Statement of Legislative Intent This ordinance is enacted in recognition of the fact that blasting operations and the use of explosives in connection therewith which are taking place in the Town can be dangerous and constitute a potential public and private nulzence. The said blasting operations are „end have been a source of potential danger to persons and property, AX are of a highly volatile nature and are obvious sources of potential physical harm to residents and others in the Town. Definitions Whenever used In this'ordinance: (a) "Board" means the Board of Standards and Appeals of the • Department of Labor of the State of New York. ,(b) "Labor Law" means the Labor Law of the State of New York. (c) "Codes", "Rules" end "Regulations" means the Codes, Rules and Regulations which are prorhulgated by the Board of Standards and Appeals of the Department of Labor of the State of New York. (d) "Explosives" means gunpowder, powders used for blasting, high i explosives, blasting materials, detonating fuses, detonators land other detonating agents, smokeless powder and any chemical compound or any mechanical mixture containing any oxidizing combustible units, ' or other ingredients in such proportions, quantities, or packing that Ignition by fire, friction, concussion, percussion or detonation of any oart thereof may and is intended to cause an explosion, but shall not' nclude gasoline, kerosene, naphtha, turpentine, benzine, acetone, rthyl ether and benzol. Fixed ammunition and primers for small arms, firecrackers, safety fuses and matches shall not be deemed to be • Ixplosives when, as may be determined by the board in its rules, the ' ndividual units contain any of the above-mentioned articles or c ubstances In such limited quantity, of such nature and so packed .• hat it is impossible to produce en explosion of such units to the 'jury of life, limb or property. (e) "Building" means any building regularly occupied In whole or In art as a habitation for human beings, and any church, school house, Hiway station or other building or place where ,people are. :customed to live, work or assemble. (f) "Person" includes natural person, partnership, association or i arporation. action 4. Licenses (a) No person shall purchase, own possess, transport or use plosives in operations in the Town of Wappinger outside the limits ,, any incorporated village therein unless a license therefor shall have en issued as provided under the Labor Law. (b) In addition to the aforementioned license, no person shall blast use any explosives in blasting operations in the Town of Wappinger', tside'the limits of any incorporated village therein unless a blaster's ansa therefor shall be issued as hereinafter provided. 5. Blaster's License blaster's license shall be issued by the Town Clerk of the !Wappinger upon application on forms prescribed by her, and • 'intent of a fee of Five ($5.00) Dollars providing the applicant I. The Regular meeting of the Town Board of the Town of Wappinger was held at the Town Hall, Mill Street, Wappingers Falls, New York, on Monday August 12, 1968. Supervisor Diehl called the meeting to order at 8:05 p.m. Present: Louis Diehl, Supervisor Donald Finnan, Councilman Jim Mills, Councilman Louis Clausen, Councilman Lee Heady, Councilman Elaine H. Snowden, Town Clerk Others Present: William Horton, Superintendent of Highways Allan E. Rappleyea, Attorney to the Town Rudolph E. Lapar, Engineer to the Town The minutes of July 8, 1968, Regular, and July 29, 1968, Special Meetings were received by the Board. MR. MILLS MOVED that the minutes as submitted by the Town Clerk be and they are hereby approved, Seconded by Mr. Clausen. Motion Unanimously Carried MR. CLAUSEN MOVED that the June and July reports from the Town Justices, Building Inspector and Supervisor be received and placed on file, Seconded by Mr. Heady. CLAUSEN MOVED that the bills be paid, subject to audit, Seconded by Mr. Mills Motion Unanimously Carried Mr. Robert L'Archevesque, County Representative, was present and gave a concise report of today's County Board Meeting, highlighting matters more pertinent to the Town of Wappinger. Among other things he reported that Mrs Rita Kasner was appointed by the Board as executive director of the Dutchess County Youth Board and in connection with this, the fact that he had introduced a resolution (which was unanimously passed) concerning the "Belly of the Whale" which will be passed on to the YOuth Board for a study to be conducted in the Wappinger area. Also, an appointment was made to the Public Defenders Office -Mr. Marshall Brenner was appointed as Deputy to the 165 Public Defender. Two Resolutions came before the Board -one author- izing the issuance of $50,000 in Serial Bonds to pay the cost of the purchase of certain lands West of the airport site (the LeRoy Property, Town of Poughkeepsie and Wappinger). This Resolution had failed. The other Resolution was on study of recreational needs in Southern Dutchess. He also mentioned his letter to Mr. Schoentag, passing along Mr. Heady's suggestion of the Merle Travis farm as a possible County recreation site. Mr. Joseph Incoronato asked Mr. L'Archevesque if any