The first resident to speak was Gary Lindstrom. He stated that on the agenda was a discussion
item pertaining to Noise Ordinance. He wanted to point out that unless there is proper
measurement devices for noise levels the noise ordinance can be subjective. Unless there is a
way to measure the noise the ordinance is meaningless.

VII. Discussions
A. Rotary Club of Wappingers Falls: War Memorial at Schiathaus Park
Supervisor Gutzler introduced Jim Sedor, president of the Rotary Club. Mr. Sedor thanked Joe
Geraci, the eagle scout who volunteered to do work on the grounds around the statue, for all his
work done on the war memorial. The Rotary Club has some concerns the first of which was that
they were not mentioned at the Memorial Day Ceremony as been a local supporter of the War
Memorial, Mr. Sedor briefly explained that the Rotary Club has been maintaining the statue for
16 years when Mr. Parsons approached the Rotary Club and asked that they be trustees of the
Memorial. He stated that every year the statue is inspected and cleaned. They also are
responsible for making sure that the Town of Wappinger is doing their part in maintaining the
property that it sits on. He stated that he had a copy of Don Schwartz's report. The report
contains the finding of the inspection of the statue and grounds. He added given the
responsibilities of the Rotary, they are requesting an agreement between the Rotary and the
Town of Wappinger be drawn up. This will define what is expected from the Rotary and what is
expected from the Town. Mr. Sedor requested a meeting to work out the agreement. Supervisor
Gutzler apologized for not mentioning the Rotary at the services. She stated that after speaking to
Mr. Sedor she did run in by the Attorney to the Town, Al Roberts because she was unclear what
defined the grounds. Al Roberts explained that his understanding in the beginning was that there
would be a perpetual fund created that would keep up the treatment of the statue as needed and
the Town would maintain the grounds and the base. The trust is broad enough to include other
duties should the Town and the Rotary lead to something else. He didn't know what the
additional costs would be and if there is money available they would have to do the calculations.
He added that there should be enough money for the chemical treatments at least. Bob Gray,
Engineer to the Town, requested a copy of Don Schwartz's report. Councilwoman Czarniecki
questioned if park land trust money could be used. Al Roberts stated that park land trust money
is only to be used for Capital Improvements. Maintenance is up to the community. Councilman
Beale stated that maintenance is defined as mowing the lawn and keeping grounds. He added that
the Town was lucky to have the Eagle Scout candidate, who re leveled the bricks at the base. He
questioned what the Town is not doing that the Rotary feels the Town should be doing. Mr.
Sedor stated that some of the short comings were stated in the letter from Mr. Schwartz Given to
the Engineer. He then gave one to the board members. Supervisor Gutzler stated they would look
over the letter and work on an agreement. Councilman Beale noted that there was mention of

cracking and wondered if that was noticed before the Eagle Scout did the brick work. Mr. Sedor
state the Eagle Scout did patch the foundation but didn't do what was recommended in the letter.
He didn't take it far enough. The concrete work that was done could probable be let go for a year
and when the cracks reappear it can be epoxy. Mr. Sedor requested a meeting. Councilman Beale
questioned Al Roberts if the matter of the base concrete, would it be considered a capital
improvement. Mr. Roberts responded that he believed the epoxy treatment probably would be.
B. Noise Ordinance - Beale
Councilman Beale stated he spoke to the Attorney to the Town, Al Roberts breifly about the
Noise Ordinance. He questioned where the ordinance stands now with the adjustment and
amendments. Attorney Roberts stated that they are waiting to get them finalized with the DEP.
As the resident just said there is a certain subjective to noise. He explained the methodology and
added that there are provisions in the ordinance for violations for claiming audio able noise.
Some of the surrounding communities have and one of the communities have has their ordinance
declared unconstitutional. The Town of Wappinger will have both claim audible as well as sound
measurement through appropriate instrumentation. He added that like any code it is going to
need training, enforcement, and equipment. Councilman Bettina stated that with A&W Scrap he
has been trying to get this through for years. People have the right to quiet enjoyment and he
wanted to make sure it is in within reason. Mr. Roberts then pointed out a court of appeals case
that pointed out that noise is part of everyday living. Councilman Beale stated that he would like
to focus on individuals that have a residence in the area of a commercial establishment that is
having a band outside all day long and the ordinance doesn't speak to that. Individuals that prefer
to have a nice quiet day are now having Deaf Leopard performing in the back yard. He
questioned what could be done. He spoke to the residence who said that the state police will not
enforce Town of Wappinger Laws because they are not clear. He added that he has spoken to the
Town of Poughkeepsie Police to see how they handle the Frat parties in the residential
neighborhoods. He gave a copy of their code to the Attorney. In Poughkeepsie it states that a
decibel reading is not required to prove a violation of the chapter. Al Roberts stated that they are
on the verge of a very comprehensive state of the art noise code. Councilman Beale questioned
who will enforce it on a Sunday afternoon. Laws can be written but if they can't be enforced how
are they providing a service. Mr. Roberts stated that the enforcement would be up to the board.
Discussion continued. David Stolman, Town Planner, stated that the code is only a meeting or
two away from a draft. The code is light years ahead of what there is now. The equipment
specified in the code no longer exists. Councilman Beale questioned how other municipalities
enforce their noise ordinance without carrying a decibel meter around. He stated that he didn't
understand why there is a need for decibel meters when someone has a band playing at their bar
and people can't sit outside their home. Mr. Stolman added that it will include plainly audible as
well as decibel meters. Councilman Kuzmicz questioned if the code would include ATV's Mr.
Roberts responded that it would be included. Councilman Bettina stated that taxes are paid to
Dutchess County so he feels that Dutchess County Sheriff and the State Police should be
enforcing it. If they don't then someone should sit down and explain the code and that they
should be enforcing. Discussion continued

