Adjournment • TOVI.:-.4 • 228 The Regular Meeting of the Town Board of the Town of Wappinger was held on Monday, December 9, 1968, at the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:10 P.M. Present: Absent: Louis Diehl, Supervisor Louis Clausen, Councilman G. Donald Finnan, Councilman Leonce Heady, Councilman James Mills, Jr. Councilman Others Present: William Horton, Superintendent of Highways Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town MR. CLAUSEN moved that the minutes of the Regular Meeting of Nov. 12, 1968, as submitted by the Town Clerk, be and they are hereby approved. Seconded by Mr. Finnan. Motion Unanimously Carried The Supervisors and Town Justices Reports were received for November, and the Building Inspector reports for October and November were received. MR. FINNAN moved the reports be received and placed on file. Seconded by Mr. Clausen. Motion Unanimously Carried The following bills were presented for payment: General Fund Highway $11,792.11 6,299.72 Oakwood Sewer $289.17 Oakwood Water 192.22 Rockingham 514.41 MR. FINNAN moved the bills be paid, subject to audit. Seconded by Mr. Clausen. Motion Unanimously, -Carried Mr. Arthur Bisom had requested to speak to the Board on a subject pertaining to Oakwood Knolls Development. He first commented on an accusation from the Wappingers Taxpayers Association that he was a stooge for Mr. Logan, Wappinger Republican Committee Chairman, 22 9 which he refuted, adding if this could be proved, he would donate $500. to any charitable organization. Getting to his topic, he reflected that about two years ago, the Highway Superintendent had done about $800. worth of work on the Oakwood Knolls Roads, had that money been put back? He asked that this be checked into. Mr. Diehl said Mr. Horton would have some figures for the next Regular Meeting. He then asked what was being done with outstanding bills for the sewer, and where the money came from to pay for the work done on the billings and who stood the loss on the unpaid bills, Oakwood District or the Town. Mr. Diehl answered that all monies came out of the District and the District alone bore the loss of non-payment. A letter was received from Mrs. G. Marvullo regarding a hazard at the entrance of Dugan Lane from All Angels Road. The letter requested the Town Board to ask the County to remedy the situation, by widening the apron at the entrance enough to allow two cars to exit and enter at the same time. MR. FINNAN moved that Mr. Horton be directed to contact Mr. Petrovits to investigate the possibilities of widening the exit of Dugan Lane into All Angels Hill Rd. Seconded by Mr. Clausen. Motion Unanimously Carried The following letters were received from the Planning Board: Dec. 5, 1968 Town Board Town of Wappinger Wappingers Falls, New York Re: Howard Prager Rezoning Petition, Approx. 50 acres on E/Side of Montfort Rd. from R-40 to Rd -20 Gentlemen: The Town of Wappinger Planning Board has reviewed the above-named petition, which you referred to them on October 14th for recommendation. At the Planning Board's December 2nd meeting, a motion was unanimously carried to recommend that the Town Board disapprove the rezoning petition, submitted by Howard Prager, on the basis that (1) this area is not suited for multi -family dwellings , and (2) the Planning Board is concerned with increasing the traffic on Montfort Road. I also note that the recommendation or the Dutchess County Department of Planning has been received relative to this matter. s/ Robert Y. Heisler,Chr. Ping. Bd. December 4, 1968 Town Board Town of Wappinger Wappingers Falls, New York Re: John Holler Rezoning Petition, Approx. 7 Acres on N.Cor/Pye Lane and All Angels Hill Road from R-40 to GB Gentlemen: The Town of. Wappinger Planning, Board has reviewed the abovenamed petition, which you referred to them on October 14th for recommendatibn. At the Planning Board's meeting of December 2nd, a motion was unanimously carried to recommend that the Town Board disapprove the rezoning petition, submitted by John Holler, on the basis that a rezoning to GB (General Business) would be improper for this area. Respectfully submitted, s/ Robert Y. Heisler, Chrm. Town of Wappinger Planning Bd. MR. HEADY moved that the recommendation on the Howard Prager Rezoning Petition from the County Planning Board and the Town Planning Board be accepted and the rezoning petition be denied. Seconded by Mr. Finnan. Motion Unanimously Carried MR. HEADY moved that the