Adjournment The Regular Meeting of the Town Board of the Town of Wappinger was held Monday, April 14, 1969, at the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:16 P.M. Present: Louis Diehl, Supervisor" Louis Clausen, Councilman G. Donald Finnan, Councilman Leonce Heady, Councilman James Mills, Jr, Councilman Elaine H. Snowden, Town Clerk Others Present: William Horton, Superintendent of Highways Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town Supervisor Diehl called for a minute of silent prayer in respect to the former General Dwight D. Eisenhower, former President of the United States. A minute of silent prayer was observed. Minutes of the March 10, 1969 Regular Meeting, as submitted by the Town Clerk, be and they are hereby approved, moved by COUNCILMAN CLAUSEN, seconded by Mr. Mills. Motion Unanimously Carried The reports for the month of March were received from the Town Justices, Building Inspector and Supervisor. MR. MILLS moved the reports be accepted and filed. Seconded by Mr. Clausen. Motion Unanimously Carried Bills received for payment were as follows: General Fund $26,607.13 OKSD $ 169.25 Highway 3,077.42 OKWD 136.24 RFSD 307.08 MR. CLAUSEN moved the bills be paid, subject to audit. Seconded by Mr. Finnan. Motion Unanimously Carried Mr. Clausen stated he had a number of phone calls from residents of Wildwood Forest Section II (regarding the road bonds) and moved that at this time the rules be suspended in order to discuss the status of the performance bonds for the roads in Section II with the several residents present, seconded by Mr. Finnan. Motion Unanimously Carried Mr. Don Mendorf, Mr. Fred DiMaria, Mr. James Langley, Split Tree Drive and Mr. Walter Cronin & Mrs. Clifton Haight, Widmer Rd, spoke, asking for clarification of the bonds, have they expired and is the Attorney looking into the situation. Has the work on the drainage been inspected as the pipe was laid, would litigation be commenced against the developer, and, is there a question as to which road specifications the developer was under. Mr. Rappleyea answered the residents questions and explained the Towns' position with regard to the bond status, the possible outcome and the difference of opinion as to the specifications the developer was to use. He further stated that if the situation was proceeding toward being resolved by the next Board meeting, he may recommend to the Board that legal action be instituted. Mr. Eck had requested to speak to the Board regarding the North Wappinger Sewer Improvement. He made reference to the Special Meeting of April 1, and reminded the Board that they had stated at that time, the application would be signed and in Albany in ten days, had it been signed? Mr. Diehl answered no - Mr. Eck said this had been going on month after month, how long is the Board going to wait? Motion made by Mr. Clausen, seconded by Mr. Mills to resume rules. Motion Unanimously Carried 1r. Eck had written the Board about investigating a plan he had to offer regarding a water supply for the Town. Mr. Diehl had previously arranged an informal meeting with the Town Board , the Village Board and Mr. Eck, set for tommorrow night, to discuss this plan. Mr. Eck reserved his discussion for the informal meeting. Mr. Worona communicated with the Board regarding the petition of Angel Brook Acres Corp. for rezoning that had been before the Board for some period of time. Mr. Worona asked that the Board schedule a public hearing for the rezoning of a parcel of the Angel Brook Acres Corp. land from R-40 to LB, that this matter may be resolved one way or another. Mr. Diehl reiterated that he had asked the Planning Board to communicate with the developers asking for specific commitments had not gotten a definite answer of any plans which the developers might have. He personally wished to know more specific facts. He feels there are certain answers he must have and doesn't have at this time. He added that he felt that the classification of Office Research (OR) should be added to the Town Ordinance, where it specifically belonged, he didn't know. Mr. Worona continued to maintain public hearings should be held in fairness to the developers. The request of Mx. Coombs, representing John Vorndran and his rezoning petition, was in the same vein as Mr. Woronas', and as such he was asked to speak at this point in the agenda. Mr. Coombs said he had a petition with 165 signatures of residents in that area (All Angels Hill Rd. & Brown Rd.) who feel local business is indicated in that area. Mr. Coombs also stated that in answer to the potential traffic problems, his client has an agreement with the County that if the LB petition is granted he (Vorndran) will donate land to straighten the road in that vicinity. He took issue also with Mr. Diehl about knowing at this time precisely what was planned, he felt this was in the realm of site plan approval. MR. MILLS moved that the Town Board hold an executive session at the Town Hall with the Planning Board and the petitioners (Vorndran and Alpert), to see if these petitions pending before the Board can get resolved one way or another, to be held April 4, 1969 at 7 P.M. Seconded