WHEREAS, there is now pending in the Dutchess County Supreme Court a tax certiorari
proceeding commenced in 2011 by DCH NY Imports, LLC, regarding premises located at 1271
Route 9, Grid # 6157-04-570395, seeking a reduction in the 2011 tax assessment for the
2011/2012 assessment; and
WHEREAS, the owners of the above mentioned parcel have agreed to withdraw the
petition requesting a reduction in said tax roll reduction; and
WHEREAS, the Town Assessor and Special Counsel have recommend a settlement of
this tax review proceeding; now, therefore be it

RESOLUTION: 2012-175
Resolution Ratifying Reimbursement Protocol for Fees Incurred from Town Professionals
in Connection with the Construction of a Water Main to New York City's Water Facilities
Located in Chelsea
WHEREAS, by Resolution No. 2012-163, the Town Board ratified and confirmed the
execution of an Agreement in Principle (hereinafter "AIP") between the Town of Wappinger and
the City of New York acting by and through its Department of Environmental Protection
(hereinafter "DEP"); and
WHEREAS, amongst other things, the AIP outlined the general terms pursuant to which
the Town will construct a 12 inch water main from a point of connection with the United
Wappinger Water District (UWWD) near Route 9 and Old Hopewell Road to the Chelsea Shaft
6B site (hereinafter "Shaft 6B Site"); and
WHEREAS, the AIP authorizes an advance of $100,000.00 from DEP to the Town for
the purposes of conducting preliminary studies associated with the construction of the 12 inch
water main; and
WHEREAS, on May 18, 2012, Supervisor Gutzler received a letter from the New York

City Water Board outlining the terms and conditions pursuant to which the Town would be
reimbursed for all costs and expenses associated with undertaking the preliminary studies for the
construction of the 12 inch water main; and
WHEREAS, a copy of said letter is attached hereto and made a part hereof.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby confirms and ratifies the actions of Supervisor Gutzler in
executing the aforementioned letter agreement identifying the protocol for
reimbursement of professional fees and expenses incurred by the Town for
preliminary studies and work undertaken in connection with the proposed
construction of a 12 inch water main from a point of connection with a water line
owned and operated by the UWWD to the Shaft 6B site.

RESOLUTION: 2012-176
Resolution Authorizing Town Professionals to Commence Work Associated with the
Construction of a 12 Inch Water Main to New York City's Shaft 611 Site Located in
Chelsea
WHEREAS, New York City owns and its Department of Environmental Protection
(DEP) operates New York City's water supply system, which provides, on average, 1 billion
gallons of high quality drinking water to the residents of New York City and other
municipalities; and
WHEREAS, New York City's drinking water is supplied by three (3) primary aqueducts,
one of which is the Delaware Aqueduct which passes through the Town of Wappinger
approximately 600 feet below the Hudson River; and
WHEREAS, the DEP has identified two leaks in a section of the Delaware Aqueduct and
has undertaken a project to address the leaks to assure the long term sustainability of its ability to
supply water to New York City; and
WHEREAS, the aqueduct repair project is known as the "Water for the Future" (WFF)
which involves, among other things, the construction of a bypass tunnel that will cross
underneath the Hudson River and continue through portions of the Town of Wappinger; and
WHEREAS, as a component of the WFF project, DEP will construct a new shaft on the
eastern side of the Hudson River on New York City property located in the Hamlet of Chelsea
and otherwise referred to as the "Shaft 6B" site; and
WHEREAS, the construction of the bypass tunnel and the new Shaft 6B, DEP will
require approximately 169,200 gallons of water per day commencing in the fall of 2013; and
WHEREAS, concomitantly, the Town needs to provide a source of good quality water to
the Chelsea Hamlet area, where many of the residences are located on small parcels that
currently use individual well sources that have become unreliable; and
WHEREAS, DEP proposes to contract with the Town for the construction of a 12 inch
water main utilizing the water facilities of the United Wappinger Water District (UWWD); and
WHEREAS, after the conclusion of the WFF repair project, the water main can be used
to supply water to the residents of the Chelsea Hamlet area as well as other residents of the Town
of Wappinger along the pipeline route; and
WHEREAS, the Town and DEP have entered into an Agreement in Principle (AIP),
outlining the terms and conditions pursuant to which the Town of Wappinger will construct a 12
inch water main from the point of connection with the UWWD water system located near Route
9 and Old Hopewell Road to the Chelsea Shaft 6B site; and
WHEREAS, to complete the construction of the 12 inch water main by the fall of 2013,

