1968-04-16 SPMA Special Meeting of the Town Board of the Town of Wappinger was held April 16, 1968 at the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:05 P.M. Present: Supervisor Diehl Councilman Clausen Councilman Finnan Councilman Heady Councilman Mills Town Clerk, Elaine H. Snowden Others Present: Engineer to the Town, Rudolph Lapar Attorney to the Town, Allan Rappleyea Mr. Diehl announced that the primary reason for this meeting was to act on the Route 9 Amendments to the Town Zoning Ordinance and Zoning Map. He stated that the Board had considered all possibilities, and realizing both a yes and no vote can do certain things, specifically, a no vote could possibly be more tragic than some difficulties with a yes vote, and all of the factors have been taken under consideration. Before going into the voting he said there were two Amendments that the Town Clerk will read, which are to become part of the Zoning Ord- inance. He also stated the fact that if the Resolutions were voted down, the area under consideration would revert back to the existing zoning and, therefore, many of the commercial areas classified under the proposed amendment would revert back to the old residential areas. Mr. Rappleyea explained that the two Amendments, (just referred to, to be read) are proposed amendments (amendments to the proposed ord- inance before the' Board tonight for action) and would, if the Board passed the proposed ordinance before it, be then referred to'the County Planning Board, Town and Village Clerks, the Public Hearing set and notices published. They would not be incorporated in the proposals presently before the Board. They would be acted on separately, as directed by Town Law, at a future date. He went into further explana- tions of the areas of the proposed changes as related to the proposed amendments. He said that they were in keeping with the general opinion and consensus of the Board. He continued on the explanation of the permitted uses, i.e., in the HB1 & HB2 & SC areas a person would be limited to the sizes of lots that are set forth in HB1 and HB2 - a residence can be built on these commercial properties but the parcel could not be reduced to a smaller size than the area it presently would be in - the other change would be the changing from non -conforming use any lot (in HB1 Or HB2) that does not now conform to the lot size, providing the owner did not own an adjoining lot. Mr. Worona asked about the SC portion which was being changed to HB. He showed concern that in the proposed SC area there were still two property owners who would have to be involved in order to meet the 30 acre requirement) but that of these property owners one had at least 65 acres which was not included in this zone. Mr. Clausen pointed out d that if there should be a shopping center proposal whereby one property owner could come in with the required lot size that the Planning Board is so committed that they would rezone that area for shopping center use. Mr. Clausen moved the rules be suspended, seconded by Mr. Finnan and carried. Rules suspended to permit questions from the floor. Mr. Worona failed to see how any amendment to the Zoning Ordinance could be adopted, when it was predicated before the vote, that there would be further amendments. Mrs. Weber asked that if the proposed Amendments are passed tonight what guarantee that the further amendments would also be adopted. Mr. Diehl said the only guarantee he could give was his own word, and Ne:, r would ask each member to pledge his wor7 whether it be to vote either O(02- co' et' 6, yes or no_ Mr. Worona commented that he had not heard, in any of the public hearings, any references to the consequences or dire results that would ensue if the zoning was left as is, or if all of Route 9 were rezoned commercial, what would the dire results be? Mr. Diehl said he didn't feel there were any, but, in his opinion, if an area was zoned residential, no injustice was done by leaving it so, but the areas that had been commercial should remain so. Mr. Worona 7 9 asked why the Board would reject a proposal of all commercial zoning along Route 9. Mr. Clausen's response to Mr. Worona was that there were some members of the Board who would not be in favor of all of Route 9 zoned commercial. There had already been considerable work put into revisions, and a considerable amount of give and take on all parts. Hans Weber asked how the Board could arbitrarily say what should be commercial and what residential. Charles