by Mr. Finnan. Motion Unanimously Carried MR. CLAUSEN moved the rules be suspended, seconded by Mr. Mills and unanimously carried. Mrs. Mary Smalz, Edgehill Manor asked that any names on Mr. Coombs petition that are not Town of Wappinger residents be eliminated. Mr. Coombs stated every effort was made to see that the signatures were only those of Town of Wappinger residents. MR. CLAUSEN moved the rules be resumed, seconded by Mr. Heady, and unanimously carried. Mr. Diehl commented, while on the subject of rezoning, that several suggestions were brought forth at the meeting of the County Exten- sion Service, one regarding a suggestion for Planning Boards of Towns to appoint four or five people, as a cross section of the Town to act as an advisory group to the Planning Board, subject to the call of the Planning Board. He felt it a good idea, particularly in rezoning matters, and recommended to the Town Planning Board they give consideration to this idea, and if an advisory group is formed, consider some women for appointment. The clerk was directed to write the Planning Board and forward this personal recommendation. MR. MILLS moved the rules be suspended, seconded by Mr. Clausen and unanimously carried. Mr. Cortellino suggested that it be decided by the Planning Board and Town Board how much commercial and industrial area was needed for the Town - in short, re-evaluate the Towns' position toward zoning. MR. MILLS moved the rules be resumed, seconded by Mr. Clausen, and unanimously carried. A letter was received by Mr. Melvin Sucich, Rt. 9D, regarding drainage problems he was having. Mr. Lapar indicated he felt it was a legal problem between 2 land owners, and out of the Towns' jurisdiction. Mr. Rappleyea said that the position of the Town would be that as far as the demaopment that borders this particular property is concerned, is the proper installation of drainage according to subdivision plan, it is not the Towns' obligation for drainage along Rt 9D, nor is it the obligation of the Town to work out disputes between adjoining property owners. MR. HEADY moved to refer Mr. Sucichs' letter to Mr. Rappleyea for an answer. Seconded by Mr. Mills. Motion Unanimously, Carried The following letter was received from the Town Justices: March 25, 1969 Town Board Town of Wappinger Wappingers Falls, New York Gentlemen: It has come to our attention that an hourly pay rate has never been established for the Town Court Enforcement Officers for their services when serving jury notices, criminal process, as court officers etc. If this is so, may we suggest that such a rate be estab- lished as soon as possible. May we also take the liberty of suggesting a rate of two dollars and fifty cents ($2.50) per hour, as a fair rate of payment. Thank you for your courtesy. Very truly yours, s/ William J. CLAUSEN moved that the rate of payment for the Town Court Enforcement Officers be established at $2.50 per hours, as recommended by Judges Bulger & Francese. Seconded by Mr. Mills. Motion Unanimously Carried MR. HEADY moved the following letter from Attorney Joseph D. Quinn, Jr. re: "Cornell, ap. v. Town of Wappinger, res." be accepted and placed on record, seconded by Mr. Clausen, and unanimously carried. March 25, 1969 Town Board Town of Wappinger Town Hall Mill Street Wappingers Falls, N.Y. Re: Cornell, ap. v. Town of Wappinger, res. Gentlemen: On July 18, 1968, Malcolm Cornell and Louis Eck instituted the above captioned proceeding against the Town of Wappinger in the New York,Supreme Court. In the proceeding, petitioners sought to compel the Town to secure approval for the establish- ment of a municipal sewer improvement, to discharge the attorneys who have been retained by the Town for such purpose, and to cancel a lease agreement by the Town and the County of Dutchess for use of county property at the airport for disposal of refuse and garbage by the sanitary landfill method. This firm appeared in the proceeding on behalf of the Town of Wappinger, and the matter was argued before Mr. Justice Hoyt on August 15, 1968. On September 20, 1968, the Court handed down a decision directing dismissal of the petition, with costs to the Town. On October 7, 1968 judgment was made and entered in favor of the Town and against Messrs. Cornell and Eck. On November 4, 1968 petitioners appealed the adverse judgment to the Appellate Division of the New York Supreme Court, Second Judicial Department. On February 4, 1969, we moved on behalf of the Town to quash the appeal for lack of prosecution. On Febru- ary 13, 1969, petitioners filed an opposing affidavit wherein they attempted to both controvert the facts set forth in our motion papers and to withdraw the appeal. On February 24, 1969, the Appellate Division granted the cross-motion for withdrawal and denied the dismissal motion as academic. A copy of the decision slip and the order entered thereon are enclosed herewith for your records. We are pleased to inform you that this litigation has been finally terminated in the Town's favor. Quinn, Jr. The following letter was received from the Planning Board; April 10, 1969 Town Board - Town of Wappinger Mill Street Wappingers Falls, New York