Adjournment 22 The Regular Meeting of the Town Board of the Town of Wappinger was held on Tuesday, Nov. 12, 1968, at the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:12 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman G. Donald Finnan, Councilman Leonce Heady, Councilman James Mills, Jr. Councilman Elaine Snowden, Town Clerk Others Present: Rudolph Lapar, Engineer to the Town Allan Rappleyea, Attorney to the Town MR. FINNAN moved that the minutes of the Regular Meeting of Oct. 14 and the Special Meeting of Oct. 28, as submitted by the Town Clerk be and they are hereby approved. Seconded by Mr. Clausen. Motion Unanimously Carried The Board received copies of the Town Justices and Supervisor for the month of October. MR. CLAUSEN moved the Town Justices and Supervisors' reports be received and placed on file. Seconded by Mr. Heady. Motion Unanimously Carried Bills in the following amounts were presented: General Fund Highway $14,384.22 Rockingham Farm $ 292.41 12,217.01 OkSd 125.54 OKWD 186.43 MR. CLAUSEN moved the bills be paid, subject to audit. Seconded by Mr. Mills. Motion Unanimously Carried A letter from Ben -Allen Breslow, Attorney for Mr. Rawls (Roberts Running Creek Mobile Park) was received, concerning the drainage problem at the Rawls property on Montfort Rd. and Pye Lane. Mr. Diehl reported that Mr. Lapar and Mr. Horton have contacted Mr. Rawls and at this point the problem has been resolved. The following letter was received from the Planning Board: 421 October 28, 1968 Town Board Town of Wappinger Wappingers Falls, New York Gentlemen: As requested in your letter of September 18th referring Mr. Ludewig's September 9th letter to us, for review and recommendation, we suggest the following: 1) As suggested by Mr. Ludewig, a 7 ft. high stockade fence and such plantings as shall be deemed appropriate to render the site esthetically pleasing should be required as a mini- mum screening around a private sewage disposal plant which is part of a Site Plan application. The Planning Board will act according to this recommendation in reviewing all such future Site Plans. 2) As for the suggestion that a certified check in the amount of $3,000 be deposited with the Town Clerk for the purpose of completing any unfinished work, the Planning Board does not feel any recommendation falls; within their purview. CLAUSEN moved that the Town Board concurred in the Planning Boards' recommendation that the Planning Board require a 7 ft. high stockade fence, and such plantings as shall be deemed esthetically pleasing, as minimum screening around private sewage disposal plants as a part of Site Plan application to be effective immediately. Seconded by Mr. Finnan. Motion Unanimously Carried MR. CLAUSEN moved that the Town Board and Planning Board shall require a $3,000.00 certified check, as a cash bond, from developers receiving consents for private sewage disposal plants, to be placed in escrow, to guarantee the safe and adequate performance of the plant. Seconded by Mr. Finnan. Motion Unanimously Carried Martin Leskow, Chairman of the Board of Assessors requested permission for Mrs. Gladys Timbo, clerk to the Board, to attend the annual confer- ence on Assessment Administration in Buffalo, January 19 to 22, 1969. MR. MILLS moved that Mrs. Timbo be granted p-ermission to attend this conference and that her legitimate expenses be a Town charge. Seconded ,s 22'2 by Mr. Heady. Motion Unanimously Carried The following letter was received: November 7, 1968 Town Board Town of Wappinger Town Hall Mill Street Wappingers Falls, N.Y. Re: Cornell v. Town of Wappinger Gentlemen: Previous to this time, we successfully defended the above captioned mandamus proceeding in the New York Supreme Court. In an opinion handed down by Mr. Justice Hoyt, the proceeding was dismissed with costs. A judgment in favor of the Town was entered on that decision on October 7,1968. The petitioners Cornell and Eck have filed a notice of appeal to the Appellate Division of the New York Supreme Court. A copy of the same is enclosed herewith. We think that the appeal lacks merit and that it should be defended. Accordingly, we request that you authorize this firm to pro- ceed with the defense of the subject appeal. Authorization may be granted by a simple voice motion made -and carried by a simple major- ity at any regular or special Town Board meeting. FINNAN moved to authorize the firm of Quinn & Reilly to take action necessary to defend the appeal taken to the Appellate Division of the New York Supreme Court in the proceedings entitled Cornell & Eck v. Town of Wappinger, in relation to the formation of the sewer district and the landfill operation. Seconded by Mr. Heady. Motion Unanimously Carried Informal bids had been solicited for the installation of radiators for the Supervisors' Office. MR. MILLS moved to accept the bid of Shaker, Travis & Quinn for the price of $554.00 for installation of radiators in the Supervisors Office. Seconded by Mr. Finnan. Motion Unanimously Carried. The Board having requested the relocation of a street light at the intersection of New Hackensack and Jackson Rds: 223. MR. FINNAN moved to authorize Central Hudson to make the change of the intersection street at New Hackensack & Jackson Rds, street light #15 and the additional rental of one pole @ $12 per year. Seconded by Mr. Clausen. Motion Unanimously Carried The following Resolution was offered by MR. HEADY who moved its adoption: RESOLUTION AUTHORIZING THE SUPERVISOR OF THE TOWN OF WAPPINGER TO EXECUTE AGREEMENT BETWEEN VILLAGE OF WAPPINGERS FALLS AND THE TOWN OF WAPPINGER WHEREAS, the Village of Wappingers Falls has requested the Town of Wappinger to consent to its use of the present premises rented from the County of Dutchess as a landfill site, and