recommendation on the John Holler Rezoning Petition of the Town Planning Board be accepted and the rezoning petition be denied. Seconded by Mr. Finnan. Motion Unanimously Carried MR. CLAUSEN moved that December 30, 1968, 8:00 P.M. be set for the Annual Audit Meeting. Seconded by Mr. Heady. Motion Unanimously Carried A report was received from Rudolph E. Lapar, Consulting Engineer, on the Boral Sewage Disposal Corporation Sewage Treatment Plant estimate. Mr. Diehl ordered the report be received and placed on file. Mr. Robert L'Archevesque, County Representative, came before the Board and gave a report on the County Board of Representatives Meeting (Dec. 9, 1968). Most of the business concerned County. The, only pertinent thing to the Town was a Resolution regarding the Village of Wappingers Falls in connection with the Sanitary Landfill Mr. L'Archevesque said the Resolution had not been acted on, and that the County Committee would like to meet with the Town Board and review the operation with them Friday, 12-13-68, at 3:00 P.M. at the Landfill Site. Mr. Diehl commented on the -Landfill operation, stating that Mr. Horton, this day, had taken snow fence to the site, and the Board has author- ized Mr. Horton to hire an extra man to police the site at the times when the site is open. Mr. Lapar and Mr. Diehl are also meeting with the Dutchess County Health Department on Thurs, 12-12-68 in regard to achieving better operations at the Landfill Site. A letter was received from the Wappinger Women's Republican Club complimenting the Board on voicing an opposition to the salary increases proposed by the County Board of Representatives. Communications were received from W. B. Vogel, District Maintenance Engineer, New York State Department of Transportation, regarding turning over sections of old Route 9 to the Town. MR. CLAUSEN moved that communication be sent to Mr. Vogel in connection with old Route 9, stating that the Town is unhappy with the present situation and the Board directs the Attorney to the Town, the Highway Superintendent and the Engineer to the Town to further discuss the problems that are existing at the present time, in relation to Route 9. Seconded by Mr. Finnan. Motion Unanimously Carried The following letter was received: Nov. 26, 1968 Town Board Wappingers Falls Town Hall Wappingers Falls, New York Subject: Plan to Construct a Drainage Pipe Behind Kretch Circle Street Gentlemen: We, the undersigned, residents of Kretch Circle Street, hereby bring to your attention the improper planning of the subject drainage pipe. Under the present plan, the drainage will be constructed across our properties within twenty-five yards from our houses. The drainage will be about 500 feet long and will involve the use of explosives during the construction. • From the point of view of our personal property rights, safety and financial efficiency, we request the town authorities to investigate other methods and routes for the drainage and compare with the present plan. As an example, we propose to connect the drainage directly with a creek that lies about 100 feet away from our properties. We hope full cooperation from you and look forward for a proper solution. Thank you. Signed by Residents of Kretch Circle (2) Mr. Lapar said he had discussed this situation with Mr. Horton and they both feel that the drainage should go in. the Road where it is at all possible. A letter was received from the New York State Federation of Official Planning Organizations stating that certificates were awarded to Eugene Schuele, Robert Steinhaus and Robert Heisler for attending the entire series of sessions. Mr. Rappleyea reported on Amherst Lane, noting that the case is #2 for the December term, and that either way, (settled by the court or outside) it should reach a conclusion this month. MR. DIEHL moved, in regard to the leaking oil problem in Oakwood Knolls. Development, that a letter be sent to the Dutchess County Health Department and the New York State Department of Health asking them to take immediate action against Mobil_ Oil Company for neglect in their plant, or oil lines, or storage tanks containing fuel oil in Oakwood Knolls Development, Town of Wappinger. Seconded by Mr. Heady. Motion Unanimously Carried Mr. Diehl commented that ground work has been started on solving the Oakwood Knolls Road problems and he feels that at the next meeting further action will be taken along these lines. MR. CLAUSEN moved the rules be suspended to bear