Gentlemen: At its March 17th meeting, the Planning Board received from you, for recommendation, the rezoning petition submitted - by Mr. and Mrs. Thomas Marcojohn. Upon reviewing said petition, the Board found that the property in question is described as being bounded on the North by Smithtown Road. Upon reviewing "Schedule A", which is attached to the petition, the Board found that said property is described as being bounded on the North by Cooper Road. The Planning Board is aware of the fact that this property is located on the southerly side of Smithtown Road. However, since both Smithtown and Cooper Roads are existing Town Roads and are located in the same general area, the Board feels that this discrepancy should be corrected before any action is taken on the petition, so as to alleviate any possible confusion. The following letter was also received in reference to the same petition: April 7, 1969 Town Board Town of Wappinger Mill Street, Wappingers Falls, New York } Re: Application of Thomas Marcojohn and Madlyn Marcojohn for the rezoning of certain premises situate at Route No.9 in the Town of Wappinger, Dutchess County, New York Gentlemen: It has recently come to our attention that the above entitled application was referred to your body from the Town of Wappinger Planning Board without recommendation. It appears that the Planning Board declined to make a recommenda- tion on this application because of a discrepancy in the description of the subject parcel. It further appears the alleged discrepancy resulted from a reference to Cooper Road as one of the boundaries of the subject parcel. It is to be noted that paragraph "Sixth" of the application generally describes the premises as being bounded on the North by Smithtown Road. It is our understanding that this is a proper description of the northerly boundary of the property. It appears that the confusion arises out of the fact that the legal description referred to Cooper Road. It is our under- standing that at the time that Mr. & Mrs. Marcojohn acquired title to the premises, what is now known as Smithtown Road was then designated Cooper Road. We enclose herewith a xerox copy of the descriptive portion of the deed by which the applicants acquired title to the premises. It is to be noted reference is made to Cooper Road as being the northerly boundary. This is the only legal description of the premises presently avail- able. In light of the foregoing, it would be appreciated if the Town Board would refer the matter back to the Planning Board for their recommendation. Very truly yours, s/ Harold H. Reilly MR. CLAUSEN moved that the Marcojohn petition be referred back to the Planning Board along with the letter from Harold Reilly, (petitioners attorney) for further review and recommendation ; and refer to Mr. Rappleyea also. Motion Unanimously Carried A letter was received from the Supervisors and County Legislators Association of the State of New York, Inc. in anticipation of acquainting the Town Board of this associations aims and purposes. MR. CLAUSEN moved this -letter be accepted and placed on file. Seconded by Mr. Mills. Motion Unanimously Carried The following report was received: April 14, 1969 Town Board, Town of Wappinger Mill Street Wappingers Falls, N.Y. 12590 Re: Gentlemen: Town of Wappinger Storm Sewer Contract #1 On Friday, April 11, 1969 at 11:00 A.M., bids for the above contract were opened and read by the Town Clerk. The results of the bids are as follows: 1. Dave Alexander Inc. 2. Chief Construction Inc. 3. Fred J. Lafko 4. Motion Unanimously Carried The following letter was received: March 17, 1969 Town Board of: Wappingers Falls Louis Diehl - Supervisor Mills Street Wappingers Falls, New York Dear Sir, The Chamber of Commerce of Wappingers Falls has long been interested in highway safety. With the construction of new Route 9 from Wappinger Falls to Fishkill some hazardess conditions have been created at intersections. We have asked the State of New York to take steps to correct these conditions. Inclosed is our letter to the Department of Transportation proposing steps to be taken. We would like to mist the help of the Town Board to promote our proposal. A resolution introduced by the Board will place �1 K.... _.._ 3 ilii L 1 more emphasis on the unsafe road conditions. Very truly yours, s/ William Pritchard Vice President The Town Clerk noted that this letter had been answered by her, and copies of all communications from the Department of Transporta- tion received by the Town, with regard to the addition of arrow lights on traffic signals, were forwarded to Mr. Prichard, indicating the Towns' efforts on the same problem. A letter was received from Ted C. Olson, 10 Russ Place regarding the question of ownership of the sewer lines up to his property lines, (as he has had problems of sewer stoppage intheline located under Russ Place) and who controls the action of L&A filtration. Mr. Lapar stated that this was between Mr. Lafko and Mr. Olson. A discussion ensued between Mr. Lafko and Mr. Olson as to where the problem was and who was responsible. Mr. Olson then asked if he made a formal complaint to the Town Board what