of the members of the Board of Representatives had considered legislation, on a County level, to penalize those operators of private Sewer plants that are in violation of the Health Laws of the County. Mr. L'Archevesque said it hadn't been discussed, but he had spoken to Mr. Henry Scoralik about it on a State level. He incidentally had asked Mr. Mike Morris to attend tonite's meeting in order to state for the record the Department of Health's report and status of Fleetwood Sewage Plant. Motion Unanimously Carried In consideration of Mr. Lapar's uncomfortable case of poison sumac, Mr. Incoronato's request for an engineers report on the Fleetwood Sewer Plant and Mr. Cronin's drainage problem were placed next on the agenda. Mr. Lapar, on Fleetwood, asked to wait until Mr. Morris arrived to report. On Mr. Cronin's problem, which was in regard to a drainage problem behind his home on Widmer Road (Wildwood II) Mr. Lapar said he and Mr. Ludewig had seen Mr. Cronin and Mr. Cornell, inspected the site, and feels that Mr. Cornell seems to be in a position to do the work but there seems to be a problem between the two parties , which is outside the province of the Town. If, when everything is completed in that area, and Mr. Cornell has not performed according to subdivision plat filed then Mr. Cronin can come in. Mr. Cornell elaborated that Mr. Cronin had put up No Tresspassing signs on his property, prohibiting him access to the two incomplete houses. Mr. Cronin stated he had a contract with Mr. Cornell giving a completion date of June 1st which was not fulfilled. He had sought legal counsel, and asked for a written response from Mr. Cornell which he had not received. Mr. Morris from the Dutchess County Health Dept. reported on Fleetwood Sewer Plant, saying he had been inspecting on a regular basis. The large problem confronting the operators was removal of sludge from the tanks. The elimination of oders from the plant would be achieved by the removal of the sludge. As for the effluent being ejected by the plant etc., the County Attorney is in touch with the Attorney General's office. Mr. Effron, Attorney for Mr. Gallo, said the problem was to find a 167 place to dispose of the sludge. Mr. Incoronato asked Mr. Morris about plant inspections; distress calls from Fleetwood residents; the number of times Mr. Gallo had been instructed to remove sludge, and other related matters. He reminded the board that at the time of submission by the Fleetwood residents for forming a sewer district, one of the provisos was that when said plant , at time of title transfer, be in reasonable state of repair and maintenance. In light of discussion tonight, he felt this is not a fulfilment of that proviso, prompting him to solicit the attorney to the district and the Board to suspend any further negotiations with Mr. Gallo until at least this condition, air and water pollution, is cleared up. Mr. Aldrich commented that the Department of Audit and Control had been in contact with him requesting additional information, and that they were anxious to see this become a municipal district for this very problem and further he intends that the contract will be performed, and expect that when the Town takes this system ove4 it will be in the condition the contract calls for. He feels that with County Health Department surveicl1ance and Mr. Effrons efforts to perform the contract, that the Town will buy a system that functions properly and is in good shape, if it isn't, the Town won't buy it, it will be considered a breach of contract. MR. CLAUSEN MOVED that Mr. Lapar on behalf of the Town have a meeting with Mr. Scoralik tomorrow and investigate this very serious situation to see where the Town stands. Seconded by Mr. Mills. Motion Unanimously Carried A request was received from Martin Leskow for return of i of his subdivision fee. MR. CLAUSEN MOVED that $32.00 be returned to Mr. Leskow constituting 1 of his subdivision application fee. Seconded by Mr. Mills. Motion Unanimously Carried MR. MILLS MOVED that the communication received from Attorney Joseph D. Quinn Jr. regarding $44,486.96 Bond Anticipation Renewal Note #2, 1968, to finance the purchase and acquisition of Highway construction and maintenance equipment (Bond Resolution of June 8, 1967) be received y 168 and placed on file with Renewal Note. Seconded by Mr. Clausen. Motion Unanimously Carried A letter was received by Mr. Ludewig, Building Inspector and Zoning Administrator regarding the preparation of a base Town Zoning Map for the Town, and recommending Rudolph Lapar be engaged by the Town to undertake this preparation of this map. MR. MILLS MOVED that Mr. Lapar be engaged to prepare a Zoning Base Map accepting his proposal for charges to the Town on a man-hour basis at the following rates: Principal $12.00 per hour: Draftsman $6.00 per hour. Motion Unanimously Carried The following letter was received from Mr. Lapar: July 23, 1968 Town Board Town of Wappinger Mill Street Wappingers Falls, New York Re: Improvements to the Town Highway Garage and other Facilities Gentleen: At your request, at the last Town Board meeting, you directed me to give you an estimate of the cost of fencing the Town Highway Property. On July 17, I met with Mr. Bill Horton and his assistant, Mr. Ken Croshier, and we discussed, in addition to the fencing, various things that should be done as soon as possible to improve the operations of the Highway Department. They are listed as follows with approximate cost estimates: 1. Purchase of 3 acres of land immediately North and contiguous with the existing parcel. (the owner, Mr. Barber, has been informally approached and is willing to sell. No price has been mentioned.) 