1968-10-28 SPMA Public Hearing was held on October 28, 1968 by the Town Board of the Town of Wappinger, Mill Street, Wappingers Falls, New York on the proposed 1969 Town of Wappinger Budget. Supervisor Diehl called the Public Hearing to order. Present: Louis Diehl, Supervisor Louis Clausen, Councilman G. Donald Finnan, Councilman Leonce Heady, Councilman James Mills, Jr. Councilman Elaine H. Snowden, Town Clerk Others Present: Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town William Horton, Superintendent of Highways Supervisor Diehl opened the Hearing at 8:08 P.M. The Clerk offered for the record the Affidavits of Posting and two publications, duly signed and notarized (affidavits on file \ in the office of the Town Clerk) . The following N otice of Hearing was read: Notice is hereby given that the preliminary budget of the Town of Wappinger for the fiscal year beginning January 1st, 1969, has been completed and filed in the office of the Town Clerk,• at Town Hall, Mill Street, Wappingers Falls, N.Y. where it is available for inspection by any interested person at all reasonable hours. Further notice is hereby given that the Town Board of the Town of Wappinger will meet and review said preliminary budget and hold a public hearing thereon, at the Town Hall, at 8 o'clock P.M. on the 28th day of October 1968, and that at such hearing any person may be heard in favor of or against the preliminary budget as compiled or for or against any item or items therein contained. Pursuant to Section 113 of the Town Law, the proposed salaries of the following town officers are hereby specified as follows: Supervisor $4,500 Justice of the Peace 2,700 Justice of the Peace 2,700 Councilman (4) each 1,500 Town Clerk 6,100. Supt. of Highways 8,400 Supervisor Diehl asked if there were any persons present who wished to be heard. Mr. Richard Rose„ secretary of the Taxpayers' Association, Anvil Court, asked about the increase in the budget on Town Buildings 21 4 6 V 215 and Offices" expenses. Mr. Frank Benn, Route 9, asked for a breakdown on these increased expenses; reason for increase in "Assessors, Contractual & Other Expenses"; questioned attorneys fees, whether it meant an increase for the Town Lawyer. Mr. Rose said he had understood there was no building proposed for Recreation, why the increase, objecting to so much being spent on ball fields. Mr. Benn asked what "youth" under Recreation covered, and under "Revenues" what constituted the increase in fines, fees etc. Mr. Cornell and Mr. Benn challenged the low estimate of Mortgage Tax anticipated. Charles Cortellino, Russ Place, asked how much was spent on Recreation in 1968 - Oakwood Knolls Water District, what is the ' revenue from this District to this point for this year and also on the Sewer District. Mr. Benn questioned the appropriation for Sanitary Landfill. Mr. Benn and Mr. Rose asked about the unexpended kalance in the Highway Budget, why, if there was that much left this year why can't the 1969 Budget be cut by that amount. Discussion continued along this vein - surplus funds and unexpended balances being applied against the '69 Budget between Mr. Benn, Mr. Rose, Mr. Rappleyea and the Board. Mr. Lafko asked about the legality of including an appropriation for Landfill. He asked if the Attorney had advised them if the Town has the legal right, under the present landfill set-up, to appropriate the $25,000? He felt the Board was putting forth an illegal budget. He referred to Section 64 of Town Law as basis for his statement. Mrs. Alfred Cottrell, Eck Drive, was disturbed about the cut in the Planning Board Budget, referring to exclusion of monies for a planning consultant. MR. Notice of Special Meeting having been given by postcard, sent to each Board member and mailed at the Wappinger Postoffice on October 24, 1968. Supervisor Diehl called the meeting to order at 10:04 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman G. MILLS moved that the regularly scheduled Board meeting for November 11, 1968 be rescheduled for November 12, 1968, due to the fact that November 11 is Veterans Day. Seconded by Mr. Heady. Motion Unanimously Carried The Board was informed that Mr. Elting Scott, an Assistant Dog Warden, had resigned. MR. DIEHL moved that James Guarino, All Angels Hill Road, be appointed Assistant Dog Warden. Seconded by Mr. Heady. Motion Unanimously Carried. The Board was informed of the resignation of Norma Clark as an Election Inspector (D) in District #13. MR. MILLS moved that Helen Hildebrandt be appointed as a Democratic Election Inspector in District #13 to fill the vacancy created by the resignation of Norma Clark. Seconded by Mr. Finnan. Motion Unanimously Carried RESOLUTION OF TOWN BOARD ADOPTING ANNUAL BUDGET WITHOUT AMENDMENT The following resolution was offered by Councilman Clausen who offered its adoption: _ WHEREAS, this Town Board has met at the time and place specified in the notice of public hearing on the preliminary budget and heard all persons desiring to be heard thereon; now therefore, be it 219 RESOLVED, that this Town Board does hereby adopt such preliminary budget as originally compiled, as Liie annual budget of this Town for the fiscal year beginning on the 1st day of January, 1969, and that such budget as so adopted be entered in detail in the minutes of the prOceedings of this Town Board, and be it FURTHER RESOLVED, that the Town Clerk of this Town shall prepare and certify, in duplicate, copies of said annual budget as adopted by this Town Board, together with the estimates, if ahy adopted pursuant to Section 202-a, Subd. 2, of the Town Law and deliver one copy thereof to the Supervisor of this Town to be presented by him to the County Board of Representatives of this County. Seconded by: Councilman Finnan Dated: Oct. 28, 1968 Roll Call Vote: Supervisor Diehl Aye Councilman Clausen Aye Councilman Finnan Aye Councilman Heady Aye Councilman Mills Aye Mr. Clausen answered the question Mr. Lafko brought up in the Public Hearing regarding the legitimacy of the budgetary item on Landfill, stating that after discussion with the Attorney to the Town, the Board felt they have adopted a legal Budget. He also made comment to Mr. Cornell regarding the Performance Bond on Section II of Wildwood Forest:indicating that it appeared this bond had expired. Mr. Cornell replied that it hadn't run out, if it had been renewed. It was agreed the matter would be further checked. MR. MILLS moved the meeting be adjourned. Seconded by Mr. Heady.