action could the Board take? Mr. Rappleyea answered that who owns what depends on who installed it, the Town would not enter into the argu- ment, however, because it is not a public district, it is a private corporation. The following letter was received: MEMO TO: Town Board, Town of Wappinger FROM: Joseph E. Ludewig, Zoning Administrator DATE: April 11, 1969 SUBJECT: New Town Zoning Maps Gentlemen: You will recall that the completion of the relocation of Route 9 and the creation of new zoning categories made it necessary to revise our zoning map. You authorized me to arrange for the preparation of such. I asked Rudy Lapar if he would have the time to undertake this project because I felt that he was better qualified than some outside engineer, because of his familiarity with the Town. .He agreedto undertake the job at a cost not to exceed $1500 for professional services provededby him and his staff, and pointed out that the Town would-be .billed :directly by the Hudson Valley Blue Print Company for the cost of reproducing and enlargements that were required to complete this project. The actual cost for Lapar's services was $1000, and the printing and enlarging amounted to about $650. The map consists of a 36" x 72" Base Map showing every parcel in the Town, some 6,000. It is scored off in ten sections, which have been "blown up" for easy identification of individual parcels. If you approve of this map, I would request that you authorize us to have printed a supply so that we may be able to furnish copies to anyone wishing to obtain same. I would suggest that the large map should be priced at $5.00 per copy, and each section at $2.00 per copy. I would appreciate your notifying me of what action you wish me to take. CLAUSEN moved that the Base Map prepared by Rudolph Lapar, Engineertothe Town of Wappinger, be approved, the price suggested by Mr. Ludewig of $5.00 per copy of the large map and $2.00 for each section be accepted, and further, the fee for professional services of Rudolph Lapar for map preparation, be approved. Seconded by Mr. Mills. Motion Unanimously Carried Mr. Diehl made the following statement that in view of the fact of the efforts put forth by Mr. Eck regarding construction of a building to accomodate teenage events and recreation and with the understanding of thousands of dollars pledged to construct said building and with the understanding that the said teenage recrea- tion building cannot legally be constructed on airport property and this all being a true fact - I, Louis Diehl, Supervisor of the Town of Wappinger, in an effort not to lose this endeavor in behalf of the need for such a recreation center for all recreation needs in the Town of Wappinger present the following resolution for adoption. The following resolution was proposed by MR. DIEHL who moved its adoption: Be it resolved that a part of the recreation area on Robinson Lane (Becker site) owned by the Town of Wappinger be made available for the construction of this proposed recreation building immediately and that the principals concerned meet as soon as possible with Allan Rappleyea, Attorney to the Town to formulate all necessary papers to assure cooperation and positive action. That the resolution be forwarded immediately to Allan Rappleyea, Attorney, to the Town, Mr. Joseph Ludewig, Buidling Inspector and Zoning Administrator, Mr. Hugh J. Maurer, Chairman of the Recreation Commission, Town of Wappinger and Mr. Robert Heisler, Chairman of the Planning Board and to Mr. Louis Eck (who in turn will advise all other principals concerned) so as all the mentioned principals will be aware of the resolution and pool their -various abilities to meet all laws and specifications so as this endeavor will become a reality in the immediate future. Seconded by: Louis Clausen Roll Call Vote: Supervisor Diehl Aye Councilman Clausen Aye Councilman Finnan Aye Councilman Heady Ave Councilman Mills Aye Carried: April 14, 1969 Mr. Clausen asked Mr. Eck if he was familiar with the article that appeared in tonights' Poughkeepsie Journal about the airport and the Taxpayers' Association, and is it correctly stated that the Taxpayers' Association plans to build a $100,000.00 building. (Mr. Eck answered "Yes") and basically the offer is for a teenage center and therefore your problem is getting a piece of land. Mr. Eck stated they had a lease, that's no problem, we have the land. Mr. Clausen said in the event they didn't have the land, would the offer (of the $100,000) still hold. Mr. Clausen asked again that as an offer, should any and all land you may have proposed fail, would the offer still stand toward the community for these teenagers on available land in the Town. Mr. Eck said let's get through with the one we started and then I'll talk to you further. Mr. Mills commented on an item brought up at the Extension Service Seminar in Millbrook, that of replacement of trees that Towns are losing, due to disease. MR. MILLS moved that the Town Clerk and Mr. Horton see if they can find some information regarding how the Town can go about getting replacement trees and the kind of cost involved, to see if the Town can start a tree replacement in