2. The addition of a building (40' x 50') between the two existing buildings, The reasons for this building are many, such as, (a) storage space for equipment that is normally left outside and, therefore, has a reduced anticipated life; (b) the Highway Department is called upon to store various things like voting machines, sewage pump (Oakwood Knolls), and recreation equipment. The approximate cost of the building $14,000 3. Chain Link Fence -approximately 1,400 linear ft. $6,000 4. Adequate drainage will be installed by the Town Highway Dept. whentheadditional lands are purchased. vty/Rudolph E. Lapar 169 MR. Motion Unanimously Carried Mr. Lapar submitted the following report: August 5, 1968 Town Board Mill Street Town of Wappinger Wappingers Falls, New York Re: Proposed Lake Oniad Latteral Sewer District Gentlemen: As per your request at the Town Board meeting of July 8, 1968, I have prepared a cost estimate for sewering the Lake Oniad area. The specific areas included were as defined by filed maps #1853 and #2141. Following is my cost estimate for this proposed project which would tie into the proposed trunk of the proposed Wappinger Sewage Disposal District: Total Construction Cost Contingencies @ 15% Engineering & Attorney @ 15% $ 226,900 34,035 34,035 TOTAL BOND REQUIRED $ 294,970 Say $ 300,000 The cost to the average homeowner was based on a 40 -year bond @ 5% interest, therefore, the cost/year to amortize the proposed bond would be $ 174.84/unit It will be obvious to the Board that the charge is high. The reason for this is that approximately 3,000 ft. of outfall sewer would be needed to tie into the proposed major trunks. I would recommend to the Lake Oniad Lot Owners Association and to the Town Board that if this district is ever formed it be expanded to include such areas as the rest of Central Avenue, Erwin Drive and Roberts Road. I am enclosing a map of the proposed district for your examination. It will be available in the Town Clerk's Office. The map is just for general information, and a more detailed study may be made if a petition to form the district is presented to the Town Board. I have further projected my cost estimate into the year 1970, if construction has not started by that year, the estimate will, of course, have to be re -calculated. vty/Rudolph E. Lapar MR. CLAUSEN MOVED that Mr. Lapar's report be accepted. Seconded by Mr. Finnan. Motion Unanimously Carried Mr. Lapar submitted a report regarding Sewer and Water House connections in various developments. MR. DIEHL ORDERED it be referred back to Mr. Lapar for further study and to check with state laws in connection with house connections of Water and Sewer, and also, to the Attorney to the Town. A reply was received from the New York State Department of Transportation with regard to installation of a traffic control device at the intersection -of Rte. 9D and New Hamburg -Hopewell Road. Mr. Diehl reflected the Board's feelings that the Town would consider financing this light and control at the Firehouse, if itwouldbe a full time stop and go light. In contraction with the request for bids on air conditioning, proposals were sought in relation to electric service. Popper Electric Company was sole bidder and in looking into the proposals it became obvious the more important was to increase the ampere Electric service to the Town Building. Mr. Mills recommended that Poppers Bid for electric service be accepted. Mr. Diehl suggested the solicitation of at least two other bids. MR. MILLS MOVED to solicit additional bids for wiring service to the Town Building and also have Mr. Lapar prepare and to solicit for separate bids for some other method of air conditioning the Town Hall. MILLS MOVED that Mr. Rappleyea be authorized to proceed with condemnation proceedings on the acquisition of R.O.W. from Ackerly and Fitzgerald into the Oakwood Knolls Sewer Plant, in accordance with the Resolution that the Board previously passed making the offer. Motion Unanimously Carried Mr.-Lafko had requested to be put on the agenda to discuss both the Sewer Disposal District and Sanitary Landfill operations at the County Airport. 