Cortellino asked how often,can the zoning be rezoned. This being answered "at any time", he continued by commenting that he, or no one, would then have a long range protection of zoning. Mrs. Dominicus registered her complaint about being rezoned resi- dential. Mr. Bisom started to comment on Fishkill's feelings about Wappingers rezoning. Mr. Diehl here interrupted to make note of a :phone call from a Village of Fishkill Trustee, Richard Lauria, who was calling on behalf of his Board to voice their opposition to_the proposed rezoning of Route 9. Mr. Bisom continued by predicting that in 10 years all of Route 9 will be commercial. Discussion continued, rehashing the same objections and arguments. Mr. Clausen stated that, in his opinion, referring to Mrs. Heim - burger, that if any member of the Board could state a reason why she shouldn't remain commercial he'd like to hear it, but in his way of thinking she should remain so. Mr. Diehl commented that there were 7 parcels that he knows of that would become residential which had been commercial. Mr. Diehl called a 15 minute recess at 9:13 P.M. The Supervisor called the meeting back to order at 9:38 P.M. Mr. Diehl asked that each member express his opinion in regard to the amendments to the proposed ordinance, whether at the end of the legal period, would he vote yes or no as to whether these amendments would take effect. Mr. Diehl said he would vote yes; Mr. Clausen said he would vote yes; Mr. Finnan said he would vote yes; Mr. Heady said he would vote yes; Mr. Mills said he would vote yes. 80 Clausen moved the rules be resumed. Seconded by Mr. Mills and carried. Mr. Rappleyea advised the Board that, ' in respect to -the proposed ordinances, they being in two separate forms, and as petitions were filed in relation to both ordinances'in opposition on March's Public Hearing and also as the Dutchess County Planning Board opposed both ordinances thereby requiring a 4 to 1 vote, in order to adopt these proposed ordinances. He further advised that the first one relates to definitions, characterizations of districts, and certain other requirements. The second relates only to the changing of specific areas on the map in relation to the first ordinance. The first ordinance could be passed and the second defeated but they could not pass the second if the first is defeated. The Clerk read the Resolution amending the Zoning Ordinance of the Town of Wappinger. Rules were suspended to permit a question from Mr'.- Lafkoeregarding the definitions of the districts. Rules resumed. 11 RESOLUTION OF THE TOWN BOARD OF -THE TOWN OF WAPPINGER, AMENDING THE ZONING ORDINANCE OF THE TOWN OF WAPPINGER IN RELATION TO DEFINITIONS AND DISTRICT CLASSIFICATIONS. Mr. Diehl called for a recess at 10:17 P.M. The Supervisor called the meeting back to order at 10:39 P.M. Mr. Diehl made the following statement "that this Board as public record would favorably consider rezoning the following parcels of land, if and when an acceptable site plan is filed with the Planning Board; Heimburger, Meyer, Blacksmith, Hesse, Totten, Wacker, Muntzenberger and Dominicus, and I would ask if each member of the Board would state so. Mr. Clausen: I would, Mr. Finnan: definitely, Mr. Heady: Aye, Mr. Mills: Aye, Mr. Diehl: Yes." OF THE TOWN OF WAPPINGER, DUTCHESS COUNTY The following resolution was proposed by Councilman Mills who moved its adoption: BE IT RESOLVED AND ORDAINED by the Town Board of the Town of Wappinger, -Dutchess County, New York that the Town of Wappinger 82 Zoning Ordinance adopted January 29, 1963, as amended, is hereby further amended as follows: Section 1: District HB -1, as set forth in Section 43 is hereby amended by adding the following sub -division under "Permitted Principal Uses". "10. All uses permitted pursuant to Section 421 of this Ordinance." Section 2: District HB -2, as set forth in Section 423 is hereby amended by adding the following sub -division under "Permitted Principal Uses". ,1 I, 7 All uses permitted pursuant to Section 421 of this Ordinance." Section 3: District SC, as set forth in Section 423 is hereby amended by adding the following sub -division under "Permitted Principal Uses". All uses permitted pursuant to Section 421 of this Ordinance." Section 4: Section 424 entitled "Business and Industry District Standards" shall be amended by -adding thereto the following sub -division. "d. Any lot held in separate ownership prior to the adoption of this amendment which said lot is located in either a