204 The Regular Meeting of the Town Board of the Town of Wappinger was held on Monday, October 14, 1968 at the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:07 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman G. Donald Finnan, Councilman James Mills, Jr. Councilman Absent: Leonce Heady, Councilman Others Present: Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town William Horton, Superintendent of Highways MR. MILLS moved that the minutes of the Regular Meeting of September 9, and the Special Meeting of September 26, 1968, as submitted by the Town Clerk, be and they are hereby approved. Seconded by Mr. Finnan. Motion Unanimously Carried The monthly reports from the Building Inspector, Supervisor and •Town Justices -were received. MR. CLAUSEN moved they be accepted and placed on file. Seconded by Mr. Finnan. Motion Unanimously Carried Bills for the month of September were presented in the following amounts: General Fund Highway $14,883.57 21, 723.14 Oakwood Sewer $406.49 Oakwood Water 187.15 Rockingham 701.76 MR. MILLS moved the bills be paid subject to audit. Seconded by Mr. Clausen. Motion Unanimously Carried Mr. L'Archevesque, County Representative, reported to the Board on the County Board of Representatives meeting. Rules were suspended, on motion of MR. DIEHL, seconded by Mr. Mills and carried, to permit questions directed to Mr. L'Archevesque from Mr. Bisom and Mr. Cortellino. 205 MR. CLAUSEN moved the rules be resumed. Seconded by Mr. Mills and carried. The resignations of Mary Egan (D) and Janice Stafford (R) as Election Inspectors left vacancies in Districts 9 and 4. MR. MILLS moved that Alice Liebermann be appointed as a Democratic Election Inspector in District 9, and Tenna Jensen be appointed as a Republican Election Inspector in District 4. Seconded by Mr. Clausen. Motion Unanimously Carried Petitions for the rezoning of parcels of land were received from John Holler, Howard Prager, and John Vorndran. MR. FINNAN moved these three petitions be referred to the Town of Wappinger Planning Board and the Dutchess County Planning Board for their review and recommendation. Seconded by Mr. Clausen. Motion Unanimously Carried A letter was received from Judge Bulger, Town Justice, regarding a trial for a violation of the Town Dog Ordinance and requesting information as to whom the Board plans appoint as prosecutor. MR. CLAUSEN moved the letter be accepted and placed on file. Seconded by Mr. Mills. Motion Unanimously Carried Notice of Claim was received from Paul F. Diggins, Brian C. Brown versus Town of Wappinger. MR. MILLS moved it be accepted and placed on file. Seconded by Mr. Clausen. Motion Unanimously Carried A request for permission for three members of the Planning Board to attend the New York State Federation of Official Planning Organiza- tion Meeting, October 20 to 22, 1968, South Fallsburg, New York, was received. MR. CLAUSEN moved permission be granted to three members of the Planning Board to attend this meeting and that their legitimate expenses be a town charge. Seconded by Mr. Finnan. Motion Unanimously Carried 206 Three communications were received from the law firm of Quinn & Reilly 1, advising of the examination of validity of the $43,300.00 Revenue Anticipation Renewal Note #1, 1968, 2, advising of the examination of validity of the $9,040 Tax Anticipation Renewal Note #1, 1968, 3, Informing the Board of Justice Hoyts' decision, special term of the New York Supreme Court, Aug. 15, concerning the Cornell & Eck mandamus proceedings ("there is absolutely no basis for granting any of the relief sought or indeed for commencing this proceeding. The petition is dismissed with costs to the respondent. )" MR. FINNAN moved the correspondence from Quinn & Reilly be accepted and placed on file. Seconded by Mr. Mills. Motion Unanimously Carried A letter of thanks from Mr. John Schouten to the Superintendent of Highways for straightening the bad curve on Ketchamtown Rd. was received and read. MR. MILLS moved the letter be accepted and placed on file. Seconded by Mr. Clausen. Motion Unanimously Carried Mr. Diehl ordered the following letter placed on record: September 24, 1968 Town Board Town of Wappinger Wappingers Falls, N.Y. Gentlemen: Herewith enclosed is a copy of the Order from Audit and Control denying the application of the Town of Wappinger for permission to establish Town of Wappinger Garbage District, which this day has been received and duly filed in my office. Snowden Town Clerk An answer to the Boards' request for further traffic control (signal light) at the intersection of Myers Corners Rd. and All Angels Hill Rd. was received from Edgar M. Petrovits, Commissioner of Dutchess County Dept. Public Works. Mr. Petrovits stated that he wasn't allowed to erect traffic signals, nor pay for their maintenance. 