1 7 5. Mr. Diehl ruled that, for the best interests of the Town of Wappinger and that since legal papers had been served upon him as Supervisor of the Town there would be no discussion of either the Sewer District or Landfill OPerations from the agenda by any person who had asked to be placed or the agenda for these subjects, until the Court has made a decision. Mr. Lafko on the basis of Mr. Diehl's statement, asked what section of what Law had Mr. Diehl quoted and what legal papers did L & A submit that he can't talk on it. MR. MILLS MOVED the Board support Mr. Diehl in his decision to strike any discussion with regard to either the Sewer Disposal District or Landfill operations at the County Airport. Seconded by Mr. Clausen. Motion Unanimously Carried Mr. Lafko asked to receive a letter on this motion. Mr. Diehl informed him it would be part of the minutes as public information. Mr. Lafko said he would like to inform the Board legally there is no longer a contract in effect between L & A and the Town of Wappinger. Mr. Cortellino had asked to speak on the possibility of creating a seven man Board instead of the present five man Board. He elaborated by pointing out that though not necessarily creating a W'rd system - it would allow for better representation of the Town and also the Supervisor would be eliminated asChairman, allowing the Board itself to choose its chairman. He hoped this would be looked into seriously. Mr. Cortellino asked if any information was available regarding monies spent on the Oakwood Knolls Roads. Mr. Horton did,not have complete facts on this at this time. It was suggested Mr. Cortellino pursue this at a later time with Mr. Horton. There was some further discussion on Ritters responsibility with regard to these Roads, and Mr. Diehl had been in touch with Mr. Reilly trying to unravel the problems. Mr. Rappleyea reported that there had been a Hearing on Thrusday, August 8, 1968 on Tall Trees, Section II, with Continental Casualty Co—present Written decision has not been filed but from the Bench the Judge indicated that he would undoubtedly give the Town a trial date in the Fall. 176 He feels that the Insurance Company will move a little faster now in getting the indemnity people into the picture. Mr. Clausen asked Mr. Rappleyea where things stand on the oil leakage problem in Oakwood Knolls. Mr. Rappleyea stated he had thought the residents were in a process of a resolution of this problem, but it now appears that it will not be a peaceful settlement, and he will proceed to bring it before the Courts -in accordance with prior Board direction. Snowden, Town Clerk "AN ORDINANCE REGULATING BLASTING AND THE USE OF EXPLOSIVES IN BLASTING OPERATIONS" Section 1. Statement of Legislative Intent This ordinance is enacted in recognition of the fact that blasting operations and the use of explosives in connection therewith which are taking place in the Town can be dangerous and constitute a potential public and private nuisance. The said :blasting operations are and have been a source of potential dagger to persons and property, are of a highly volatile nature and are .obvious sources of potential physical harm to residents and others in the Town. The blasting operations and use of explosives in -connection therewith creates a situation, which if not properly -controlled, will make the Town a less safe and less pleasant place in which to live, to engage in business and can harm the Welfare of the Town as a whole. The intent of this ordinance is to establish procedures for the regulation of blasting and the use of explosives in blasting operations in the Town of Wappinger. Section 2. Title This ordinance shall be known as an ordinance regulating blasting and the use of ex plosives in blasting operations. Section 3. Definitions Whenever used in this ordinance: (a) "Board" means the Board of Standards and Appeals of the Department of Labor of the State of New York. (b) "Labor Law" means the Labor Law of the State of New York. (c) "Codes", "Rules" and "Regulations" means the Codes, Rules and Regulations which are promulgated by the Board of Standards and Appeals of the Department of Labor of the State of New York. (d) "Explosives" means gunpowder, powders used for blasting, high explosives, blasting materials, detonating fuses, detonators and other detonating agents, smokeless powder and and any chemical compound or any mechanical mixture containing any oxidizing combustible units, or other ingredients in such proportions, quaxities, or packing that ignition by fire, friction, concussion, percussion or detonation of any part thereof may and is intended to cause an explosion, but shall not include gasoline, kerosene, naphtha, turpentine, benzine, acetone, ethyl ether and benzol. Fixed ammunition and primers for small arms, firecrackers, safety fuses and matches shall not be deemed to be explosives when, as may be determined by the board in its rules, the individual units contain any of the above-mentioned articles or substances in such limited quantity, of such nature and so packed that it is impossible to produce an explosion of such units to the injury of life, limb or property. (e) "Building" means any building regularly occupied in whole or in part as a habitation for human beings, and any church, school house, railway station or other building or place where people are accustomed to live, work or assemble. (f) "Person" includes natural person, partnership, association or corporation. Section 4. Licenses (a) No person shall purchase, own, possess, transport or use explosives 1L 110101110610my operations in the Town of Wappinger kutside the limits of anyincorporated village therein unless a license