HB -1 or HB -2 District and which said lot does not meet the area and/or the width'and/or the depth requirements of Section 424 of this Ordinance at the time of the adoption of this amendment shall be considered as complying with such minimum lot standards for area, width or depth provided such lot does not adjoin any other lot or parcel held by thesame owner." Section 5: This Ordinance shall take effect immediately upon the adoption, posting and publication as provided for by Town Law. Seconded by: Mr. Clausen AN ORDINANCE AMENDING THE ZONING LAW OF THE TOWN OF WAPPINGER, DUTCHESS COUNTY The following resolution was offered by Councilman Mills who moved its adoption: BE IT RESOLVED AND ORDAINED by the Town Board of the Town of Wappinger, Dutchess County, New York that the Town of Wappinger Zoning Ordinance adopted January 29, 1963, as amended, and the Zoning map which accompanies the same is hereby further amended as follows: Section 1: The following parcels described on the Tax Map of the Town of Wappinger are hereby rezoned from SC to HB -1. Lots 38-12and.45-2-as set forth on Tax Map #58, Block 1. Section 2: The following parcels described on the Tax Map of the Town of Wappinger are hereby rezoned from R-20 to HB -2. Lots 3,6,7 and 8 as set forth on Tax Map #72, Block 1. Section 3: The following parcel described on the Tax Map of the Town of Wappinger is hereby rezoned from RD -20 to HB -1. Lots 38 Block 1, Tax Map #61 Section 4: The following parcel described on the Tax Map of the Town of Wappinger is hereby rezoned from HB -1 to RD -20. Section 5: The Ordinance shall take effect immediately upon adoption posting and publication as provided for by Town Law. Seconded By; Councilman Finnan MR. HEADY moved that these amendments be forwarded to the Dutchess County Planning Board, the Town Board, the Town Clerks of Fishkill and Poughkeepsie, the Village Clerk of the Village of Wappingers Falls and the Clerk of the Board of County Representatives of the County of Dutchess. Seconded by Councilman Mills. Motion Unanimously Carried Hearing to be set at the next Regular Town Board Meeting. Petitions were received by the Board from residents of the Fleet- wood development - one on the establishment of a sanitary sewer, and the second in relation to the establishment of a water district. MR. FINNAN moved to refer these two petitions to the Attorney to the Town and the Engineer to the Town. Seconded by Mr. Clausen. Motion Unanimously Carried Mr. Mills moved the meeting be adjourned. Snowden, Town Clerk Proposed by Councilman Seconded by Councilman RESOLUTION of the Town Board of the Town of Wappinger, Amending the Zoning Ordinance of the Town of Wappinger in Relation to Definitions and District Classifications. 14-4 ark PAAils 84A WHEREAS, the Planning Board of the Town of Wappinger has proposed that the following amendment be made to the Zoning Ordin- ance of the Town of Wappinger, Dutchess County, New YOrk, and WHEREAS, the Town Board on the 19th day of February, 1968, did introduce such zoning amendment, and did refer this applica- tion to the Planning Board of the Town of Wappinger and the County of Dutchess for their consideration and recommendation, and WHEREAS, the Planning Board of the Town of Wappinger did file its report and recommendations with the Town Board on the llth day of March, 1968, and WHEREAS, after due notice a public hearing was held by the Town Board of the Town of Wappinger at the Town Hall, Mill Street, , Wappingers Falls, New York, at 8:00 P.M. on the 25th day of March, 1968, at which all persons desiring to be heard in favor of said rezoning and also all those desiring to be heard in opposition thereto were given an opportunity to be heard, and WHEREAS, the Dutchess County Planning Board was on the 21st day of February, 1968, given due notice of the change and said Dutchess County Planning Board thereafter did on March 25th file with the Town Board of the Town of Wappinger its report and recommendations containing therein opposition to said zoning amendments and, WHEREAS, due notice was given to the Town Clerk of the ad- joining Towns, and the Clerk of the Board of Supervisors of the 848 f County of Dutchess, at least ten days prior to the public hearing, and, WHEREAS, the Town Board of the Town of Wappinger takes cog- nizance of the Dutchess County Planning Board report, but does not agree with said recommendations by reason of the Town Board's belief that the proposed zoning ordinance classifies properties with- in