right to direct the_Engineer to check water pressures in some of
these homes, and Mr. Rapplyea replied NO.
Mr. Finnan brought up the problems being experienced at the Highway
Garage, flooding, well water etc.
MR. FINNAN moved that the Supervisor be empowered to negotiate
for the purchase of three acres of property owned by Mr. Barber
next to the Town Highway Dept. property. Seconded by Mr.- Clausen.
Motion Unanimously Carried

Hill Road. As often happens, very substantial difficulties
soon arose during construction which caused us to seek the
assistance of Mr. Joseph Ludwig in his capacity as the Town
Building Inspector. His assistance and advice at that time was
given promptly and without reservation, and the difficulties

we sought Mr. Ludwig's advice and assistance, and in all instances,
we were courteously received and promptly assisted to our complete
satisfaction.
I am writing you to commend Mr. Ludwig for his efforts on_

under your jurisdiction. Mr. Ludwig's attention to an individual
home owners problems, despite the many other demands on his time
as. the Town Building Inspector reflects both on him and on your
administration.
I am reasonably confident that our problems during construc-
tion were not unusual and trust that Mr. Ludwig will continue to
receive all the support he needs so that others may benefit from
his assistance.

Section 1. The Town of Wappinger Zoning Ordinance and Map
adopted January 29, 1963, is amended by rezoning the following
described parcel of land from "R-40 Residential" to "LB Local
Business", said tract of land being located in the Town of Wappinger,