207 - Mr. Diehl ordered the letter placed on file. A recommendation from the Planning Board concerning engaging a Planning Consultants Services was received. MR. FINNAN moved a letter be forwarded to the Planning Board denying their request, as there were no funds allocated in the 1969 Budget for this service. Seconded by Mr. Mills. Motion Unanimously Carried The following letter was received: October 10, 1968 Town Board Town of Wappinger Mill Street Wappingers Falls, New York Re: Rockingham Sewer District Sand Filters Attention: Supervisor Diehl Gentlemen: We have received approval of all contract documents relating to the Rockingham Sewer District Sand Filter construction and authority to bid. This approval was transmitted by phone from Mr. Robert Holland of the Federal Water Pollution Control Administration. A letter of authority to bid will follow. The Rockingham District may now advertise for and receive bids on this project. Please advise us as to preferred advertising date and bid receipt date. Yours truly, s/ Vincent C. Kelley, P.E. MR. CLAUSEN moved this matter be turned over to the Attorney to the Town for further study and answer. Seconded by Mr. Finnan. Motion Unanimously Carried The following letter was received: October 10, 1968 Town Board Town of Wappinger Wappingers Falls, New York Re: Mr. Ted C. Olsen 10 Russ Place Town of Wappinger Gentlemen: Mr. Ted C. Olsen requested me to write to you regarding a 208 certain problem regarding the sewage line in the street in front of his premises, which affects his house. The engineers that Mr. Olsen has spoken to indicate that the L&A Filtration lines which are presently receiving sewage from individual houses, is on a bad pitch, which creates a backup condi- tion in the houses and, more, particularly, Mr. Olsen's house. This is to notify you officially of this condition and request that prior to any purchase of the L&A Filtration system by the Town, that this condition be corrected by L&A Filtration so that it will not be necessary to be an expense upon the Town, if they purchase same. Motion Unanimously Carried Proposed Rules, Regulations & Ordinances, Town of Wappinger, Various Sewer Districts, was submitted by Rudolph Lapar, Engineer to the Town. MR. CLAUSEN moved Mr. Lapars' proposed Rules & Regulations be accepted and referred to Mr. Rappleyea, Attorney to the Town. Seconded by Mr. Finnan. Motion Unanimously Carried A letter from James V. Porter had been received, asking for discussion with the Board regarding the need for playing fields for Senior Little League. The Board asked Mr. Porter if he cared to make comment. Mr. Porter said he had hoped to discuss this with the Board prior to the establishment of the Town Budget, as the league had hoped to see the Town spend more money to enlarge this program. MR. CLAUSEN moved that a letter be directed to the Recreation Commission stating that the Town Boards' position would be that of establishing ball fields be given high priority. Seconded by Mr. Mills. Motion Unanimously Carried Mr. Mills reported for the Tax Committee on his investigation into the possibilities of tax payments in quarterly or third payments. He had contacted several several surrounding Towns, and most were still receiving the single payment, he intends to pursue the subject further, 209 to ascertain whether it would benefit the residents, or put another undue burden on them. Fleetwood Application Resolutions was tabled until Attorney for the District arrives. MR. CLAUSEN moved the Supervisor be authorized and empowered to transfer the following budget accounts: The sum of $1,900.00 has been appropriated to account 1008 (Youth Agency - Equipment). This account has been overexpended andoverdrawn by the sum of $242.68 in order to meet bills presented for payment. The additional monies were obtained from 1009 (Youth Agency - Other Contractual). We therefore recommend that the Town Board authorize the transfer of the sum of $242.68 from 1009 (Youth Agency - Other Contractual) to account 1008 (Youth Agency - Purchase of Equipment) in order to eliminate the overdraft and reimburse said account and in order to rectify and confirm the previously unauthorized appropriation. The sum of $600.00 has been appropriated to account 607 Bonds. This account has been overexpended and',overdrawn by the sum of $640.00 in order to meet bills presented for payment. The additional monies were obtained from account 1202 (Contingency). We