the Town of Wappinger as "Commercial" for reason that the Town needs additional assessed valuation and for the further reason that Route 9 as reconstructed by the State of New YOrk has adequate traffic capacity to justify commercial zoning in certain areas adjacent thereto, NOW, THEREFORE, IT IS HEREBY AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE TOWN OF WAPPINGER, DATED January 29, 1963 BE IT RESOLVED BY THE TOWN BOARD OF WAPPINGER, Dutchess County, New York,in pursuance of authority conferred by Article 16 of the Town Law of the State of New York, and also in pur- suance of Article 9 to the extent applicable, that the TOWN OF WAPPINGER ZONING ORDINANCE, adopted January 29, 1963, is hereby amended as follows: Section 1. Article II, Section 220, entitled "Definitions is hereby amended by amending the following definitions: "Section 220. Definitions Building Setback Line: A line indicating the minimum horizontal distance permitted between the outside line of the main building or any enclosed projection thereof and a street right- of-way line. Frontage: All the property abutting upon one side of a street between two (2) lot lines, measured along the street right-of-way line. Lot Width: The distance between the side lot lines taken at the building setback line and measured along a line parallel to the street right-of-way line,. Lot, Corner: A lot, of which at least two adjoining sides each abut street rights-of-way for a total distance of 50 feet or more. * Lot, Interior: Any lot other than a corner lot. * Lot, Through: An interior lot having frontage on two parallel, or approximately parallel, street rights-of-way and also known as a double frontage lot. Lot Line, Front: The lot line that separates the lot from the street right-of-way. In the case of corner lots and through lots, the front lot line shall be the line (s) that separates the lot and that (those) street right (s) -of -way from which vehicular access is provided. Yard, Front: A yard extending across the full width of the lot and lying between the front lot line and the nearest line of the building. In the case of corner lots and through lots the depth of the front yard shall be measured between the building setback line (s) and the front lot line (s)." *New Definitions Section 2. Article III, Section 300, entitled "Classes of Districts" is hereby amended to add to the number of classes so that the classes shall read as follows: "Section 300. Classes of Districts The Town of Wappinger is hereby divided into the following districts. Article IV, Section 423, entitled "Schedule of Business and Industry District Uses" is hereby amended to add the following districts and to define their uses: "Section 423. Schedule of Business and Industry District Uses. No building or premises shall be used, and no building or group of buildings, or part of a building or structure, shall be erected, constructed, enlarged, altered, arranged or designed to be used, in whole or in part, except for one or more of the uses set forth below. Only those uses listed as being permitted in a specific district shall be permitted in that district. In addition, a use marked with an asterisk (*), is subject to the standards and procedures set forth in Section 430. Where indicated, the uses in a district are subject to approval of site plans by the Planning Board. DISTRICT PERMITTED PRINCIPAL USES HB -1 1. Accessory uses that are customaril incidental and sub- ordinate to a per- mitted principal use. -2- DISTRICT (HB -1) (cont' d) PERMITTED PRINCIPAL USES 84 PERMITTED ACCESSORY USES to be sold exclusively on the premises provided that: a. An area fully concealed from any street and equal to not more than 20% of the gross floor area devoted to retail sales shall be so used: b. Not more than ten employees are engaged in such production or processing. 7. Motor vehicle sales, service stations and repair garages, subject to the pro- visions of Section 430 and Section 439.02 hereof. 8. Public utilities structures 9. Motels and tourist homes. PROHIBITED PRINCIPAL USES 1. 2. The outdoor storage of junked cars or automobile parts. Any use which is noxious or offensive by reason of emission of odor, dust, noise, glare, smoke, gas, fumes, or radiation or which presents a hazard to public health or safety. PERMITTED PRINCIPAL USES HB -2 1. Highway Business (subject to site plan approval 2. by Planning 3. Board. (See Sec. 440) 4. 5. 