some of the areas where we've cut down tremendous numbers of elm, etc., it should be looked into now, before it is too late. Seconded by Mr. Clausen Motion Unanimously Carried 34 Mr. Clausen noted that caution should be used in replacing trees, so as not to obstruct drivers vision on the highways and be a hazzard. Resolution Establishing a Town of Wappinger Narcotic Guidance Council The following Resolution was offered by SUPERVISOR DIEHL who moved its adoption: WHEREAS, the New York State Legislature has provided for the establishment of a Narcotic Guidance Council, now, there- fore, BE IT RESOLVED, that the Town Board of the Town of Wappinger, hereby establishes a Town of Wappinger Guidance Council pursuant.. to the authority provided in Article 12E of the General Municipal Law, and that the -Town Board hereby confers upon such Council the following powers: (a) To make immediately available to the community, basic knowledge acquired in the field of drug use especially by youth; (b) To create a climate in which persons seeking assistance in coping with narcotics problems can meet, without embarrassment, with responsible individuals or agencies in a position to render assistance; (c) To authorize persons approved by the council to contact and counsel persons within the community suspected ofusing narcotics or those persons allegedly having knowledge of such usage, and (d) To cooperate with other narcotic guidance councils and with the state, and federal narcotics commissions =and :agencies in bringing local and community trouble areas to their attention. and BE IT FURTHER RESOLVED that said council shall consist of five members, one of whom shall be appointed to serve until March 1st, 1970, two of whom shall be appointed to serve until March 1, 1971, and two of whom shall beappointedto serve until March 1st, 1972. Thereafter, such terms shall be for periods of three years each. In the event of any vacancies caused by reason other than expiration of term, appointments shall be made to fill the; unexpired term. A Public Hearing was held on a -rezoning petition of Chelsea Ridge Inc. on April 1, 1969 for a zoning change from R-20 to LB.: MR. i Y'moved the following ordinance be adopted: BE IT RESOLVED and ordained by the Town Board of the Town of Wappinger, Dutchess County, New York, in pursuance of the authority conferred by the laws of the State of New York, as follows: Section 1. MILLS moved the following ordinance be adopted: BE IT RESOLVED AND ORDAINED by the Town Board of the [Town of Wappinger, Dutchess County, New York, in pursuance of the authority conferred by the laws of the State of New York, as follows: Section 1. The Town of Wappinger Zoning Ordinance and Map adopted January 29, 1963, as amended from tiem to time, is hereby further amended by rezoning the following described parcel of land from R-20 "One Family Residential District" to RD -40 "Optional Dwelling Residential District," All that certain lot, piece or parcel of land situate in the Town of Wappinger, County of Dutchess and State of New York, being more particularly bounded and described as follows: Beginning at a point on the Southerly line of lands of Chelsea Ridge, Inc., said point being the Northeast corner of lands of now or formerly R. Fredrick Jr., and running thence along the northerly lines of lands of now or formerly said R. Fredrick Jr., along the northerly line of lands of now or formerly R.Fredrick, Sr., and along the northerly line of lands of now or formerly Piana North 88-13-00 West 881.50 feet to a point on the northeasterly line of lands of Chelsea Ridge, Inc.; thence along the northeasterly line of lands of said Chelsea Ridge, Inc. along the remains of a stone wall, north 35-00-50 West 385.00 feet to a point; thence leaving said line and running through lands of Rosenberg & Silver (Chelsea Ridge, Inc.) the following; South 76-05-00 East 1564.83 feet to a point; thence South 11-40-00 West 15.00 feet to a point; thence North 76-00-10 West 426-56 feet to the point of beginning containing 3,590 acres of land, be the same more or less. Mrs. Cottrell questioned the Board about the traffic signal light at the southerly entrance to the Imperial Plaza on Route 9. She noted that it was just blinking yellow caution, and was much more hazardous than when it was in operation , could the Board ask the Village to look into it. Mr. Cronin asked if, when an ordinance is changed, does the Town Board have approval on site plans. 353 Mr. Eck asked how much does the Town spend on the sanitary landfill per week overall. Mary Schmalz thanked the Board for the light at the intersection of All Angels Hill Road and Myers Corners Road " whoever is responsible, thank you." . MR. MILLS moved the rules be resumed, seconded by Mr. Heady and unanimously carried. Mr. Diehl stated that since there have been several complaints to the Town Board regarding the traffic light at the Imperial Plaza'a southerly entrance on Route 9, he asked that the Clerk write the Mayor and the Trustees of the Village of Wappingers Falls, and ask if they can look into this matter to have this traffic light either put into full operation or turned off completely.