work in the nature of preliminary environmental, engineering and legal studies must be
commenced immediately; and
WHEREAS, in accordance with the terms and conditions of the AIP, New York City
agrees to advance up to $100,000.00 to the Town to reimburse the Town for costs it incurs for
such preliminary work.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby authorizes and directs the Engineer to the Town, Robert
J. Gray, and any members of his engineering firm, Morris Associates Engineering
and Consultants, the Attorney to the Town, Albert P. Roberts, and any members
or employees of his firm, and David Stolman of Frederick P. Clark Associates,
Planning and Environmental Consultants, and any members or employees of his
firm, to immediately undertake such preliminary engineering, legal and
environmental studies as is necessary to commence construction of the 12 inch
water main above described.
3. The Town Board further authorizes and directs Robert J. Gray, or any other
engineer associated with Morris Associates, to prepare a Map, Plan and Report for
a no cost extension of UWWD to the Shaft 6B site and further directs the
Attorney to the Town, Albert P. Roberts, Attorney Douglas E. Goodfriend, the
Town's Special District Consultant and the Planner to the Town, David Stolman,
and any members or employees of his firm, to provide any required legal and
environmental studies associated and/or needed in connection with the
preparation of the Map, Plan and Report.
4. The costs incurred by the Town for the aforementioned preliminary work and the
preparation of the Map, Plan and Report shall be reimbursed by DEP in
accordance with the letter agreement dated May 17, 2012, a copy of which
attached hereto and made a part hereof.

IX. Items for Special Consideration
A. Councilman Kuzmicz
Councilman Kuzmicz stated that he would like an update on the property maintenance
ordinances from Attorney Al Roberts. Mr. Roberts stated they are trying for the first meeting in
June.
B. Councilwoman Czarniecki
Councilwoman Czarniecki stated that she would like to get everyone involved in community
clean up or park clean up. She asked for the boards input. Supervisor Gutzler stated that maybe
the Council members could coordinate a clean up on their Roads in their wards. Councilman
Beale stated that he has a problem with Creek Road with the fisherman have been dumping their
containers. He asked Graham Foster, Highway Superintendent, if he bagged it up would the
Town Highway come along and pick it up. Mr. Foster stated that the Highway Department will
not be going around picking up county roads there isn't enough to clean up town roads.
C. Councilman Bettina
Councilman Bettina stated he wanted David Stolman to work on the Agriculture and a resolution
pertaining to it. Mr. Stolman added he believed what Councilman Bettina was referring to was
bring the local zoning in compliance with the Ag, & markets law.

D. Supervisor Gutzler
Supervisor Gutzler stated that a resident was charges $150.00 for an electrical permit when she
should only have been charge $50.00. She is requesting a refund of $100.00 The residents is
from 16 Patty Place. Councilman Beale made the motion to refund the $100.00 Seconded by
Councilman Bettina. All were in favor

Supervisor Gutzler stated her next item was also a refund request from the resident at 19 Sabra
Lane. He applied for a permit but canceled it. He is requesting a refund of $400.00. Barbara
Roberti, Zoning Administrator explained that he opened a building permit and applied for a
variance but before he went before the board his job was cut. Councilman Bettina stated that he
was told that there was a review time and money spent for the professionals reviewing the
application. Whether you build or not, you do not get your money back. He asked Attorney Al
Roberts for his opinion. Mr. Roberts stated if the application was submitted and the permit issued
he doesn't feel it was appropriate. Supervisor Gutzler stated that he is requesting a partial refund
or total. She would like to refund the $400.00 Councilman Kuzmicz made the motion to refund
the $400.00 seconded by Councilman Beale. The vote resulted in 4 AYE and 1 NAY