6. All uses as permitted and regulated in the (HB -1) Highway Business District, except that motor vehicle sales, service stations and repair garages shall not be subject to the provisions of Section 430 herein. Amusement establishments subject to the provisions of Section 430 hereof. Wholesale and storage business: building material storage and supply; building, plumbing, electrical and similar contractors establishment; provided that any lot containing out- door storage shall be surrounded by an opaque fence or wall with a height of not less than 6 feet nor more than 10 feet. Truck transfer terminals, subject to the provisions of Section 430 hereof. Laundry and dry cleaning establishments serving commercial businesses. Radio, television, and other electronic transmission structures. A. Accessory uses that are custo- marily incidental and subordinate to a per- mitted prin- cipal use. PROHIBITED PRINCIPAL USES 1. Any use which is noxious or offensive by reason of emission of odor, dust, noise, smoke, gas, fumes, or radiation or which presents a hazard to ptiblic health and safety. -3- DISTRICT PERMITTED PRINCIPAL USES SC Multiple Attached and/or Detached Principal Uses Shall be Permitted Shopping as Follows: Center (subject to site plan approval by Planning Board. (See Sec.440) 1. Stores and shopes for the con- duct of retail business, restaur- ant and other places serving food and beverages, and establishments for the performance of various personal services, excluding drive-in eating places. 2. Professional, governmental, and business offices. 3. Hospitals and clincs, excluding veterinary facilities. 4. Motor vehicle,+ sales, repair and service in fully enclosed structures. 5. Gasoline filling stations subject to the provisions of Section 423, Item 7 under the HB -1 District. 6. Bowling alleys, theaters, and other commercial amusements in fully enclosed structures. PROHIBITED PRINCIPAL USES 1. Any use which is noxious or offensive by reason of emission of odor, dust, noise, smoke, gas fumes, or radiation or which presents a hazard to public health or safety. 84F j, PERMITTED ACCESSORY USES a. (a) Where parking is located between a building and the street providing access, the front yard shall be at least seventy-five (75) feet deep and access across the street frontage shall be limited to a separate entrance and a separate exit drive. (b) Where adjoining a limited and/or controlled access highway, there shall be a minimum setback of thirty (30) feet from said highway right-of-way line to the nearest line of the main building. (c) Where adjoining a Residence District or adjoining a street on which a Residence District abuts on the op- posite side, there shall be a yard at least as wide as the yard required in the adjoining Residence District, and in no case shall the mein building be set back less than thirty (30) feet from the adjoining Residence District boundary or street right-of-way line." Section 5. Article 4, Section 439, entitled "Individual Standards for each Special Use" is hereby amended to add the fol- lowing subdivision to read as follows: 439.02 Additional Requirements for Motor Vehicle Sales, Service Stations, and Repair Garages. 439.021 No driveway to or from any gasoline filling station shall be within 200 feet (measured almg the street line on that side of the street on which such gasoline filling station has its main frontage and on which such driveway would cross) of the boundary line of any Residence District, or of any school, church, park, play- ground, hospital, public library, institution for dependents or children or any place of public assembly designed for the simultaneous use of 100 persons or more, regardless of the district where either premises are located. 439.022 There shall be not more than one fuel pump for each 1,500 square feet of lot area. 439.023 Fuel pumps shall be set back from the street at least twenty-five feet. All other buildings and structures, except underground storage tanks, shall be set back at least forty-five feet from the street line, ten feet from each side line, and twenty feet from the rear lot line, unless larger front or side yards are specified in Section 424. A suitable land- scaped area, at least 10 feet wide or a 6 foot high, stockade -type wooden fence, with finished side.facing the residence district, shall be maintained adjoining a lot in a residence district. Such landscaping or fencing shall not be located closer than 10 feet to the street line. -6- Section 439 (continued) 439.024 All automobile parts, wrecked or damaged moto: vehicles, or similar articles shall be stored within a building; major repair work may be carried on outdoors where it is impracticable to do such work within a building, but in no case shall any vehicles requiring such work be stored outdoors for a period exceeding five days. Gasoline or oil sales, changing of tires and other similar automobile servicing shall not be considered to be major repair work. 439.025 Use of a building for any residence or sleeping quarters shall not be permitted. 