from Mr. Versace, Seconded by Mr. Finnan. Mr. Versace commented that he hoped, the Board would take some action on the Oakwood Road problem, and also, a letter had been sent by the Oakwood Civic Association requesting a meeting with the Board. Mr. Diehl asked the Association indulgence with regard to this meeting until the Board cleared up a few pressing items. Motion made by MR. CLAUSEN, seconded by Mr. Heady to resume Rules, and carried. The folloWing Resolution was offered by MR. HEADY, who moved its adoption: RESOLUTION OF THE TOWN BOARD OF THE TOWN OF WAPPINGER, AUTHORIZING PURCHASE OF LANDS FOR ROAD PURPOSES IN THE TOWN OF WAPPINGER WHEREAS, the Town Highway Superintendent has requested the Town Board to acquire a parcel of land located in the Town of Wappinger from Robert J. Lawson and Anna M. Lawson; for the purpose of widening the road known as River Road, and WHEREAS, Robert J. Lawson and Anna M. Lawson have agreed to accept the sum of $500.00 in full payment for all their right, title and interest in and to the same parcel, NOW, THEREFORE, BE IT RESOLVED, that the Supervisor of the Town of Wappinger is hereby authorized and directed to pay to Robert J. Lawson and Anna M. Lawson, the sum of $500.00 upon the delivery to the Town of Wappinger of a full covenant warranty - deed covering the following described parcels: Parcel 1 Beginning at a point on the northerly edge of the existing pavement, said point being distant 5 feet northerly, measured at right angles from Station 27446 of the hereinafter described base line of the proposed reconstruction of River Road; and running thence along a stone wall North 38-30-00 West 18 feet more or less to a point 17 feet northerly measured at right angles from Station 27+56; thence through lands of Edmonds, the grantor herein, South 70-31-20 West 391.55 feet to a point 18 feet northerly from Station 31+46; thence North 84-47-10 West 334.44 feet to a point 41 feet northerly, measured at right angles from Station 34+91; thence South 76-47-10 West 327.99 feet to a point 24 feet northerly, measured at right -angles from Station 38+07; to a point at the corner of a chain link fence,thence South 10-35-00 East 22 feet more or less to a point 3 feet northerly, measured at right angles from Station 38+07, to edge of the existing pavement; thence Easterly along the northerly edge of the existing pavement 915 feet more or less to the point of beginning, containing 0.493 acres of land to be the same more or less. HEADY moved the Rules be suspended to permit questions from the floor, seconded by Mr. Clausen and carried. There were some questions regarding the County Sewer plans. The New York Telephone Company plans for enlarged toll free calling areas. Mr. L'Archevesque asked if the Board would consider adopting a position regarding the toll free calls, and forward it to the County for the Dec. 18 Public Hearing. MR. FINNAN moved the rules be resumed. Seconded by Mr. Clausen and carried. Mr. Finnan stated that he had had an inquiry regarding a street light in Hughsonville that Central Hudson relocated. It was formally between the Hughsonville Fire House and Route 9D, it now is located East of the Fire House lighting only a couple of vacant fields. He requested the Lighting Committee look into it and report back to the Board. Mr. Diehl asked Mr. L'Archevesque if anything has developed at the County level on the traffic control light at the intersection of All Angels Hill Road and Myers Corners Rd. Mr. L'Archevesque commented that there wasn't enough traffic to warrant a control there. Mr. Finnan still maintains the problem was created by the realignment of Myers Corners Road. Mr. Diehl referred the problem to the Highway Committee and Mr. Horton to set up a meeting with Mr. L'Archevesque and the County Commission of Highways to investigate all dangerous intersections. MR. CLAUSEN moved the rules be suspended to permit discussion from the floor, seconded by Mr. Finnan and carried. Mr. Bisom asked if a road count had been made on Myers Corners Road, and when the rest of Myers Corners Road would be finished. There was also some discussion about speed limits on County Roads in Wappinger. Mr. Horton stated he was hopeing for a further check possible speed limit reductions, with Mr. L'Archevesque. MR. HEADY moved the rules be resumed, seconded by Mr. Clausen and carried. MR. CLAUSEN moved the meeting be adjourned, seconded by Mr. Heady and unanimously carried. Meeting adjourned at 9:25 P.M.