therefor shall have been issued as provided under the Labor Law. (b) In addition to the aforementioned license, no person shall blast or use any explosives in blasting operations in the Town of Wappinger outside the limits of any incorporated village therein unless a blaster's license therefor shall be issued as hereinafter provided. -2- Section 5. Blaster's License (a) A blaster's license shall be issued by the Town Clerk of the Town of Wappinger upon application on forms pre- scribed by her, and upon payment of a fee of Five ($5.00) Dollars providing the applicant shall have complied with the requirements as provided for under the Labor Law and under the Codes, Rules and Regulations, and shall, in addition, shall have furnished evidence in the form of a certificate of insurance issued by an insurance company authorized to do business in the State of New York, in form acceptable to the Town Attorney guaranteeing that the applicant has in full force and effect at the time of the making of such application a policy of public liability insurance including a specific endorsement covering any and all liabilities arising from blasting operations. The said policy and certificate shall provide for bodily injurycoverage in limits of not less than One Hundred Thousand to Three Hundred Thousand Dollars ($100,000/ $300,000) and for property damage coverage in limits of not less tran Twenty-five Thousand ($25,000.00) Dollars and shall further providF that the Town of Wpppinger, Dutchess County, New York, will be held harmless from any and all claims, actions and proceedings, which may be brought against it by any person, firm or corporation for injury to person or damage to property resulting from or occasioned by such blasting operations. Such policy shall contain the further provisj.on that it shall not be cancelled, terminated, modified or changed by the insurance company issuing it unless at least 10 days prior written notce of such cancellation, termination, mopdification or change is sent to the Town Clerk by registered mail. The policy shall further provide that the presence of the Town Engineer or any consulting engineer responsib:e for specific town projects or their representatives on the site of the operation shall not affect the obligation of the insurer under its said policy. No blaster's license shall be valid unless such insurance coverage shall remain in full force and effect. ,10 (b) The blaster's license shall be valid for one year from the date of its issuance provided that applicant shall comply with the requirements contained in this ordinance, with the Labor Law and with the said Codes, Rules and Regulations. Section 6. General Provisions for Handling Explosives. The holder of a blaster's license aforementioned shall perform blasting operations in accordance with the provisions, regulations and requirements of the Labor Law and of the Codes, Rules and Regulation and any and all amendments thereto, and in addition, shall perform such blasting operations in accordance with recommended good practices usually employed in the industry. Section 7. Hours of Blasting. It shall be unlawful to blast or carry on any blasting operation during other than daylight hours, or at any time on Sunday, except with the approval in writing of the Town Engineer. Section 8. Covering Blasts. Before firing any blasts, except where the same is in a tunnel, the material to be blasted shall be covered on the top and sides with heavy woven material of rope, wire or rubber, of sufficient size, weight and strength to prevent the escape of broken rock or other material in a manner liable to cause injury or damage to persons or property unless written permission dis- pensing with the same is obtained from the Town Engineer or any consulting engineer responsible for specific town projects. Section 9. Exemptions. The provisions of this ordinance shall not apply to any of the following: (1) Agencies of the United States, including its Armed Services. (2) The State of New York and its political and civil subdivisions; (3) Any school district or portion thereof situated in the Town: -4- (4) Any district corporation; (5) Any public benefit corporation; (6) Police and fire -fighting forces: Section 10. Violation and Penalty.. Any person violating any of the provisions of this ordinance, or failing to comply therewith, shall be guilty of a ..!mthsvicieti •!'misdemeanor and, upon conviction, shall be punished by imprison- ment for a term of not more than one year, or by a fine of not more than one thousand dollars, or both such fine and imprison- ment. Each violation of any provision of this ordinance shall be a separate and distinct offense, and in case of continuing viola- tion, each day such violation shall be permitted to exist shall constitute a separate offense. Section 11. Repeal of Inconsistent Ordinances. All ordinances or parts of ordinances not consistent with the provisions of this ordinance are hereby repealed. Section 12. Separability If any section, paragraph, subdivision, clause, phrase or provision of this ordigince shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part so decided to be invalid or unconstitutional.