439.026 No gasoline filling station and no gasoline or oil pump or automotive service appliance, unless within a building, shall be permitted to be established on a lot that is within 1000 feet of another lot which there is an existing automobile service station or out- door gasoline or oil pump or automotive appliance; or of another lot for which a building permit has been issued for the erection of such a station, pump or service appliance. This requirement shall in no way be construed to cause any existing use to become non- conforming; except that, if such a use has been discontinued, for any reason, for a period of over one year, or has been changed to, or replaced by, a conforming use, such use shall be subject to the provisions of Section 416 hereof." Section 5. Article 4, Section 444, entitled "Factors to be Considered in Site Plan)of Development Approval," sis.:_i be amended to read as follows: "Section 444. Factors to be Considered in Site Plan of Development Approval. In acting on any proposed site plan of development, the Planning Board shall take into consideration the requirements of the Town Development Plan adopted by said Board, and the Official Map as it may be adopted by the Town Board. The Planning Board shall also consider the proposed location of main and accessory buildings on the site and their relation to one another, traffic circulation within the site, the provision of ingress and egress from local or secondary roads, whenever possible, especially in the case of sites abutting limited and/or controlled access highways, height and bulk of buildings, provision of off-street parking space, provision of buffer areas and other open spaces on the site, and displayof signs, so that -7- 4T Section 444 (continued) any development will adequately handle pedestrian and vehicular traffic within the site and in the street system adjoining, and will harmoniously and satisfactorily fit in with contiguous land and buildings and adjacent neighborhoods. Further- more, where a through lot or a corner lot abuts a local or secondary street and a limited and/or controlled access highway, the Planning Board may require that vehicular access to the lot be pro- vided only from the local or secondary strRet. In addition, the Planning Board shall conslder the factors of drainage, road alignment and other engineering aspects of such site plan, and may require the review of such factors by engineering authorities appointed by the Town. The Planning Board shall consider the comments and recommenda- tions of any governmental authorities or commi- ssions which may be concerned with any proposed site plan of development." Section 7. Article 4. Section 455, entitled "Layout and Location of Off -Street Parking Facilities," is amended to read as follows: "Section 455, Layout and Location of Off -Street Parking Facilities. 455.01 The required off-street parking facilities shall be provided on the same lot or premises with the struture or land use they serve. However, off- street parking spaces required for structures or land uses on two adjoining lots may be provided in a s*pgle common or joint facility on one or both of said lots. Also, the Planning Board may permit all or part of the required off-street parking spaces to be located on any lot within 500 feet of the building, except in a Residence District, if the Board determines it is impracti- cal to provide parking on the same lot with the building. 455.02 Parking, loading and service areas used by motor vehicles within the Business and Industrial Districts shall be physically separated from any street right-of-way by a suitable barrier, approved by the Planning Board against unchanneled motor vehicle ingress or egress. 455.03 A parking area within a Business or Industrial District shall be located no less than ten (10) feet from any adjoining Residence District or limited and/or controlled access highway right - of way. 455.04 The owner of a parking area within a Business or Industrial District that adjoins either a Residenoe'.