WHEREAS, there is attached hereto an agreement setting forth the terms for such agreement, now therefore BE IT RESOLVED, that the Supervisor of the Town of Wappinger is hereby authorized and directed to execute said agreement on behalf of the Town of Wappinger. Diehl Wappinger Town Supervisor Mill Street Wappingers Falls, New York 12590 Dear Mr. Diehl: This is in reply to your letter of October 23 concerning a special census of the town of Wappinger. The enclosed forms outline the procedure used and indicate the data collected in a special census. The estimated cost of a special census of Wappinger, based on your population estimate of 19,500, is $4,555. The total cost is divided two ways. The town should send to this office a check for $1,840, made payable to Census, Department of Commerce. Later the town should pay the balance of the cost directly to local persons when such payment is certified by the special census supervisor. For use in the census, we shall need eleven copies of the map of Wappinger on a scale of approximately one inch to 1,200 feet showing the present town boundaries. On one copy of the map, the town boundaries should be outlined in color and certified to be correct by a town official. In addition, we shall need five copies of the map of that part of Wappingers Falls village in Wappinger town on a scale of approximately 1 inch to 800 feet showing the present cor- porate limits. The boundaries and effective date of any annexations to the village since March 18, 1965, should be shown_on one copy of the map. The corporate limits should be outlined in color on one copy and certified to be correct by a village official. Please give us the name and title of the local official authorized to sign a formal agreement for the census, and a telephone number where he can be reached. In order to conduct the census between March 15 and May 15 in accord- ance with New State State Law, we shall need to have the initial pay- ment and maps no later than January 15. Ross Eckler Director Bureau of the Census RESOLUTION FOR SPECIAL CENSUS FOR THE TOWN OF WAPPINGER The following resolution was offered by Councilman Mills who moved its adoption: WHEREAS, the Town of Wappinger has experienced substantial growth in population since 1965 and WHEREAS, it has been estimated that the cost of a special census would be $4,555.00, now therefore, BE IT RESOLVED, that the Supervisor is hereby authorized and directed to request the United States Department of Commerce to conduct a special census in the Town of Wappinger at the earliest feasible time. Seconded by: Councilman Clausen Dated: Nov. 12, 1968 Roll Call Vote: Supervisor Diehl Aye Councilman Clausen Aye Councilman Finnan Aye Councilman Heady Aye Councilman Mills Aye RESOLUTION FOR TRAFFIC SURVEY ON ROUTE 9 IN THE TOWN OF WAPPINGER The following resolution was offered by Supervisor Diehl who moved its adoption: WHEREAS, the intersection at Route 9 and Hopewell Road and Rt.9 and Myers Corners Road have a heavy traffic flow and are frequently used by school buses and 22 5 WHEREAS, the divided type highway makes it difficult for traffic to make a left turn to cross the opposite land of traffic, NOW, THEREFORE BE IT RESOLVED, that the Town of Wappinger hereby requests the New York State Department of Transportation to conduct a traffic survey on said highway to determine the feasibil- ity of installing traffic lights for the express purpose of controll- ing left turns. He thought a new public hearing to change local laws before the Public Hearing before the Public Hearing on the Establishment of a Sewer Improvement could be set. Charles Cortellino asked about the inclusion of the KB&M on MacFarlane Road. Mr. Cornell commented that the Town already can have one sewer plant for one dollar, how is it justifiable then to purchase it for $206,000. He hopes the Board will reverse its' stand on this. Mr. Eck made reference to a draft of a resolution that had an inclu- sion in handwriting "pursuant to Article 12c" wanting to know who had written it in. He then mentioned having been late with a request to be put on the Agenda for this meeting and stated that the Town of Wappin- ger Taxpayers Association would submit a letter to be put on the Agenda perpetually. Mr. Diehl stated the Board would still require a letter each month requesting to be put on. Mr. Eck went back to the Sewer District discussion by saying he couldn't find out who authorized Mr. Quinn to include the $206,000 that was in the Engineering Report. Mr. Fulton asked if the Board was being legally advised that the Town has a contract in force to purchase L&A Filtration Corp. He also asked if it was the understanding of the Board that the Town has established a dump at the Airport or established a Landfill. Mr. Diehl retorted the Town has a Sanitary Landfill at the County Airport. Mr. Lafko brought up Resolution #34, 1967 saying that if the Town was using this same resolution it was travelling illegally, that that resolution died when Audit & Control denied the original application. MR. MILLS moved the rules be resumed. Seconded by Mr. Finnan and unanimously carried. Mr. Clausen brought up the interference on cablevision that numerous people were experiencing. It was his feeling that if you are hooked up to Cable TV there shouldn't be interference; one is paying for a service that one isn't getting. If there is a problem and the cable company can't find it, obviously they aren't meeting their committment, 22 7 it would seem then that it would come back to the Town Board and the fulfillment of the agreement. CLAUSEN moved that a letter be sent to Mr. Ed Valentine, Chairman of the CATV Committee, asking him if he wouldn't look into the situation, and report back to the Board his recommendation as to what might be done.