therefore recommend that the Town Board authorize the transfer the sum of $640.00 from 1202 (Contingency) to account 607 (Bond) in order to eliminate the overdraft and reimburse said account and in order to rectify and confirm the previously unauthorized appropriation. The sum of $3,500.00 has been appropriated to account 608 (fire and Liability). This account has been overexpended and overdrawn by the sum of $255.13 in order to meet bills presented for payment. The additional monies were obtained from account 1202 (Contingency). We therefore recommend that the Town Board authorize the transfer of the sum of $255.13 from 1202 (Contingency) to account 608 (Fire and Liability) in order to eliminate the overdraft and reimburse said account and in order to rectify and confirm the previously unauthorized appropriation. The sum of $3,500.00 has been appropriated to account 1302 (Town Share - Employees Retirement). This account has been overexpended and overdrawn by the sum of $268.78 in order to meet bills presented for payment. The additional monies were obtained from account 1311 (Contingency). We therefore recommend that the Town Board authorize the transfer of the sum of $268.78 from 1311 (Contingency) to account 1302 (Town Share - Employees Retirement) in order to eliminate the overdraft and reimburse said account and in order to rectify and confirm the pre- viously unauthorized appropriation. 2 1 0 The sum of $1,000.00 has been appropriated to account 1307 (Town Share - Printing and Advertising). This account has been overexpended and overdrawn by the sum of $178.78 in order to meet bills presented for payment. The additional monies were obtained from account 1311 (Contingency). We therefore recommend that the Town Board authorize the transfer of the sum of $178.78 from account 1311 (Contingency) to account 1307 (Town Share - Printing and Advertising) in order to eliminate the overdraft and reimburse said account and in order to rectify and confirm the previously unauthorized appropriation. The sum of $8,000.00 has been appropriated to account 1308 (Attorney Fees). This account has been overexpended and overdrawn by the sum of $541.66 in order to meet bills presented for payment. The additional monies were obtained from account 1311 (Contingency). We therefore recommend that the Town Board authorize the transfer of the sum of $541.66 from account 1311 (Contingency) to account 1308 (Attorney Fees) in order to eliminate the overdraft and reimburse said account and in order to rectify and confirm the previously unauthorized appropria tion. Seconded by Mr. Mills Roll Call Vote: Supervisor Diehl Aye Councilman Clausen Aye Councilman Finnan Aye Councilman Mills Aye Recommendations from the Dutchess County Planning Board and the Town Planning Board on the rezoning petition of Stella & Phillip Dominicus was received. MR. CLAUSEN moved to accept the correspondence and place on file until the several other rezoning request recommendations are received. Seconded by Mr. Finnan. Motion Unanimously Carried Mr. Walter Cronin had requested to speak again to the Board concerning Section II Wildwood Forest. He stated again his problem was due to lack of proper grading and backfilling. He had written Mr. Cornell and has not received an answer. He reiterated his request to the Board, that the Engineer and Building Inspector withhold final approval of this subdivision until his property conforms to the master drainage plan. Mr. Lapar reported that he and Mr. Horton agree and give the same recommendation they gave at last months meeting, that at the time Mr. Cornell asks the Town to take over the roads they will then go and see 2 1 1 if everything is alright. Mr. Eck had requested to speak to the Board on behalf of the Taxpayers Association of Wappinger concerning the North Wappinger Sewer District and the Landfill District. The Board requested he state all of his questions, then he would receive the answers. His first question was what were the notes referred to earlier in the meeting that Mr. Quinn had written the Board about? What Section of Town Law was Fleetwood Water & Sewer Districts filed under and how long did it take? How come the North Wappinger Sewer District has taken two years or more? Has any new application been made? Is a new engineering study being made under 12C? Does the Board know the difference between Article 12A and 12C? Was it the intention that this district be only paid for , maintenance and cost, by the enclosed area of the District, not the entire Town? Then to Mr. Lapar, who first alerted him he should be working a study under Article 12C, is it a fact