X. New Business
A. Councilman Beale
Councilman Beale asked how the clean up was handled in the past. He had cleaned up Creek
Road and Myers Corners Road with Supervisor Ruggiero and the Highway picked up the bags.
Graham Foster, Highway Superintendent, stated that when Supervisor Ruggiero was in office the
Highway department had two more guys and eight less subdivisions. You can't keep cutting men
and adding jobs. Councilman Beale questioned if Mr. Foster was refusing to pick up the bags of
trash. Mr. Foster stated yes they have no jurisdiction. Councilman Beale added he disagreed that
he didn't have jurisdiction and that part of the problem with the country is that everyone only
wants to take care what they are responsible for. He could not understand why the Highway
department can't pick up the bags when there are Town residents willing to pick up road side
trash. Supervisor Gutzler stated that if one of the Council members want to coordinated
something in their ward they should coordinate it with the County or the State. She agreed with
the Highway Superintendent. Councilman Beale added that he didn't understand why the
Highway person driving by couldn't stop and pick up the bags when they are driving by. Mr.
Foster stated that he would have to meet the requirements of the County. Councilman Beale
questioned how it was done in the past to which Mr. Foster responded he had two more men.
Councilman Beale added that Mr. Fosters attitude was the wrong attitude to have. He stated in
2007 the town Highway picked up the bags. Mr. Foster felt there wasn't a reason why the County
can't pick up the bags. Discussion continued
B. Councilman Bettina
Councilman Bettina questioned Barbara Roberti if any permits were given out to venders at
Robinson Lane over the weekend. She stated no. She stated she has not approved anything for a
Jewelry peddler. The Town Clerk, Christine Fulton, also stated that the clerk's office has not
issued a permit. Councilman Bettina added that he would like to find out who he paid and
approved it. The board received a picture of the vender who was at Robinson Lave over the
weekend. He added that only the board can charge a fee not Little League or anyone else. He
would like to see the venders fined and seen in court. Councilman Beale stated that Little League
was told before that a vender shouldn't be there without a permit.

C. Supervisor Gutzier
Supervisor Gutzler stated that she had approached the board about an Amnesty day for the
Recycle Center. She proposed a free day with proof of residency for June 16'h when residents can
bring bulk items free of charge. She asked the board to approve the Amnesty. Councilman
Bettina stated it was a great idea and commended the Supervisor for the idea. He proposed two
days, one day in the spring and one in the fall. Councilman Beale asked what the restrains would
be for the day. Supervisor Gutzler stated it would be a normal business day 9-12pm. Councilman
Bettina added that after all, the residents are paying for the center in their taxes. Councilman
Beale questioned what the residents would be able to bring. Supervisor Gutzler stated that they
could bring bulk items. Councilman Beale stated that he doesn't feel there is any point in having
the permit process at all if there is going to be allowed an Amnesty. There was a lot of time and
thought put into the permit process and budgets. There has already been a drop in revenue
budgeted therefore he is against the Amnesty day and prorating the permits .Councilwoman
Czarniecki stated she was not in favor of prorating the permits but she was in favor of selling the
permits annual. She suggested they be sold by quarter with each quarter being a different color.
The fee should be set up by house hold and the trailer should be folded into one fee. She feels the
fee structure needs to be reviewed because there are residents that don't fit into the guild line and
restraints that are put on it. She is not in favor of an Amnesty day but will support what the board
is in favor of. Councilman Bettina stated he is in favor of the Amnesty day. He feels the taxes are
paying for it but agreed with Councilwoman Czarniecki that the permit process needs to be
reviewed. Councilman Kuzmicz stated that there needs to be a policy. If there is going to be a
permit process then let's stick to it if there is loop holes that allows people to work around the
process than there isn't a reason to have the process. He suggested reviewing the process and
solving everything at once as appose to the making of exception to every situation when
circumstances arrise. He is not in favor of making exceptions. Supervisor Gutzler added that she
suggested the Amnesty day to help dispose of items, reestablish goodwill with the community
and it will give the board the opportunity to reevaluate the process. Councilman Beale stated that
this was a dangerous discussion to have because the same people on the board that argued that
there had to be a permit fee because it was unfair to the residents that everyone is being taxed,
are the same board members that are now arguing that there needs to be free days. There needs to
be consistence, The entire process was established to create a revenue stream to subsidies this
operation. He added that the responsible residents that bought the permits in the last quarter of
2011 and the first and second quarter of 2012 will be treated unfairly. What do you say to those
people trying to be good citizens? He stated he will not support the Amnesty Day added it is
irresponsible to even entertain the idea. Discussion continued
Supervisor Gutzler then discussed the Flood Plain maps. She stated that the FEMA maps