under 12C a new study is necessary regarding cost operations and repairs? How long should it take to make the new study to apportion the cost over the entire Town outside the Village? Are the study and reports that are on file with Audit & Control sufficient to file an application under 12A? Mr. Eck asked that letters from Attorney Quinn to Mr. Diehl, dated September 9, one from Mr. Quinn to Adler -Brenner dated October 4 and Adler-Brenners answer to Mr. Quinn be read. After the reading he commented that it appeared to him that Mr. Quinn wasn't moving. He then asked what was the Boards' intentions toward the Sewer District, when were they going to move. Mr. Diehl asked the Attorney to the Town to answer Mr. Ecks' questions for the Board. Mr. Diehl called for a recess at 9:25 P.M. The Supervisor called the meeting back to order at 9:31 P.M. He asked Mr. Rappleyea, Attorney to the Town to answer Mr. Ecks' questions. Mr. Eck then asked Mr. Lapar when he first knew they were to proceed under 12C. Mr. Lapar said when he spoke to Mr. Adler, after Mr. Adler had received Mr. Quinn's letter. Mr. Eck then asked how long would it take to make a new study. Mr. Lapar couldn't give any definite date. MR. CLAUSEN moved the rules be suspended. Seconded by Mills and carried. Mr. Lafko felt Mr. Rappleyea was inadvertently mistaken on several points, and there was discussion between the two about this. MR. CLAUSEN moved the rules be resumed. Seconded by Mr. Mills and carried. The Board returned to the Fleetwood Water Applications. A Resolution for application to the Water Resources Commission of the State of New York for approval of the purchase and operation of the plant and facilities contained within Fleetwood Manor Water District authorizing Supervisor Diehl to sign said application was moved by MR. MILLS, seconded by Mr. Clausen and unanimously carried. (The Resolution In the Matter of the Application for the Formation of a Water District in the Town of Wappinger is annexed hereto and made a part hereof of the minutes of this meeting.) A Resolution authorizing and empowering Supervisor Diehl to petition the Public Service Commission of the State of New York for permission to transfer the plant facilities and appurtenances of the Fleetwood Water Works Corp. to Fleetwood Manor Water District was moved by MR. CLAUSEN. Seconded by Mr. Finnan and unanimously carried. (The Resolution in the Matter of the Application for the Establishment of a Water District in the Town of Wappinger, is annexed hereto and made and part hereof of the minutes of this meeting.) The Board returned to Mr. Eck, who wished to address the Board concerning the Sanitary Landfill. He maintained that Town Law says there must be a Public Hearing and a referendum on a landfill project, but the Town claimed an emergency, although, according to an article in the newspaper the Town of Poughkeepsie now has two more years to run on their landfill, so the Town of Wappinger could have still used that - that there wasn't an emergency - so he feels the Town of Wappinger is working illegally on the landfill site. MR. MILLS moved that the Town Clerk be directed to write the County Civil Service Commission to come down to the Town of Wappinger and evaluate all the jobs that are presently enforced in the Town, to try to set up some code structure, as far as job responsibility, job classification, for future reference in setting equatable salaries. Seconded by Mr. Clausen. Motion Unanimously Carried MR. MILLS moved the Town Clerk be directed to write to the County to put up a street light at the new County Road (Jackson) where it comes into New Hackensack Rd. Seconded by Mr. Finnan. Motion Unanimously Carried MR. FINNAN moved that a letter be directed to Mr. Petrovits regarding the intersection of All Angels Hill Rd. and Myers Corners Rd. (and in answer to Mr. Petrovits' statement that the Town would have to be responsible for a traffic light at this intersection) asking for further study of this area be made, since it appears that following the County realignment of Myers Corners Rd., the incidence of traffic accidents has greatly increased. Seconded by Mr. Mills. Motion Unanimously Carried Mr. Clausen - regarding methods of taxation - stated that he felt there should be a more equatible means of taxation, the method of course should be left to legislature on state and federal levels. MR. CLAUSEN moved that the Town Board go on record as being in favor of a revised method of taxation so that the tax structure would be more equatible, and send a letter to this effect to all of the major candidates running for Congress and Senate.
